WASHINGTON (MarketWatch) - The head of
the Commodity Futures Trading Commission said Wednesday he was
concerned about a provision in proposed legislation that would
require securities and futures regulators to determine whether
a particular swap needed to go through a transparent clearinghouse
on a contract-by-contract basis. "I believe it is best for
a clearinghouse that is managing its risk to determine if a particular
product should be cleared," said CFTC Chairman Gary Gensler
in prepared testimony to the House Financial Services Committee.
Gensler pointed out that an Obama administration proposal for
derivatives regulation has a presumption that if any standardized
product was accepted for clearing, it and all future iterations
of the product must go through a clearinghouse, which is an intermediary
between the buyer and seller of the swap. Gensler and legislators
support permitting tailored swaps to continue to trade on the
over-the-counter market as long as they meet new reporting, recordkeeping
and capital requirements.

NEW YORK (MarketWatch) -- The Federal Reserve
Bank of New York bought $1.3 billion in Treasurys on Wednesday,
the sole buyback this week as the central bank nears the end
of its purchase program. Dealers submitted $7.895 billion in
debt maturing between 2020 and 2026 to the Fed. Policy makers
plan to finish the buybacks later this month, which have been
an effort to keep down borrowing costs, particularly for companies
and homebuyers. After the buyback, yields on 10-year Treasury
notes , which move inversely to prices, remained lower by 5 basis
points at 3.21% ahead of an auction of more of the benchmark
securities.

Energy Department Announces New Private
Sector Partnership to Accelerate Renewable Energy Projects
New Financial Institutional Partnership Program will accelerate
deployment of billions in lending under Recovery Act
Washington DC --- U.S. Energy Secretary Steven Chu today announced
the Department of Energy (DOE) will provide up to $750 million
in funding from the American Recovery and Reinvestment Act to
help accelerate the development of conventional renewable energy
generation projects. This funding will cover the cost of loan
guarantees which could support as much as $4 to 8 billion in
lending to eligible projects, and the Department will invite
private sector participation to accelerate the financing of these
renewable energy projects.
To this end, the Department announced the creation of its new
Financial Institution Partnership Program (FIPP), a streamlined
set of standards designed to expedite DOEs loan guarantee
underwriting process and leverage private sector expertise and
capital for the efficient and prudent funding of eligible projects.
A renewable energy economy is a true opportunity to create
new jobs, reinvigorate Americas competitiveness and support
the presidents goal of doubling renewable energy in the
United States, said Secretary Chu. American innovation
can be the catalyst that jumps starts a new clean energy Industrial
Revolution.
The Recovery Act created a new Section 1705 under Title XVII
of the Energy Policy Act of 2005 (Title XVII) for the rapid deployment
of renewable energy projects and related manufacturing facilities,
electric power transmission projects and leading edge biofuels
projects that commence construction before September 30, 2011.
This first solicitation under the new program will seek loan
guarantee applications for conventional renewable energy generation
projects, such as wind, solar, biomass, geothermal and hydropower.
Past solicitations for renewable energy generation projects have
focused on loan guarantee applications using new or innovative
technologies not in general use in the marketplace.
The goal of FIPP is to leverage the human and financial capital
of private sector financial institutions by accelerating the
loan application process while balancing risk between DOE and
private sector partners participating in the program.
Under this first FIPP solicitation, proposed borrowers and project
sponsors do not apply directly to DOE but instead work with financial
institutions satisfying the qualifications of an eligible lender
which may apply directly to DOE to access a loan guarantee. The
solicitation invites applications from eligible lenders for partial,
risk-sharing loan guarantees from DOE. The guarantee percentage
will be no more than 80% of the maximum aggregate principal and
interest during a loan term, and the project debt must obtain
a credit rating of at least BB or an equivalent with
a nationally recognized credit rating agency.
This solicitation marks the eighth round of solicitations issued
by the Departments Loan Guarantee Program since its inception.

IR-2009-088: Special Sales Tax Deduction
for Car Purchases Available through End of 2009
WASHINGTON With 2010 models arriving
in dealer showrooms, the Internal Revenue Service reminds taxpayers
that purchasing a new car, light truck, motor home or motorcycle
could qualify them for a special deduction for the state and
local sales and excise taxes on their 2009 tax returns.
Purchases made before Jan. 1, 2010, will qualify for this deduction
under the American Recovery & Reinvestment Act of 2009 (ARRA).
The deduction is limited to the sales and excise taxes and similar
fees paid on up to $49,500 of the purchase price of a new vehicle.
