$320 Million Available for Conservation Projects in Arkansas, Kentucky, Illinois, Indiana, Iowa, Louisiana, Minnesota, Mississippi, Missouri, Ohio, Tennessee, and Wisconsin

WASHINGTON, September 24, 2009-Agriculture Secretary Tom Vilsack today announced a new initiative to improve water quality and the overall health of the Mississippi River Basin in taped remarks to the Gulf Hypoxia Task Force Meeting in Des Moines, Iowa. The Mississippi River Basin Healthy Watersheds Initiative (MRBI) will provide approximately $320 million over the next four years for voluntary projects in priority watersheds located in 12 key states. Participation in this initiative, which will be managed by USDA's Natural Resources Conservation Service (NRCS), will be made available through a competitive process for potential partners at the local, State and national levels.

"The Obama Administration is committed to taking bold steps with our State and local partners to clean up the entire Mississippi River Basin, a critical natural resource that provides drinking water for tens of millions of Americans," said Vilsack. "Industrial, municipal, residential, and agricultural sources have all contributed pollutants to the waters of the Mississippi River Basin, and the MRBI will provide resources that will help us come together to address this issue."

Department of Energy Announces Testing for AeroSys, Inc. Products to Ensure Compliance with Appliance Standards

Washington, DC – As part of its renewed efforts to ensure compliance with national energy efficiency appliance standards, the U.S. Department of Energy today issued a test notice requiring AeroSys, Inc. to provide sample air conditioners and heat pumps for laboratory testing by DOE. The test notice, issued under 10 CFR 430.70, requires AeroSys to make test samples of certain AeroSys-manufactured air conditioners and heat pumps available to DOE at its own expense. The Department will then determine whether these products comply with applicable DOE energy standards, which are designed to strengthen efficiency levels for various appliances, save money for consumers, and reduce greenhouse gas emissions.

“In response to our subpoena, AeroSys provided confidential certification test data that claimed to show standards compliance for seven of its basic models,” said DOE General Counsel Scott Blake Harris. “But we concluded that the AeroSys data left open questions about whether their products fully comply with all of the relevant energy efficiency standards. As the next step in the process, we will be testing the products ourselves to ensure that these appliances meet national energy efficiency standards.”

President Obama and Secretary Chu have moved aggressively to clear the backlog of energy efficiency standards for appliances and reinforce the Department’s efforts to save energy for American consumers and businesses. In February 2009, President Obama tasked the Department of Energy with quickening the pace of energy conservation standards for appliances, while continuing to meet legal and statutory deadlines. The Department of Energy has now issued energy efficiency standards for each of the appliance categories highlighted by the President, and is continuing to move forward to develop new energy saving standards and to consistently and agressivley enforce existing standards.

Credit Quality Declines in Annual Shared National Credits Review

WASHINGTON — Credit quality declined sharply for loan commitments of $20 million or more held by multiple federally supervised institutions, according to the 32nd annual review of Shared National Credits (SNC).
The credit risk of these large loan commitments was shared among U.S. bank organizations, foreign bank organizations (FBO), and nonbanks such as securitization pools, hedge funds, insurance companies, and pension funds. Credit quality deteriorated across all entities, but nonbanks held 47 percent of classified assets in the SNC portfolio, despite making up only 21.2 percent of the SNC portfolio. U.S. bank organizations held 30.2 percent of the classified assets and made up 40.8 percent of the SNC portfolio.

