WASHINGTON (CNN) With a runoff presidential election in
Afghanistan appearing likely, Secretary of State Hillary Clinton
told CNN Friday that she expects the current president, Hamid
Karzai, will win.

MESSAGE FROM THE MAJORITY LEADER
This past week, the last of the five House
and Senate Committees with jurisdiction over health reform, the
Senate Finance Committee, passed a health insurance reform bill
with a bipartisan vote of 14 to 9. This significant milestone
takes us one step closer to enacting reform legislation that
lowers costs for middle-class families, expands coverage, and
provides quality health care choices for all Americans. With
all five committees of jurisdiction reporting out a bill, both
the House and Senate will move in the weeks ahead to bring final
legislation forward for a vote.
By a strong bipartisan majority, the House passed the Iran Sanctions
Enabling Act earlier this week to strengthen pressure on Iran
to end its dangerous pursuit of nuclear weapons. This bill authorizes
state and local governments to divest from any company that invests
at least $20 million in Irans energy sector. By passing
this bill, we send a strong message that the United States will
use every tool we have to prevent Iran from pursuing nuclear
weapons. The House also passed the Homeland Security appropriations
conference report, which provides funds to protect Americans
from terrorist threats and secure our borders.
Next week, the House will consider legislation that invests in
solar energy research, helping to improve our solar technologies
and decrease their cost, by creating a long-term plan to guide
solar energy research. In addition, we will consider the Coast
Guard Authorization Act, which strengthens the Coast Guard in
its role of keeping our nation safe.

ANNOUNCES $49 MILLION IN GRANTS UNDER THE SPECIALTY CROP BLOCK
GRANT PROGRAM
WASHINGTON, October 15, 2009 - Agriculture
Deputy Secretary Kathleen Merrigan today announced the award
of 55 grants totaling approximately $49 million for 745 projects
to enhance the competitiveness of specialty crops, which are
defined as fruits, vegetables, tree nuts, dried fruits, horticulture
and nursery crops, including floriculture. Upon reviewing states'
plans for funding, USDA selected projects that support local
and rural agriculture interests, increase the competitiveness
of small producers, and promote or create direct marketing opportunities
for specialty crop producers.
"Developing local and regional food
systems that spur economic opportunity is the purpose of our
'Know Your Farmer, Know Your Food' initiative and these grants
today are a significant part of achieving that goal," said
Merrigan. "We are pleased to be continuing this partnership
in every state across the country to support their diverse efforts
to promote healthy eating and grow specialty crop markets by
expanding access to fresh, local foods."
Funds will be used by the 50 states, the
District of Columbia, the Commonwealth of Puerto Rico, Guam,
the U.S. Virgin Islands, and the Commonwealth of the Northern
Mariana Islands, according to their plans submitted to USDA that
describe how the state agency will carry out the program. Summaries
of all awards can be viewed at www.ams.usda.gov/scbgp.
Through the Specialty Crop Block Grant
Program, USDA is committed to increasing child and adult nutrition
knowledge and consumption of specialty crops; improving efficiency
and reducing costs of distribution systems; assisting all entities

Good Handling and Good Manufacturing practices, including cost
share arrangements for funding audits of small farmer, packer
and processor systems; investing in specialty crop research;

