ECONOMY WEEKLY WEEK OF NOVEMBER 30,
2009
This new report from the Congressional
Budget Office is further evidence of what private forecasters
and government economists have been saying: the Recovery Act
is already responsible for more than 1 million jobs nationwide.
From independent economists to Congresss own nonpartisan
research body, the experts have spoken and the debate is no longer
whether the Recovery Act is creating and saving jobs, but how
we provide even more opportunities to drive growth and support
American workers.

Today, the Department of Labor released the unemployment report
for November, which shows that job losses are continuing to decrease.
While this news is encouraging, unemployment is still far too
high. That is why Congress is continuing our efforts to spur
economic growth and get Americans back to work.
Economy Highlights:
Today, the Department of Labor announced that a relatively
few 11,000 American jobs were lost in November, compared to 111,000
jobs that vanished in October. Analysts had expected a much higher
jobs-lost number in November -- as many as 130,000. This
is the fewest number of jobs lost in a single month since the
beginning of the recession in December 2007. In addition, job
losses for September and October were revised to show improvements
of 150,000 better than previously reported. Finally, the unemployment
rate fell from 10.2% in October to 10% in November, all positive
indications that the economy is seeing signs of improvement.

The Labor Department announced that for the fifth straight
week, the four-week average of new claims for unemployment benefits
dropped by 14,250 to 481,250, the lowest in 13 months and a sign
that labor markets are improving. [MarketWatch,

The National Association of Realtors (NAR) announced that
in October, the number of signed contracts increased for the
ninth consecutive month, an indication that the housing market
is headed in a good direction and that the homebuyers tax credit
put in place is working. Between September and October
NAR's Pending Home Sales Index rose 3.7% to 114.1 from 110 in
October. But the index is 31.8% higher than a year ago, when
it was 86.6. That's the biggest year-over-year gain in the history
of the index
. NAR's chief economist, Lawrence Yun, gives
much of the credit for increased sales to the homebuyer's tax
credit, which first-time homebuyers could claim to reduce their
taxes by up to $8,000. [CNNMoney.com,

Recovery Highlights:
The nonpartisan Congressional Budget
Office found that the American Recovery and Reinvestment Act
is having the intended effect of creating jobs and growing the
economy. The report estimates that in the third quarter
of calendar year 2009, an additional 600,000 to 1.6 million people
were employed in the United States and real (inflation adjusted)
GDP was 1.2 to 3.2 percent higher, than would have been the case
in the absence of ARRA. Those ranges
..encompass most economists
views on the effects of fiscal stimulus. [Congressional

MESSAGE FROM THE MAJORITY LEADER
As Democrats continue to focus on job creation,
this week brought encouraging news. Today it was announced that
the unemployment rate fell in November and job losses are continuing
to decrease a positive indication that the economy is
improving and evidence that Democratic economic policies are
starting to work. Nearly a year after President Obama inherited
the worst economic crisis since the Great Depression, we also
heard from the nonpartisan Congressional Budget Office this week
that the Recovery Act has saved or created up to 1.6 million
jobs, while growing the economy for the first time in more than
a year. While these reports are reasons to be hopeful, too many
Americans remain out of work and are having trouble providing
for their families. The President and
Congress will keep doing everything we
can to turn that around and get Americans back to work.
This week, the House passed legislation
that permanently fixes the estate tax, which will give small
businesses, farmers, and families the certainty they need to
plan for future years. Attached to the estate tax bill is Statutory
Pay-As-You-Go legislation, a proven tool for turning
deficits to surpluses. Under PAYGO, Congress will be forced to
make the tough decisions necessary to ensure our nation pays
for what it buys, helping restore our nations fiscal health.
I hope that the Senate will join the House in taking this essential
first step out of Americas deep fiscal hole.
Next week, the House will consider legislation to protect American
consumers and prevent the irresponsible behaviors and practices
that contributed to the financial crisis last Fall. The Wall
Street Reform and Consumer Protection Act restores responsibility
and accountability to Wall Street through tough rules and regulation
of risky practices. It protects consumers on Main Street by ensuring
that bank loans, mortgages, and credit cards are fair and transparent,
and ensures that taxpayer money will not be put on the line again
by putting an end to too big to fail financial firms.

