from foreclosure rescue and loan modification scams to deceptive
offers of FDIC-insured certificates of deposit (CDs). The advice
was published in the Spring 2009 issue of FDIC Consumer News,
the agencys quarterly newsletter for consumers, which can

federal deposit insurance limit of $250,000 per depositor through

BTS Releases North American Surface
Trade Numbers for March
Trade using surface transportation between the United States
and its North American Free Trade Agreement (NAFTA) partners
Canada and Mexico was 27.9 percent lower in March 2009 than in
March 2008, dropping to $51.1 billion, according to the Bureau
of Transportation Statistics (BTS) of the U.S. Department of
Transportation (Table 1). March was the third consecutive month
with a yearly decline of greater than 27 percent.
The value of U.S. surface transportation trade with Canada and
Mexico rose 6.5 percent in March 2009 from February 2009 (Table
2). Month-to-month changes can be affected by seasonal variations
and other factors.
Surface transportation consists largely of freight movements
by truck, rail and pipeline. About 88 percent of U.S. trade by
value with Canada and Mexico moves on land.
The value of U.S. surface transportation trade with Canada and
Mexico in March was down 9.3 percent compared to March 2004,
and up 17.4 percent compared to March 1999, a period of 10 years
(Table 3). Imports in March were up 11.9 percent compared to
March 1999, while exports were up 24.3 percent.
U.S. Surface Transportation Trade with Canada
U.S.Canada surface transportation trade totaled $31.0 billion
in March, down 34.2 percent compared to March 2008 (Table 4).
The value of imports carried by truck was 26.8 percent lower
in March 2009 compared to March 2008, while the value of exports
carried by truck was 25.1 percent lower during this period.
Michigan led all states in surface trade with Canada in March
with $3.2 billion (Table 5).
U.S. Surface Transportation Trade with Mexico
U.S.Mexico surface transportation trade totaled $20.0 billion
in March, down 15.1 percent compared to March 2008 (Table 6).
The value of imports carried by truck was 15.5 percent lower
in March 2009 than March 2008 while the value of exports carried
by truck was 6.4 percent lower.
Texas led all states in surface trade with Mexico in March with
$6.8 billion (Table 7).
The TransBorder Freight Data are a unique subset of official
U.S. foreign trade statistics released by the U.S. Census Bureau.
New data are tabulated monthly and historical data are not adjusted
for inflation. March TransBorder numbers include data received
by BTS as of May 12.

President Obama hit a home run with his
nomination of Judge Sonia Sotomayor to the Supreme Court -- and
not just because she's the "woman who saved baseball"
by ending the strike in 1995, nor simply because she would be
the first Latina ever to serve on the high court.
It was a home run because in her three-decade
career as a prosecutor, judge, private litigator and law professor,
she has time and again earned bipartisan praise as one of America's
finest legal minds. And it was the right choice because Judge
Sotomayor -- herself born and raised in a South Bronx housing
project -- has summed up the American dream in her own incredible
story and never once forgotten how the law affects our daily
lives.
Now her historic nomination goes to the
Senate. I know that process well, and I can tell you that the
debate of the coming weeks and months will be shaped by the public
response in the next few hours and days. It's critical that the
Senate and the public clearly see where the American people stand.

I've followed Judge Sotomayor's remarkable
journey for years. I voted for her when President George H.W.

Born to a Puerto Rican family, Sotomayor
grew up in a public housing project in the South Bronx. She was
an avid reader from an early age, and was first inspired to pursue

mother's belief in the power of education and her own relentless
work ethic, she excelled in school. She won a scholarship to
Princeton University, graduated summa cum laude, and then went
on to attend Yale Law School where she served as an editor of
the prestigious Yale Law Journal.
Like President Obama, Sotomayor passed
up many more lucrative opportunities after law school to put
her degree to work for the public good. She served as an Assistant
District Attorney in New York, tackling some of the hardest cases
facing the city, including robberies, assaults, murders, police
brutality, and child pornography. Her growing reputation for
fearlessness and legal brilliance prompted her first nomination
to the federal bench, and she's only continued to soar.
If confirmed, she would start with more
federal judicial experience than any Justice in a century, more
overall judicial experience than any Justice in 70 years, and
replace David Souter as the only Justice with firsthand experience
as a trial judge. She has participated in over 3,000 panel decisions
and authored roughly 400 opinions, expertly handling difficult
issues of constitutional law, complicated procedural matters,
and lawsuits involving complex business organizations.
In her years on the bench, Judge Sotomayor
has earned acclaim from legal scholars and experts from both
sides of the aisle for her intellectual toughness, her probing
oral questioning, and her ability to issue decisions that hold
both factual details and legal doctrines in equal measure. And
she's never failed to apply a steady, common-sense analysis of
how the law touches our daily lives.

