Hoyer Speaks at Press Conference on
the Vitter-Bennett Census Amendment
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) joined Members of the Congressional Tri-Caucus
today for a press conference on the damaging ramifications of
the Vitter-Bennett amendment to the successful implementation
of the 2010 Census. Below are his remarks as prepared for delivery:
The census doesnt exist to score political pointsit
exists to give us an accurate picture of our country. Adding
a new question to the census, especially at this late date, would
be damaging and irresponsible. That's also the opinion of every
living Director of the Census. For one, it would cost hundreds
of millions of dollars and require us to destroy census materials
that were already finalized as early as 18 months ago.
It would also lead to an inaccurate count. With a question
about citizenship, immigrants who fear being deported, along
with their families and friends, are much more likely to avoid
the census.
And thats a problem for all of us. We need an accurate
count to distribute federal money fairly and to ensure that none
of our communities get shortchangedthat our roads get the
money they need to stay safe, that our schools have enough teachers,
and that our streets have enough police officers.
The Vitter-Bennett Amendment makes all of that much less
likely. Thats why the Democratic leadership will continue
to work for a fair, accurate, and impartial census.

BX/PXs Revamped Layaway Program makes it Easier to Shop
Now, Pay Later
DALLAS Visit your local exchange and it soon becomes apparent
that reports of layaways demise have been greatly exaggerated.
In fact, Army & Air Force Exchange Service BXs and PXs are
reintroducing and, in some cases, expanding layaway options.
Clothing, handbags and shoes are still eligible for 30-day
layaway, but full payment on many other categories can be put
off for up to 60 days when shopping the exchange, said
AAFES Chief Operating Officer Mike Howard.
Military shoppers whose Families holiday wish list included
something that sparkles or shines were able to begin making arrangements
as far out as Sept. as fine jewelry can be put on layaway for
up to 120 days at AAFES.
Delaying full payment might even be mom and dads secret
weapon in keeping presents under wraps this year as toys can
be put on layaway up until Christmas Eve.
Let the kids look in the attic, under the tree or even
your car trunk, said Howard. Keeping the toys on
layaway, and in the exchanges back room, can really take
a lot of stress out of the holidays.
Any purchase of $25 or more is eligible for layaway at AAFES.
A 15 percent deposit on the total purchase price is required
to hold a product.
Merchandise excluded from AAFES layaway program includes
clearance merchandise, computers, peripherals, major appliances,
furniture, mattresses, exercise equipment, electronics $299 and
up as well as seasonal and outdoor living products.

USTDA is hosting a group of 6 Lithuanian
officials involved in the development of a new nuclear power
plant in the eastern city of Visaginas. The country currently
relies on a single Soviet-designed nuclear reactor for more than
70% of its electricity. That facility is scheduled to be decommissioned
by the end of 2009; as such the Government of Lithuania has prioritized
the design and construction of a modern replacement plant. Delegates
will tour selected facilities and meet with firms specializing
in plant design and engineering. They will also visit relevant
public institutions to address regulatory and financing issues.

USTDA is funding an electricity conference
in Cairo, Egypt in Spring 2010. Through this conference, USTDA
seeks to improve the Middle East and North Africas electricity
sector to benefit MENA producers and consumers. The proposed
Conference is intended to support opportunities for the supply
of advanced U.S. equipment and services in the MENA electricity
sector. The conference will serve to present substantial commercial
value to U.S. equipment and service suppliers. The program would
consist of a three-day conference featuring plenary workshops,
project sessions, roundtable discussions and one-on-one meetings.
Significant opportunities for U.S. electricity generation and
distribution equipment and service operators exist in MENA despite
differing levels of development throughout the region. The conference
would focus on market opportunities in Morocco, Algeria, Tunisia,
Egypt, Libya, Jordan, Lebanon, Yemen, Iraq, Turkey and the West
Bank. Saudi Arabia, Oman, Bahrain, Qatar, Kuwait and the UAE
would be given observer status, due to their regional location
and importance.

