This week I unveiled a wide-ranging overhaul of our financial system, restoring accountability and responsibility to give Americans the confidence that the system works for and protects them -- not powerful Wall Street special interests.

This is an ambitious proposal. It goes further than others have proposed. But I know that if we want to prevent another economic collapse, we need to transform the way we regulate our financial sector.

Here is a brief summary of what my bill will do:

Creates the Consumer Financial Protection Agency: Creates an independent watchdog to protect American consumers from fraud and abuse and ensure they get the clear, accurate information from credit card companies, mortgage companies and banks.
Ends Too Big to Fail: Prevents excessively large or complex financial companies from being capable of bringing down the economy.
Protects Against Systemic Risks: Creates an independent council of regulators to identify and address systemic risks posed by large, complex companies, products, and activities before they threaten the stability of the financial system.
Creates a Single Independent Federal Bank Regulator: Eliminates the convoluted system of duplicative federal bank regulators increasing accountability and ending unnecessary overlap, conflicting regulation, and "charter shopping."
Reforms Executive Compensation and Corporate Governance: Provides shareholders with a say on pay and corporate affairs with a non-binding vote on executive compensation and director nominations.
Closes Loopholes in Regulation: Eliminates loopholes that allow risky and abusive practices to go on unnoticed and unregulated.
Protects Investors: Provides tough new rules for transparency and accountability from investment advisors, financial brokers and credit rating agencies -- holding them accountable while protecting investors and businesses.
Enforces Regulations on the Books: Strengthens oversight and empowers regulators to aggressively pursue financial fraud, conflicts of interest and manipulation of the system that benefits special interests at the expense of American families and businesses.

My name is Dustin Hausner. I am the Chair of the Community Service Committee. The Committee and the YDA Executive Board has decided that the Community Service Project for the Orlando Conference will be a Clothing Drive. In many areas of the country summer has ended and winter is beginning.

Instead of throwing out summer clothes or clothes that just doesn't fit donate them in Orlando. We are asking each member who is attending to bring a Minimum of Five pieces of Clothing to donate.

You can donate socks, shirts, pants, shorts, sweaters, jackets, and so on. As long as the clothing is not damaged or say inappropriate comments they will be accepted.

Each member can make a big difference in someone's life. One sweater could mean a persons warmth through the cold winter without getting sick from the cold. You the member have the power to give to those who need your help.

DOT Administrative Law Judge Approves Ultimate Fares Settlement
The internet travel agency Ultimate Fares has been fined $600,000 and its owner $30,000 for violations of advertising regulations under a settlement approved by a U.S. Department of Transportation Administrative Law Judge (ALJ).
The fine, which would be the largest ever assessed for advertising violations, will become final in 30 days unless the Department decides to review the action or a petition for review is filed.
An investigation by the Department’s Aviation Enforcement Office found that Ultimate Fares failed to include the federal excise tax and the service fee it charged to consumers in fares published on its website between March 2008 and September 2009. This violated the Department’s requirement that published airfares must state the full price to be paid including service fees and any ad valorem tax, such as the Federal excise tax, which is assessed as a percentage of the fare. Ultimate Fares continued to omit the tax from its stated fares even after the Enforcement Office began its investigation, according to the consent order issued by ALJ Richard C. Goodwin. Ultimate Fares also failed to disclose which flights were being operated on a code-share basis as required by the Department’s rules.
In addition to the $30,000 penalty assessed against Ultimate Fares’ owner Roni Herskovitz, he also will be barred from any involvement in the online air travel agency business for 12 months.

DOE AND USDA SELECT PROJECTS FOR MORE THAN $24 MILLION IN BIOMASS RESEARCH AND DEVELOPMENT GRANTS

Washington, November 12, 2009 - The U.S. Departments of Agriculture and Energy today announced projects selected for more than $24 million in grants to research and develop technologies to produce biofuels, bioenergy and high-value biobased products. Of the $24.4 million announced today, DOE plans to invest up to $4.9 million with USDA contributing up to $19.5 million. Advanced biofuels produced through this funding are expected to reduce greenhouse gas emissions by at least 50 percent.

"The selected projects will help make bioenergy production from renewable resources more efficient, cost-effective and sustainable," said Energy Secretary Steven Chu. "These advancements will benefit rural economies through creation of new processing plants and profitable crops for U.S. farmers and foresters."

"Innovation is crucial to the advancement of alternative, renewable energy sources, and these awards will spur the research needed to make significant progress in bioenergy development," said Agriculture Secretary Tom Vilsack.