AGRICULTURE SECRETARY VILSACK ANNOUNCES
INTERIM DIRECTIVE COVERING ROADLESS AREAS IN NATIONAL FORESTS
WASHINGTON, May 28, 2009 - Secretary of
Agriculture Tom Vilsack announced today that he is signing an
interim directive regarding inventoried roadless areas within
our National Forests and Grasslands.
"This interim directive will provide
consistency and clarity that will help protect our national forests
until a long-term roadless policy reflecting President Obama's
commitment is developed," said Vilsack.
The directive provides decision-making
authority to the Secretary over proposed forest management or
road construction projects in inventoried roadless areas.
The U.S. Forest Service, with jurisdiction
over the National Forests and Grasslands, makes decisions about
what projects can take place on those lands. In simultaneously
upholding and overturning the 2001 Clinton roadless rule, the
courts have created confusion and made it difficult for the U.S.
Forest Service to do its job. The directive will ensure that
USDA can carefully consider activities in these inventoried roadless
areas while long term roadless policy is developed and relevant
court cases move forward.
This interim directive changes procedural
requirements for Forest Service projects in inventoried roadless
areas. It does not prevent the Secretary from either approving
projects that he believes are in the interest of forest stewardship
or prohibiting projects he believes are not. The Secretary will
work closely with the US Forest Service to implement this interim
directive.
This interim directive does not affect
roadless areas on National Forest System lands in Idaho - Idaho
is exempt from this interim directive. Idaho developed its own
roadless rule through the Administrative Procedures Act. That
rule already prescribes how decisions with respect to forest
management and road building in roadless areas in Idaho are to
be made.
This interim directive will last for one
year and can be renewed for an additional year.

Microsoft has released security advisory
971778 indicating that it is
investigating public reports of a vulnerability in DirectX. This
vulnerability exists in the way Microsoft DirectShow handles
QuickTime
files and does not require Apple QuickTime to be installed on
the
system. By convincing a user to open a specially crafted QuickTime
media file, a remote attacker may be able to execute arbitrary
code.
Additionally, the advisory indicates that Microsoft Windows 2000
Service Pack 4, Windows XP, and Server 2003 are vulnerable.
US-CERT encourages users and administrators
to review Microsoft
security advisory 971778 and apply the workarounds provided in
the
document to help mitigate the risks.
US-CERT will provide additional information
as it becomes available.

HUD is accepting nominations for HMIS Achievement Awards. Outstanding
Achievements in HMIS include excellence in:
Increasing HMIS coverage
Improving data quality
Using HMIS data to directly improve service delivery or
local planning
Effective project management
Technological innovations
Training services or delivery
Other (must specify)
HMIS Achievement Awards will be presented to organizations that
have demonstrated outstanding achievements in HMIS during the
past year. Eligible nominees are: HMIS lead agencies and/or grantees,
CoCs, HUD field offices, or homeless providers. Self-nomination
is allowed.
Nominations should include a detailed description of why the
organization should be recognized including any measurable outcomes
achieved during the past year that resulted from the nominee's
actions. For example, excellence in HMIS coverage should include
the percentage of providers participating, how that rate has
improved over the past year, and the actions that led to the
change.
The HMIS Award selection committee will review the nominations
and choose the winners. In the event additional information is