III. Speaker Pelosi Youth Health Care Press
Conference Recap
DNC intern Laura Britton recaps the press
conference with House Speaker Nancy Pelosi and progressive youth
groups announcing benefits of health reform to young Americans.
This afternoon, Speaker of the House Nancy
Pelosi held a press conference with Representatives Chris Van
Hollen (D-MD) and Kathy Dahlkemper (D-PA) to announce a victory
for young people that will be included in the final House health
reform bill: a provision allowing young Americans to stay on
their parents insurance through the age of 26. Representatives
from Rock the Vote, Young Invincibles Want Change, and Campus
Progress spoke on behalf of all young Americans, stressing the
need for this provision. Young Democrats from 30 states also
attended the event. A young woman who was diagnosed with thyroid
cancer at 22 and Crohns disease at 26 shared a personal
and heartbreaking account of her 6-year struggle to find and
keep a health insurance provider. Had her health coverage under
her fathers plan extended until age 26, she would know
for sure if she is cancer-free and her credit cards would not
be maxed out due to the high cost of medications and tests necessary
to her survival.
Because of exorbitant health care costs
and youthful feelings of invincibility, Americans ages 19-26
have the highest uninsured rate of any age group in the U.S.
population. During the first few years following college graduation,
few young people are lucky enough to be provided health coverage
by their employer. Speaker Pelosi and the other speakers stressed
that the health insurance reform bill must provide an affordable
option to ease the burden on taxpayers and to prevent young people
from being buried under medical debt. Speaker Pelosi noted that
this extension of health coverage will allow young Americans
to pursue their dreams rather than to let the attainment of health
coverage steer their job search. She was confident that the final
bill will be ready by Thanksgiving.

The FDIC's Summary
of Deposits system has been updated with data from the June
30, 2009 annual surveys conducted by the Federal Deposit Insurance
Corporation (FDIC) and the Office of Thrift Supervision (OTS).
The system provides deposit totals for each of the more than
99,000 domestic offices operated by over 8,100 FDIC-insured commercial
and savings banks, savings associations, and U.S. branches of
foreign banks. It also enables users to locate offices in a particular
geographic area and create custom market share reports for geographic
areas down to the zip code level. The system features historical
data beginning in 1994 that can be analyzed on-line using various
summary tables, charts, graphs, and custom downloads. The SOD

of a collaborative study with the National Eye Institute and

DOE Update on USEC Cleanup, R & D,
and Loan Guarantee Application
WASHINGTON, DC - Over the course of this year, the Department
of Energy has worked closely with USEC on its loan guarantee
application. This summer, the Department made several announcements
related to USEC and its application, and is providing an update
on those announcements at this time.
At the end of July, the Department of Energy announced an investment
worth about $150 to $200 million per year for the next four years
to expand and accelerate cleanup efforts of Cold War-era contamination
at the Portsmouth uranium enrichment facility adjacent to the
American Centrifuge Plant (ACP). This investment, on top of the
base budget and Recovery Act funding, is expected to create 800
to 1,000 new jobs on the Portsmouth site. The Department continues
to move forward with this plan.
The Department also announced in late July a willingness to invest
up to $45 million over the next 18 months for USEC to support
ongoing ACP technology demonstration activities, beginning with
$30 million the Department requested from Congress for FY 2010.
However, in the recently completed FY 2010 energy and water appropriations
conference report, Congress did not provide the $30 million needed
for this work.
In addition, USEC announced on September 28th that the centrifuges
in Piketon had to be taken offline and disassembled due to a
flaw in their manufacturing process. USEC has indicated that
it will be several months before the centrifuges can be rebuilt
with new parts and testing can start over. For both of these
reasons, the Department does not see a path to providing the
$30 million in technology demonstration funding at this time.
Finally, DOE announced at the beginning of August an agreement
with USEC to delay a final review on the companys loan
guarantee application for the American Centrifuge Plant in Piketon,
Ohio until a set of technical and financial milestones have been
met. That agreement remains in place.

