support for investing in innovative clean energy technologies
and the aviation sector in China. These activities further the
proactive goals of the Administration by promoting the use of
technologies that limit the carbon released from coal-fired power
plants and establishing the U.S.-China Energy Cooperation Program.
USTDA also awarded a grant that will advance China's domestic
aviation sector by providing technical assistance to analyze

ANNIVERSARY
SHANGHAI, CHINA, October 30, 2009 - Agriculture
Secretary Tom Vilsack met today with alumni of the U.S. Department
of Agriculture's Cochran Fellowship Program in Shanghai, China.
At a sit-down reception with about 15 Cochran Fellows, Vilsack
thanked the alumni for their hard work and on selecting a career
of vital importance to global trade and development.
"The USDA is committed to supporting
people around the world who are striving to better their lives,
and the lives of others, through studies and careers in agriculture,"
said Vilsack. "The Cochran Fellowship Program helps participants
become leaders in their fields and develop expertise that will
enhance agricultural productivity, help feed hungry people, stimulate
economic growth, and strengthen sustainable agricultural practices."
The Cochran Program is administered by
USDA's Foreign Agricultural Service (FAS). It provides U.S.-based
agricultural training for senior and mid-level specialists and
administrators from public and private sector institutions abroad.
Cochran Fellows traditionally have careers in agricultural trade,
agribusiness development, management, policy, and marketing in
their home countries. In China, the Cochran Program has provided
training to 660 Chinese fellows since 1989, including 19 in 2009
to-date and 30 in 2008. Fields of study have included food safety,
meat and poultry inspection, dairy management, and plant variety
and protection.
USDA began administering the Cochran Program
25 years ago after the program's namesake, U.S. Senator Thad
Cochran of Mississippi, envisioned providing training and support
to help developing nations improve their agricultural systems
and strengthen and enhance trade links with the United States.
Since its inception in 1984, the Cochran
Program has provided training for over 13,500 international participants
from 122 countries worldwide. In 2008, the Program received 520
participants from 75 countries. Cochran alumni have made valuable
contributions to improving national trade policies and regulatory
frameworks that increase market access for American agricultural
products.
Vilsack is in China with U.S. Trade Representative
Ron Kirk and Commerce Secretary Gary Locke to participate in
meetings for the U.S.-China Joint Commission on Commerce and
Trade (JCCT). The JCCT serves as an important forum for Cabinet-level
officials from both countries to resolve trade concerns and enhance
economic opportunities and cooperation. Before attending the
JCCT meetings, Vilsack officially opened the U.S. Trade and Investment
Mission in Manila, the Philippine capital, and also met with
Philippine President Gloria Arroyo, Secretary of Agriculture
Arthur C. Yap and other government officials.

indicates that the American Recovery and Reinvestment Act of
2009 contributed between 3 and 4 percentage points to real GDP
growth in the third quarter. This suggests that in the absence
of the Recovery Act, real GDP would have risen little, if at
all, this past quarter.