WASHINGTON, DC - Today, President Barack Obama announced his
intent to nominate the following individuals for key administration
posts: Gordon Heddell, Inspector General, Department of Defense;
Ellen Murray, Assistant Secretary for Resources and Technology,
Department of Health and Human Services; Polly Trottenberg, Assistant
Secretary for Transportation Policy, Department of Transportation;
and James J. Markowsky, Assistant Secretary for Fossil Energy,
Department of Energy.
President Obama said, "Each of these individuals brings
extensive expertise in their chosen fields, and they are joining
my administration at a time when we face great challenges. Their
experience and knowledge of the issues will be important as we
move forward to put America on a path to prosperity and security.
I am grateful for their decision to serve."
President Obama announced his intent to nominate the following
individuals today:
James J. Markowsky, Nominee for Assistant Secretary for Fossil
Energy, Department of Energy
James J. Markowsky is currently a consultant in the energy and
electric power generation area, a member of the National Research
Council's Committee on America's Energy Future and a Member and
the Chair of the National Academy of Engineering's Section 6
- Electric Power/Energy Systems Committee. Previously, Markowsky
was the President of Research and Development Solution, LLC,
from 2004 - 2005 where he was involved in providing technical
support services, including R&D technology planning and analysis;
R&D project planning and analysis; and R&D operations
and process engineering, design and analysis to DOE's National
Energy Technology Laboratories. Before that he was executive
vice president of power generation, at American Electric Power
Service Corporation(AEP), where his responsibilities included
providing overall administrative, operational, and technical
direction for the AEP System's 21,000MWe coal and 800 MWe hydro
power generating facilities. Markowsky's career with AEP extended
from 1971 - 2000, and his other positions included; executive
vice president of engineering and construction, senior vice president
and chief engineer, vice president - mechanical engineering,
assistant vice president - mechanical engineering, AEP Sloan
Fellow, and section manager.
Markowsky received several awards including the Washington Coal
Club's Lifetime Achievement Award in 2002 and has 26 publications
in the area of power generation and fossil energy. He earned
degrees from: Massachusetts Institute of Technology - MS in Industrial
Management -1981; Cornell University - Ph.D. in 1971 and MS in
1970, both in Mechanical Engineering; and Pratt Institute - Bachelor
of Mechanical Engineering -1967.
Gordon Heddell, Nominee for Inspector General, Department of
Defense
Gordon S. Heddell has been Inspector General for the Department
of Labor since 2001 and Acting Inspector General at the Department
of Defense since 2008. Mr. Heddell began his Government service
in 1966 as an Army Chief Warrant Officer, Helicopter Pilot, serving
in both Korea and Taiwan during the Vietnam-era conflict. Following
his military tours of duty, Mr. Heddell served for 29 years in
the U.S. Secret Service, where he held various law enforcement,
management, and leadership positions.
He began his career with the Secret Service as a Special Agent,
progressing to Assistant Special Agent-in-Charge in 1982. Between
1982 and 1985, he served as Assistant Special Agent-in-Charge
in the Office of Administration, where he managed the day-to-day
administrative operations of the Secret Service, nationwide.
Mr. Heddell then served for two years as Assistant to the Special
Agent-in-Charge in the Washington field office where he directed
investigations of threats made against the President, Vice President,
and other high-ranking government officials in Washington, D.C.
Between 1987 and 1989, Mr. Heddell served as Assistant Special
Agent-in-Charge in the Philadelphia field office, where he supervised
complex criminal investigations relating to counterfeiting and
various types of financial fraud. From 1989 to 1991, Mr. Heddell
served as Deputy Assistant Director, where he managed inspections
of offices, as well as internal investigations into allegations
of wrongdoing by employees, worldwide. Mr. Heddell assumed an
executive position in the Vice Presidential Protective Division
in 1993, as Deputy Special Agent-in-Charge. In 1995, he was promoted
to Special Agent-in-Charge and served in that position until
1998. From 1998 until December 2000, Mr. Heddell served as Assistant
Director. In this executive position, he led the Secret Service's
Inspection and Internal Affairs programs, worldwide. Mr. Heddell
holds a Bachelor of Arts degree in Political Science from the
University of Missouri, a Master of Arts degree in Legal Studies
from the University of Illinois (formerly Sangamon State University),
and was a Woodrow Wilson Public Service Fellow while at the Secret
Service. He is a former member of the International Association
of Chiefs of Police and was the creator of the Secret Service's
mentoring program at two D.C. public schools.
Ellen Murray, Nominee for Assistant Secretary for Resources and
Technology, Department of Health and Human Services
Ellen Murray has served as Staff Director for the United States
Senate Appropriations Subcommittee on Labor, Health and Human
Services, Education and Related Agencies since 1999. In that
capacity, she oversees the annual $150 billion LHHS Appropriations
bill. Murray has extensive knowledge of the Department of Health
and Human Services budget. Prior to her tenure with the Senate,
she served in both the budget office and the Office of the General
Counsel at HHS. Previously, Murray served as an economist at
the Social Security Administration. She is a graduate of Trinity
College in Washington, DC with a degree in Economics and the
George Mason University School of Law.
Polly Trottenberg, Nominee for Assistant Secretary for Transportation
Policy, Department of Transportation
Polly Trottenberg serves as Executive Director of Building America's
Future, a national bipartisan coalition that supports U.S. infrastructure
investment and a more accountable, sustainable and performance-driven
national transportation policy. Building America's Future is
chaired by Governor Edward G. Rendell, Mayor Michael R. Bloomberg
and Governor Arnold Schwarzenegger and has a membership of elected
officials from across the U.S. Prior to joining Building America's
Future, Trottenberg served in the U.S. Senate for 12 years, most
recently as Deputy Chief of Staff and Legislative Director for
Senator Barbara Boxer, and worked extensively on transportation
policy.
She also served as Legislative Director for Senator Charles Schumer
and as Legislative Assistant for Transportation, Public Works
and Environment for the late Senator Daniel Patrick Moynihan.
Trottenberg previously worked at the Port Authority of New York
and New Jersey and the Massachusetts Port Authority on aviation
and transportation finance issues, and on the Joint Commerce
and Labor Committee of the Massachusetts State Senate. She received
her Master's in Public Policy from Harvard University, Kennedy
School of Government and her BA in American History from Columbia
University, Barnard College.