"Immigration is an issue where our
fears and misconceptions distract us from the values that have
made our nation great.
It is unacceptable to have 12 million people
in our country living in the shadow of our legal system. Of course,
we must secure the border, and require the undocumented to register
and become legal, pay a fine, pay their taxes, learn English
and pass criminal background checks. Those who have serious criminal
records should be sent back to their country of origin.
Many of you come from families who have
been here for generations. Others are new immigrants striving
to achieve the American dream. There are nearly 1.6 million Hispanic-owned
businesses in the United States that add 400 billion dollars
each year to our economy. Your innovation and hard work sustain
Americas values; your successes shape its future.
My own family shares a common experience
with those who have sought the hope of America. My mother and
her parents came to America in 1950 from Warsaw, being some of
the few members of her family to have survived the horrors of
World War II in Poland. Of the three of them, my mom, then 12,
was the only one who spoke English, and she helped find them
all a place to live, and figured out where she was supposed to
go to school.
And they were able to rebuild their lives
here and succeed beyond their dreams because America welcomed
them. It greeted them not with prejudice but with opportunity,
and they worked hard --they worked very hard-- to be worthy of
that great gift. It was a gift that my grandmother, Halina Klejman,
who loved this country as deeply as anyone I have ever known,
taught me never to take for granted, and thats a lesson
that my wife Susan and I are trying now to teach our three little
girls.
Opportunity is the precious gift that this
country has given each generation, asking of each generation
that it, in turn, not squander that inheritance but increase
it, and pass it along to the next. It is our turn, now, and I
believe we will rise to the test.
We can fulfill our great national legacy
with a balanced, compassionate approach to immigration that rewards
hard work, expands opportunity for all, and doesnt seek
to single out the most vulnerable among us for exploitation and
blame.
I believe we need a comprehensive immigration
bill that is smart, economically sound, and family-focused.
As a co-sponsor and advocate for the DREAM
Act, the AgJobs Act and the Save Our Small and Seasonal Business
Act, I believe we have a real chance to make headway on immigration
reform. These bills will reward those who play by the rules while
helping farmers, small businesses and, ultimately, consumers.
We need to connect people to opportunity
in a way that is fair for everyone. Those who work hard and play
by the rules should have a chance to live the American Dream.
We must fight for these values. We believe
in an America where you have the opportunity to achieve anything,
to confront any challenge, to compete with anyone in the world,
to serve others. Today the challenges are profound, but we can
meet them. The time has come to set aside the childish games
of politics. We need to face reality. We have work to do. Every
generation of Americans has done it, and we are their proud heirs
What we must do, now, will make our children proud of us.
If we think of them, then we can succeed,

The U.S. Bureau of Economic Analysis (BEA)
has issued the following news release today:
U.S. personal income grew 0.2 percent in the second quarter of
2009, the first growth in a year for the U.S. and for 15 states,
according to estimates released today by the Bureau of Economic
Analysis. In the first quarter, U.S. personal income fell 2.3
percent.
The annual estimates (1969-2008) and quarterly estimates (1969:I-2009:I)
of state personal income have been revised to incorporate the
comprehensive revisions of the National Income and Product Accounts
(NIPA).

USDA CONDUCTING CONFIRMATORY TESTING
ON POSSIBLE DETECTION OF 2009 PANDEMIC H1N1 INFLUENZA IN U.S.
SWINE
WASHINGTON, Oct. 16, 2009 - Agriculture
Secretary Tom Vilsack today announced that the U.S. Department
of Agriculture (USDA) National Veterinary Services Laboratories
will be conducting confirmatory testing on swine samples collected
at the 2009 Minnesota State Fair between August 26 and September
1. The pigs sampled at the time showed no signs of illness and
were apparently healthy. The samples collected were part of a
University of Iowa and University of Minnesota cooperative agreement
research project funded by the U.S. Centers for Disease Control
and Prevention (CDC) which documents influenza viruses where
humans and pigs interact at such as fairs.
"Like people, swine routinely get
sick or contract influenza viruses. We currently are testing
the Minnesota samples to determine if this is 2009 pandemic H1N1
influenza," said Vilsack. "We are working in partnership
with CDC as well as our animal and public health colleagues and
will continue to provide information as it becomes available."
USDA's National Veterinary Services Laboratories
may have confirmatory results within the next few days.
"I want to remind people that they
cannot get this flu from eating pork or pork products,"
said Vilsack.
An outbreak of 2009 pandemic H1N1 influenza
occurred in a group of children housed in a dormitory at the
fair at the same time samples were collected from the pigs, but
no direct link to the pigs has been made. Information available
at this time would suggest the children were not sickened by
contact with the fair pigs.
USDA continues to remind U.S. swine producers
about the need for good hygiene, biosecurity and other practices
that will prevent the introduction and spread of influenza viruses
in their herd and encourage them to participate in USDA's swine
influenza virus surveillance program. Monitoring and studying
these influenza viruses in swine, will help USDA learn about
the virus, develop better tools to diagnose and develop new and
improved vaccines to protect our U.S swine herds. USDA encourages
commercial pork producers to intensify the biosecurity practices
that they have in place, particularly during this flu season.