The 2009 review covered 8,955 credits totaling $2.9 trillion extended to approximately 5,900 borrowers. Loans were reviewed and categorized by the severity of their risk—special mention, substandard, doubtful, or loss—in order of increasing severity. The lowest risk loans, special mention, had potential weaknesses that deserve management attention to prevent further deterioration at the time of review. The most severe category of loans, loss, includes loans that were considered uncollectible.
Key findings were:
Criticized assets, which included SNCs classified as special mention, substandard, doubtful, or loss, reached $642 billion, up from $373 billion last year, and represented 22.3 percent of the SNC portfolio compared with 13.4 percent in 2008.
SNC commitment volume increased $92 billion, or 3.3 percent, while the number of credits remained virtually unchanged.
Classified assets, which included SNCs classified as substandard, doubtful, or loss, rose to $447 billion from $163 billion and represented 15.5 percent of the SNC portfolio, compared with 5.8 percent in 2008. Classified dollar volume increased 174 percent from a year ago.
Special mention assets, which exhibited potential weakness and could result in further deterioration if uncorrected, declined to $195 billion from $210 billion and represented 6.8 percent of the SNC portfolio, compared with 7.5 percent in 2008.
The severity of criticism increased with the volume of SNCs classified as doubtful and loss rising to $110 billion, up from $8 billion in 2008. Loans in nonaccrual status also increased nearly eight times to $172 billion from $22 billion. Nonaccrual loans included $32 billion in credits classified as loss and $56 billion classified doubtful.
The distribution of credits across U.S. bank organizations, foreign bank organizations, and nonbanks remained relatively unchanged. U.S. bank organizations held 40.8 percent, while FBOs and nonbanks held 38 percent and 21.2 percent, respectively. Nonbanks continued to hold a disproportionate share of classified assets. Nonbanks held 47 percent of classified assets and 52 percent of nonaccrual loans. Federal Deposit Insurance Corporation-insured institutions held 24.2 percent of classified assets and 22.7 percent of nonaccrual loans.
Criticized volume was led by the Media and Telecom industry group with $112 billion, Finance and Insurance with $76 billion, and Real Estate and Construction with $72 billion. These three groups also represented the highest shares of criticized credits with 17.3 percent, 11.7 percent, and 11.2 percent of criticized credits in the SNC portfolio, respectively.
The review identified significant deterioration in credit quality of leveraged finance credits, with these loans representing more than 40 percent of the dollar volume of total criticized assets. About 72 percent of the dollar volume of the 50 largest leveraged finance SNCs were criticized, which represents one-third of all criticized assets.
Underwriting standards in 2008 improved from prior years, with examiners identifying fewer loans with structurally weak underwriting characteristics compared to credits written in 2007 and 2006. However, the SNC portfolio contained loans with structurally weak underwriting characteristics that were committed before mid-2007 that contributed significantly to the increase in criticized assets.
The SNC program was established in 1977 to provide an efficient and consistent review and classification of SNC, which includes any loan and or/formal loan commitment, and any asset such as real estate, stocks, notes, bonds, and debentures taken as debts previously contracted, extended to borrowers by a federally supervised institution, its subsidiaries, and affiliates that aggregates to $20 million or more and is shared by three or more unaffiliated supervised institutions. Many of these large loan commitments are also shared with foreign banking organizations and nonbanks, including securitization pools, hedge funds, insurance companies, and pension funds.
In conducting the 2009 SNC review, agencies reviewed $1.2 trillion of the $2.9 trillion credit commitments in the SNC portfolio, or 41 percent of the credits by dollar volume. The 2009 SNC sample was heavily weighted toward non-investment grade and criticized credits. The results of the review are based on analyses prepared in the second quarter of 2009 using credit-related data provided by federally supervised institutions as of December 31, 2008, and March 31, 2009.

AGRICULTURE SECRETARY VILSACK NAMES MEMBERS TO NATIONAL ORGANIC STANDARDS BOARD

WASHINGTON, Sept. 24, 2009 - Agriculture Secretary Tom Vilsack today announced the appointment of five new members to the National Organic Standards Board (NOSB), bringing new vision, further diversity, and additional experience to the organization.

The appointees will serve terms beginning Jan. 24, 2010, and ending Jan. 24, 2015. The appointees are:

Joe Dickson, an organic retailer from Austin, Texas, who is currently Certification Director of Whole Foods;

Jay Feldman, an environmentalist from Washington, D.C., currently Executive Director of Beyond Pesticides, with nearly 30 years experience in environmental issues;

John Foster, an organic handler from McMinnville, Ore., who works for Earthbound Farms and also has a strong farming background and experience as an organic inspector;

Wendy Fulwider, an organic farmer from Viroqua, Wis., who has worked to develop animal standards for the organic industry; and

Annette Riherd, an organic fruit and vegetable farmer from Oologah, Okla., who is also an advocate for buy fresh/buy local and organic and direct marketing.