Secretary Salazar Announces Designation
of 22 New National Recreation Trails in 13 States
WASHINGTON Secretary of the Interior
Ken Salazar recently designated 22
trails in 13 states as newly recognized National Recreation Trails,
adding
more than 525 miles of trails to the National Trails System.
"From coast to coast, the National
Trails System helps connect American
families with the wonders of the outdoors," said Salazar.
"These new
National Recreation Trails, built through partnerships with local
communities and stakeholders, will create new opportunities for
fitness and
stewardship, while creating a lasting legacy for our children
and
grandchildren."
This announcement is timed to coincide
with the 17th annual celebration of
National Trails Day on Saturday, June 6, 2009. The theme for
this year,
Take In the Outdoors, encourages people of all ages
to get outside and
use trails for exercise and exploration. Thousands of trail enthusiasts
will participate in hikes, educational programs, bike rides,
volunteer
repair projects, festivals, paddle trips, and trail dedications
across the
country. A complete schedule of activities is available at

National Recreation Trails (NRTs) have
been a touchstone of the National
Trails System since the first designations in 1971. The NRTs
recognize
existing trails and trail systems that connect people to local
resources
and improve their quality of life.
NRTs link communities to recreational opportunities
on public lands and in
local parks across the Nation. These designations contribute
to A Decade
for the National Trails, 2008-2018, commemorating the 50th
anniversary of
the National Trails System in 2018.
Each of the new trails will receive a certificate
of designation, a letter
of congratulations from Secretary Salazar, and NRT trail markers.
These
trails join a network of more than 1,050 previously designated
trails that
total more than 12,500 miles.
The NRT program is jointly administered
by the National Park Service and
the USDA Forest Service in conjunction with a number of other
Federal and
nonprofit partners, notably American Trails, which hosts the
National
Recreation Trail website at www.americantrails.org/nationalrecreationtrails
.
For 2009, Interior Secretary Ken Salazar
has designated the following 22
trails as National Recreation Trails, listed by state:

The FDICs Center for Financial Research and the JFSR invite
submissions for the 9th Annual Fall Research Conference to be
held in Arlington, Virginia on Thursday, September 17, and Friday,
September 18, 2009. The on-going financial sector crisis has
focused attention on compensation and governance practices. It
has been alleged that compensation and governance systems reward
management for risk taking and short term profits and the size
and scope of corporate operations expanded at the expense of
shareholders and taxpayers. In response to incentives, the management
of many financial services firms pursued investment strategies
that proved to be unsustainable despite extensive resources devoted
to prudential oversight and financial stability monitoring. Recent
events highlight the need to examine the management incentives
and governance structures in place in the financial services
industry, including the supervisory agencies and central banks
that regulate and service the industry.
The 9th Annual FDIC-JFSR conference will provide a forum to discuss

symposium on Improving Assessment of the Default Risk of
Single-Family Mortgages to be held in Arlington, VA, on

The performance of single-family mortgages in the U.S. has deteriorated
sharply since mid-2005, revealing weaknesses in exiting methods
for predicting mortgage defaults and estimating default loss
severities. Events have shown there is need for improvement in
the data and models used to assess single-family mortgage default
risk and in the processes and controls surrounding models used
in the mortgage lending process. This symposium will provide
a forum to discuss the causes of recent experience and ways to
improve the assessment of single-family mortgages default risk,

FHFA intends to publish the papers presented at, and the proceedings
of, the symposium in fulfillment of this statutory requirement.
No submitted paper will be quoted or used without permission
of the author.