The deduction is reduced for joint filers with modified adjusted
gross incomes (MAGI) between $250,000 and $260,000 and other
taxpayers with MAGI between $125,000 and $135,000. Taxpayers
with higher incomes do not qualify.
Taxpayers who make qualifying new vehicle purchases this year
can estimate the deduction with the help of Worksheet 10 in IRS Publication
919, How Do I Adjust My Withholding? Lines 10a to 10k of
the worksheet show how to take into account purchases above the
$49,500 limit, as well as the reduced deductions for taxpayers
at higher income levels.
The special deduction is available regardless of whether taxpayers
itemize deductions on their returns. Taxpayers who do not itemize
will add this additional amount to the standard deduction on
their 2009 tax return.

Agriculture Secretary Vilsack Announces
2010 DCP and ACRE Signup Begins
WASHINGTON, Oct. 7, 2009 - Agriculture
Secretary Tom Vilsack today announced that enrollment for the
2010 Direct and Counter-cyclical Program (DCP) and the Average
Crop Revenue Election (ACRE) program has begun and will continue
through June 1, 2010. USDA urges producers to make use of the
eDCP automated website to sign up, or producers can visit any
USDA Service Center to complete their 2010 DCP or ACRE contract.
The electronic service saves producers'
time, reduces paperwork and speeds up contract processing at
USDA Farm Service Agency (FSA) offices. It is available to all
producers who are eligible to participate in the DCP and ACRE
Programs and can be accessed at www.fsa.usda.gov/dcp. To access
the service, producers must have an active USDA eAuthentication
Level 2 account, which requires filling out an online registration
form at www.eauth.egov.usda.gov followed by a visit to the local
USDA Service Center for identity verification.
USDA computes DCP Program payments using
base acres and payment yields established for each farm. Eligible
producers receive direct payments at rates established by statute
regardless of market prices. For 2010, eligible producers may
request to receive advance direct payments based on 22 percent
of the direct payment. USDA will issue advance direct payments
beginning Dec. 1, 2009. Counter-cyclical payment rates vary depending
on market prices. Counter-cyclical payments are issued only when
the effective price for a commodity is below its target price.
The effective price is the higher of the national average market
price received during the 12-month marketing year for each covered
commodity and the national average loan rate for a marketing
assistance loan for the covered commodity.
The optional ACRE Program provides a safety
net based on state revenue losses and acts in place of the price-based
safety net of counter-cyclical payments under DCP. A farm's payment
is based on a revenue guarantee calculated using a 5-year average
state yield and the most recent 2-year national price for each
eligible commodity. For the 2010 crop, the 2-year price average
will be based on the 2008 and 2009 crop years.
An ACRE payment is issued when both the
state and the farm have incurred a revenue loss. The payment
is based on 83.3 percent (85 percent in 2012) of the farm's planted
acres times the difference between the State ACRE guarantee and
the state revenue times the ratio of the farm's yield divided
by the state expected yield. The total number of planted acres
for which a producer may receive ACRE payments may not exceed
the total base on the farm. In exchange for participating in
ACRE, in addition to not receiving counter-cyclical payments,
a farm's direct payment is reduced by 20 percent, and marketing
assistance loan rates are reduced by 30 percent.
The decision to enroll in the ACRE Program
is irrevocable. The owner of the farm and all producers on the
farm must agree to enroll in ACRE. Once enrolled, the farm shall
be enrolled for that initial crop year and will remain in ACRE
through the 2012 crop year.
The June 1, 2010, deadline is mandatory
for all participants. USDA will not accept any late-filed applications.

Obama Announces More Key Administration Posts 10/5/09
Today, President Barack Obama announced his intent to nominate
the following individuals to key administration posts:
|
The White House, U.S. Government Printing
Office (GPO) and the National Archives' Office of the Federal
Register (OFR) achieved a breakthrough in making Government information
available and usable by the public
GPO converted the text of the Federal Register
(2000-2009) into XML (extensible markup language) and placed
it online in numerous Federal Government portals, which include:
GPO's Federal Digital System <www.fdsys.gov>,
The Federal Register Web site <www.federalregister.gov>
and the Government's new portal for Government data <www.data.gov>.
This project began when President Barack Obama challenged Federal
agencies to create a more open and transparent Government. GPO's
Federal Digital System (FDsys), a world-class information management
system for Federal publications, is instrumental in enabling
this enhanced capability for the Federal Register.