Team California Wins the Communications
Contest at U.S. Department of Energy Solar Decathlon
WASHINGTON, DC Team California today snagged the top spot
in the Communications contest at the U.S. Department of Energys
Solar Decathlon.
Todays contest is the third out of ten contests that make
up the international competition taking place on the National
Mall in Washington, D.C. Team California impressed jurors with
the communications strategies, promotional materials, and people
skills the team displayed while conveying the technical aspects
of household solar energy systems to the public.
Team California constructed an easy-to-navigate Web site
with a user-friendly home page, which encourages further site
exploration, said Communications Juror Jamie Van Mourik,
who is with the U.S. Green Building Council. On the Mall,
it is evident by their elaborate signage and ability to manage
crowd flow, their communications plan was well though-out, offering
a solid analysis to maximize educational opportunities.
Currently, twenty university-led teams from the United States,
Canada, Germany, and Spain are competing in DOEs fourth
Solar Decathlon to design, build, and operate houses powered
by the sun. Teams are competing in ten contests that evaluate
several aspects of a homes appearance, such as architecture,
market viability, and comfort that measure the way it optimizes
efficiency and provides energy for space heating and cooling,
hot water, home entertainment, lighting, and appliances.
Team California finished with 69.75 points, followed by Cornell
University and Team Ontario/BC, which tied for second place with
66.75 points. Team California leads in the overall standings
with 403.5 points followed by Team Germany (401.2 points) and
the University of Illinois at Urbana-Champaign (392.3 points).
For the Communications contest, teams earned points based on
a number of subjective criteria, including audience analysis,
quality and inventiveness of Web site content, presentation of
visual aids, and memorable branding. The panel of judges, made
up of Web site developers and public relations experts, evaluated
each teams Web site, communications plan, and student-led
house tours. Also, jurors considered whether the team effectively
delivered their messages to target audiences, as well as to people
with little technical understanding of solar energy systems.
Teams had the potential to earn up to 75 points.
Results from the next contest, Lighting Design, worth 75 points,
will be announced Thursday, October 15 at 10:00am on the National
Mall in the Solar Village. An overall winner of the competition
will be announced on Friday, October 16 at 8:00am.
Held on the National Mall in Washington, D.C., the Department
of Energy Solar Decathlon is open to the public through Sunday,
October 18. The houses are open for tours weekdays from 11:00am
to 3:00pm and weekends 10:00am to 5:00pm.