Commercial banks and savings institutions
insured by the Federal Deposit Insurance Corporation (FDIC) reported
net income of $7.6 billion in the first quarter of 2009, a decline
of $11.7 billion (60.8 percent) from the $19.3 billion that the
industry earned in the first quarter of 2008. Higher loan-loss
provisions, increased goodwill write-downs, and reduced income
from securitization activities all contributed to the year-over-year
earnings decline. Three out of five insured institutions reported
lower net income in the first quarter and one in five was unprofitable.
"The first quarter results are telling us that the banking
industry still faces tremendous challenges, and that going forward,
asset quality remains a major concern," said FDIC Chairman
Sheila C. Bair. "Banks are making good efforts to deal with
the challenges they're facing, but today's report says that we're
not out of the woods yet." She added, "As I see it,
we're now in the cleanup phase for the banking industry. It will
take some more time. But in the end, we'll have a stronger banking
industry that's better able to meet the demand for credit as
the economy recovers."
Insured institutions set aside $60.9 billion in provisions for
loan losses in the first quarter, an increase of $23.7 billion
(63.6 percent) over the first quarter of 2008. Expenses for goodwill
impairment and other intangible asset expenses totaled $7.2 billion,
up from $2.8 billion a year earlier. These negative factors outweighed
the positive effects of increased noninterest income (up $7.8
billion or 12.8 percent), higher net interest income (up $4.4
billion or 4.7 percent), and higher realized gains on securities
and other assets (up $1.9 billion). Twenty-one FDIC-insured institutions
failed during the first quarter, the largest number since the
fourth quarter in 1992. The FDIC's "Problem List" grew
during the quarter from 252 to 305 institutions, and total assets
of problem institutions increased from $159 billion to $220 billion.
The FDIC also noted that asset-quality indicators continue to
decline. Insured institutions charged off $37.8 billion in bad
loans in the first quarter, almost twice the $19.6 billion of
a year earlier. The amount of loans and leases that were noncurrent
(90 days or more past due or in nonaccrual status) rose by $59.2
billion during the quarter, and are $154.3 billion higher than
a year ago.
"Troubled loans continue to accumulate, and the costs associated
with impaired assets are weighing heavily on the industry's performance,"
Chairman Bair noted. "Nevertheless, compared to a year ago,
we see some positives. Net interest income is higher, and noninterest
revenue is up at larger banks, particularly trading revenues.
Realized gains on securities and other assets improved, too.
But these positive factors were outweighed by higher expenses
for bad loans and for goodwill impairment."
Financial results for the first quarter are contained in the
FDIC's latest Quarterly Banking Profile, which was released today.
Also among the major findings:
Tier 1 capital reached a record high. Tier 1 capital rose to
almost $70 billion, the largest quarterly increase ever reported
by the industry. However, much of the increase occurred at institutions
that received capital from the U.S. Treasury Department's Troubled
Asset Relief Program (TARP). A number of institutions also reduced
their dividends to support capital growth. Dividend payments
in the first quarter totaled $7.2 billion, about half the $14.0
billion insured institutions paid in the first quarter of 2008.
The FDIC noted that 97 percent of insured institutions were well-capitalized
by regulatory standards.
Total assets declined by $302 billion. Downsizing by a few large
banks caused total industry assets to fall by $302 billion (2.2
percent) during the first quarter. Two-thirds of all institutions
reported asset growth in the quarter, but reductions at eight
large banks caused the industry total to decline. Total loans
and leases fell by $159.6 billion (2.1 percent), while assets
in trading accounts declined by $144.5 billion (14.9 percent).
The FDIC's Deposit Insurance Fund (DIF) reserve ratio fell to
0.27 percent. Growth in insured deposits and a shrinking fund
balance caused the Deposit Insurance Fund's reserve ratio to
decline from 0.36 percent of insured deposits to 0.27 percent
in the first quarter. Insured deposits increased by $82.4 billion
(1.7 percent) during the quarter. The DIF balance declined from
$17.3 billion at the end of 2008 (amended from the originally
reported unaudited balance of $19 billion) to $13.0 billion on
March 31, 2009. However, the FDIC Board of Directors approved
an amended restoration plan in February that is designed to restore
the DIF reserve ratio to 1.15 percent within seven years. The
FDIC has already set aside $28 billion in reserve to cover projected
losses for the next 12 months. In addition, the FDIC will collect
more than $8 billion in premiums during the second quarter, including
$5.6 billion from the special assessment the FDIC Board approved
on May 22.
"Insured deposits increased 1.7 percent in the quarter --
some $82 billion -- and they are up by nine percent over the
last 12 months," Chairman Bair said. "This growth in
insured deposits is a vote of confidence from bank customers.
They obviously see the value of the FDIC guarantee."