"The transformation, undertaken by
the Government Printing Office and the National Archives and
Records Administration, vastly increases the Federal Register's
usefulness to the American public and further opens the curtains
on the inner workings of Government, a major goal of the Obama
Administration," said Beth Noveck, Deputy Chief Technology
Officer for Open Government.
The change supplements the official publishing
formats with XML, a form of text that can be manipulated in virtually
limitless ways with digital applications. For example, people
who want to know about the workings of the Executive branch of
the Federal Government no longer need to sift through the Federal
Register in its traditional Department-by-Department and Agency-by-Agency
format. This new format will allow applications to be developed
that will support user needs and can rearrange the Federal Register's
contents in personalized ways to match their particular interests.
It will be possible, for example, to download the Federal Register
and easily see what proposed actions might affect one's community
or region, or what actions might have an impact on one's profession
or business interests.
"Providing ten years of Federal Register
data in a format that is easy to manipulate is an exciting and
ground-breaking development," said Ray Mosley, Director
of the Federal Register. "This paves the way for consumers,
rather than Government officials to be in charge of deciding
how to access critical information. The Government Printing Office
and the Office of the Federal Register accomplished a minor miracle
in warp-speed time."
"I want to congratulate GPO employees
who worked with The White House and the Office of Federal Register
in providing the American people the tools to provide openness
and transparency to the documents of our democracy," said
Public Printer Bob Tapella. "GPO's Federal Digital System
not only provides transparency to our Government, but provides
Americans a permanent repository of authentic Federal Government
information."

This image from NASA's Mars Reconnaissance Orbiter shows gullies
near the edge of Hale crater on southern Mars. Martian gullies
carved into hill slopes and the walls of impact craters were
discovered several years ago. On Earth, gullies usually form
through the action of liquid water -- long thought to be absent
on the Martian surface. Whether liquid water carves gullies under
today's cold and dry conditions on Mars is a major question that
planetary scientists are trying to answer. Gullies at this site
are especially interesting because scientists recently discovered
actively changing examples at similar locations. Images separated
by several years showed changes in the appearance of some of
these gullies. Today, planetary scientists are using the HiRISE
camera on MRO to examine gullies such as the one in this image
for change that might provide a clue about whether liquid water
occurs on the surface of Mars. The view covers an area about
1 kilometer, or 0.6 mile, across and was taken on Aug. 3, 2009.

The report, titled "Foreign Holdings
of U.S. Agricultural Land," is available on the FSA Website
at www.fsa.usda.gov/FSA/webapp?area=home&subject=ecpa&topic=afa.
The publication reports that foreigners
have an interest (partial or total ownership) in 1.6 percent
of all privately held U.S. agricultural land and 0.92 percent
of all land in the United States. This is a 1.4 million acre
increase from 2007.
The report includes a wide variety of figures
and statistics, including:
A breakdown of land held by foreigners
by the type of acreage:
Forest land - 58 percent
Cropland - 13 percent
Pasture and other agricultural land - 26 percent
Which countries have foreigners holding
the largest amount of land:
Canadians hold the largest amount of land: almost 7.3 million
acres, or 34 percent.
People from these three countries collectively
hold more than 6.7 million acres, or 31 percent of the foreign
held acres in the U.S.:
Netherlands, almost 3.9 million acres (18 percent);
United Kingdom, over 1.5 million acres (7 percent); and
Germany, almost 1.4 million acres (6 percent).
The proportions of foreign-owned agricultural
land to all privately owned agricultural land by state:
Maine has the largest amount of foreign
held U.S. agricultural land at 3.35 million acres, or 18.7 percent
of the privately held agricultural land in the state.
In Hawaii, 8.8 percent of private agricultural land is foreign
held.
Washington (7.2 percent), Nevada (5.2 percent), and Alabama (5.1
percent) have the next largest proportions of foreign held land.
The publication's findings are based on
reports submitted in compliance with the Agricultural Foreign
Investment Disclosure Act of 1978 (AFIDA). The law was created
to establish a nationwide system for the collection of information
pertaining to foreign ownership in U.S. agricultural land. The
AFIDA regulation requires foreign investors who acquire, transfer
or hold an interest (other than a security interest) in U.S.
agricultural land to report such holdings and transactions to
the secretary of agriculture on an AFIDA Report Form FSA-153.
The data gained from these disclosures is used in the preparation
of an annual report to Congress.

AGRICULTURE SECRETARY VILSACK ANNOUNCES
FUNDING TO 1890 LAND-GRANT INSTITUTIONS TO PROMOTE JOBS AND BUSINESS
GROWTH
WASHINGTON, Oct. 6, 2009 - Agriculture
Secretary Tom Vilsack today announced the selection of 15 historically
African-American land-grant educational institutions in 14 states
to receive $1.5 million in economic development and business
promotion grants.
