FOOD PURCHASES FOR DOMESTIC NUTRITION PROGRAMS, ASSISTS PORK,
CHERRY, PLUM AND APPLE FARMERS
KANSAS CITY, Mo., Nov. 11, 2009 - Agriculture
Secretary Tom Vilsack today announced USDA's intention to purchase
$82.6 million worth of pork, cherry, plum and apple products
for federal food nutrition assistance programs. Vilsack made
this announcement today at the National Association of Farm Broadcasters
annual convention.
"These purchases will assist pork,
cherry, plum and apple producers, who are currently struggling
due to depressed market conditions," said Vilsack. "Today's
actions will help stabilize prices and markets, stimulate the
economy, and provide high quality food to Americans in need of
USDA's nutrition assistance programs."
USDA intends to purchase $50 million of
pork, $12.2 million of tart cherries, $1.8 million of dried plums
and $18.6 million of apples. The Department will seek the lowest
overall costs by surveying potential suppliers and publicly inviting
bids to assure contracts are awarded to responsible bidders.
The pork purchase will help farmers greatly
reduce their sow herd in a market where production costs continue
to exceed market value. The tart cherry, dried plum and apple
purchase will help alleviate the stress caused by higher inventories
and low prices that farmers are receiving for their commodities.
Each year, USDA purchases a variety of
high-quality food products to support the National School Lunch
Program, the School Breakfast Program, the Summer Food Service
Program, the Food Distribution Program on Indian Reservations,
the Commodity Supplemental Food Program and The Emergency Food
Assistance Program. USDA also makes emergency food purchases
for distribution to victims of natural disasters.
Government food experts focus on ensuring
all purchased food is healthy and nutritious. Food items normally
are required to be low in fat, sugar and sodium. The commodities
must meet specified grade requirements and be USDA-certified
to ensure they meet government standards of quality. USDA purchases
only commodities produced in America.

I. Description
Microsoft has released multiple security

A remote, unauthenticated attacker could
execute arbitrary code,
gain elevated privileges, or cause a vulnerable application to
crash.
III. Solution
Apply updates from Microsoft
Microsoft has provided updates for these
vulnerabilities in the
Microsoft Security Bulletin Summary for November 2009. The security
bulletin describes any known issues related to the updates.
Administrators are encouraged to note these issues and test for
any
potentially adverse effects. Administrators should consider using

Care Professional Sentenced To Prison For Product Tampering

DREA LYNNE GIBSON, 43, of Fall City, Washington, was sentenced
today in U.S. District Court in Seattle to a year and a day in
prison and three years of supervised release for product tampering
in violation of federal law. GIBSON pleaded guilty in May 2009,
admitting that she tampered with doses of Demerol, a narcotic
pain medication, at the surgical center where she worked. At
sentencing U.S. District Judge Ricardo Martinez said, This
is an extremely serious offense. Using Demerol for herself is
one thing, stealing it is another. But replacing it with something
else takes it to another level. Replacing the Demerol with epinephrine
shows she was willing to put other people in pain and even at
risk of death to treat her own pain.

today with a group of lobbyists and others who currently chair
Industry Trade Advisory Committees (ITACs). The group had objected
to the Administration's new policies barring the appointment
(and reappointment) of federally registered lobbyists to agency
boards and commissions. Although we have previously addressed
their views here and here, we feel it important to meet with
those with whom we disagree to discuss their concerns face to