National Archives Celebrates Homecoming
of Long-Lost Lincoln Letter -
TOMORROW
WHAT: A ceremony at which a donor will
present to the National
Archives an original letter written by Abraham Lincoln in 1863.
This
letter, in President Lincoln's own hand on Executive Mansion
letterhead, was originally part of the Records of the U.S. Treasury.
At
some point in time prior to when the records came to the National
Archives, half of the letter containing the substance of President
Lincoln's letter was torn from the volume and ended up in private
hands. The donor, who is a private collector, is giving this
letter to
the National Archives.
With the exception of the half that remained
in a volume at the
National Archives, the contents of the letter have not been available
to
scholars or the general public. This will be the first time that
the
letter will be available to the media.

President Obama Announces Over $467 Million
in Recovery Act Funding for Geothermal and Solar Energy Projects
WASHINGTON President Obama today announced over $467 million
from the American Reinvestment and Recovery Act to expand and
accelerate the development, deployment, and use of geothermal
and solar energy throughout the United States. The funding announced
today represents a substantial down payment that will help the
solar and geothermal industries overcome technical barriers,
demonstrate new technologies, and provide support for clean energy
jobs for years to come. Todays announcement supports the
Obama Administrations strategy to increase American economic
competiveness, while supporting jobs and moving toward a clean
energy economy.
We have a choice. We can remain the worlds leading
importer of oil, or we can become the worlds leading exporter
of clean energy, said President Obama. We can hand
over the jobs of the future to our competitors, or we can confront
what they have already recognized as the great opportunity of
our time: the nation that leads the world in creating new sources
of clean energy will be the nation that leads the 21st century
global economy. Thats the nation I want America to be.
"We have an ambitious agenda to put millions of people to
work by investing in clean energy technology like solar and geothermal
energy, Energy Secretary Steven Chu said. "These technologies
represent two pieces of a broad energy portfolio that will help
us aggressively fight climate change and renew our position as
a global leader in clean energy jobs.
Geothermal Energy
Geothermal energy is a clean source of renewable energy that
harnesses heat from the Earth for heating applications and electricity
generation; geothermal plants can operate around the clock to
provide significant uninterrupted base load electricity,
or the minimum amount a power utility must provide to its customers.
The Recovery Act makes a $350 million new investment in this
technology, dwarfing previous government commitments. Recovery
Act funding will support projects in four crucial areas: geothermal
demonstration projects; Enhanced Geothermal Systems (EGS) research
and development; innovative exploration techniques; and a National
Geothermal Data System, Resource Assessment and Classification
System.
Geothermal Demonstration Projects ($140 Million)
Funding will support demonstrations of cutting-edge technologies
to advance geothermal energy in new geographic areas, as well
as geothermal energy production from oil and natural gas fields,
geopressured fields, and low to moderate temperature geothermal
resources.
Enhanced Geothermal Systems Technology Research and Development
($80 Million)
Funding will support research of EGS technology to allow geothermal
power generation across the country. Conventional geothermal
energy systems must be located near easily-accessible geothermal
water resources, limiting its nationwide use. EGS makes use of
available heat resources through engineered reservoirs, which
can then be tapped to produce electricity. While the long-term
goal of EGS is to generate cost competitive clean electricity,
enabling research and development is needed to demonstrate the
technologys readiness in the near-term.
Innovative Exploration Techniques ($100 Million)
Funding will support projects that include exploration, siting,
drilling, and characterization of a series of exploration wells
utilizing innovative exploration techniques. Exploration of geothermal
energy resources can carry a high upfront risk. By investing
in and validating innovative exploration technologies and methods,
DOE can help reduce the level of upfront risk for the private
sector, allowing for increased investment and discovery of new
geothermal resources.
National Geothermal Data System, Resource Assessment, and Classification
System ($30 Million)
The long-term success of geothermal energy technologies depends
upon a detailed characterization of geothermal energy resources
nationwide. In 2008, the United States Geological Survey (USGS)
conducted an assessment of high temperature resource potential
in the Western United States. To fully leverage new low-temperature,
geopressured, co-production, and EGS technologies, DOE will support
a nationwide assessment of geothermal resources, working through
the USGS and other partners. Second, DOE will support the development
of a nationwide data system to make resource data available to
academia, researchers, and the private sector. Finally, DOE will
support the development of a geothermal resource classification
system for use in determining site potential.
Solar Energy
Solar energy is a rapidly expanding industry with a double-digit
annual growth rate in the United States. DOE is focused on supporting
the U.S. industrys scaling up of manufacturing, production,
and distribution so the technology can become cost competitive
with conventional sources of energy. DOE will provide $117.6
million in Recovery Act funding to accelerate widespread commercialization
of clean solar energy technologies across America. These activities
will leverage partnerships that include DOEs national laboratories,
universities, local government, and the private sector, to strengthen
the U.S. solar industry and make it a leader in international
markets.
Photovoltaic Technology Development ($51.5 Million)
DOE will expand investment in advanced photovoltaic concepts
and high impact technologies, with the aim of making solar energy
cost-competitive with conventional sources of electricity and
to strengthen the competitiveness and capabilities of domestic
manufacturers.
Solar Energy Deployment ($40.5 Million)
Projects in this area will focus on non-technical barriers to
solar energy deployment, including grid connection, market barriers
to solar energy adoption in cities, and the shortage of trained
solar energy installers. Combined with new technology development,
these deployment activities will help clear the path for wider
adoption of solar energy in residential, commercial, and municipal
environments.
Concentrating Solar Power Research and Development ($25.6 Million)
This work will focus on improving the reliability of concentrating
solar power technologies and enhancing the capabilities of DOE
National Laboratories to provide test and evaluation support
to the solar industry.