Bagasse-Based Cogeneration Development Orientation Visit

USTDA is sponsoring a 10-day Orientation
Visit (OV) for up to 15 Pakistani delegates representing sugar
mill executives and energy regulatory bodies. The objective of
the visit is to introduce delegates to the latest biomass cogeneration
technologies (i.e., high-efficiency boiler systems) and cane
industry practices as efficient methods for energy conservation
and pollution reduction as well as cost-effective options for
placing additional generating capacity on the grid. AEAI will
organize the OV, which will take place September 26 October
9, 2009, and entail roundtable discussions, site visits, training
and other activities in Washington, D.C., Louisiana, and southern
Florida. The itinerary includes visits to major U.S. sugar mill
biomass cogeneration facilities as well as meetings with U.S.
and state-based policy makers and regulators who represent the
biomass cogeneration and renewable energy sectors.

The OV will familiarize Chinese cold storage facility owners
with U.S. technologies and best practices for the development
of an advanced cold supply chain infrastructure. The OV will
encourage adoption of advanced technologies that can improve
Chinas cold supply chain, positively impacting the nations

WASHINGTON (CNN) The banking system
today may be in a more precarious position than it was a year
ago, the man charged with overseeing a $700 billion bailout program
said Wednesday.
Neil Barofsky, the special inspector general
managing the Troubled Asset Relief Program, told CNN's Wolf Blitzer
on Wednesday that the government's decision to support bank mergers
over the past year may have put the U.S. economy more at risk.
"These banks that were too big to
fail are now bigger," Barofsky said. "Government has
sponsored and supported several mergers that made them larger
and that guarantee, that implicit guarantee of moral hazard,
the idea that the government is not going to let these banks
fail, which was implicit a year ago, is now explicit, we've said
it.

The last reports of calls and commitments
are just coming in from events on the West Coast, and I wanted
to share the news with you.
As you know, we set a big goal: 100,000
calls to Congress placed or committed to in a single day by OFA
supporters and allied organizations. By 2:30 p.m., you had crushed
it. So, we gulped and said let's go for 200,000, not knowing
what would happen. But the calls just kept pouring in -- keeping
phones ringing off the hook in congressional offices in D.C.
and your representatives' district offices around the country.
Then, OFA supporters gathered in over 1,000
living rooms and community centers from Macon, Georgia to Missoula,
Montana. You called hundreds of thousands of key voters in your
community and got them to agree to call Congress and speak out
for reform, too. President Obama joined in at a call party in
New York -- and he had some amazing words of support for the
folks like you who make this movement possible.
I'm looking at the numbers, and with almost
all of the reports now in, the tally wasn't 200,000 calls placed
or pledged -- it was 315,023. You did it.
Take a moment to watch the President's inspiring
words to OFA volunteers on this incredible day.
Your voice was overwhelming -- with reports
in the media of congressional offices "completely crushed
with calls." CBS News described your effort as an "onslaught."
And a congressional aide was quoted with a common response, saying
their office was deluged by "pretty much non-stop health
care calls from OFA."
You set a new OFA record, you caught the
national media's attention, and you certainly put Congress on
notice. But you know that's not what really matters.
The message I sent earlier talked about
a woman, Jenny U., whose insurance company cut off her coverage
because they decided her kidney donation to her sick daughter
counted as a "pre-existing condition." What really
matters is that today you brought America one giant, irreversible
step closer to being a place where no one will ever have to suffer
that kind of injustice again. That's what all the messages, late
nights, and phone calls ultimately add up to. It's what makes
everything we do together worthwhile -- and it's why we'll keep
fighting together until the job is done.

This close-up view of the friction stir weld tack tool used to
manufacture of space shuttle external tanks shows the process
of tack welding barrel panels together. Barrels were previously
fabricated using traditional fusion welding, but friction stir
welding is different in that the materials are not melted. A
rotating tool pin uses friction and applied pressure to join
the 20-foot longitudinal panels together. Friction stir welding
is the most recent upgrade to the space shuttle's external tank,
the largest element of the shuttle and the only element that
is not reusable. The new welding technique utilizes frictional
heating combined with forging pressure to produce high-strength
bonds virtually free of defects. Friction stir welding transforms
the metals from a solid state into a "plastic-like"
state, and then mechanically stirs the materials together under
pressure to form a welded joint. Invented and patented by The
Welding Institute, a British research and technology organization,
the process is applicable to aerospace, shipbuilding, aircraft
and automotive industries. One of the key benefits of this new
technology is that it allows welds to be made on aluminum alloys
that cannot be readily fusion arc welded, the traditional method