Vilsack Says Child Nutrition Reauthorization
is Opportunity to Work Towards Goal of Ending Childhood Hunger
WORCESTER, Mass., November 9, 2009 - Agriculture
Secretary Tom Vilsack today visited Worchester, Mass., to help
launch a hospital hunger initiative at UMass Memorial Health
Care in Worchester aimed at eliminating hunger in our communities
and reducing the barriers that keep families from receiving adequate
nutrition. Vilsack was joined by Congressman Jim McGovern and
Governor Deval Patrick as part of his efforts to draw attention
to the issues of food insecurity and hunger and promote the upcoming
Child Nutrition Reauthorization.
"President Obama and I are committed
to improving the nutrition and health of all Americans, which
is why we look forward to working with Congress to improve the
health and nutrition of America's families through the Child
Nutrition Reauthorization." said Vilsack. "The reauthorization
presents a significant opportunity to improve the quality of
school meals served to more than 31 million children in more
than 100,000 schools across the country and to reduce barriers
to participation. The collaborative effort we are celebrating
at today's event, and others like it, will play a key role in
eliminating the barriers that keep families from participating
in nutrition programs and reduce food insecurity in our communities."
Vilsack was on hand with Congressman McGovern
to unveil a new handbook that takes a practical, hands-on approach
to combating food insecurity and hunger. The book, called "Hunger
in the Community: Ways Hospitals Can Help," provides hospitals
workers with all the information they need to get a program started.
USDA's Food and Nutrition Service (FNS),
the Federal agency that administers the Nation's domestic nutrition
assistance programs, is the nation's first line of defense against
hunger and a critical safety net for the underserved Americans.
FNS administers the 15 domestic nutrition
assistance programs which together comprise the Nation's food
safety net. They include the Supplemental Nutrition Assistance
Program or SNAP (formerly the Food Stamp Program); National School
Lunch Program (NSLP); Special Supplemental Nutrition Program
for Women, Infants and Children (WIC); Fresh Fruit and Vegetable
Program; and the Emergency Food Assistance Program (TEFAP), among
others.
Nutrition education and outreach efforts
to the underserved are top priorities in all FNS mission areas.
By providing nutrition education, low-income individuals and
families are better equipped to connect dietary choices and physical
activity with overall wellbeing. To increase participation, FNS
conducts outreach targeting eligible populations, such as Hispanics
and the elderly.
USDA's Food and Nutrition Service supports
individuals and families in need by putting healthy foods within