tax returns. U.S. District Court Judge Elizabeth A. Kovachevich

consented to the permanent injunction.

Many people concerned about their mortgage,
their job or their finances may be especially vulnerable to scams
and other costly "fixes" for their problems. The Federal
Deposit Insurance Corporation today issued a variety of tips
to help consumers be on guard financially in the current economy.
The advice was published in the Spring 2009 issue of FDIC Consumer
News, the agency's quarterly newsletter for consumers. Among
the topics covered:
Our latest tips for protecting against foreclosure rescue and
loan modification scams that target homeowners having difficulty
making their monthly mortgage payments;
A warning about frauds promising easy money -- supposedly from
the government's economic stimulus package or from lenders or
employers -- but ending with the victims losing money instead;
Examples of financial services that sound good but may come with
heavy fees, such as certain programs to cover overdrafts (bounced
checks or other withdrawals that would deplete a bank account)
and credit cards advertised to help repair a damaged credit history;
Potential risks and costs associated with blank "convenience
checks" that credit card companies send to their customers
offering a quick way to write a loan, pay bills or transfer another
debt to their account; and
Why an advertised interest rate on a short-term certificate of
deposit (CD) that is far above the competition could be a marketing
ploy by a non-bank company trying to sell uninsured, long-term
investments that may not be in the consumer's best interest.
The latest issue also notes that, on May 19, Congress extended
the temporary federal deposit insurance limit of $250,000 per
depositor through December 31, 2013. This is important news,
especially for people who have or plan to place long-term deposits,
because the insurance limit would have reverted back to $100,000
per depositor on January 1, 2010, if Congress did not authorize
the extension.
Other timely articles describe the Obama Administration's program
for lowering monthly mortgage payments through refinancing opportunities
and loan modifications; various tips on shopping for a CD; and
an FDIC legal opinion clarifying the deposit insurance coverage
of a pre-paid card if the bank holding the money for the card
fails.

WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement today marking
the 100th day since President Obama enacted the American Recovery
and Reinvestment Act:
Today marks the 100th day since the
enactment of the American Recovery and Reinvestment Act, a sweeping
economic package designed to turn our economy arounda process
that is just beginning. Congress and the Obama Administration
crafted it to grow the economy in both the short and long-terms
with tax cuts for 95% of Americans, strategic investments in
infrastructure and new energy, transportation, and healthcare
technologies, and direct help for those families hit hardest
by this recession.
After just 100 days, the effects of the Recovery Act are
already being felt. It has saved or created 150,000 jobs so far,
put Americans to work at more than 3,600 construction projects,
funded important technology from high-speed rail to plug-in hybrids,
and much more. Our economy still has a long way to go before
its recovery is completebut we have made significant progress,
and the Recovery Act is a key reason.