Department of Energy Announces Steps to
Strengthen Enforcement of Energy Efficiency Standards
Steps will help ensure that manufacturers have a level playing
field
Washington, DC - Today, the U.S. Department of Energy (DOE) announced
three new steps to strengthen its ability to enforce energy efficiency
standards. These new steps are part of the Departments
ongoing effort to save energy for American consumers and businesses
by clearing the backlog of energy efficiency standards for appliances
and aggressively enforcing energy efficiency standards. This
summer, as part of its tougher enforcement efforts under the
new Administration, DOE initiated investigations of alleged violations
against both an air conditioner manufacturer and a freezer manufacturer.
Both investigations are expected to be concluded shortly.
While efficiency standards had faced significant delays in prior
years, the Obama Administration has released five appliance efficiency
standards ahead of deadlines. These five standards will save
over 2 billion metric tons of carbon dioxide once in effect.
Over the next 30 years, they will save Americans an estimated
$250 - $300 billion.
The steps announced today include the formation of an enforcement
team within the Office of the General Counsel. Second, the Department
announced a program to randomly review manufacturers compliance
with DOE certification requirements. Finally, the Department
issued guidance further detailing its energy efficiency enforcement
regulations.
For the sake of our environment and our economy, its
critical that we enforce our energy efficiency regulations,
said Scott Blake Harris, General Counsel of the Department. Strong
enforcement of the rules will encourage compliance and keep manufacturers
who break the law from having a competitive advantage over manufacturers
who play by the rules.
In its new guidance on Energy Efficiency Enforcement Regulations,
the Department confirms that under existing DOE regulations,
DOE can take enforcement action and assess civil penalties if
a manufacturer fails to properly certify a covered product and
retain records. Specifically, the Department clarifies that any
failure to certify covered products according to DOEs rules
violates the Energy Policy Conservation Act of 1975 and DOEs
regulations.
The new enforcement team, reporting to the General Counsel, is
comprised of lawyers with extensive litigation and regulatory
experience. As part of its increased enforcement efforts, the
enforcement team will be initiating a compliance review of certification
reports for covered consumer products. DOE will randomly select
previously filed certification reports for review, request certification
records as needed, and hold manufacturers accountable for failing
to certify covered products according to DOE rules.

Secretary Chu Announces Up to $55 Million
in Funding to Develop Advanced Carbon Capture Technology at Existing
Coal-Fired Power Plants
Funding Opportunity Announcement Solicits Proposals for Bench-
through Pilot-Scale Projects
Washington, DC U.S. Energy Secretary Steven Chu announced
today that $55 million will be made available to develop advanced
technologies that can capture carbon dioxide from flue gases
at existing power plants so that the greenhouse gas may be sequestered
or put to beneficial use. The funding announced today is a direct
investment in carbon capture and storage related technologies
that will support the Obama Administrations effort to help
mitigate the effects of CO2 a major greenhouse gas and
contributor to global climate change.
Todays announcement will not only help fight climate
change, but also create new jobs and help position the United
States as a leader in carbon capture and storage technologies
for many years, said Secretary Chu. These technologies
will not only give us a healthier planet, they will strengthen
our economy and lay a foundation for a new generation of clean
energy jobs."
Coal is one of the nations most abundant energy resources
supplying nearly 50 percent of domestic electricity. Secretary
Chu sent a letter this week to world energy ministers and other
scientific leaders calling for an aggressive global effort to
advance carbon capture and sequestration technology to the point
where widespread, affordable deployment can begin in 8 to 10
years. The funding announced today will support the development
of technologies that can remove 90 percent of the CO2 in a flue
gas stream at no more than a 35 percent increase in the cost
of electricity.
The funding opportunity is seeking applications for bench- and
pilot-scale projects in four areas of interest: membranes, solvents,
solid sorbents, and condensed-phase capture. The solicitation
is specifically focused on advanced technologies for post-combustion
CO2 capture and purification that can be retrofitted to existing
pulverized coal power plants.

will announce the winners of the 2009 Solar Decathlon on Friday,
October 16 starting at 8:00am ET. A week ago, 20 teams began
a competition to test the performance of the solar-powered, high-efficiency
homes that they have designed and built. Fridays announcement
will cap off a competition that included tests in 10 areas ranging
from architecture, comfort, livability and market viability to
how well the solar homes provide energy for space heating and
cooling, hot water, lights, and appliances.