will travel to Allentown, PA to spend some time out of Washington
and take the temperature on what Americans are experiencing during
these challenging economic times. We visited Allentown in advance
to tell the stories of two local small businesses making their
way in these difficult times. One, Egypt Star Bakery, is a Lehigh
Valley institution, with a close-knit staff dedicated to serving
one another and their community. They've weathered the recession
by tightening their belts and making some personal sacrifices
for the sake of the business. The other, Applied Separations
Inc., is a small engineering firm that hires and trains people
in green technologies, in some cases retraining workers who have

OPPORTUNITIES FOR SMALL BUSINESSES AND RURAL COOPERATIVES
WASHINGTON, Dec. 3, 2009 - Agriculture
Deputy Secretary Kathleen Merrigan today announced the second
in a series of small business conferences aimed at increasing
USDA's Food Commodity Contracting Opportunities for Rural America
initiative. The second conference will take place on December
9 at the University of Arkansas Pine Bluff, Pine Bluff, Ark.
Merrigan is scheduled to be the luncheon speaker.
"The food commodity contracting initiative
is a great example of USDA working to help small businesses build
capacity and creating new opportunities for producers throughout
rural America," Merrigan said.
The initiative is designed to enable rural
economic growth by increasing small business contracting participation
in rural areas of the country. USDA intends to help small farmer-owned
cooperatives and small rural businesses to better compete for
government and commercial contracts at the department.
Each year USDA purchases more than $5.2
billion in goods and services essential to meeting the needs
of its customers and the various missions of the Department.
Approximately 50 percent of these dollars are spent on food commodities.
USDA's Office of Small Disadvantaged Business Utilization and
USDA's Rural Development, Farm Service Agency, and Agricultural
Marketing Services are co-hosting the conferences and at least
four additional events will be held in other regions of the country.
The conference will be held in the S. J.
Parker 1890 Extension Complex, University of Arkansas Pine Bluff,
from 9 a.m. to 5 p.m. Registration is free. On-site registration

food projects and who set and establish policy and standards;
and

Dear Friend,
We had a meeting of the Senate Democratic
Caucus yesterday, and I wanted to send you a quick update about
the health care reform bill.
First of all, we had big news Monday when
the Congressional Budget Office released its report on the cost
of the reform bill to consumers. The CBO confirmed that our bill
would lower health care premiums for almost everyone in America.
Whether you have insurance through your job or purchase your
own coverage, your premiums will likely go down under the current
bill.
This was a watershed moment in this debate,
because Republicans are making the cost of premiums one of their
primary talking points. They insist that premiums would go up
for middle-class Americans, and tout studies by their friends
in the insurance industry to make their point. But the unbiased,
nonpartisan CBO provides the definitive answer to questions about
pending legislation, and its report shows once and for all that
the vast majority of Americans will see their premiums go down.
Does this mean the Republicans will stop
fighting our health care reform efforts? Of course not. In our
Democratic Caucus meeting yesterday, we discussed the ongoing
efforts by Republicans to delay, obstruct, and kill this bill
using every means at their disposal. Their latest weapon of choice
is the politically motivated poison pill amendment.
They are going to try to force Democrats
to make politically difficult votes, votes that if they succeed
would end our chances for passing a reform bill. In the Caucus
meeting, we discussed the importance of maintaining the unity
needed to beat back these efforts from the Republicans.
While they are working to kill this bill,
Democrats are working to make it even stronger. A great example
is an amendment, proposed by my friend Senator Barbara Mikulski
of Maryland, which would protect women's health services.
There's a long debate ahead of us, and
the continuing support that you have shown our reform efforts
are helping us face the relentless attacks from the Republicans.

