Saddam's trial thrown into chaos« Thread Started on Dec 29, 2006, 5:48am » --------------------------------------------------------------------------------Saddam's trial thrown into chaos BAGHDAD: The genocide trial of ousted Iraqi leader Saddam Hussein was once again thrown into chaos yesterday when the chief judge ejected a key defence lawyer only to recall him later the same day. Soon after the hearing opened, Judge Mohammed Al-Oreibi Al-Khalifah ordered the arrest of Badie Aref, always a vocal presence in the trial, for "violating professional conduct". Aref is defending Farhan Al-Juburi, former head of military intelligence in northern Iraq and one of seven accused of killing tens of thousands of Kurds in 1988 during the Anfal military campaign. Khalifah clashed with Aref over the manner in which he was addressing the court. The stormy session began with Aref making a statement before the court, but when he referred to the prosecutor as "brother" the prickly judge took offence. "I warned your colleagues yesterday twice to respect the court and its officials," said Khalifah, who objected to the informality of the term.Aref insisted that the information he wanted to give was more important than the form of address and then used the word "brothers" again to refer to the prosecutors. The judge then ordered him to be ejected. Aref protested at the judge's order, after which Khalifah said: "You are arrested for 24 hours for violating professional conduct." But later in the day Juburi asked the judge to recall Aref. "We want the sessions to continue normally till the end and ask you to cancel the decision against Badie Aref," he said. The judge accepted the demand but Aref himself later left the court. Aref has been the most vocal of the defence lawyers, subjecting almost all the witnesses presented by the prosecution since the trial started on August 21 to badgering cross-examination. Saddam's trials, including the previous one in which he was handed a death sentence, have been marred by chaotic sessions with accused and their attorneys often ejected from the courtroom.On Tuesday, a working party of the United Nations Human Rights Council said the first trial had fallen so far short of international standards that Saddam's detention was "arbitrary". The UN body urged the Iraqi government "to refrain from carrying out the sentence of death by hanging imposed in a proceeding which does not meet applicable standards of a fair trial."read at source> http://www.kuwaittimes.net/Navariednews ... 1040643507