 

Projects announced today must contribute a minimum of 20 percent of matching funds for research and development projects and 50 percent of matching funds for demonstration projects. Funding is provided through USDA's National Institute of Food and Agriculture (NIFA) and DOE's Biomass Program. Selected projects are aimed at increasing the availability of alternative fuels and biobased products that are produced from a diverse group of renewable sources of biomass.

Biofuels and Biobased Products:

USDA Awards

GE Global Research (Irvine, CA) up to $1,597,544: to develop detailed and simplified kinetic models of biomass gasification. A fundamental modeling capability will enable the widespread design of feedstock-flexible biomass gasifiers that are cost-effective and scaled to match the regional distribution of biomass feedstocks.

Gevo, Inc. (Englewood, CO) up to $1,780,862: to develop a yeast fermentation organism that can cost-effectively convert cellulosic-derived sugars into isobutanol, a second generation biofuel/biobased product. As an advanced biofuel, isobutanol strikes a unique balance between high octane content and low vapor pressure, it can be converted into hydrocarbons, and as a biobased product it can be used as a chemical precursor for numerous high-value products such as isobutylene and PET plastic products.

Itaconix ( Hampton Falls, NH) up to $1,861,488: to develop production of polyitaconic acid from northeast hardwood biomass, using an integrated extraction-fermentation-polymerization process. Polyitaconic acid is a water soluable polymer with a 2 million metric ton per year market potential as a replacement for petrochemical dispersants, detergents, and super-absorbents.

Yenkin-Majestic Paint Corporation (Columbus, OH) up to $1,800,000: to demonstrate, at scale, the operation of a dry fermentation system that uses pre- and post-consumer food wastes from supermarkets and restaurants, waste sawdust, grass, leaves, stumps and other forms of wood waste to produce biogas, heat, and electrical power. Yenkin-Majestic will use these products to demonstrate a distributed stand-alone system for the operation of a large industrial facility.

Velocys, Inc. (Plain City, OH) up to $2,651,612: to improve biorefinery economics through microchannel hydroprocessing. This project will explore the unique capabilities of heat and mass transfer inherent in microchannel reactor technology with advanced catalysts to intensify chemical processes, resulting in more efficient conversion of cellulosic residues to liquid transportation fuels.

DOE Awards

Exelus, Inc. (Livingston, NJ) up to $1,200,000: to develop a Biomass-to-Gasoline (BTG) technology that represents a fundamental shift in process chemistry and overall approach to creating biofuels. The technology uses unique, engineered catalysts that facilitate new reaction pathways to liquid motor fuels from biomass. The BTG process replaces conventional high-temperature processes like gasification and pyrolysis with a series of mild, low-temperature reactions. The self-contained process uses minimal water and no acids or chemical additives.

Biofuels Development Analysis:

USDA Awards

Purdue University (West Lafayette, IN) up to $933,883: to develop an analysis of the global impacts of second generation biofuels in the context of other energy technologies and alternative economic and climate change policy options. This project will modify, extend and link established modeling frameworks to capture the strengths of each framework in a hybrid, multidisciplinary system.

University of Minnesota (St. Paul, MN) up to, $2,715,007: to assess the environmental sustainability and capacity of forest-based biofuel feedstocks within the Lake States region. DOE and USDA Select Projects for more than $24 Million in Biomass Research and Development Grants

Washington, DC – The U.S. Departments of Agriculture and Energy today announced projects selected for more than $24 million in grants to research and develop technologies to produce biofuels, bioenergy and high-value biobased products. Of the $24.4 million announced today, DOE plans to invest up to $4.9 million with USDA contributing up to $19.5 million. Advanced biofuels produced through this funding are expected to reduce greenhouse gas emissions by at least 50 percent compared to today’s biofuels.

“The selected projects will help make bioenergy production from renewable resources more efficient, cost-effective and sustainable,” said Energy Secretary Steven Chu. “This work will also benefit rural America by leading to new processing plants and new opportunities for U.S. farmers and foresters.”

“Innovation is crucial to the advancement of alternative, renewable energy sources, and these awards will spur the research needed to make significant progress in bioenergy development,” said Agriculture Secretary Tom Vilsack.

Projects announced today must contribute a minimum of 20 percent of matching funds for research and development projects and 50 percent of matching funds for demonstration projects. Funding is provided through USDA’s National Institute of Food and Agriculture (NIFA) and DOE’s Biomass Program. Selected projects are aimed at increasing the availability of alternative fuels and biobased products that are produced from a diverse group of renewable sources of biomass.