USDA's Agricultural Marketing Service oversees the National Organic Program (NOP) and the NOSB. The NOSB includes four producers, two handlers, one retailer, three environmentalists, three consumers, one scientist and one certifying agent. The Board is authorized by the Organic Foods Production Act of 1990 and makes recommendations to the Secretary of Agriculture regarding the National List of Allowed and Prohibited Substances for organic operations. The NOSB also may provide advice on other aspects of the organic program.

 

The NOP is responsible for regulating the fastest growing segment of U.S. agriculture, the organic industry. U.S. sales of organic foods have grown from $1 billion in 1990, when the Organic Foods Production Act established the NOP, to a projected $23.6 billion in 2009. Congress increased NOP funding to $2.6 million in FY08 and to $3.2 million in FY09.

Obama Administration Delivers More than $106 Million for Energy Efficiency and Conservation Projects in 9 States

Washington, DC – Energy Secretary Steven Chu announced today that more than $106 million in funding from the American Recovery and Reinvestment Act is being awarded to 9 states to support energy efficiency and conservation activities. Under DOE’s Energy Efficiency and Conservation Block Grant (EECBG) program, these states will implement programs that lower energy use, reduce carbon pollution, and create green jobs locally.
“This funding will allow states across the country to make major investments in energy solutions that will strengthen America's economy and create jobs at the local level,” said Secretary Chu. “It will also promote some of the cheapest, cleanest and most reliable energy technologies we have - energy efficiency and conservation - which can be deployed immediately. Local communities can now make strategic investments to help meet the nation's long term clean energy and climate goals.”
States receiving funding today include: Delaware, Hawaii, Iowa, Indiana, Massachusetts, Oklahoma, Tennessee, Vermont and Virginia.
Today’s awards to the State Energy Offices will be used to support state-level energy efficiency priorities, along with funding local conservation projects in smaller cities and counties. At least 60 percent of each state’s award will be passed through to local cities and counties not eligible for direct EECBG awards from the Department of Energy. The EECBG Program was funded for the first time by the American Recovery and Reinvestment Act and provides formula grants to states, cities, counties, territories and federally-recognized Indian tribes nationwide to implement energy efficiency projects locally.
Projects eligible for support include the development of an energy efficiency and conservation strategy, energy efficiency audits and retrofits, transportation programs, the creation of financial incentive programs for energy efficiency improvements, the development and implementation of advanced building codes and inspections, and installation of renewable energy technologies on municipal buildings.
Transparency and accountability are important priorities for the EECBG program and all Recovery Act projects. All grantees have specific measures they must take before spending the full amount of awarded funding, such as ensuring oversight and transparency, submitting a conservation strategy to the Department of Energy, and complying with environmental regulations.

Throughout the program’s implementation, DOE will provide strong oversight at the local, state, and tribal level, while emphasizing the need to quickly award funds to help create new jobs and stimulate local economies. Communities will be required to report regularly to DOE on the progress they have made toward successfully completing projects and reaching program goals.

Six Facts About the American Opportunity Tax Credit
Many parents and college students will be able to offset the cost of college over the next two years under the new American Opportunity Tax Credit. This tax credit is part of the American Recovery and Reinvestment Act of 2009.
Here are six important facts the IRS wants you to know about the new American Opportunity Tax Credit:
This credit, which expands and renames the existing Hope Credit, can be claimed for qualified tuition and related expenses that you pay for higher education in 2009 and 2010. Qualified tuition and related expenses include tuition, related fees, books and other required course Materials.
The credit is equal to 100 percent of the first $2,000 spent and 25 percent of the next $2,000 per student each year. Therefore, the full $2,500 credit may be available to a taxpayer who pays $4,000 or more in qualifying expenses for an eligible student.
The full credit is generally available to eligible taxpayers who make less than $80,000 or $160,000 for married couples filing a joint return. The credit is gradually reduced, however, for taxpayers with incomes above these levels.
Forty percent of the credit is refundable, so even those who owe no tax can get up to $1,000 of the credit for each eligible student as cash back.
The credit can be claimed for qualified expenses paid for any of the first four years of post-secondary education.
You cannot claim the tuition and fees tax deduction in the same year that you claim the American Opportunity Tax Credit or the Lifetime Learning Credit. You must choose to either take the credit or the deduction, which ever is more beneficial for you.

