The Mississippi River Basin Healthy Watersheds Initiative (MRBI) will provide approximately $320 million over the next four years for voluntary projects in priority watersheds located in 12 key states. for AeroSys, Inc. Products to Ensure Compliance with Appliance
Standards Washington, DC As part of its renewed efforts to ensure compliance with national energy efficiency appliance standards, the U.S. Department of Energy today issued a test notice requiring AeroSys, Inc. to provide sample air conditioners and heat pumps for laboratory testing by DOE. The test notice, issued under 10 CFR 430.70, requires AeroSys to make test samples of certain AeroSys-manufactured air conditioners and heat pumps available to DOE at its own expense. The Department will then determine whether these products comply with applicable DOE energy standards, which are designed to strengthen efficiency levels for various appliances, save money for consumers, and reduce greenhouse gas emissions. In response to our subpoena, AeroSys provided confidential certification test data that claimed to show standards compliance for seven of its basic models, said DOE General Counsel Scott Blake Harris. But we concluded that the AeroSys data left open questions about whether their products fully comply with all of the relevant energy efficiency standards. As the next step in the process, we will be testing the products ourselves to ensure that these appliances meet national energy efficiency standards. President Obama and Secretary Chu have moved aggressively to clear the backlog of energy efficiency standards for appliances and reinforce the Departments efforts to save energy for American consumers and businesses. In February 2009, President Obama tasked the Department of Energy with quickening the pace of energy conservation standards for appliances, while continuing to meet legal and statutory deadlines. The Department of Energy has now issued energy efficiency standards for each of the appliance categories highlighted by the President, and is continuing to move forward to develop new energy saving standards and to consistently and agressivley enforce existing standards. ### |

Credit Quality Declines in Annual Shared National Credits Review WASHINGTON Credit quality declined
sharply for loan commitments of $20 million or more held by multiple
federally supervised institutions, according to the 32nd annual
review of Shared National Credits (SNC). The 2009 review covered 8,955 credits totaling
$2.9 trillion extended to approximately 5,900 borrowers. Loans
were reviewed and categorized by the severity of their riskspecial
mention, substandard, doubtful, or lossin order of increasing
severity. The lowest risk loans, special mention, had potential
weaknesses that deserve management attention to prevent further
deterioration at the time of review. The most severe category
of loans, loss, includes loans that were considered uncollectible.

AGRICULTURE SECRETARY VILSACK NAMES MEMBERS TO NATIONAL ORGANIC STANDARDS BOARD WASHINGTON, Sept. 24, 2009 - Agriculture Secretary Tom Vilsack today announced the appointment of five new members to the National Organic Standards Board (NOSB), bringing new vision, further diversity, and additional experience to the organization. The appointees will serve terms beginning Jan. 24, 2010, and ending Jan. 24, 2015. The appointees are: Joe Dickson, an organic retailer from Austin, Texas, who is currently Certification Director of Whole Foods; Jay Feldman, an environmentalist from Washington, D.C., currently Executive Director of Beyond Pesticides, with nearly 30 years experience in environmental issues; John Foster, an organic handler from McMinnville, Ore., who works for Earthbound Farms and also has a strong farming background and experience as an organic inspector; Wendy Fulwider, an organic farmer from Viroqua, Wis., who has worked to develop animal standards for the organic industry; and Annette Riherd, an organic fruit and vegetable farmer from Oologah, Okla., who is also an advocate for buy fresh/buy local and organic and direct marketing. USDA's Agricultural Marketing Service oversees the National Organic Program (NOP) and the NOSB. The NOSB includes four producers, two handlers, one retailer, three environmentalists, three consumers, one scientist and one certifying agent. The Board is authorized by the Organic Foods Production Act of 1990 and makes recommendations to the Secretary of Agriculture regarding the National List of Allowed and Prohibited Substances for organic operations. The NOSB also may provide advice on other aspects of the organic program.