"These funds help provide entrepreneurship
training and benefits to rural youth," Vilsack said. "President
Obama believes our nation's economic competitiveness and the
path to the American dream depend on providing every student
with an education that will enable them to succeed in a global
economy. Using these funds, students will learn to take advantage
of existing economic development opportunities in their communities
- such as renewable energy resources - as well as the vast business
knowledge and connections that these schools and their faculty
members have."
The grants, provided through USDA Rural
Development, will help create businesses, promote cooperatives
and provide jobs. The recipients are among the 18 institutions
supported under the Second Morrill Act of 1890, a law providing
for the establishment of land-grant institutions focusing on
agriculture, home economics and the mechanic arts.
West Virginia State University, in Institute,
W.Va., plans to use part of its $100,000 award to help the West
Virginia Biofuels Farmers Cooperative collect used cooking oil
and refine it into renewable energy. It also will work with an
economic development agency in Webster County to provide office
space, shipping equipment and publicity for about 15 start-up
businesses.
The University of Arkansas-Pine Bluff will
receive $115,000 to implement a rural entrepreneurial collaborative
between cooperatives and businesses in the Delta region of the
state. The University will support community-based efforts such
as the Rural Life Conference, which involves more than two dozen
organizations working on economic development strategies, education
and training for rural residents.
In 2008, Langston University, in Langston,
Okla., used a $100,000 USDA Rural Development grant to conduct
a rural business retreat for youth. The retreat featured an age-appropriate
curriculum to teach 10th-12th graders about potential entrepreneurship
opportunities associated with wind energy, biofuels and hydro
power. The program was developed in collaboration with professionals
in climatology and civil engineering.
Funding of recipients announced today is
contingent upon their meeting the conditions of the cooperative

$190 MILLION FOR RURAL WATER PROJECTS
Recovery Act Funds Will Help Improve Infrastructure
in Rural Areas of 17 States
WASHINGTON, October 6, 2009 - Agriculture
Secretary Tom Vilsack today announced the selection of $190 million
in water and environmental project loans and grants that are
being funded through the American Recovery and Reinvestment Act.
Dallas Tonsager, Under Secretary for Rural Development, made
the announcement on behalf of Vilsack during a speech at the
National Rural Water Association meeting in Louisville, Ky.
"Recovery Act projects are putting
people to work and helping rural communities of all sizes build
a foundation for economic strength and future prosperity,"
said Tonsager. "The 27 water and wastewater projects we're
announcing today are helping to achieve the Obama Administration's
economic recovery goals to rebuild and revitalize the nation's
infrastructure while creating or retaining jobs."
Altogether, USDA has announced $1.8 billion
for water and environmental project loans and grants, benefiting
people throughout the country.
The City of Washougal in Clarke County,
Wash., will receive a $3 million loan to construct a one million
gallon water reservoir. This small community is located on the
Washington side of the Columbia River, with its lowlands and
famous prairie situated on the west entrance to the scenic Columbia
River Gorge. Recently, Washougal has experienced rapid growth
and is in need of additional water storage to meet the expanding
population. ARRA Funds will be used to fully fund the purchase
and installation of the new water reservoir.
In Tyner, Ky., the Jackson County Water
Association, Inc. was selected to receive $5.14 million in grant
and loan funding to construct water and environmental infrastructure
projects. The water association proposes to construct a supplemental
intake structure to increase the water supply, build two booster
pump stations and construct 14 miles of main transmission pipes.
Jackson County is located in southeastern Kentucky and is part
of the Appalachian Regional Commission chain and one of Kentucky's
persistent poverty counties. These improvements will provide
a reliable supply of drinking water for the association's 4,257
existing customers.
The ARRA funding announced today is being
administered by USDA Rural Development's Water and Environmental
Program which provides loans and grants to ensure that the necessary
investments are made in water and wastewater infrastructure to
deliver safe drinking water and protect the environment in rural
areas.
Funding of individual recipients is contingent
upon their meeting the terms of the loan or grant agreement.

Seven years ago this week the House of
Representatives debated the Iraq War Resolution which was presented
by President Bush. I made the case for NOT going to war. I analyzed
the Bush war resolution, paragraph by paragraph, and pointed
out "Key Issues" which argued against Congress voting
to go to war. I distributed the attached analysis, personally,
to over 200 members of Congress from October 2, 2002 until October
10, 2002 when the vote occurred.