EPA Proceeds with Revoking Regulations
Allowing Carbofuran Pesticide Residues on Food
WASHINGTON The U.S. Environmental
Protection Agency is moving forward to implement the agencys
May 2009 final rule revoking tolerances, or residue limits, for
the pesticide carbofuran. EPA continues to find that dietary
exposures to carbofuran from all sources combined are not safe.
The evidence is clear that carbofuran
does not meet todays rigorous food-safety standards,
said Steve Owens, assistant administrator for EPAs Office
of Prevention, Pesticides and Toxic Substances. EPA has
carefully evaluated the scientific issues and has provided more
than 500 days of public comment on this decision. It is now important
to move forward with the needed public health protections, especially
for children.
Short-term health effects include headache,
sweating, nausea, diarrhea, chest pains, blurred vision, anxiety
and general muscular weakness.
EPA encourages growers to switch from carbofuran
to safer pesticides or other environmentally preferable pest
control strategies. Since the tolerances are being revoked, EPA
reminds growers that carbofuran should not be applied to any
food crops after December 31, 2009. Use of carbofuran after this
date could result in adulterated food products, which would be
subject to enforcement by the U.S. Food and Drug Administration.
The United States has a safe and abundant food supply, and everyone
should continue to eat a variety of foods, as recommended by
the federal government and nutrition experts.
During the objection period, the chemical
company FMC Corporation, which manufactures carbofuran, and three
grower associations submitted objections to EPAs tolerance
revocations and requested an administrative hearing. EPA has
concluded that the regulatory standard for holding an evidentiary
hearing has not been met. EPAs explanation about why a
hearing is not warranted, and the reasons for denying the objections
are available on the web and will be published soon in a Federal
Register notice. As part of the administrative process, FMC may
appeal the revocation of the carbofuran tolerances to a federal
circuit court of appeals.
EPAs May 2009 action to revoke carbofuran
tolerances was the culmination of a regulatory process that began
in 2006 when the agency published its risk assessments for carbofuran
and determined, in August 2006, that no uses were eligible for
reregistration. While FMC has voluntarily canceled 22 carbofuran
uses, the elimination of these uses was not sufficient to allow
the agency to make a finding that combined dietary exposures
to carbofuran from food and water are safe. The process to cancel
the remaining carbofuran registrations is under way and will
address unacceptable risks to farmworkers during pesticide application
and to birds in and around treated fields.

Financial Regulators Adopt Guidance on
Prudent Commercial Real Estate Loan Workouts
The Federal Financial Institutions Examination Council (FFIEC)
released a policy statement today supporting prudent commercial
real estate (CRE) loan workouts. This policy statement, adopted
by each of the financial regulators, 1 provides guidance for
examiners, and for financial institutions that are working with
CRE borrowers who are experiencing diminished operating cash
flows, depreciated collateral values, or prolonged delays in
selling or renting commercial properties. The financial regulators
recognize that prudent loan workouts are often in the best interest
of both financial institutions and borrowers, particularly during
difficult economic conditions. This policy statement details
risk-management practices for loan workouts that support prudent
and pragmatic credit and business decisionmaking within the framework
of financial accuracy, transparency, and timely loss recognition.
Financial institutions that implement prudent loan workout arrangements
after performing comprehensive reviews of borrowers financial
conditions will not be subject to criticism for engaging in these
efforts, even if the restructured loans have weaknesses that
result in adverse credit classifications. 2 In addition, performing
loans, including those renewed or restructured on reasonable
modified terms, made to creditworthy borrowers, will not be subject
to adverse classification solely because the value of the underlying
collateral declined.
The policy statement includes examples of CRE loan workouts.
The examples, provided for illustrative purposes only, reflect
examiners analytical processes for credit classifications
and assessments of institutions accounting and reporting
treatments for restructured loans. The policy statement reiterates
existing guidance that examiners are expected to take a balanced
approach in assessing institutions risk-management practices
for loan workout activities.

WASHINGTON, Oct. 30, 2009 - In response
to the events at Bushways Packing Inc. in Grand Isle, Vt., Agriculture
Secretary Tom Vilsack said:
"The deplorable scenes recorded in
the video released by the Humane Society of the United States
are unequivocally unacceptable. The callous behavior and attitudes
displayed in the video clearly appear to be violations of USDA's
humane handling regulations.
"USDA's Food Safety and Inspection
Service (FSIS) is investigating these alleged violations of the
Humane Methods of Slaughter Act (HMSA). FSIS took immediate action
with respect to its employee and the establishment upon preliminary
verification of the incident. The Department fully supports the
investigation of all those involved in these alleged violations
of the HMSA. To this end, I have also called on our Inspector
General to conduct a criminal investigation of the events in
the video.
"FSIS has a rigorous program to train
inspection personnel in verifying humane handling and slaughter
at establishments. When an FSIS employee observes behaviors that
are not in compliance with the HMSA, they are obligated to take
immediate action. The behavior of FSIS and establishment personnel
witnessed in this video is inexcusable."