The NOP is responsible for regulating the fastest growing segment of U.S. agriculture, the organic industry. U.S. sales of organic foods have grown from $1 billion in 1990, when the Organic Foods Production Act established the NOP, to a projected $23.6 billion in 2009. Congress increased NOP funding to $2.6 million in FY08 and to $3.2 million in FY09. # |
Obama Administration Delivers More than
$106 Million for Energy Efficiency and Conservation Projects
in 9 States Washington, DC Energy Secretary Steven Chu announced today that more than $106 million in funding from the American Recovery and Reinvestment Act is being awarded to 9 states to support energy efficiency and conservation activities. Under DOEs Energy Efficiency and Conservation Block Grant (EECBG) program, these states will implement programs that lower energy use, reduce carbon pollution, and create green jobs locally. This funding will allow states across the country to make major investments in energy solutions that will strengthen America's economy and create jobs at the local level, said Secretary Chu. It will also promote some of the cheapest, cleanest and most reliable energy technologies we have - energy efficiency and conservation - which can be deployed immediately. Local communities can now make strategic investments to help meet the nation's long term clean energy and climate goals. States receiving funding today include: Delaware, Hawaii, Iowa, Indiana, Massachusetts, Oklahoma, Tennessee, Vermont and Virginia. Todays awards to the State Energy Offices will be used to support state-level energy efficiency priorities, along with funding local conservation projects in smaller cities and counties. At least 60 percent of each states award will be passed through to local cities and counties not eligible for direct EECBG awards from the Department of Energy. The EECBG Program was funded for the first time by the American Recovery and Reinvestment Act and provides formula grants to states, cities, counties, territories and federally-recognized Indian tribes nationwide to implement energy efficiency projects locally. Projects eligible for support include the development of an energy efficiency and conservation strategy, energy efficiency audits and retrofits, transportation programs, the creation of financial incentive programs for energy efficiency improvements, the development and implementation of advanced building codes and inspections, and installation of renewable energy technologies on municipal buildings. Transparency and accountability are important priorities for the EECBG program and all Recovery Act projects. All grantees have specific measures they must take before spending the full amount of awarded funding, such as ensuring oversight and transparency, submitting a conservation strategy to the Department of Energy, and complying with environmental regulations. Six Facts About the American Opportunity
Tax Credit Many parents and college students will be able to offset the cost of college over the next two years under the new American Opportunity Tax Credit. This tax credit is part of the American Recovery and Reinvestment Act of 2009. Here are six important facts the IRS wants you to know about the new American Opportunity Tax Credit: This credit, which expands and renames the existing Hope Credit, can be claimed for qualified tuition and related expenses that you pay for higher education in 2009 and 2010. Qualified tuition and related expenses include tuition, related fees, books and other required course Materials. The credit is equal to 100 percent of the first $2,000 spent and 25 percent of the next $2,000 per student each year. Therefore, the full $2,500 credit may be available to a taxpayer who pays $4,000 or more in qualifying expenses for an eligible student. The full credit is generally available to eligible taxpayers who make less than $80,000 or $160,000 for married couples filing a joint return. The credit is gradually reduced, however, for taxpayers with incomes above these levels. Forty percent of the credit is refundable, so even those who owe no tax can get up to $1,000 of the credit for each eligible student as cash back. The credit can be claimed for qualified expenses paid for any of the first four years of post-secondary education. You cannot claim the tuition and fees tax deduction in the same year that you claim the American Opportunity Tax Credit or the Lifetime Learning Credit. You must choose to either take the credit or the deduction, which ever is more beneficial for you. Comptroller Dugan Defends Strong National
Standards for Financial Providers WASHINGTON Comptroller of the Currency John C. Dugan said today that uniform national standards have proved to be a powerful engine for prosperity and growth, and urged Congress to strengthen federal consumer protection rules and ensure they are applied to all providers of the same financial products. While many parts of the Treasury Departments regulatory reform proposal would enhance consumer protection, provisions that would repeal preemption should be rejected, Mr. Dugan said in a speech to Women in Housing and Finance. This radical change is fundamentally at odds with the concept of efficient national standards for national products and services offered across state lines in national markets a concept that has been central to the economic prosperity of the United States since the adoption of our Constitution, and one that has been critical to the flourishing of our national banking system since 1863, he said. Mr. Dugan noted that key parts of the Treasury plan promote the concept of uniform national standards, and said that one of the critical benefits of the proposed Consumer Financial Protection Agency would be to ensure that consistent federal rules apply to all financial providers, including the shadow banking system of nonbank lenders that was responsible for the largest share of the most abusive subprime loans that fueled the financial crisis. However, the Treasury proposal would allow states to adopt and enforce different rules, which would result in a patchwork of federal and state laws that disadvantage consumers and give rise to significant uncertainty about which sets of standards apply to institutions conducting a multistate business. More fundamentally, we live in an era where the market for financial products and services is often national in scope, Mr. Dugan said. In this context, regressing to a regulatory regime that fails to recognize the way retail financial services are now provided, and the need for a single set of rules for banks with customers in multiple states, would discard many benefits consumers reap from our modern financial product delivery system. There are a number of areas in which complying with different