USDA Awards

· GE Global Research (Irvine, CA) up to $1,597,544: to develop detailed and simplified kinetic models of biomass gasification. A fundamental modeling capability will enable the widespread design of feedstock-flexible biomass gasifiers that are cost-effective and scaled to match the regional distribution of biomass feedstocks.

· Gevo, Inc. (Englewood, CO) up to $1,780,862: to develop a yeast fermentation organism that can cost-effectively convert cellulosic-derived sugars into isobutanol, a second generation biofuel/biobased product. As an advanced biofuel, isobutanol strikes a unique balance between high octane content and low vapor pressure, it can be converted into hydrocarbons, and as a biobased product it can be used as a chemical precursor for numerous high-value products such as isobutylene and PET plastic products.

· Itaconix ( Hampton Falls, NH) up to $1,861,488: to develop production of polyitaconic acid from northeast hardwood biomass, using an integrated extraction-fermentation-polymerization process. Polyitaconic acid is a water soluable polymer with a 2 million metric ton per year market potential as a replacement for petrochemical dispersants, detergents, and super-absorbents.

· Yenkin-Majestic Paint Corporation (Columbus, OH) up to $1,800,000: to demonstrate, at scale, the operation of a dry fermentation system that uses pre- and post-consumer food wastes from supermarkets and restaurants, waste sawdust, grass, leaves, stumps and other forms of wood waste to produce biogas, heat, and electrical power. Yenkin-Majestic will use these products to demonstrate a distributed stand-alone system for the operation of a large industrial facility.

· Velocys, Inc. (Plain City, OH) up to $2,651,612: to improve biorefinery economics through microchannel hydroprocessing. This project will explore the unique capabilities of heat and mass transfer inherent in microchannel reactor technology with advanced catalysts to intensify chemical processes, resulting in more efficient conversion of cellulosic residues to liquid transportation fuels.

DOE Awards

· Exelus, Inc. (Livingston, NJ) up to $1,200,000: to develop a Biomass-to-Gasoline (BTG) technology that represents a fundamental shift in process chemistry and overall approach to creating biofuels. The technology uses unique, engineered catalysts that facilitate new reaction pathways to liquid motor fuels from biomass. The BTG process replaces conventional high-temperature processes like gasification and pyrolysis with a series of mild, low-temperature reactions. The self-contained process uses minimal water and no acids or chemical additives.

· Purdue University (West Lafayette, IN) up to $933,883: to develop an analysis of the global impacts of second generation biofuels in the context of other energy technologies and alternative economic and climate change policy options. This project will modify, extend and link established modeling frameworks to capture the strengths of each framework in a hybrid, multidisciplinary system.

· University of Minnesota (St. Paul, MN) up to, $2,715,007: to assess the environmental sustainability and capacity of forest-based biofuel feedstocks within the Lake States region. This project will address key uncertainties about expanding feedstock harvests in the northern Lake States, including environmental impacts, economic feasibility and avoided fossil-fuel CO2 emissions.

A Message from Dr. David Blumenthal, National Coordinator for Health Information Technology

As the many activities mandated by the HITECH Act move forward, I want to take a moment to share my vision of the overarching goal and some of its implications. Our goal, above all else, is to make care better for patients, and to make it patient-centered. Information policy and health IT policy should serve that goal.
A key premise: information should follow the patient, and artificial obstacles – technical, business related, bureaucratic – should not get in the way. As a doctor, I have many times wanted access to data that I knew were buried in the computers or paper records of another health system across town. Neither my care nor my patients were well served in those instances. That is what we must get beyond. That is the goal we will pursue, and it will inform all our policy choices now and going forward. This means that information exchange must cross institutional and business boundaries. Because that is what patients need. Exchange within business groups will not be sufficient – the goal is to have information flow seamlessly and effortlessly to every nook and cranny of our health system, when and where it is needed, just like the blood within our arteries and veins meets our bodies’ vital needs.
If we are to reap the benefit of information exchange, Americans must also be assured that the most advanced technology and proven business practices will be employed to secure the privacy and security of their personal health information, both within and across electronic systems, and that persons and organizations who hold personal health data are trustworthy custodians of the information. We must have comprehensive, clear, and sustainable policies that strengthen existing protections, fill gaps as they emerge, fortify new opportunities for patients’ access to and control of their information, and align with evolving technologies. I will devote a separate letter to this critical issue and the many activities mandated by the HITECH Act that we are developing.