from U.S. Energy Secretary Chu in honor of National Weatherization
Day. The text of the Op-ed is below:
Weatherization: Saving Money by Saving Energy
Published: October 30, 2009
I've always been a bit of an energy efficiency nut.
I've made it my mission to cut the utility bills at every home
we've owned. Long before I learned about the risks of climate
change, I was fanatical about energy efficiency because I'm cheap.
Whenever my wife and I move into a new home, I check the attic
for adequate insulation. I look for leaks around doors and windows
and install a programmable thermostat if needed. In our latest
home, I've also insulated our water pipes with inexpensive foam
from our local hardware store and painted mastic sealant on the
seams of the air ducts. When our hot water heater needed replacement,
we installed a tank-less water heater which decreased our summer-time
gas use by 50%. In the summer, we found that setting the thermostat
at 77 - 78 degrees and a gentle breeze from a fan was all that
is required to be comfortable.
So far, we are on track to cut our utility bills by about half
compared to the previous owner, but we are doing more. Our home
has two large skylights that funnel too much heat out in the
winter and let too much heat in the summer. We intend to replace
these older windows with modern widows with five times the efficiency.
Taking these steps is called "weatherization." I would
rather call it "saving money by saving energy." Over
the next several years, we want to help millions of American
families seize the same opportunity to cut their utility bills
by making their homes and appliances more energy efficient while
increasing comfort.
We are making a major down payment on this effort through the
President's economic recovery plan.
First, the Recovery Act expanded tax credits for energy efficiency
upgrades to your home. If you purchase and install certain energy-efficient
windows, insulation, doors, roofs, or heating and cooling equipment,
you can receive a tax credit for 30% of the cost, up to $1,500.
For example, if insulating your attic costs around $1,600, you'll
receive a $480 tax credit, and you could save up to $200 on your
utility bill each year.
Second, we are launching an innovative new effort called "Retrofit
Ramp Up" that will simplify and reduce the cost of home
retrofits by funding pioneering programs that reach whole neighborhoods
and towns. If we can energy audit and retrofit a reasonable fraction
of the homes in any given residential block, the cost will be
greatly reduced. Programs such as these will decrease barriers
to saving money: inconvenience, inertia, and inadequate information.
We want to make home energy efficiency upgrades irresistible
and a social norm for homeowners.
This effort could offer homeowners innovative ways to finance
the upfront investments they can't afford on their own. For example,
homeowners might receive a loan for an energy improvement and
pay back the principal and interest over time via an assessment
on their property tax bill. The homeowners might pay an extra
$400 per year on their property tax bill but save $500 a year
on their utility bill. Since the financing would be attached
to the property tax bill, both the savings and the loan payments
stay with the house if the owners decide to sell.
Finally, for low-income families who are hit hardest by high
utility bills, the Recovery Act provides $5 billion for home
weatherization. This is the largest single investment in home
energy efficiency in U.S history. This program is creating jobs
now, putting money back in the pockets of hardworking Americans,
reducing our environmental footprint, and making these homes
more livable. However, some people - including me - have been
frustrated that the program started off more slowly than we'd
hoped.
It took a few months for states to develop their plans and for
the Energy Department to ensure those plans met the highest standards
of accountability. We also used this time to work with the Labor
Department to establish standards that guarantee these jobs pay
a fair wage. States and their local weatherization agencies also
began training this new workforce and buying millions of dollars
in necessary equipment and materials, like caulk guns, insulation
blowers, and service vehicles. We are taking the care and time
necessary to make sure these taxpayer dollars are well spent.
Those purchases are creating jobs. A good example is an insulation
machine manufacturer called Krendl in Delphos, Ohio. Because
of Recovery Act-driven purchases, Krendl has expanded its workforce
by 30 percent, and one of Krendl's distributors, Applied Energy
Products, Inc., increased its staff by almost 60 percent.
Here's more good news:
All 50 states have received 100% of their Recovery Act weatherization
funding and have begun to double and triple their home energy
efficiency efforts. Workers are being hired, homes are being
improved, and families are being helped.
In September, we estimate we weatherized 15,000 - 20,000 homes
- the fastest pace in the 30 year history of the Weatherization
Assistance Program. We expect to be weatherizing 20,000 to 30,000
homes per month soon.
This effort has already created or saved thousands of jobs, and
the pace of hiring is accelerating. The Department of Energy
and our partners have an aggressive training and technical assistance
program to continue to invest in green workforce development.
We're training a workforce and building a home energy efficiency
industry that will be a crucial part of America's new, clean
energy economy. As states, utilities and private companies increasingly
pursue home energy efficiency - in part because of the innovative
incentive programs I described earlier - we will have the capacity
to help millions of Americans lower their utility bills.
Energy efficiency is simply good economics. It will save you
money. It will create jobs. It is a way for you to personally
decrease your carbon emissions and help save our planet.