Comptroller Dugan Defends Strong National Standards for Financial Providers
WASHINGTON — Comptroller of the Currency John C. Dugan said today that uniform national standards have proved to be a powerful engine for prosperity and growth, and urged Congress to strengthen federal consumer protection rules and ensure they are applied to all providers of the same financial products.
While many parts of the Treasury Department’s regulatory reform proposal would enhance consumer protection, provisions that would repeal preemption should be rejected, Mr. Dugan said in a speech to Women in Housing and Finance.
“This radical change is fundamentally at odds with the concept of efficient national standards for national products and services offered across state lines in national markets – a concept that has been central to the economic prosperity of the United States since the adoption of our Constitution, and one that has been critical to the flourishing of our national banking system since 1863,” he said.
Mr. Dugan noted that key parts of the Treasury plan promote the concept of uniform national standards, and said that one of the critical benefits of the proposed Consumer Financial Protection Agency would be to ensure that consistent federal rules apply to all financial providers, including the “shadow banking system” of nonbank lenders that was responsible for the largest share of the most abusive subprime loans that fueled the financial crisis.
However, the Treasury proposal would allow states to adopt and enforce different rules, which would result in a patchwork of federal and state laws that disadvantage consumers and give rise to significant uncertainty about which sets of standards apply to institutions conducting a multistate business.
“More fundamentally, we live in an era where the market for financial products and services is often national in scope,” Mr. Dugan said. “In this context, regressing to a regulatory regime that fails to recognize the way retail financial services are now provided, and the need for a single set of rules for banks with customers in multiple states, would discard many benefits consumers reap from our modern financial product delivery system.”
There are a number of areas in which complying with different standards set by individual states would require a bank to determine which state’s law governs – the law of the state where the product or service is provided, the law of the home state of the bank, or the law of the state where the consumer is located, and “it is far from clear how a bank could do this based on objective analysis, and any conflicts could result in penalties and litigation in multiple jurisdictions,” the Comptroller said.
In the case of checking accounts, he said, there could be differences in rules on the number and amount of withdrawals or deposits, permissible minimum balance requirements and ATM screen disclosures. States could assert that these requirements apply according to the law of the state in which the branch offering the account is located, the home state of the bank, the state where the customer resides, or someplace else.
“How would a bank advertise in the newspaper or on the radio to promote its checking accounts if it were located in a multistate region – such as the Washington DC area – if different states imposed different requirements regarding terms and disclosures?” he asked.
“Even if the bank figured all this out for a particular customer, that could all change if the customer moved, or if the bank merged with another bank located in a different state,” he said. “Would that mean the customer would have to open a new account to incorporate the state’s required terms? And even if Congress added language to address some of the questions we can think of today, there would only be more uncertainties tomorrow – and no realistic possibility of writing a fix into national law each time a new issue arose.”
The Comptroller also noted that many arguments for abandoning preemption are simply wrong, including the notion that national banks were the source of predatory and unsafe mortgage loans, while state institutions were not.
“It is widely recognized that the worst subprime loans that have caused the most foreclosures were originated by nonbank lenders and brokers regulated exclusively by the states. Although the OCC has little rulewriting authority in this area, we have closely supervised national bank subprime lending practices. As a result, national banks originated a relatively smaller share of subprime loans and applied better standards, resulting in significantly fewer foreclosures – as demonstrated in an attachment to this speech prepared last year by OCC staff,” he said.
“Meanwhile, nothing in federal law precluded states from effectively regulating their own nonbank mortgage lenders and brokers,” he added. “Indeed, that’s why the plan’s grant of strong rulewriting and enforcement authority at the federal level over the shadow banking system of unregulated financial providers, through the CFPA, is such a good idea.”