to Address Key U.S. Trade and Economic Priorities
WASHINGTON, October 21, 2009 -- U.S. Secretary
of Commerce Gary Locke and U.S. Trade Representative Ron Kirk
will serve as co-chairs with Chinese Vice Premier Wang Qishan
of the 20th session of the U.S.-China Joint Commission on Commerce
and Trade (JCCT) held on Wednesday, October 28th and Thursday,
October 29th in Hangzhou, China. U.S. Secretary of Agriculture
Tom Vilsack will join this effort to address key U.S. trade and
economic priorities. The 2009 JCCT marks the first time three
Obama cabinet officials have traveled together to a key economic
summit abroad.
The JCCT, established in 1983, is the main
forum for addressing bilateral trade matters and promoting commercial
opportunities between the United States and China.
"The first JCCT under the Obama Administration
provides an important opportunity to engage China on trade concerns
impacting American companies," Secretary Locke said. "It
is critical that we make progress on several priority issues,
including intellectual property rights protection and enforcement,
clean energy, medical devices and pharmaceuticals."
"China is America's second largest
trading partner and is a fast growing market for American exporters,"
said Ambassador Kirk. "As we convene the 20th session of
the JCCT, the Obama Administration recognizes that as we look
to the next 20 years of our relationship with China, our successful
engagement must include strong and smart U.S. trade policy. The
JCCT gives the United States and China a venue to consider the
breadth of our trade relationship and identify steps that each
side can take to ensure that it is fair, sustainable, and mutually
beneficial going forward."
"With two-way trade between the United
States and China in agricultural, fish and forest products exceeding
$21 billion in 2008, American farmers and ranchers recognize
the benefits of our economic engagement with China, but they
also rightly seek great equity and balance in our trade relationship,"
said Secretary Vilsack. "The JCCT is an opportunity to work
with China to address the wide range of trade and economic issues
that affect the lives of U.S. agricultural producers and consumers."
During the 2009 JCCT in Hangzhou, American
and Chinese officials will participate in a high-level annual
plenary meeting as well as and review progress made by a large
number of working groups convened throughout the year to bring
U.S. and Chinese officials together to engage in detailed discussions
of specific trade issues. Examples of these groups include the
IPR Working Group, the Insurance Dialogue, and the Information
Industry Working Group.
China was the second largest supplier of
U.S. good imports in 2008 (after Canada) and was the third largest
market for U.S. exports in 2008 (after Canada and Mexico). U.S.
goods exports to China were $70 billion in 2008, up 649% since
2000. Trade in services with China (exports and imports) totaled
$23.0 billion in 2007 (latest data available); services exports
were $14.2 billion and services imports were $8.8 billion.