HHS Strengthens HIPAA Enforcement
The U.S. Department of Health and Human
Services (HHS) issued an interim
final rule with request for comments today to strengthen its
enforcement
of the rules promulgated under the Health Insurance Portability
and
Accountability Act (HIPAA). The Health Information Technology
for
Economic and Clinical Health (HITECH) Act, which was enacted
as part of
the American Recovery and Reinvestment Act of 2009, modified
the HHS
Secretary's authority to impose civil money penalties for violations
occurring after Feb. 18, 2009. These HITECH Act revisions significantly
increase the penalty amounts the Secretary may impose for violations
of
the HIPAA rules and encourage prompt corrective action.
Prior to the HITECH Act, the Secretary
could not impose a penalty of
more than $100 for each violation or $25,000 for all identical
violations of the same provision. A covered health care provider,
health
plan or clearinghouse could also bar the Secretary's imposition
of a
civil money penalty by demonstrating that it did not know that
it
violated the HIPAA rules. Section 13410(d) of the HITECH Act
strengthened the civil money penalty scheme by establishing tiered
ranges of increasing minimum penalty amounts, with a maximum
penalty of
$1.5 million for all violations of an identical provision. A
covered
entity can no longer bar the imposition of a civil money penalty
for an
unknown violation unless it corrects the violation within 30
days of
discovery.
The interim final rule with request for
comments published today
conforms the HIPAA enforcement regulations to these revisions
made by
the HITECH Act. It may be viewed and commented on at:
www.regulations.gov.
This rulemaking will become effective on Nov. 30,
2009, and HHS will consider all comments received by Dec. 29,
2009.
"The Department's implementation of
these HITECH Act enforcement
provisions will strengthen the HIPAA protections and rights related
to
an individual's health information," said Georgina Verdugo,
the director
of HHS Office for Civil Rights (OCR). OCR is responsible for
administering and enforcing HIPAA's privacy, security and breach
notification rules.
"This strengthened penalty scheme
will encourage health care providers,
health plans and other health care entities required to comply
with
HIPAA to ensure that their compliance programs are effectively
designed
to prevent, detect and quickly correct violations of the HIPAA
rules,"
said Verdugo. "Such heightened vigilance will give consumers
greater
confidence in the privacy and security of their health information
and
in the industry's use of health information technology."
This interim final rule with request for
comments is the first of
several steps HHS is taking to implement the HITECH Act's enforcement
provisions. The remaining provisions, which have yet to become
effective, will be addressed in the next few months in forthcoming
rulemakings. Additional information about HIPAA and several related