Secretary Chu Announces New Investments
in Cutting-Edge Wind Energy Research Facilities
Recovery Act funding to support wind energy technology research,
development, and career education opportunities at three U.S.
universities
Washington, DC U.S. Energy Secretary Steven Chu announced
new investments today in three university-led wind energy research
facilities that will enhance the United States leadership
role in testing and producing the most advanced and efficient
wind turbines in the world. The funding is from the American
Recovery and Reinvestment Act, and the research will focus on
improving both land-based and offshore wind generation.
Wind power has the potential to provide 20 percent of our
electricity and create hundreds of thousands of jobs, said
Secretary Chu. We need to position the United States as
the clear leader in this industry, or watch these high-paying
jobs go overseas. The investment were making today will
help ensure that America has both the talent and the technology
we need to compete.
Three university-led consortia have been selected for up to $24
million to support university research and development programs
to improve land-based and offshore wind turbine performance and
reliability, as well as provide career educational opportunities
for undergraduate and graduate students in wind energy technologies.
The three competitively selected, university-led projects will
include partners from private industry, state and local governments,
and other universities. The projects selected today support the
Obama Administrations focus on increasing clean energy
generation, while supporting the long-term development of a clean
energy workforce.
Over the next two years, the university consortia will acquire
utility-scale and prototype wind turbines that will provide researchers
and students with hands-on R&D and educational opportunities
on the most rapidly growing form of renewable energy in the country.
Universities will also use the DOE funds to enhance their wind
technology curricula and provide financial assistance to students
for research fellowships and internships with the rapidly expanding
wind industry.
The following projects have been selected for negotiation of
an award:
Illinois Institute of Technology (Chicago, Ill.) up to
$8 million
The Institute will use this funding to install a test turbine,
a GE 1.5 MW turbine, at an existing wind project owned by a consortium
partner at Marseilles, Illinois. The university consortiums
research and development plan includes advanced concepts for
rotor control and drive train control, robust sensors for blades,
and improved aero elastic models to improve wind turbine performance
and reliability. The close proximity of the Universitys
turbine to an existing wind farm provides an ideal opportunity
to study turbine to turbine wake interaction, wind farm interaction,
and wind energy efficiencies. The Institute will develop and
offer wind energy courses addressing the technical, operational,
social, and environmental aspects of wind energy in consultation
with industry. Fellowships will be offered annually to masters
and undergraduate students in wind energy engineering fields
of study.
University of Maine (Orono, Maine) - up to $8 million
The University of Maine plans to design and deploy two 10 kW
and one 100 kW floating offshore turbine prototypes. Two turbines
will be located at the University of Maine's Deepwater Offshore
Wind Test Site that will be located in a pre-selected site in
state waters and one turbine will be operated at an offshore
test site in the Isle of Shoals by the University of New Hampshire.
The University consortium's research and development plan includes
optimization of designs for floating platforms by evaluating:
(1) options for using more durable, lighter, hybrid composite
materials, (2) manufacturability, and (3) deployment logistics.
Educational initiatives include a model Master of Science Degree
in Renewable Energy and the Environment with a focus on deepwater
wind energy and a new undergraduate minor in Deepwater Wind Energy.
The University will target educational grants at individuals
who are participating in Maine-based wind energy education and
training in order to enter the job market.
University of Minnesota (Minneapolis, Minn.) up to $8
million
The University plans to install a new Siemens 2.3 MW turbine
research facility at the University of Minnesota Outreach Research
and Education (UMore) Park in Rosemount, Minnesota to study novel
mechanical power transmission and electric generator systems.
The University consortiums research and development plan
includes active and passive flow control strategies to increase
energy capture, broaden the operational envelope of the turbine,
and reduce structural loads and fatigue. The University of Minnesotas
turbine will be in close proximity to an existing wind farm,
providing an opportunity to further validate and reinforce research
findings regarding turbine wake interaction, wind farm interaction,
and wind energy efficiencies. The educational initiatives include
new graduate and undergraduate web-based course modules, programs
specifically focused on wind power technologies and integration
with other renewables, and student internships with industrial
partners at consortium field sites.
Final award amounts are subject to final project negotiations.