of Religions

Thank you, Mr. Chairman, for convening
this hearing on this important and timely issue. For a number
of years, the U.S. Commission on International Religious Freedom
has been monitoring closely, and speaking out against, the campaign
by some countries to create a global blasphemy law through the
passage of UN resolutions against the so-called defamation
of religions.
While they may sound tolerant and progressive,
these resolutions do not solve the very real problems of persecution
and discrimination suffered by the adherents of many religions
around the world. Rather, they exacerbate these problems. The
defamation of religions concept promotes intolerance
and human rights violations, creating wide latitude for governments
to restrict free expression and religious freedom. In addition,
the concept deviates sharply from the historically rooted object
of international human rights protections by addressing the interests
of religious institutions and interpretations, rather than the
rights of individuals.
The defamation of religions
resolutions have been sponsored annually by the Organization
of the Islamic Conference, or OIC, in the UN Human Rights Council
and its predecessor since 1999, and in the General Assembly since
2005. At the Human Rights Council in Geneva, these efforts have
been led by Pakistan. Egypt has played a leading role at the
General Assembly in New York. The OICs publicly-stated
goal is the adoption of a binding international covenant against
the so-called defamation of religions.
Although the defamation resolutions
purport to protect religions generally, the only religion and
religious adherents that are specifically mentioned are Islam
and Muslims. Aside from Islam, the resolutions do not specify
which religions are deserving of protection, or explain how or
by whom this would be determined. The resolutions also do not
define what would make a statement defamatory to religions or
explain who decides this question. For its part, the OIC
appears to deem any criticism of Islam
or Muslims to be religiously defamatory speecha view that
goes well beyond the existing legal concept of defamation, which
protects individuals against false statements of fact that damage
their reputation and livelihood.
In terms of states practices, there
is no universal international approach toward defamation
of religions. The UN High Commissioner for Human Rights
conducted a survey in 2008 and found no common understanding
of the concept among those countries that said they had laws
on the issue. Instead, the laws surveyed addressed somewhat
different phenomena and appl[ied] various terms such as contempt,
ridicule, outrage and disrespect to connote defamation.
What should we glean from this narrow focus
on Islam and the ambiguity of the applicable legal standard?
For the Commission, it signals that the defamation of religions
resolutions are a poorly veiled attempt to export the repressive
blasphemy laws found in some OIC countries to the international
level. Under these laws, criminal charges can be levied against
individuals for defaming, denigrating, insulting, offending,
disparaging, and blaspheming Islam, often resulting in gross
human rights violations. In Pakistan, for example, the domestic
law makes blasphemy against Islam a criminal offense subject
to severe penalties, including death. Extremists have abused
these broad provisions to intimidate members of religious minorities,
including members of disfavored minority Muslim sects, and others
with whom they disagree, and unscrupulous individuals have found
them to be useful tools to settle personal scores. Blasphemy
allegations in Pakistan, which are often false, have resulted
in imprisonment on the basis of religion or belief, as well as
vigilante violence resulting in the death of accused individuals.
The defamation of religions
resolutions usually come before the UN General Assembly in the
fall and the UN Human Rights Council in the spring, and they
continue to pass each year in each body. Yet there is some good
news to report: the international community is startingthough
I would stress only startingto understand the problems
with these resolutions. The last three times they were considered
the votes in favor decreased from a majority to a plurality of
members. At both the March 2008 and March 2009 Human Rights Council
sessions, as well as the December 2008 General Assembly, the
combined number of no votes and abstentions outnumbered the yes
votes, although the resolutions still passed. The Commission
hopes that this trend will continue when the expected defamation
of religions resolution comes before the General Assembly
later this fall. To that end, we are working on a number of fronts,
including with various Members of Congress, to encourage UN member
states to oppose these resolutions. The Commission welcomed Secretary
Clintons recent remarks in New York affirming the United
States continued opposition, and we urge the State Department
to continue vigorously to engage all governments to urge them
to vote no.
Like any smart tactician that detects a
weakening of support, the OIC is diversifying its push for banning
certain forms of speech by reaching into other venues and masking
its objective through other language. The OIC sought, but failed,
to insert language against the defamation of religions
in the outcome document of the April 2009 Durban Review Conference.
Instead, a compromise was reached to include a phrase deploring
the derogatory stereotyping and stigmatization of persons
based on their religion or belief. This is a somewhat better
approach because it focuses on individuals, not religions, and
does not attach legal prohibitions or punishments.
The OIC also has attempted to include the
defamation of religions concept into UN resolutions
dealing with the freedom of expression. At the most recent UN
Human Rights Council session, the United States worked with Egypt
to jointly sponsor a compromise freedom of expression resolution
that sought to find common ground between the defamation
proponents and opponents. Like the Durban II Conference document,
this resolution does not mention defamation of religions,
but rather focuses on negative religious stereotyping, thereby
rightly keeping the focus on individuals rather than belief systems.
It also does not call for any laws against such stereotyping,
but instead expresses concern about it.
However, many in the human rights community
were surprised by the United States co-sponsorship of this
resolution because it condemned any advocacy of national,
racial or religious hatred that constitutes incitement to discrimination,
hostility or violence and called on states to take
effective measures, consistent with their international human
rights obligations to address such advocacy. Having just
returned from Commission delegations to the European Union and
Holy See, I know that many of our EU partners were equally surprised.
The language on advocacy of hatred constituting incitement is
taken from Article 20(2) of the International Civil and Political
Rights, or ICCPR. Article 20(2) also requires states to enact
laws against such incitementa requirement on which the
United States has placed a reservation to the extent that doing
so would violate U.S. constitutional free expression guarantees.
To be sure, the U.S./Egypt resolution does not expressly call
for legal prohibitions, and therefore does not run afoul of the
U.Ss reservation, and the U.S. previously has supported
UN resolutions on religious intolerance and discrimination that
condemned incitement but did not require laws against it.
But the Commission is concerned that this
use of the incitement language is a Trojan Horse for the defamation
of religions efforts. The United States and other supporters
of free expression therefore must remain vigilant against attempts
to conflate defamation of religions and Article 20(2)
incitement. In addition to seeking a new anti-blasphemy norm
through the defamation resolutions, the OIC has argued
in various UN contexts that speech insulting or criticizing religions
is outlawed under existing international law norms against incitementciting
ICCPR Article 20(2).
Article 20(2) has always been and should
continue to be a limited exception to the fundamental individual
freedoms of expression and religion meant to protect individuals
from violence or discrimination, not to protect religious beliefs
from criticism. The United States should recognize that the defamation
proponents efforts to redefine and significantly broaden
this provision are of serious concern.
National or international laws purporting
to ban criticism or defamation of religions are not
the solution to the very real problems of religious intolerance
and discrimination. In fact, such prohibitions do more harm than
good, as evidenced by the human rights abuses perpetrated under
them in countries such as Pakistan. The United States should
continue strongly to oppose, and urge other UN members to oppose,
both the defamation of religions resolutions and
all efforts to reinterpret ICCPR Article 20(2) to encompass allegedly
religiously defamatory speech.