When you hear people say: "If only
we had known then what we know now," remember, some did
know of the false case for war against Iraq. And since so many
know now that we should not have gone to war against Iraq, then
why are we still there?

Analysis of Joint Resolution on Iraq
by Dennis J. Kucinich
October 2, 2002
Whereas in 1990 in response to Iraq's war
of aggression against and illegal occupation of Kuwait, the United
States forged a coalition of nations to liberate Kuwait and its
people in order to defend the national security of the United
States and enforce United Nations Security Council resolutions
relating to Iraq;
KEY ISSUE: In the Persian Gulf War there
was an international coalition. World support was for protecting
Kuwait. There is no world support for invading Iraq.
Whereas after the liberation of Kuwait
in 1991, Iraq entered into a United Nations sponsored cease-fire
agreement pursuant to which Iraq unequivocally agreed, among
other things, to eliminate its nuclear, biological, and chemical
weapons programs and the means to deliver and develop them, and
to end its support for international terrorism;
Whereas the efforts of international weapons
inspectors, United States intelligence agencies, and Iraqi defectors
led to the discovery that Iraq had large stockpiles of chemical
weapons and a large scale biological weapons program, and that
Iraq had an advanced nuclear weapons development program that
was much closer to producing a nuclear weapon than intelligence
reporting had previously indicated;
KEY ISSUE: UN inspection teams identified
and destroyed nearly all such weapons. A lead inspector, Scott
Ritter, said that he believes that nearly all other weapons not
found were destroyed in the Gulf War. Furthermore, according
to a published report in the Washington Post, the Central Intelligence
Agency has no up to date accurate report on Iraq's WMD capabilities.
Whereas Iraq, in direct and flagrant violation
of the cease-fire, attempted to thwart the efforts of weapons
inspectors to identify and destroy Iraq's weapons of mass destruction
stockpiles and development capabilities, which finally resulted
in the withdrawal of inspectors from Iraq on October 31, 1998;
KEY ISSUE: Iraqi deceptions always failed.
The inspectors always figured out what Iraq was doing. It was
the United States that withdrew from the inspections in 1998.
And the United States then launched a cruise missile attack against
Iraq 48 hours after the inspectors left. In advance of a military
strike, the US continues to thwart (the Administration's word)
weapons inspections.
Whereas in 1998 Congress concluded that
Iraq's continuing weapons of mass destruction programs threatened
vital United States interests and international peace and security,
declared Iraq to be in "material and unacceptable breach
of its international obligations" and urged the President
"to take appropriate action, in accordance with the Constitution
and relevant laws of the United States, to bring Iraq into compliance
with its international obligations" (Public Law 105-235);
Whereas Iraq both poses a continuing threat
to the national security of the United States and international
peace and security in the Persian Gulf region and remains in
material and unacceptable breach of its international obligations
by, among other things, continuing to possess and develop a significant
chemical and biological weapons capability, actively seeking
a nuclear weapons capability, and supporting and harboring terrorist
organizations;
KEY ISSUE: There is no proof that Iraq
represents an imminent or immediate threat to the United States.
A "continuing" threat does not constitute a sufficient
cause for war. The Administration has refused to provide the
Congress with credible intelligence that proves that Iraq is
a serious threat to the United States and is continuing to possess
and develop chemical and biological and nuclear weapons. Furthermore
there is no credible intelligence connecting Iraq to Al Qaida
and 9/11.
Whereas Iraq persists in violating resolutions
of the United Nations Security Council by continuing to engage
in brutal repression of its civilian population thereby threatening
international peace and security in the region, by refusing to
release, repatriate, or account for non-Iraqi citizens wrongfully
detained by Iraq, including an American serviceman, and by failing
to return property wrongfully seized by Iraq from Kuwait;
KEY ISSUE: This language is so broad that
it would allow the President to order an attack against Iraq
even when there is no material threat to the United States. Since
this resolution authorizes the use of force for all Iraq related
violations of the UN Security Council directives, and since the
resolution cites Iraq's imprisonment of non-Iraqi prisoners,
this resolution would authorize the President to attack Iraq
in order to liberate Kuwaiti citizens who may or may not be in
Iraqi prisons, even if Iraq met compliance with all requests
to destroy any weapons of mass destruction. Though in 2002 at
the Arab Summit, Iraq and Kuwait agreed to bilateral negotiations
to work out all claims relating to stolen property and prisoners
of war. This use-of-force resolution enables the President to
commit US troops to recover Kuwaiti property.