AGRICULTURE, INTERIOR MOBILIZING EMPLOYEES, VOLUNTEERS FOR SATURDAY'S NATIONAL PUBLIC LANDS DAY

Largest One-Day Volunteer Effort to Improve America's Public Lands

WASHINGTON, September 24, 2009 - In honor of Public Lands Day, this Saturday, September 26, 2009, Agriculture Secretary Tom Vilsack and Secretary of the Interior Ken Salazar are pleased to announce a variety of planned activities, including: cleaning up rivers, lakes and wetlands; mulching the Lincoln Memorial; restoring fish and wildlife habitat; a wild horse auction, and free entrance at hundreds of federal recreation sites on public lands nationwide.

To mark the 16th Annual National Public Lands Day federal agencies, the National Environmental Education Foundation, and tens of thousands of volunteers will be participating in the nation's largest one-day public lands volunteer event in history. The U. S. Forest Service, National Park Service, Bureau of Land Management and dozens of other federal land management agencies will be holding events from coast to coast, focusing on the need for shared stewardship of public lands and educating the public about the importance of natural resources. National Public Lands Day volunteers at all federal sites managed by the U.S. Forest Service, National Park Service, Fish and Wildlife Service, Bureau of Land Management, and Army Corps of Engineers will receive free admission on Sept. 26, and many sites will provide a coupon to return for "fee-free" day use activity any time in the next year. Many state sites are also offering free admission for the day.

"Our nation's forests are incredible assets that have major economic, environmental, and social significance for all Americans," said Secretary of Agriculture Tom Vilsack. "Forests are sources of clean abundant water, fish and wildlife habitat, carbon storage, and a wide array of recreational activities for all to enjoy. But they are in need of restoration and conservation. It is essential that we reconnect Americans across the nation with the natural resources and the landscapes that sustain us. By working together we will restore forests, making them more resilient to climate change while protecting critical water resources and improving overall forest health."

"Interior manages more than 500 million acres of land - one-fifth of the nation's land mass," Secretary of the Interior Ken Salazar said. "These lands include every type of ecosystem, from coastal estuaries and streamside habitat on our nation's rivers to prairie wetlands and alpine forests. We need greater public involvement to protect and restore these vast, valuable natural resources. National Public Lands Day is a great opportunity not only to reach out to our citizen-stewards but also to do some good work."

The U.S. Department of Agriculture's U.S. Forest Service will host 96 project sites for volunteer initiatives across the country, including restoring fish and wildlife habitat, testing water quality in streams and rivers, cleaning up rivers, lakes and wetlands, and planting vegetation near bodies of water. Highlights of these efforts are appended. In 2008, more than 120,000 volunteers built trails and bridges, removed trash and planted over 1.6 million trees throughout the country. This year's events promise to be even more successful. In recognition of the day, fees will be waived at hundreds of recreation sites on public lands nationwide.

Interior land management bureaus, including the National Park Service, Bureau of Land Management and U.S. Fish and Wildlife Service, will be hosting several hundred volunteer events at their sites across the country. One of the largest events will be at the National Mall, where Interior employees and friends will join senior administration and departmental officials to improve and beautify The Watergate Steps on the west side of the Lincoln Memorial. Volunteer activities will include, invasive species removal long the steps, and clearing debris, overgrown branches and trash and mulching around the Lincoln Memorial. Registration begins at 8:00 a.m at 23rd and Independence Avenue, NW, Washington, D.C. Tools, snacks, and beverages will be provided.

National Park Service Acting Director Dan Wenk will be on the National Mall and at the White House Ellipse at 5 p.m. EDT to welcome volunteers who donated their time and effort to spruce up more than 30 national park sites in the Washington Metropolitan Area. At 7 p.m.Wenk will introduce a preview of the new Ken Burns film, The National Parks: America's Best Idea. The showing is free. The film debuts on PBS on September 27.