Hoyer Statement on Permanent Extension
of Estate Tax Relief
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) spoke on the House Floor today in support
of the Permanent Estate Tax Relief for Families, Farmers, and
Small Businesses Act of 2009. Below are his remarks as prepared
for delivery:
I rise to support this bill, which
permanently extends estate tax relief to American familiesand
which strikes a fair balance between what we owe to families,
farmers, and small businesses, and what we owe to our countrys
fiscal future.
This bill simply continues present
law at current rates and exemptions. But it does not abolish
the estate tax altogether, which would be a severe mistake. Abolishing
the estate tax would add billions and billions to our deficitand
while a small number of wealthy families would benefit, the growth
of our economy as a whole would suffer. So would vital programs
on which millions of Americans rely. The estate tax also sets
a limit on the concentration of inherited wealth from generation
to generationwhich, at a time when this countrys
middle class is truly struggling, would make inequality even
starker and more damaging to our countrys social fabric.
That is why advocates of a dynamic
economy have supported an estate tax for generations. When first
proposing an estate tax, Theodore Roosevelt said: the man
of great wealth owes a particular obligation to the State because
he derives special advantages from the mere existence of government.
And As Bill Gates Sr. recently argued, the estate tax puts
a brake on the concentration of wealth and power, generates substantial
revenue from those most able to pay and encourages billions of
dollars in charitable giving each year. The estate tax is not
only fair, but an essential component of our nations economic
dynamism.
Finally, its important that
this bill is permanent, and not a temporary fix; that guarantees
families, farmers, and small businesses the certainty they need
to plan ahead. President Bushs estate tax policy, by contrast,
gave the country anything but certainty: it phased out the estate
tax, repealed it entirely for 2010, and then brought it back
at 2001 levels for 2011. That was truly irresponsible tax and
fiscal policy, which made it impossible for families to plan
with confidence for the future. It also hid the policys
true cost to our national budget. This bill can change that:
it is in keeping with President Obamas pledge of a new
honesty in budgeting.
I also want to point out that passing
this bill is also an important step toward fiscal responsibility,
because attached to it is the Houses support for statutory
pay-as-you-go, or PAYGO. As we know, the principle of paying
for what we buy was central to turning record deficits into surpluses
under President Clintonand it can be an important step
in our return to fiscal health today. By passing this bill, we
can also strengthen our commitment to pay for all new policies
that reduce revenues or expand entitlements.
In fact, I wish that this extension
of estate tax relief were also paid forbut because it is
so unlikely that we will have the votes to pay for the extensions
of policies with bipartisan support, I choose to support the
strongest version of PAYGO possible. That is the PAYGO provision
attached to this billand I hope that the Senate will join
the House in taking this essential first step out of Americas
deep fiscal hole.
I urge all of my colleagues to support
this bill, which makes a fair estate tax permanent, makes estate
planning more reliable, and makes our commitment to fiscal discipline
clear.

Rights Day, the Royal Netherlands Embassy, with the U.S. Commission
on International Religious Freedom (USCIRF), will host a panel
discussion on international religious freedom. Both The Netherlands
and the United States assign a high priority to the promotion
of freedom of religion in their international human rights policies.
The event will mark International Human Rights Day and raise
awareness for the important issue of religious freedom. You are

11 from 2 until 3:30 PM in the Russell Senate Office Building

The panel discussion will focus on how
countries, international organizations, and NGOs can work together

SUBJECT: Fraudulent Correspondence Claiming
to Be From the FDIC
Summary: Fraudulent correspondence bearing the FDIC's name continues
to be mailed, faxed and e-mailed. This correspondence is being
used in illegal schemes to collect sensitive personal information,
such as bank account numbers, and to steal money and other assets.
The Federal Deposit Insurance Corporation
(FDIC) is reminding financial institutions, businesses and consumers
that fraudulent correspondence claiming to be from the FDIC continues
to be mailed, faxed and e-mailed in the United States and other
countries. The correspondence uses various techniques to gain
the trust of recipients in hopes they will provide sensitive
personal information, including bank account numbers, that can
be used to steal money and other assets. Recipients should NOT,
under any circumstances, respond to the fraudulent requests.
Institutions also are encouraged to inform customers that fraud
artists may use the names of the FDIC and other government agencies
and to take appropriate precautions.
The criminals, knowing that people trust
the FDIC name, have duplicated the official logo and seal in
fraudulent letters, forms, certificates and other correspondence.
Recent examples have included invoices, bills, transfer forms,
guarantees, endorsements, and confirmations of stock and investment
purchases. In some cases, recipients were asked to complete fraudulent
forms and return them by fax or e-mail. In other cases, recipients
were asked to remit funds via check or wire transfer service.
The FDIC rarely sends unsolicited bills
or other similar documents to financial institutions, businesses
and consumers. In particular, the FDIC does not send unsolicited
correspondence asking for sensitive personal information, including
bank account information. Anyone receiving such correspondence
should contact the FDIC immediately by calling toll-free at 1-877-ASK-FDIC
(1-877-275-3342) or by e-mailing to alert@fdic.gov.
Do not use contact information listed for
the FDIC in the correspondence because it is likely to be falsified.
Information about counterfeit items, cyber-fraud
incidents and other fraudulent activity may be forwarded to the
FDIC's Cyber-Fraud and Financial Crimes Section, 550 17th Street,
N.W., Room F-3054, Washington, D.C. 20429, or transmitted electronically
to alert@fdic.gov. Questions related to fraudulent correspondence,
deposit insurance or consumer issues should be submitted to the