On the question of exchange, however, the HITECH Act is pretty specific about eliminating inappropriate barriers.
It squarely tackles the commercial barriers. The HITECH Act calls for the “development of a nationwide health information technology infrastructure that allows for the electronic use and exchange of information and that…promotes a more effective marketplace, greater competition...[and] increased consumer choice” among other goals. (Section 3001(b)) This means we cannot support arrangements that restrict the secure, private exchange of information required for patient care across provider or network boundaries. Some of these arrangements may improve care for those inside their walls. But ultimately, they have the potential to carve the nation up into disconnected silos of information, and thus, to undermine the vision of a secure, interoperable, nationwide health information infrastructure, which the law requires us to establish. Consumers, patients and their caretakers should never feel locked into a single health system or exchange arrangement because it does not permit or encourage the sharing of information.
It tackles the economic barriers. The HITECH Act incentives for providers and hospitals are powerful tools. While the official definition of “Meaningful Use” won’t be finalized until next year, the HITECH Act specifically highlights “information exchange” as one requirement for the incentives.
It tackles the technical barriers. The HITECH Act focuses on “interoperability” or “interoperable products.” In plain English, this means that our policies, programs, and incentives must aim for electronic health record (EHR) software and systems that can share information with different EHRs and networks so that information can follow patients wherever they go. And to build the pipelines to carry this information, HHS is directed to invest in the infrastructure to “support the nationwide electronic exchange and use of health information …including connecting health information exchanges…” (Section 3011) This means we will work with all our partners in the health and IT industries and with organizations that are committed to information sharing to develop the technologies and policies that can help us deliver information securely, privately, and accurately to whomever needs to see it on behalf of the patient’s health. We must ensure interoperability for the future.
It provides building blocks for information exchange across jurisdictions. The grants for states and state-designated entities in Section 3013 – which will total $564 million – target information exchange across boundaries, not only within each state but explicitly as part of a nationwide framework. We will start announcing the awards this winter. These grantees’ activities must support interoperability that lets patient data follow the patient across political and geographic boundaries. The grantees will be our partners in building the nationwide infrastructure mentioned previously.
In short, the HITECH Act not only authorizes but requires us to mobilize all our policies, programs, and incentives to give the American people the patient-centric care they deserve and expect.

EPA Cites 14 Municipalities for Stormwater Violations

(PHILADELPHIA – November 12, 2009) The U.S. Environmental Protection Agency has cited 14 municipalities in Pennsylvania and Maryland for stormwater violations, nine of which are within the Chesapeake Bay watershed.

“EPA, in partnership with the states, is taking clear steps to protect the water quality of local streams and rivers,” said Jon M. Capacasa, director of the Water Protection Division for EPA’s mid-Atlantic region. “Because many of these municipalities are in the Chesapeake Bay watershed, this action, along with others will also help protect and restore the Bay,"

Urbanized areas contain large portions of impervious surfaces such as roads, rooftops and parking lots that channel stormwater directly into local streams, rivers, and other water bodies. Improperly managed stormwater runoff from urbanized areas often contains high levels of nutrients, sediment, toxic metals, volatile organic compounds, and other pollutants.

EPA requires the cited municipalities to correct problems with their respective municipal separate storm sewer (MS4) programs and come into compliance with their state-issued discharge permits. MS4s are publicly owned drainage systems designed to collect and convey stormwater from urbanized areas.

In Pennsylvania, EPA issued orders to Birdsboro Borough and Ontelaunee Township in Berks County; Mechanicsburg Borough in Cumberland County; Atrim Township in Franklin County; East Donegal Township, Terre Hill Borough, Pequea Township, Akron Borough and East Earl Township in Lancaster County; Myerstown Borough in Lebanon County; and, Monaghan and Newberry Townships in York County.

In Maryland, EPA issued orders to Baltimore City and Anne Arundel County.

Several of these municipalities have already taken steps to comply with the orders.

SAN FRANCISCO — Following a November 10 tour of successful community economic development projects in San Francisco, Comptroller of the Currency John C. Dugan issued the following statement:
Today I visited small business enterprises in the San Francisco area and saw first-hand the positive impact that banks, community development financial institutions, and non-profit organizations are making on the availability of economic development opportunities.

I toured the Mission District, an economically diverse San Francisco neighborhood, and visited a microenterprise that is giving low-and moderate-income entrepreneurs an opportunity to own and run their own green business. The company provides its worker-owners with over 150 hours of entrepreneurship training as well as instruction on environmentally friendly cleaning techniques. This worker-owned cooperative was established through a partnership between a green cleaning products company and an organization that promotes the social and economic empowerment of low-income women in the San Francisco Bay Area through cooperative business ownership. The cooperative received its financing from a community development financial institution that had been capitalized by banks. The cooperative was able to establish and expand its operations because of the financing it received through national banks and their partners.
I also visited an incubator kitchen whose mission is to train and develop food entrepreneurs. This commercial kitchen space helps enhance market opportunities by providing caterers and potential restaurant owners with instruction on food preparation and business management. Many of these budding entrepreneurs are making the transition from home-based businesses to a professional catering or restaurant business.