standards set by individual states would require a bank to determine which states law governs the law of the state where the product or service is provided, the law of the home state of the bank, or the law of the state where the consumer is located, and it is far from clear how a bank could do this based on objective analysis, and any conflicts could result in penalties and litigation in multiple jurisdictions, the Comptroller said. In the case of checking accounts, he said, there could be differences in rules on the number and amount of withdrawals or deposits, permissible minimum balance requirements and ATM screen disclosures. States could assert that these requirements apply according to the law of the state in which the branch offering the account is located, the home state of the bank, the state where the customer resides, or someplace else. How would a bank advertise in the newspaper or on the radio to promote its checking accounts if it were located in a multistate region such as the Washington DC area if different states imposed different requirements regarding terms and disclosures? he asked. Even if the bank figured all this out for a particular customer, that could all change if the customer moved, or if the bank merged with another bank located in a different state, he said. Would that mean the customer would have to open a new account to incorporate the states required terms? And even if Congress added language to address some of the questions we can think of today, there would only be more uncertainties tomorrow and no realistic possibility of writing a fix into national law each time a new issue arose. The Comptroller also noted that many arguments for abandoning preemption are simply wrong, including the notion that national banks were the source of predatory and unsafe mortgage loans, while state institutions were not. It is widely recognized that the worst subprime loans that have caused the most foreclosures were originated by nonbank lenders and brokers regulated exclusively by the states. Although the OCC has little rulewriting authority in this area, we have closely supervised national bank subprime lending practices. As a result, national banks originated a relatively smaller share of subprime loans and applied better standards, resulting in significantly fewer foreclosures as demonstrated in an attachment to this speech prepared last year by OCC staff, he said. Meanwhile, nothing in federal law precluded states from effectively regulating their own nonbank mortgage lenders and brokers, he added. Indeed, thats why the plans grant of strong rulewriting and enforcement authority at the federal level over the shadow banking system of unregulated financial providers, through the CFPA, is such a good idea. AGRICULTURE, INTERIOR MOBILIZING EMPLOYEES, VOLUNTEERS FOR SATURDAY'S NATIONAL PUBLIC LANDS DAY Largest One-Day Volunteer Effort to Improve America's Public Lands WASHINGTON, September 24, 2009 - In honor of Public Lands Day, this Saturday, September 26, 2009, Agriculture Secretary Tom Vilsack and Secretary of the Interior Ken Salazar are pleased to announce a variety of planned activities, including: cleaning up rivers, lakes and wetlands; mulching the Lincoln Memorial; restoring fish and wildlife habitat; a wild horse auction, and free entrance at hundreds of federal recreation sites on public lands nationwide. To mark the 16th Annual National Public Lands Day federal agencies, the National Environmental Education Foundation, and tens of thousands of volunteers will be participating in the nation's largest one-day public lands volunteer event in history. The U. S. Forest Service, National Park Service, Bureau of Land Management and dozens of other federal land management agencies will be holding events from coast to coast, focusing on the need for shared stewardship of public lands and educating the public about the importance of natural resources. National Public Lands Day volunteers at all federal sites managed by the U.S. Forest Service, National Park Service, Fish and Wildlife Service, Bureau of Land Management, and Army Corps of Engineers will receive free admission on Sept. 26, and many sites will provide a coupon to return for "fee-free" day use activity any time in the next year. Many state sites are also offering free admission for the day. We need greater public involvement to protect and restore these vast, valuable natural resources. The U.S. Department of Agriculture's U.S. Forest Service will host 96 project sites for volunteer initiatives across the country, including restoring fish and wildlife habitat, testing water quality in streams and rivers, cleaning up rivers, lakes and wetlands, and planting vegetation near bodies of water. Highlights of these efforts are appended. In 2008, more than 120,000 volunteers built trails and bridges, removed trash and planted over 1.6 million trees throughout the country. Registration begins at 8:00 a.m at 23rd and Independence Avenue, NW, Washington, D.C. Tools, snacks, and beverages will be provided. National Park Service Acting Director Dan Wenk will be on the National Mall and at the White House Ellipse at 5 p.m. EDT to welcome volunteers who donated their time and effort to spruce up more than 30 national park sites in the Washington Metropolitan Area. At 7 p.m.Wenk will introduce a preview of the new Ken Burns film, The National Parks: America's Best Idea. The showing is free. The film debuts on PBS on September 27. Among numerous activities, the Bureau of Land Management is hosting the first national Wild Horse Adoption Day in cooperation with other wild horse and humane animal advocacy groups. The day is dedicated to supporting and protecting the livelihood of wild horses. Participating organizations in this event hope to encourage more people to adopt these wonderful animals. One of the adoption sites planned for that day will be held in Lorton, Virginia at the BLM's Meadowood recreation site (10406 Gunston Rd). BLM organizes wild horse adoptions and manages wild horses and burros on the western public range lands. of State and Local Equity Funds (NASLEF) presented its 2009 Leadership
Award to the Office of the Comptroller of the Currency for its
nationwide efforts to educate banks about the mechanics of Low-Income
Housing Tax Credit investing. OCCs Deputy Comptroller for
Community Affairs Barry R. Wides accepted the award on behalf
of the agency. Over the past two decades, the Low-Income
Housing Tax Credit program has financed nearly two million low-income
housing units, and induced billions of dollars of private investment,
he said in his remarks. When carefully implemented, financing
LIHTC properties provides banks with both economic and regulatory
benefits, including positive consideration under the Community