FEDERAL AGENCIES TO MEET TWO-YEAR MILESTONES
FOR ALL RESTORATION ACTIVITIES
WASHINGTON, Nov. 9, 2009 - Expanded action
and increased accountability by the federal government are the
focus of a draft strategy for restoring and protecting the Chesapeake
Bay required by President Obama's Executive Order. To accelerate
efforts and track progress, federal agencies are committing to
meet milestones every two years, leading to all activities needed
to restore the Chesapeake Bay and watershed being in place no
later than 2025.
The draft strategy, released today, contains
a comprehensive package of federal initiatives to restore clean
water, conserve treasured places, protect fish and wildlife,
and adapt to the impacts of climate change. These objectives
will be accomplished by empowering local efforts, making decisions
based on science and forging a new era of federal leadership
and accountability. Close collaboration of efforts with the six
states in the Chesapeake Bay watershed and the District of Columbia
will also be critical.
"President Obama has declared that
the Chesapeake Bay is a national treasure and committed to a
robust cleanup effort. Setting two-year benchmarks for progress
will ensure that our actions are getting the results the President
and the public expect," said EPA Administrator Lisa P. Jackson.
"This is the broadest and most publicly accountable cleanup
effort ever seen on the Chesapeake Bay and its watershed. It's
time for a new era of decisive federal leadership, and new partnerships
with state government, nonprofits, the private sector and residents
who have all been working to create a cleaner Bay."
Public comment on the draft strategy is
important to the federal agencies and will shape the final strategy.
The formal public comment period is from Nov. 9, 2009 to Jan.
8, 2010. The draft strategy can be accessed at http://executiveorder.chesapeakebay.net
and the public can click on "provide comments" to formally
submit feedback through www.regulations.gov. The draft strategy
will evolve significantly through public comments, state consultations
and agency revisions before the final strategy is published in
May 2010.
To restore clean water, EPA will create
a framework for performance and accountability to guide federal
and state pollution control programs, and expand regulatory tools
to reduce pollution from Concentrated Animal Feeding Operations
and urban and suburban runoff. The U.S. Department of Agriculture
will intensively target voluntary conservation incentives at
high priority areas. New emphasis is also placed on improving
stormwater management on federal land and reducing polluted runoff
from transportation infrastructure.
"Maintaining healthy, sustainable
farms and forests is an essential component to protecting and
restoring the Chesapeake Bay," said Secretary of Agriculture
Tom Vilsack. "Our focus is on increasing economic viability,
strengthening markets for local foods, improving water quality
and protecting the natural landscape."
The draft strategy contains numerous initiatives
to conserve natural places, animal habitats and fish and wildlife.
For example, the Department of the Interior will pursue development
of a Chesapeake Treasured Landscapes Initiative to support state
and local efforts to conserve and restore the environmental,
historic, cultural and recreational value of many of the region's
wetlands, river corridors and open spaces. The department will
look for opportunities to expand or create new units of the National
Park System, National Wildlife Refuge System, National Wild and
Scenic Rivers system and National Historic Trails system.
"Our proposed initiative will build
upon the existing partnerships with states, local communities,
conservation organizations and other stakeholders to undertake
projects that will not only conserve the Chesapeake Bay but will
lead to its restoration as one of the great natural wonders of
our country," said Secretary of the Interior Ken Salazar.
"We have a big toolbox full of conservation actions and
we plan to use it."One challenge to restoration is climate
change, which scientists project will have a variety of impacts
on the Chesapeake Bay and its watershed, including rising sea
levels, warmer water and air temperatures, and stronger storms.
NOAA and the U.S. Geological Survey are leading the development
of the federal strategy for adapting to climate change impacts
in the Bay.
"Science shows that Chesapeake Bay
habitats and living resources are already being affected by climate
change," said Dr. Jane Lubchenco, Under Secretary of Commerce
for Oceans and Atmosphere and NOAA Administrator. "We need
to adapt to climate change to ensure that the places and things
we care about - like wetlands that serve as nurseries for fish
and crabs and coastal communities that are vulnerable to sea
level rise - can be addressed in our restoration efforts."
NOAA and the Army Corps of Engineers will
also lead a revitalized effort to recover native oyster reefs
and establish self-sustaining native oyster reef sanctuaries
in key tributaries by 2020.
The draft strategy emphasizes the need
to empower local efforts because local governments, watershed
organizations and residents have a great interest and ability
to restore the environment. Federal agencies will expand technical
assistance and resources, and support development of innovative
technologies to reduce pollution and economic markets for ecosystem
services. A Chesapeake Conservation Corps will be pursued to
increase citizen stewardship, and public education will engage
people in protecting local waterways.
Federal agencies have also developed a
suite of accountability and transparency measures, led by ChesapeakeStat,
an online tool that will identify restoration projects, funding
and progress, and be publicly accessible. The draft strategy
also calls for an annual plan for spending; reporting on environmental
health and restoration progress, potentially through the Chesapeake
Bay Program's Bay Barometer; and an independent evaluation of
federal efforts.
On May 12, President Obama issued Executive
Order 13508 on Chesapeake Bay Restoration and Protection, the
first-ever presidential directive on the Bay and the first environmental
Executive Order by President Obama. The order established a Federal
Leadership Committee, chaired by EPA, and with senior representatives
from the departments of Agriculture, Commerce, Defense, Homeland
Security, Interior and Transportation. These agencies generated
draft reports in September 2009 with recommendations for addressing
issues such as water quality, public access, landscape conservation,
climate change, scientific monitoring and the protection of living
resources. These draft reports were integrated into the draft
strategy, which must be finalized by May 12, 2010.

Successful
Flight Through Enceladus Plume

The Cassini spacecraft has weathered the Monday, Nov. 2, 2009,
flyby of Saturns moon Enceladus in good health and has
been sending images and data of the encounter back to Earth.
Cassini had approached Enceladus more closely before, but this
passage took the spacecraft on its deepest plunge yet through
the heart of the plume shooting out from the south polar region.
Scientists are eagerly sifting through the results. In this unprocessed
image, sunlight brightens a crescent curve along the edge of
Saturn's moon Enceladus and highlights its misty plume. The image
was captured by Cassini's narrow-angle camera as the spacecraft
passed about 190,000 kilometers (120,000 miles) over the moon.
This image has not been validated or calibrated. A validated/calibrated
image will be archived with the NASA Planetary Data System in
2010. At its closest point on Nov. 2, Cassini flew about 100
kilometers (60 miles) above the surface of Enceladus. Since the
discovery of the plume in 2005, scientists have been captivated
by the enigmatic jets. Previous flybys detected water vapor,
sodium and organic molecules, but scientists need to know more
about the plumes composition and density to characterize
the source, possibly a liquid ocean under the moons icy
surface. It would also help them determine whether Enceladus
has the conditions necessary for life. Mission managers did extensive
studies to make sure the spacecraft could fly safely through
the plumes and not use an excessive amount of propellant. Image