Whereas the current Iraqi regime has demonstrated
its capability and willingness to use weapons of mass destruction
against other nations and its own people;
Whereas the current Iraqi regime has demonstrated
its continuing hostility toward, and willingness to attack, the
United States, including by attempting in 1993 to assassinate
former President Bush and by firing on many thousands of occasions
on United States and Coalition Armed Forces engaged in enforcing
the resolutions of the United Nations Security Council;
KEY ISSUE: The Iraqi regime has never attacked
nor does it have the capability to attack the United States.
The "no fly" zone was not the result of a UN Security
Council directive. It was illegally imposed by the United States,
Great Britain and France and is not specifically sanctioned by
any Security Council resolution.
Whereas members of al Qaida, an organization
bearing responsibility for attacks on the United States, its
citizens, and interests, including the attacks that occurred
on September 11, 2001, are known to be in Iraq;
KEY ISSUE: There is no credible intelligence
that connects Iraq to the events of 9/11 or to participation
in those events by assisting Al Qaida.
Whereas Iraq continues to aid and harbor
other international terrorist organizations, including organizations
that threaten the lives and safety of American citizens;
KEY ISSUE: Any connection between Iraq
support of terrorist groups in the Middle East, is an argument
for focusing great resources on resolving the conflict between
Israel and the Palestinians. It is not sufficient reason for
the US to launch a unilateral preemptive strike against Iraq.
Whereas the attacks on the United States
of September 11, 2001 underscored the gravity of the threat posed
by the acquisition of weapons of mass destruction by international
terrorist organizations;
KEY ISSUE: There is no connection between
Iraq and the events of 9/11.
Whereas Iraq's demonstrated capability
and willingness to use weapons of mass destruction, the risk
that the current Iraqi regime will either employ those weapons
to launch a surprise attack against the United States or its
Armed Forces or provide them to international terrorists who
would do so, and the extreme magnitude of harm that would result
to the United States and its citizens from such an attack, combine
to justify action by the United States to defend itself;
KEY ISSUE: There is no credible evidence
that Iraq possesses weapons of mass destruction. If Iraq has
successfully concealed the production of such weapons since 1998,
there is no credible evidence that Iraq has the capability to
reach the United States with such weapons. In the 1991 Gulf War,
Iraq had a demonstrated capability of biological and chemical
weapons, but did not have the willingness to use them against
the United States Armed Forces. Congress has not been provided
with any credible information, which proves that Iraq has provided
international terrorists with weapons of mass destruction.
Whereas United Nations Security Council
Resolution 678 authorizes the use of all necessary means to enforce
United Nations Security Council Resolution 660 and subsequent
relevant resolutions and to compel Iraq to cease certain activities
that threaten international peace and security, including the
development of weapons of mass destruction and refusal or obstruction
of United Nations weapons inspections in violation of United
Nations Security Council Resolution 687, repression of its civilian
population in violation of United Nations Security Council Resolution
688, and threatening its neighbors or United Nations operations
in Iraq in violation of United Nations Security Council Resolution
949;
KEY ISSUE: The UN Charter forbids all member
nations, including the United States, from unilaterally enforcing
UN resolutions.
Whereas Congress in the Authorization for
Use of Military Force Against Iraq Resolution (Public Law 102-1)
has authorized the President "to use United States Armed
Forces pursuant to United Nations Security Council Resolution
678 (1990) in order to achieve implementation of Security Council
Resolutions 660, 661, 662, 664, 665, 666, 667, 669, 670, 674,
and 677";
KEY ISSUE: The UN Charter forbids all member
nations, including the United States, from unilaterally enforcing
UN resolutions with military force.
Whereas in December 1991, Congress expressed
its sense that it "supports the use of all necessary means
to achieve the goals of United Nations Security Council Resolution
687 as being consistent with the Authorization of Use of Military
Force Against Iraq Resolution (Public Law 102-1)," that
Iraq's repression of its civilian population violates United
Nations Security Council Resolution 688 and "constitutes
a continuing threat to the peace, security, and stability of
the Persian Gulf region," and that Congress, "supports
the use of all necessary means to achieve the goals of United
Nations Security Council Resolution 688";
KEY ISSUE: This clause demonstrates the
proper chronology of the international process, and contrasts
the current march to war. In 1991, the UN Security Council passed
a resolution asking for enforcement of its resolution. Member
countries authorized their troops to participate in a UN-led
coalition to enforce the UN resolutions. Now the President is
asking Congress to authorize a unilateral first strike before
the UN Security Council has asked its member states to enforce
UN resolutions.