WASHINGTON, DC The U.S. Environmental Protection Agency
and the Department of Energy today unveiled the 2010 Fuel Economy
Guide, which gives consumers important information about estimated
fuel costs and mileage standards for model year 2010 vehicles.
Every year, consumers use the Fuel Economy Guide to find
clean, efficient, cost-effective vehicles that meets their needs
and their budgets, said EPA Administrator Lisa P. Jackson.
It's an easy, accessible resource for everyone, and helps
us cut harmful pollution from the air, and save money for American
drivers.
Fuel economy is about both saving energy and saving money,
said Energy Secretary Steven Chu. Buying fuel efficient
vehicles - like the many hybrid technologies featured in this
years Fuel Economy Guide helps limit carbon pollution,
lessen our dependence on foreign oil, and reduce driving costs
for American families.
Fuel-efficient models come in all types and sizes, so consumers
can save thousands of dollars over a vehicles lifetime
without sacrificing performance. Model year 2010 fuel economy
leaders include a wide range of hybrid models, from compact cars
to sport-utility vehicles.
Each vehicle listing in the Fuel Economy
Guide provides an estimated annual fuel cost. The estimate is
calculated based on the vehicles miles per gallon (mpg)
rating and national estimates for annual mileage and fuel prices.
The online version of the guide allows consumers to input their
local gasoline prices and typical driving habits to receive a
personalized fuel cost estimate.
Fuel efficiency is important for reducing carbon dioxide and
other greenhouse gases that contribute to global climate change.
One of the most important things consumers can do to reduce their
contribution to climate change is to buy a vehicle with better
fuel economy.
The Fuel Economy Guide continues to be available to mobile users

this network of networks to become a unparalleled platform for
innovation and speech, as well as an enduring engine for economic
growth. Last month, I proposed that the FCC adopt a fair and
high-level framework to preserve an open Internet. While my goals
are clear, the path to achieving them involves many hard questions
about how best to maximize the innovation and investment necessary
for a robust and thriving Internet. Getting input from all stakeholders
will be important as the Commission begins to address many critical
questions. That is why we launched OpenInternet.gov. We wanted
to create a place where people could join the discussion about
the open Internet. While OpenInternet.gov is still in Beta, we
are encouraged that thousands of visitors have already used the
site to watch my speech proposing open Internet principles and
more than 500 people have offered comments.

US-CERT is aware of public reports of an
increased number of spam
messages related to Microsoft Outlook or SSL certificates. These
messages contain a malicious file or link that claims to provide
an
update, but in reality, attempts to launch malware on a user's
system.
Typically, the messages instruct the user to click on a link
to save a
file or to open an attachment, either of which could infect the
user's
system.
To help protect against this type of attack,
US-CERT recommends that
users avoid opening attachments or links contained in unsolicited
email messages. Additional tips regarding email attachments can
be

FDIC's New Advisory Committee on Community
Banking Discusses Impact of Financial Crisis on Community Banks

At its first meeting since being established
by the FDIC Board in May, the FDIC's Advisory Committee on Community
Banking today discussed the impact of the financial crisis on
community banks. Other issues addressed were regulatory reform
proposals under consideration by Congress and their effect on
community banks, the impact of FDIC supervisory proposals on
these banks, and community banks' perspectives on funding the
FDIC's Deposit Insurance Fund.
"I was extremely pleased with the robust discussion among
our committee members on issues that are so critical to both
the FDIC and our nation's community banks," said FDIC Chairman
Sheila C. Bair. "The committee members voiced a number of
interesting ideas that they will pursue."
The Advisory Committee was formed to provide the FDIC with advice
and recommendations on a broad range of policy issues with particular
impact on small community banks throughout the nation, and the
local communities they serve. The committee is comprised of 14
community bankers from across the country, and one representative
from academia.
"We are fortunate to have so many highly respected professionals
who are willing to volunteer their time and talents to help the
FDIC analyze the issues most important to community banks,"
said Paul Nash, Deputy to the Chairman for External Affairs,
and the Designated Federal Official for the Advisory Committee
on Community Banking.
The members' opinions on the FDIC's proposed rulemaking to prepay
three years of deposit insurance assessments will be included
in the public comment file.