USDA Issues Recommended Decision on
Proposed Amendments to All Federal Milk Orders
WASHINGTON, D.C., Oct. 21 2009 - The U.S.
Department of Agriculture today issued a recommended decision
to adopt amendments to the producer-handler definition in all
Federal milk marketing orders. This decision is based on testimony
and evidence given at a public hearing held May 4-19 in Cincinnati,
Ohio.
The decision recommends that the producer-handler
definitions of all Federal milk marketing orders be amended to
limit exemption from pooling and pricing provisions of the orders
to those producer-handlers with total route disposition of fluid
milk products of 3 million pounds or less per month.
The public has 60 days to file comments.

OBAMA ADMINISTRATION EXPANDS EFFORTS
TO IMPROVE SCHOOL MEALS AND CHILDREN'S HEALTH
WASHINGTON, Oct. 21, 2009 - First Lady
Michelle Obama and Agriculture Secretary Tom Vilsack today announced
the Obama Administration is expanding the HealthierUS School
Challenge. Originally established to recognize elementary schools
that are creating healthier school environments through their
promotion of good nutrition and physical activity, the Challenge
will now be expanded to include middle and high schools.
"With one in three children in this
country being overweight or obese, we must take steps to ensure
that all kids have access to nutritious meals, nutrition education
and physical education so that they can lead healthy, productive
lives," said First Lady Michelle Obama. "By expanding
the HealthierUS Schools program more children will have access
to a brighter future."
In addition to expanding the HealthierUS
School Challenge, USDA is also creating an 'Adopt-a-School' program,
so that schools that have obtained the designation to assist
neighboring schools with their health and nutrition programs.
A tool kit on how to become a Healthier U.S. School can be found
at www.fns.usda.gov.
"Improving the nutrition, health,
and well being of our children is a priority for the Obama Administration
and I am proud to support the First Lady on this important initiative,"
said Vilsack. "The Obama Administration is making a historic
investment in improving our child nutrition programs and we look
forward to our continued work with Congress to continue strengthening
USDA programs that impact the health and nutrition of our children."
Congress is currently considering the Childhood
Nutrition Reauthorization legislation, which impacts the National
School Lunch and Breakfast programs. Vilsack cited the importance
of proposals to eliminate barriers that keep children from participating
in school nutrition programs, improve the quality of school meals
and the health of the school environment, and enhance program
performance.
This week, the Institute of Medicine released
a study which noted that children are eating far less dark green
and dark orange vegetables and fruits than they need, far more
refined grains and far too few whole grains, and too few low
fat or non-fat dairy products. This trend unfortunately puts
children at increased risk for a variety of obesity-related conditions
like diabetes, heart disease, cancer and high blood pressure.
The HealthierUS School Challenge was established
in 2004, and 632 have been able to achieve one of four levels
of superior performance: Bronze, Silver, Gold, and Gold of Distinction.
To qualify for the awards, a school must submit a formal application
and meet basic criteria set forth by the USDA's Food and Nutrition
Service (FNS). Schools can now complete the application online
at www.fns.usda.gov.