needs.
The FFIEC Agencies recognize that prudent loan workouts are often
in the best interest of both financial institutions and borrowers,
particularly during difficult economic conditions. This policy
statement details risk-management practices for loan workouts
that support prudent and pragmatic credit and business decisionmaking
within the framework of financial accuracy, transparency, and
timely loss recognition. Financial institutions that implement
prudent loan workout arrangements after performing comprehensive
reviews of borrowers' financial conditions will not be subject
to criticism for engaging in these efforts, even if the restructured
loans have weaknesses that result in adverse credit classifications.
The policy statement includes examples of CRE loan workouts.
The examples, provided for illustrative purposes only, reflect
examiners' analytical processes for credit classifications and
assessments of institutions' accounting and reporting treatments
for restructured loans. The policy statement reiterates existing
guidance that examiners are expected to take a balanced approach
in assessing institutions' risk-management practices for loan
workout activities.
The member Agencies of the FFIEC include the Board of Governors
of the Federal Reserve System, the Federal Deposit Insurance
Corporation, the National Credit Union Administration, the Office
of the Comptroller of the Currency, the Office of Thrift Supervision,
and the FFIEC State Liaison Committee. The FDIC currently chairs
the FFIEC.

MESSAGE FROM THE MAJORITY LEADER
This week, House Democrats introduced the
Affordable
Health Care for America Act, taking another important step
on the long, hard road to bring quality, affordable health care
to every American. Our country has been on this road since the
days of Teddy Roosevelt, but thanks to the commitment of every
Member of our caucus, I believe this is the year we will pass
health care reform. This is an idea whose time has truly come,
and next week, I look forward to bringing this bill to the House
Floor for vote.
Leader Hoyer joined House Democratic Leaders,
Members, and real Americans at an event on the
West Steps of the Capitol to introduce the Affordable
Health Care for America Act.
While our economy continued to show signs of recovery this week,
Democrats remain focused on spurring job creation. Yesterday,
Democrats passed the Small Business Financing and Investment
Act to help small businesses access credit, which will give them
the resources they need to grow and create jobs. This measure
is expected to help small businesses save and create 1.3 million
jobs each year and boost our economy.
Next week, in addition to considering health reform legislation,
the House is expected to pass another bill to protect American
consumers. The Expedited CARD Reform for Consumers Act will protect
consumers from credit card company abuses like large increases
in interest rates and fees - that have occurred in the interim
period since President Obama signed the original credit card
reform bill, which cracked down on those abuses. This will move
up the effective date for these reforms from February 22nd to
December 1st.

The U.S. Department of Health and Human Services (HHS) issued
an interim final rule with request for comments today to strengthen
its enforcement of the rules promulgated under the Health Insurance
Portability and Accountability Act (HIPAA). The Health Information
Technology for Economic and Clinical Health (HITECH) Act, which
was enacted as part of the American Recovery and Reinvestment
Act of 2009, modified the HHS Secretarys authority to impose
civil money penalties for violations occurring after Feb. 18,
2009. These HITECH Act revisions significantly increase the penalty
amounts the Secretary may impose for violations of the HIPAA
rules and encourage prompt corrective action.

Hoyer: Reports Show Recovery Act Has
Created and Saved Jobs
WASHINGTON, DC - House Majority Leader
Steny H. Hoyer (MD) released the following statement today after
the Recovery Accountability and Transparency Board announced
that a portion of Recovery Act funds directly created and saved
more than 640,000 jobs, resulting in a total of roughly 1 million
jobs created and saved so far:
Today's announcement shows the Recovery Act is working
as intended to create jobs and bring an end to the severe recession.
The reports cover only a small slice of Recovery funds, but it
matches the estimates by Moodys, the Congressional Budget
Office, and the Council of Economic Advisors that the Recovery
Act has saved or created 1 million jobs. And todays reports
do not take into account the other ways that the Recovery Act
assisted families hurt by the recession, through the largest
middle-class tax cut in history and other benefits to ensure
Americans can provide for their families and return our economy
to growth.
While we are encouraged by todays reports, Democrats
remain focused on doing everything we can to keep creating jobs.
Even as the Recovery Act has helped stop the economic downslide
and as we see signs that the economy is starting to turn around,
it is more important than ever to continue adding jobs and getting
Americans back to work, so we ensure a strong and solid economic
recovery for all families.