Airline On-Time Performance Improves
in September
Flights operated by the nations largest airlines arrived
on time at a higher rate this past September than in either September
of last year or in August 2009, according to the Air Travel Consumer
Report released today by the U.S. Department of Transportation
(DOT).
According to information filed with the Bureau of Transportation
Statistics (BTS), a part of DOTs Research and Innovative
Technology Administration (RITA), the 19 carriers reporting on-time
performance recorded an overall on-time arrival rate of 86.2
percent in September, higher than both September 2008s
84.9 percent and August 2009s 79.7 percent.
The monthly report also includes data on lengthy tarmac delays,
flight cancellations and the causes of flight delays by the reporting
carriers, as well as information on reports of mishandled baggage
filed with the carriers, airline bumping and consumer service,
disability and discrimination complaints received by DOTs
Aviation Consumer Protection Division. This report also includes
reports of incidents involving pets traveling by air, as required
to be filed by U.S. carriers.
Cancellations
The consumer report includes BTS data on
the number of domestic flights canceled by the reporting carriers.
In September, the carriers canceled 0.6 percent of their scheduled
domestic flights, a lower rate than both the 1.8 percent cancellation
rate of September 2008 and the 1.0 percent rate posted in August
2009.
Tarmac Delays
In September, the carriers filing on-time
performance data reported that .0001 percent of their scheduled
flights had tarmac delays of three hours or more, down from .012
percent in August. There were two flights with tarmac delays
of four hours or more in September.
Causes of Flight Delays
In September, the carriers filing on-time performance data reported
that 4.92 percent of their flights were delayed by aviation system
delays, compared to 6.43 percent in August; 3.88 percent by late-arriving
aircraft, compared to 6.45 percent in August; 3.89 percent by
factors within the airlines control, such as maintenance
or crew problems, compared to 5.46 percent in July; 0.37 percent
by extreme weather, compared to 0.69 percent in August; and 0.02
percent for security reasons, compared to 0.05 percent in August.
Weather is a factor in both the extreme-weather category and
the aviation-system category. This includes delays due to the
re-routing of flights by DOTs Federal Aviation Administration
in consultation with the carriers involved. Weather is also a
factor in delays attributed to late-arriving aircraft, although
airlines do not report specific causes in that category.
Data collected by BTS also shows the percentage of late flights
delayed by weather, including those reported in either the category
of extreme weather or included in National Aviation System delays.
In September, 34.59 percent of late flights were delayed by weather,
down 6.69 percent from September 2008, when 37.07 percent of
late flights were delayed by weather, and down 11.92 percent
from August when 39.27 percent of late flights were delayed by
weather.