Funds address critical water issues in
watersheds across the nation
WASHINGTON, Oct. 21, 2009 - Agriculture
Secretary Tom Vilsack today announced that the United States
Department of Agriculture's (USDA) National Institute of Food
and Agriculture (NIFA) has awarded more than $11 million through
the National Integrated Water Quality Program (NIWQP) to address
critical water resource issues including water quality protection
and water conservation.
"Cities, communities and rural areas
across the nation depend on a safe and abundant supply of water
for drinking and cooking," Vilsack said. "This research
will play a vital role in our understanding of the part water
plays in the ecosystem and developing tools and strategies to
effectively manage our water resources."
The NIWQP supports research, education
and extension projects and programs that address critical water
resource issues in agricultural, rural and urban watersheds.
These projects reflect the growing need to combine knowledge
from biological and physical sciences with social and economic
sciences to address complex water issues. The NIWQP focuses on
addressing water issues at the watershed scale. Projects funded
by the NIWQP are outcome-oriented, aiming to increase awareness
and change behaviors related to water resource management.
Funded projects in Fiscal Year 2009 include
a project that evaluates the impacts of bioenergy development
on water resources, four projects that develop tools to improve
the effectiveness of conservation practices to achieve water
quality goals by targeting critical areas and key individuals
that offer the greatest opportunity to improve water quality,
and efforts to develop a framework to revamp youth education
about water issues. The current focus on education is part of
a 2-year effort to launch a Coordinated Agricultural Project
to create an innovative, holistic educational environment to
transform youth consciousness about water and water issues.

OCC Supports Protect Your Identity Week
WASHINGTON The Office of Comptroller of the Currency has
joined the public-private coalition that supports the second
annual Protect Your Identity Week (PYIW), an initiative of the
National Foundation for Credit Counseling (NFCC) and the Council
of Better Business Bureaus (BBB). The week-long initiative, October
17 24, 2009, brings focus to the PYIW national campaigns
Web site and community events aimed at identity theft protection
and education.
Awareness and education are the first line of defense for
assisting consumers in preventing and resolving identity theft
problems, said Comptroller of the Currency John C. Dugan.
The OCC has a variety of web resources that help consumers
to understand the risks as well as how to safeguard their personal
information against theft. OCCs online materials also direct
consumers to federal resources that help minimize the impact
if they should fall victim to identity theft crimes.
Consumers can find PYIW educational events in their area, hosted
by a local member of the NFCC, BBB or other coalition member,
by going to www.ProtectYourIDNow.org. Consumers can take advantage
of identity theft workshops, onsite shredding, and credit report
reviews. The Web site also includes identity theft prevention
tips, videos, an interactive quiz to assess an individuals
risk of identity theft, and resources for victims. The Web site
is available in Spanish at www.CuideSuIdentidad.org as well.

Economic Recovery Efforts Help Small
Businesses Access Credit and Create Jobs
Today, Majority Leader Steny H. Hoyer (MD)
joined President Obama in Landover, Maryland for the President's
announcement of new initiatives to give small businesses the
tools they need to thrive, create jobs and help drive the nations
economic recovery. To support small business lending and provide
more access to credit, the President announced steps to support
lending by small banks and Community Development Financial Institutions
(CDFIs) through the Financial Stability Plan and will seek legislation
to increase the maximum size of three types of Small Business
Administration loans. This announcement builds on actions taken
earlier this year by the Obama Administration and Congress to
assist and increase the flow of credit to small businesses. Access
to credit is vital for small businesses so they can stay open
and keep people employed, as well as expand and create new jobs.