Protecting Portable Devices: Physical Security
Many computer users, especially those who
travel for business, rely on
laptops and PDAs because they are small and easily transported.
But while
these characteristics make them popular and convenient, they
also make them
an ideal target for thieves. Make sure to secure your portable
devices to
protect both the machine and the information it contains.
What is at risk?
Only you can determine what is actually
at risk. If a thief steals your
laptop or PDA, the most obvious loss is the machine itself. However,
if the
thief is able to access the information on the computer or PDA,
all of the
information stored on the device is at risk, as well as any additional
information that could be accessed as a result of the data stored
on the
device itself.
Sensitive corporate information or customer
account information should not
be accessed by unauthorized people. You've probably heard news
stories about
organizations panicking because laptops with confidential information
on
them have been lost or stolen. But even if there isn't any sensitive
corporate information on your laptop or PDA, think of the other
information
at risk: information about appointments, passwords, email addresses
and
other contact information, personal information for online accounts,
etc.
How can you protect your laptop or PDA?
* Password-protect your computer - Make
sure that you have to enter a
password to log in to your computer or PDA (see Choosing and
Protecting
Passwords for more information).
* Keep your laptop or PDA with you at all times - When traveling,
keep
your laptop with you. Meal times are optimum times for thieves
to check
hotel rooms for unattended laptops. If you are attending a conference
or
trade show, be especially warythese venues offer thieves
a wider
selection of devices that are likely to contain sensitive information,
and the conference sessions offer more opportunities for thieves
to
access guest rooms.
* Downplay your laptop or PDA - There is no need to advertise
to thieves
that you have a laptop or PDA. Avoid using your portable device
in
public areas, and consider non-traditional bags for carrying
your
laptop.
* Be aware of your surroundings - If you do use your laptop or
PDA in a
public area, pay attention to people around you. Take precautions
to
shield yourself from "shoulder surfers"make sure
that no one can see
you type your passwords or see any sensitive information on your
screen.
* Consider an alarm or lock - Many companies sell alarms or locks
that you
can use to protect or secure your laptop. If you travel often
or will be
in a heavily populated area, you may want to consider investing
in an
alarm for your laptop bag or a lock to secure your laptop to
a piece of
furniture.
* Back up your files - If your portable device is stolen, it's
bad enough
that someone else may be able to access your information. To
avoid
losing all of the information, make backups of important information
and
store the backups in a separate location (see Good Security Habits
for
more information). Not only will you still be able to access
the
information, but you'll be able to identify and report exactly
what
information is at risk.
What can you do if your laptop or PDA is
lost or stolen?
Report the loss or theft to the appropriate
authorities. These parties may
include representatives from law enforcement agencies, as well
as hotel or
conference staff. If your device contained sensitive corporate
or customer
account information, immediately report the loss or theft to
your
organization so that they can act quickly.

in Baltimore to 51 months in prison followed by two years of

Executive Convicted of Orchestrating $3.65 Billion Ponzi Scheme

Thomas Joseph Petters, of Wayzata, Minnesota, was convicted by
a federal jury in St. Paul of orchestrating a $3.65 billion Ponzi
scheme. Specifically, Petters was found guilty of 10 counts of
wire fraud, three counts of mail fraud, one count of conspiracy
to commit mail and wire fraud, one count of conspiracy to commit
money laundering, and five counts of money laundering.