Mishandled Baggage
The U.S. carriers reporting flight delays and mishandled baggage
data posted a mishandled baggage rate of 3.01 reports per 1,000
passengers in September, an improvement over both September 2008s
rate of 3.86 and August 2009s 4.04 rate. For the first
nine months of this year, the carriers posted a mishandled baggage
rate of 3.94 per 1,000 passengers, down from the 5.42 rate posted
during January-September 2008.
Bumping
The report also includes reports of involuntary
denied boarding, or bumping, for the third quarter and first
nine months of this year from U.S. carriers who also report flight
delay information. These carriers posted a bumping rate of 0.98
per 10,000 passengers for the quarter, down from the 1.03 rate
for the third quarter of 2008. For the first nine months of this
year, the carriers had a bumping rate of 1.22 per 10,000 passengers,
up from the rate of 1.12 rate posted during the first nine months
of 2008.
Incidents Involving Pets
In September, carriers reported four incidents involving the
loss, death or injury of pets while traveling by air, up from
both the zero reports filed in September 2008 and three in August
2009. All of Septembers incidents involved pet deaths.
Complaints About Airline Service
In September, the Department received 604 complaints about airline
service from consumers, down 11.6 percent from the 683 complaints
filed in September 2008 and 32.0 percent fewer than the total
of 888 received in August 2009. For the first nine months of
this year the Department received 6,675 complaints, 24.0 percent
fewer than the 8,784 complaints filed during January-September
2008.
Complaints About Treatment of Disabled Passengers
The report also contains a tabulation of complaints filed with
DOT in September against airlines regarding the treatment of
passengers with disabilities. The Department received a total
of 28 disability-related complaints in September, down from both
the 40 complaints filed in September 2008 and the total of 47
received in August 2009. For the first nine months of this year
the Department received 386 disability-related complaints, up
3.5 percent from the 373 disability complaints filed during January-September
2008.
Complaints About Discrimination
In September, the Department received 11
complaints alleging discrimination by airlines due to factors
other than disability such as race, religion, national
origin or sex up from the 10 complaints recorded in September
2008 but down from the total of 16 received in August 2009. For
the first nine months of this year the Department received 100
discrimination complaints, up 9.9 percent from the total of 91
filed during January-September 2008.

USDA ANNOUNCES NATIONAL PORK BOARD APPOINTMENTS
WASHINGTON, November 9, 2009 - Agriculture
Secretary Tom Vilsack today announced five appointments to the
15-member National Pork Board (Board). The five were chosen from
among eight pork producers nominated by the National Pork Producers
Delegate Body during its meeting in Dallas, Texas, in March.
The newly appointed Board members are:
Bradley S. Greenway, Mitchell, S.D.;
Dale N. Norton, Bronson, Mich.;
Lisa D. Colby, Newbury, Mass.
The reappointed Board members are:
Eugene C. Nemechek, Springdale, Ark.;
W. Randall Brown, Nevada, Ohio.
Established under the Pork Promotion, Research,
and Consumer Information Act of 1985, the Board develops budgets
and awards contracts to carry out a coordinated program designed
to strengthen the position of pork in the marketplace. USDA's
Agricultural Marketing Service oversees the operation of the
Board.
The mandatory program is funded by an assessment
of 0.40 percent of the market value of all hogs sold in the United
States and an equivalent amount on imported hogs, pork and pork
products.

Small Business Panel to Reconsider Regulatory
Exemptions for Insect Repellents
WASHINGTON -- The U.S. Environmental Protection
Agency (EPA) is seeking recommendations from small business on
whether insect repellents applied to the skin should continue
to be exempt from federal pesticide regulation. In another sign
of transparency, the agency is also taking a new approach to
obtaining small business views on this matter.
EPAs reconsideration of the current
exemption is based on concern that some exempted pesticide products
may not perform effectively. The changes under consideration
are intended to safeguard public health by assuring that minimum
risk skin-applied insect repellent products perform effectively,
and users receive protection from insects or ticks that may transmit
serious diseases.
Currently, pesticide products that pose
minimum risks to humans and the environment are exempt from federal
regulation under the Federal Insecticide, Fungicide and Rodenticide
Act, provided that the products are composed of certain ingredients
and are labeled according to very specific criteria under the
Act. Exempted products are not evaluated by EPA and, therefore,
the agency is unable to verify the accuracy of the efficacy information
on the labels of these minimum risk skin-applied repellents.
EPA is seeking small business input through
a Small Business Advocacy Review Panel. The Regulatory Flexibility
Act requires EPA to convene such a panel for a proposed rule
unless the agency certifies that the rule will not have a significant
economic impact on a substantial number of small entities. The
panel process offers an opportunity for small entities that are
directly affected by a proposed rule to provide input into the
rulemaking process. This action is the first time EPA has invited
small businesses to self-nominate for participation in the panel
process. Historically, EPA, in consultation with the Small Business
Administration, has made the selections without providing an
opportunity for interested small businesses to request participation.