Among numerous activities, the Bureau of Land Management is hosting the first national Wild Horse Adoption Day in cooperation with other wild horse and humane animal advocacy groups. The day is dedicated to supporting and protecting the livelihood of wild horses. Participating organizations in this event hope to encourage more people to adopt these wonderful animals. One of the adoption sites planned for that day will be held in Lorton, Virginia at the BLM's Meadowood recreation site (10406 Gunston Rd).

BLM organizes wild horse adoptions and manages wild horses and burros on the western public range lands. Adoptions can help BLM to control the wild horse and burro population from exceeding the carrying capacity of the western range lands. OCC Receives NASLEF Leadership Award

ST. LOUIS — Today the National Association of State and Local Equity Funds (NASLEF) presented its 2009 Leadership Award to the Office of the Comptroller of the Currency for its nationwide efforts to educate banks about the mechanics of Low-Income Housing Tax Credit investing. OCC’s Deputy Comptroller for Community Affairs Barry R. Wides accepted the award on behalf of the agency.
In remarks to approximately 150 state and local tax credit equity fund managers, Mr. Wides focused on the benefits of the Low-Income Housing Tax Credits and the need to fill the financing gaps that have slowed affordable housing development in many parts of the country.

“Over the past two decades, the Low-Income Housing Tax Credit program has financed nearly two million low-income housing units, and induced billions of dollars of private investment,” he said in his remarks. “When carefully implemented, financing LIHTC properties provides banks with both economic and regulatory benefits, including positive consideration under the Community Reinvestment Act.”
“The OCC has been holding seminars around the country in conjunction with the other bank regulatory agencies and the Federal Home Loan Banks to educate bankers about the LIHTC program and the new investment opportunities presented by recent legislation and changing market conditions,” Mr. Wides said. “These events, held in seven locations around the country, and our telephone seminar have reached over 1,000 bankers.”
The OCC will be holding its next seminar in Pittsburgh, Pennsylvania on October 23 in partnership with the Federal Home Loan Bank of Pittsburgh and the Federal Reserve Bank of Cleveland. Additional events are planned later this year and in 2010.

To provide banks with easy access to information and best practices, the OCC has created a number of fact sheets, resource guides, and directories that can be found on the OCC’s Web site http://www.occ.gov/cdd/taxcreditresource.htm.
The OCC’s Community Affairs Officers, who are stationed throughout the country, are also available to answer questions and provide resource materials to national banks interested in learning more about LIHTC investment opportunities.

Secretary Salazar Applauds Senate’s Confirmation of Jonathan Jarvis as Director of the National Park Service

WASHINGTON, D.C.—Secretary of the Interior Ken Salazar today praised the
Senate’s confirmation of Jonathan Jarvis to be director of the National
Park Service.

“This is a great day for the National Park Service and for the American
public,” Secretary Salazar said. “Jon Jarvis is a career professional who
has consistently stood up for protection of national parks. He brings
great wisdom and three decades of experience to the job.”

Jarvis, a 30-year veteran of the National Park Service, has served since
2002 as regional director of the agency’s Pacific West Region, where he was
responsible for 54 national parks in Washington, Oregon, Idaho, California,
Nevada, Hawaii and the Pacific Islands of Guam, Saipan and American Samoa,
as well as a host of NPS community revitalization programs that serve those
states.

"America's National Park System is a gift from past generations to this and
succeeding generations. I look forward to working with Secretary Salazar,
the Congress, our partners, and the extraordinary employees of the National
Park Service as we prepare for the next century of stewardship and
excellent visitor experiences," Jarvis said today.

Jarvis has served as superintendent of Mount Rainier National Park in
Ashford, Washington, Craters of the Moon National Monument in Idaho, and
Wrangell-St. Elias National Park & Preserve in Alaska. A trained biologist,
he was also Chief of Natural and Cultural Resources at North Cascades
National Park. Jarvis is currently the co-leader of the Children in Nature
taskforce with the National Association of State Park Directors.

A native of Virginia, Jarvis has a B.S. in biology from the College of
William and Mary and completed the Harvard Kennedy School Executive Program
in 2001.