I continue to be impressed with how important bank and community economic development partnerships are to creating and preserving jobs that stabilize communities. When national banks partner with community-based organizations they are able to pull together resources and meet the business credit needs of borrowers who don’t fit traditional credit profiles. In securing investment capital and responsible credit for growing enterprises, these bank partnerships bring jobs and opportunity back to economically distressed communities. They are adding to the economic well-being and vitality of cities across the country.
Since assuming office in 2005, Comptroller Dugan has met with community leaders from across the country and toured community development projects in Pittsburgh, Chicago, New York, Washington, D.C., Los Angeles, Dallas, and San Francisco.

Secretary Chu Announces Determination of No Adverse Material Impact for Uranium Transfer to Fund Portsmouth Cleanup


WASHINGTON, D.C. – Secretary Chu announced today that the Department of Energy has issued a final determination and market impact study for the proposed uranium transfer to fund accelerated cleanup activities at the Portsmouth Site in Piketon, Ohio, which will create between 800 to 1,000 new jobs for the community. The market review and determination confirms that the proposed transfer of uranium will not have an adverse material impact on the domestic uranium industries.

Under the determination, DOE’s Office of Environmental Management will be able to transfer as much as 300 metric tons of uranium per quarter in calendar years 2009 and 2010 for cleanup at the Portsmouth Gaseous Diffusion Plant, so long as the total transfer during that period does not exceed 1,125 metric tons of uranium. The uranium transfers will be consistent with the policies reflected in the Department's Excess Uranium Management Plan and will comply with all applicable laws to ensure minimal impact on the domestic uranium market. The Department believes that the proposed uranium transfer would raise $150-$200 million per year.

The Secretary’s Determination is based on a market impact analysis performed by Energy Resources International, Inc. (ERI), evaluating the potential effect from transferring specific quantities of the Department’s excess natural uranium hexafluoride (UF6) on the commercial nuclear fuel markets in order to fund the accelerated cleanup work at the Portsmouth Gaseous Diffusion Plant. The determination and analysis took into account the uranium transfers under the Office of Environmental Management along with scheduled transfers by the National Nuclear Security Administration (NNSA).

This Secretarial Determination of No Adverse Material Impact refers only to the proposed action to transfer excess uranium to fund the 2009 and 2010 cleanup efforts activities. A separate determination will be required later regarding possible transfers of uranium to fund decontamination and decommissioning activities at the Portsmouth Plant after calendar year 2010.

FDIC Board Approves Final Rule on Prepaid Assessments

The Board of Directors of the Federal Deposit Insurance Corporation (FDIC) today voted to require insured institutions to prepay slightly over three years of estimated insurance assessments. The pre-payment allows the FDIC to strengthen the cash position of the Deposit Insurance Fund (DIF) immediately without immediately impacting earnings of the industry.
"I am pleased, but not surprised, by the industry's willingness to step up to the task of rebuilding and strengthening the cash reserves of the fund," said FDIC Chairman Sheila C. Bair. "In September, I expressed confidence that the industry was up to this challenge and the industry has not disappointed. The comment letters we received over this past month made clear that the FDIC and the industry are of the same mind: we will do whatever it takes to maintain the public's confidence in insured institutions and we remain committed to maintaining the independence of the Deposit Insurance Fund through direct industry funding."
Payment of the prepaid assessment, along with the payment of institutions' regular third quarter assessment, will be due on December 30, 2009. The FDIC estimates that it will collect approximately $45 billion from total prepaid assessments. The payments will come from the industry's substantial liquid reserve balances, which as of June 30, totaled more than $1.3 trillion, or 22 percent more than a year ago.
Unlike a special assessment, which the FDIC collected on September 30, this prepayment will not immediately affect bank earnings. Banks will book the payments at the end of each quarter. While the prepayment will immediately improve the FDIC's liquidity, it will not have an impact on the fund balance.
Chairman Bair emphasized that "the public should know that the discussions over the past several months have never been about the FDIC's ability to fulfill its commitment to depositors, but rather how that would be done. The FDIC's commitment to depositors is absolute, and we and the industry have more than enough resources to make good on that commitment. No depositor has ever lost a penny of an insured deposit and no depositor ever will."