Milwaukee company agrees to EPA order;
will comply with federal rules to protect stratospheric ozone
(Chicago - Oct. 21, 2009) - U.S. Environmental Protection Agency
Region 5 has issued an administrative consent order to Midwest
Iron and Metal to comply with EPA regulations designed to protect
the stratospheric ozone layer. The order affects the company's
scrap metal recycling facility at 6760 N. Industrial Road, Milwaukee.
Midwest Iron and Metal has agreed, among other things, to recover
ozone-depleting refrigerants from each appliance and motor vehicle
air conditioner that it accepts or to verify that refrigerants
have been recovered according to EPA regulations. The company
will keep a log of the details of refrigerant recovery.
EPA cited Midwest Iron and Metal in February alleging the company
was in violation of federal regulations because it did not recover
refrigerant and did not obtain proper verification statements
from suppliers of small appliances.
The allegations resulted from a July 2008 EPA inspection and
a subsequent information request.
Chlorofluorocarbon refrigerants and certain substitute refrigerants
deplete the stratospheric, or "good," ozone layer,
allowing dangerous amounts of cancer-causing ultraviolet rays
from the sun to strike the earth. Production of some of these
chemicals was stopped in 1995, and federal law strictly controls
their use and handling.

Federal Emergency Management Agency (FEMA) Administrator Craig
Fugate swore in Richard Serino as FEMA Deputy Administrator at
a ceremony at Boston's Faneuil Hall. Prior to joining FEMA, Serino
served as Chief of Emergency Medical Services and Assistant Director
for the Boston Public Health Commission. In that role, he helped
bolster the city?s response plans for chemical, biological, and
radiological attacks and other emergency incidents. He brings
35 years of state and local emergency management and emergency
medical services experience to the position.

WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement after the
House Democratic leadership met with economic experts to discuss
the economy and recovery efforts:
As Democrats continue to focus on creating jobs and ensuring
a strong economic recovery, todays economic forum was an
important opportunity to hear from experts about the state of
the economy. Todays discussion centered on ways to keep
saving and creating jobs as the economy eases out of recession.
Getting Americans back to work is our number one priority, and
we will review our options and take action to achieve that goal.
We also need to look at further action to deal with the foreclosure
crisis that is still dragging down our economy and the financial
system.
At the same time, there is great concern about the deficits
facing our nation. Once we get our economy back on track and

RANDOLPH AIR FORCE BASE, Texas Interested
and eligible officers in the grade of O-5 may now submit applications
to be considered for deputy commander positions in mission support
groups in 2010.
Applications are due via e-mail to the
base support officer assignments section at the Air Force Personnel
Center here by Nov. 20.
Unless in a must-move situation (e.g. graduating
squadron commanders, completion of a joint assignment, etc.)
in summer 2010, officers interested in competing for these positions
must have a minimum of three years time-on-station and must plan
to fill the deputy commander position for at least three years.
Officers who are not in a must-move situation and have less than
three years TOS must have a waiver request signed by their wing
commander in order to compete.
Line officers in any Air Force specialty
may apply as long as they have been released by their assignment
team and can obtain endorsement from their senior rater. Additionally,
applicants must have a current Airman Development Plan updated
with their career desires and assignment location preferences.
Applicants will remain candidates through
the 2010 summer assignments cycle.
The base support assignments team will
confirm eligibility and will forward nominations to the hiring
authorities. Hiring authorities will have three days to make
a selection based on the nominees provided.

the House passed the Ryan White HIV/AIDS Treatment Extension
Act by a vote of 408 to 9:
Today, by a strong bipartisan majority, the House voted
to reauthorize the Ryan White CARE Act, which strengthens our
nations commitment to Americans with HIV/AIDS. More than
20 years ago, Ryan Whites courage in the face of illness
helped break a national silence over HIV/AIDS; today, we mark
his legacy by reauthorizing, for the fourth time, the treatment
programs named in his honor. The bill passed today increases
funding to combat HIV/AIDS by expanding access to vital support
services; ensuring that HIV/AIDS services are distributed equitably
through our states, cities, and rural communities; and helping
more individuals learn their disease status and access early
treatment. Now that this legislation has passed both chambers
of Congress, I look forward to President Obamas signature

were charged in federal court with fraud involving their applications
for accidental disability pensions, and Erika Boylan, a clerk

was arraigned today by U.S. Magistrate Judge E. Clayton Scofield,

WASHINGTON - The Federal Election Commission recently made public
its final action on six matters under review (MURs). In one matter,
the respondents agreed to pay a civil penalty of $5,000. In three
matters, the Commission found no reason to believe the respondents
violated the Federal Election Campaign Act of 1971, as amended
(the Act). It dismissed two other matters.