Whereas the Iraq Liberation Act (Public
Law 105-338) expressed the sense of Congress that it should be
the policy of the United States to support efforts to remove
from power the current Iraqi regime and promote the emergence
of a democratic government to replace that regime;
KEY ISSUE: This "Sense of Congress"
resolution was not binding. Furthermore, while Congress supported
democratic means of removing Saddam Hussein it clearly did not
endorse the use of force contemplated in this resolution, nor
did it endorse assassination as a policy.
Whereas on September 12, 2002, President
Bush committed the United States to "work with the United
Nations Security Council to meet our common challenge" posed
by Iraq and to "work for the necessary resolutions,"
while also making clear that "the Security Council resolutions
will be enforced, and the just demands of peace and security
will be met, or action will be unavoidable";
Whereas the United States is determined
to prosecute the war on terrorism and Iraq's ongoing support
for international terrorist groups combined with its development
of weapons of mass destruction in direct violation of its obligations
under the 1991 cease-fire and other United Nations Security Council
resolutions make clear that it is in the national security interests
of the United States and in furtherance of the war on terrorism
that all relevant United Nations Security Council resolutions
be enforced, including through the use of force if necessary;
KEY ISSUE: Unilateral action against Iraq
will cost the United States the support of the world community,
adversely affecting the war on terrorism. No credible intelligence
exists which connects Iraq to the events of 9/11 or to those
terrorists who perpetrated 9/11. Under international law, the
United States does not have the authority to unilaterally order
military action to enforce UN Security Council resolutions.
Whereas Congress has taken steps to pursue
vigorously the war on terrorism through the provision of authorities
and funding requested by the President to take the necessary
actions against international terrorists and terrorist organizations,
including those nations, organizations or persons who planned,
authorized, committed or aided the terrorist attacks that occurred
on September 11, 2001 or harbored such persons or organizations;
KEY ISSUE: The Administration has not provided
Congress with any proof that Iraq is in any way connected to
the events of 9/11.
Whereas the President and Congress are
determined to continue to take all appropriate actions against
international terrorists and terrorist organizations, including
those nations, organizations or persons who planned, authorized,
committed or aided the terrorist attacks that occurred on September
11, 2001, or harbored such persons or organizations;
KEY ISSUE: The Administration has not provided
Congress with any proof that Iraq is in any way connected to
the events of 9/11. Furthermore, there is no credible evidence
that Iraq has harbored those who were responsible for planning,
authorizing or committing the attacks of 9/11.
Whereas the President has authority under
the Constitution to take action in order to deter and prevent
acts of international terrorism against the United States, as
Congress recognized in the joint resolution on Authorization
for Use of Military Force (Public Law 107-40); and
KEY ISSUE: This resolution was specific
to 9/11. It was limited to a response to 9/11.
Whereas it is in the national security
of the United States to restore international peace and security
to the Persian Gulf region;
KEY ISSUE: If by the "national security
interests" of the United States, the Administration means
oil, it ought to communicate such to the Congress. A unilateral
attack on Iraq by the United States will cause instability and
chaos in the region and sow the seeds of future conflicts all
other the world.
Now, therefore, be it
Resolved by the Senate and House of Representatives
of the United States of America in Congress assembled,
SEC. 1. SHORT TITLE.
This joint resolution may be cited as the
"Authorization for the Use of Military Force Against Iraq".
SEC. 2. SUPPORT FOR UNITED STATES DIPLOMATIC
EFFORTS
The Congress of the United States supports
the efforts by the President to-
(a) strictly enforce through the United
Nations Security Council all relevant Security Council resolutions
applicable to Iraq and encourages him in those efforts; and
(b) obtain prompt and decisive action by
the Security Council to ensure that Iraq abandons its strategy
of delay, evasion and noncompliance and promptly and strictly
complies with all relevant Security Council resolutions.
KEY ISSUE: Congress can and should support
this clause. However Section 3 (which follows) undermines the
effectiveness of this section. Any peaceful settlement requires
Iraq compliance. The totality of this resolution indicates the
Administration will wage war against Iraq no matter what. This
undermines negotiations.
SEC. 3. AUTHORIZATION FOR USE OF UNITED
STATES ARMED FORCES.
AUTHORIZATION. The President is authorized
to use the Armed Forces of the United States as he determines
to be necessary and appropriate in order to
(1)defend the national security of the
United States against the continuing threat posed by Iraq; and
(2)enforce all relevant United Nations
Security Council Resolutions regarding Iraq.
KEY ISSUE: This clause is substantially
similar to the authorization that the President originally sought.