Secretary Napolitano Announces New Proposed
Standards for Private Sector Preparedness
Department of Homeland Security (DHS) Secretary Janet Napolitano
today announced new proposed standards for a 9/11 Commission-recommended
program for the private sector to improve preparedness for disasters
and emergencies.
"Preparedness is a shared responsibility and everyoneincluding
businesses, universities and non-profit organizationshas
a role to play," said Secretary Napolitano. "Ensuring
our private sector partners have the information and training
they need to respond to disasters will strengthen our efforts
to build a culture of preparedness nationwide."
DHS published a notice in the Federal Register today seeking
public comment on three new standards identified for adoption
under the Voluntary Private Sector Preparedness Accreditation
and Certification Program (PS-Prep). PS-Prep is a partnership
between DHS and the private sector that enables private entitiesincluding
businesses, non-profit organizations and universitiesto
receive emergency preparedness certification from a DHS accreditation
system created in coordination with the private sector.

rules for banks should include some automatic measures that limit
the discretion of bankers during times of stress, said William
Dudley, the president of the Federal Reserve Bank of New York
on Tuesday. For instance, rules need to be developed that limit
the ability of banks to pay dividends during a crisis, Dudley
said. In a speech to a trade group of international bankers,
Dudley said there could also be triggers that limit compensation
and bonus payments. Dudley also backed the use of some form of
debenture by banks that would automatically replenish equity
capital in times of stress. Because the conversion would dilute
shareholders equity, bank management "would have to manage
not only for good outcomes on the upside of the boom but also
against bad outcomes on the downside," Dudley said.

Timothy Geithner on Tuesday expressed support for changes made
to major legislation expected to come to a vote Wednesday to
create a Consumer Financial Protection Agency and impose new
transparency requirements on derivatives. "There are some
improvements to the bill, but core reforms seem intact,"
said Geithner, referring to changes made to an Obama administration
proposal on bank regulation reform introduced by House Financial
Services Committee Chairman Barney Frank, D-Mass. Frank's committee
has scheduled a vote on legislation to create the CFPA and new
derivatives oversight for Wednesday, but legislative consideration
is likely throughout the week. "This is the beginning of
the legislative process," Geithner said. "They are
making a lot of progress in figuring out where the votes are."

community banks with less than $10 billion in assets an exemption
from on-site exams performed by a proposed consumer protection
agency being set up in response to the financial crisis. "It
is true that 98 % of banks wouldn't need to have on-site exams
performed by the consumer protection agency," said House
Financial Services Committee Chairman Barney Frank, D-Mass.,
"However, the 1.4 % of banks that would need exams under
the CFPA have 77 % of all the assets and 74 % of the deposits
and they are the greater contributor to the crisis." The
controversial measure, introduced by Reps. Brad Miller, D-N.C.,
and Dennis Moore, D-K.S., would also exempt credit unions with
less than $1.5 billion in assets from the CFPA examinations.

was arrested and charged late Wednesday with theft of trade secrets
and unauthorized access to a protected computer, according to

alleges that Yu copied some 4,000 Ford documents, including sensitive
design materials, onto an external hard drive the night before
he left the company back in 2007. He began working at Ford in
1997. Yu used these stolen documents to secure a job with a Chinese
car company in 2008, according to the indictment. Yu was arrested
at Chicago O'Hare.

Bank of America to "get into a dispute with the pay-master,"

Lewis will not take a salary or bonus for 2009, which means he
will return the salary he's already earned this year, Stickler
explained. This agreement with the pay czar doesn't include Lewis'
retirement package from Bank of America, which was built up over