It gives authority to the President to
act prior to and even without a UN resolution, and it authorizes
the President to use US troops to enforce UN resolutions even
without UN request for it. This is a violation of Chapter VII
of the UN Charter, which reserves the ability to authorize force
for that purpose to the Security Council, alone.
Under Chapter VII of the Charter of the
United Nations, "The Security Council shall determine the
existence of any threat to the peace... and shall make recommendations
to maintain or restore international peace and security."
(Article 39). Only the Security Council can decide that military
force would be necessary, "The Security Council may decide
what measures... are to be employed to give effect to its decisions
(Article 41) ... [and] it may take such action by air, sea, or
land forces as may be necessary to maintain or restore international
peace and security." (Article 43). Furthermore, the resolution
authorizes use of force illegally, since the UN Security Council
has not requested it. According to the UN Charter, members of
the UN, such as the US, are required to "make available
to the Security Council, on its call and in accordance with a
special agreement or agreements, armed forces..." (Article
43, emphasis added). The UN Security Council has not called upon
its members to use military force against Iraq at the current
time.
Furthermore, changes to the language of
the previous use-of-force resolution, drafted by the White House
and objected to by many members of Congress, are cosmetic:
In section (1), the word "continuing"
was added to "the threat posed by Iraq".
In section (2), the word "relevant"
is added to "United Nations Security Council Resolutions"
and the words "regarding "Iraq" were added to
the end.
While these changes are represented as
a compromise or a new material development, the effects of this
resolution are largely the same as the previous White House proposal.
The UN resolutions, which could be cited
by the President to justify sending US troops to Iraq, go far
beyond addressing weapons of mass destruction. These could include,
at the President's discretion, such "relevant" resolutions
"regarding Iraq" including resolutions to enforce human
rights and the recovery of Kuwaiti property.
PRESIDENTIAL DETERMINATION.
In connection with the exercise of the
authority granted in subsection (a) to use force the President
shall, prior to such exercise or as soon thereafter as may be
feasible, but no later than 48 hours after exercising such authority,
make available to the Speaker of the House of Representatives
and the President pro tempore of the Senate his determination
that
(1) reliance by the United States on further
diplomatic or other peaceful means alone either (A) will not
adequately protect the national security of the United States
against the continuing threat posed by Iraq or (B) is not likely
to lead to enforcement of all relevant United Nations Security
Council resolutions regarding Iraq, and
(2) acting pursuant to this resolution
is consistent with the United States and other countries continuing
to take the necessary actions against international terrorists
and terrorist organizations, including those nations, organizations
or persons who planned, authorized, committed or aided the terrorists
attacks that occurred on September 11, 2001.
(c) WAR POWERS RESOLUTION REQUIREMENTS.
-
(1) SPECIFIC STATUTORY AUTHORIZATION. -
Consistent with section 8(a)(1) of the War Powers Resolution,
the Congress declares that this section is intended to constitute
specific statutory authorization within the meaning of section
5(b) of the War Powers Resolution.
(2) APPLICABILITY OF OTHER REQUIREMENTS.
- Nothing in this resolution supersedes any requirement of the
War Powers Resolution.
SEC. 4. REPORTS TO CONGRESS
(a) The President shall, at least once
every 60 days, submit to the Congress a report on matters relevant
to this joint resolution, including actions taken pursuant to
the exercise of authority granted in section 2 and the status
of planning for efforts that are expected to be required after
such actions are completed, including those actions described
in section 7 of Public Law 105-338 (the Iraq Liberation Act of
1998).
(b) To the extent that the submission of
any report described in subsection (a) coincides with the submission
of any other report on matters relevant to this joint resolution
otherwise required to be submitted to Congress pursuant to the
reporting requirements of Public Law 93-148 (the War Powers Resolution),
all such reports may be submitted as a single consolidated report
to the Congress.
(c) To the extent that the information
required by section 3 of Public Law 102-1 is included in the
report required by this section, such report shall be considered
as meeting the requirements of section 3 of Public Law 102-1.

The Federal Bureau of Investigation (FBI)
has released information
warning the public about fraudulent email messages purporting
to come
from the FBI or the Department of Homeland Security. These email
messages contain a malicious attachment that claims to provide
an
intelligence report or bulletin, but in reality attempts to launch
malware on the user's system.
More information regarding these messages
can be found in the Federal
Bureau of Investigation's New E-Scams and Warnings web site.
To help protect against this type of attack,
US-CERT recommends that
users avoid opening attachments contained in unsolicited email
messages. Additional tips regarding email attachments can be