John C. Dugan Following Tour of West and South Dallas
DALLAS Following a tour of successful
community development projects in Dallas, Comptroller of the
Currency John C. Dugan issued the following statement:
Today, I visited two neighborhoods in which low- and moderate-income
homebuyers are being given a chance to own a home affordably.
One of these neighborhoods in South Dallas has been hit hard
by foreclosures and is being stabilized by the efforts of a local
community development corporation (CDC). The other community
in West Dallas is being revitalized by the development of homes
by non-profit organizations and another CDC to replace blighted
structures and a public housing project, which has since been
torn down.
I also heard from a successful small business owner who obtained
a loan through ACCION Texas, a non-profit microenterprise development
organization, which helped her create a language translation
business. ACCION received significant capitalization for its
loans from some of the national bankers who joined us on the
tour today, and who periodically refer borrowers who do not qualify
for bank lending programs to ACCION for technical assistance
and funding.
I also had the opportunity to visit small and medium-sized businesses
that are receiving financing from national banks and their lending
partners through the New Markets Tax Credit Program and other
government financing initiatives. The businesses I visited were
able to expand their operations and create new jobs because of
the financing they received through national banks and their
partners participating in these and other programs.
I continue to be impressed with how important bank community
partnerships, such as the Dallas Community Development Partnership,
are to the economic well-being and vitality of declining neighborhoods.
When national banks partner with community-based organizations
and local governments, major investments in housing and community
development are not only economically sound and profitable, but
are also successful in bringing jobs and homeownership back to
economically distressed communities. With incentives provided
by the Community Reinvestment Act and government programs, national
banks are able to provide marketable loans that create a sense
of renewed confidence in these communities.
Since assuming office in 2005, Comptroller Dugan has met with
community leaders from across the country and toured community
development projects in Pittsburgh, Chicago, New York, Washington,
D.C., Los Angeles, and Dallas.

2009 H1N1 Vaccine Development Activities
Overview
The newly emergent 2009 H1N1 influenza virus is a novel virus
with pandemic potential. Consistent with the National Strategy
for Pandemic Influenza, HHS is committing funds for the production
of pilot lots for clinical studies, as well as a bulk supply
of antigen and adjuvant for use in a potential vaccine for the
2009 H1N1 which will become a part of the national stockpile
of pre-pandemic influenza vaccines.
A vaccine is made from a virus or bacteria (referred to as an
antigen), which causes the human bodys immune system to
develop antibodies against a specific virus or bacteria so the
body can recognize and fight the virus or bacteria. Adjuvants
may be added to a vaccine to help generate a stronger immune
response so less vaccine is needed for the body to recognize
and fight a virus or bacteria.

NEW CIO JOINS THE ODNI
Ms. Priscilla Guthrie began work at the
Office of the Director of National Intelligence (ODNI) this week
as Associate Director of National Intelligence and Intelligence
Community Chief Information Officer (CIO). Guthrie, a former
Deputy CIO at the Department of Defense, will help lead the Intelligence
Communitys (IC) strategy to strengthen sharing, integration
and management of information across 16 intelligence agencies.
Priscillas skill in IT and
background in management of a large organization well qualify
her to further advance our information-sharing goals, said
Director of National Intelligence Dennis C. Blair. Her
prior experience in information management issues unique to national
security brings additional strength to this challenge. I look
forward to working closely with her and to her contributions
to the Intelligence Community.
The CIOs office is responsible for
establishing common information technology standards across the
Intelligence Community and for directing and managing all IT
related procurement for the IC. The CIO is also tasked with developing
IT architecture to support information sharing policies and objectives
throughout the Intelligence Community.
Before joining the ODNI, Guthrie was the
Director of the Information Technology and Systems Division of
the Institute for Defense Analyses, a non-profit corporation
that administers three federally funded research and development
centers to provide objective analyses of national security issues.
From 2001 to 2006, Guthrie served as Deputy
Assistant Secretary of Defense and Deputy Chief Information Officer
at the Department of Defense where she was responsible for information
support to deployed forces. Prior to her position at the Pentagon,
Guthrie was a Vice President at TRW, Inc., where she established
and led a small, global unit responsible for driving new IT technology
into the companys business.
Guthrie was nominated to this position
by President Obama on March 20, 2009, and confirmed by the United
States Senate on May 21, 2009. She holds a B.S. from Pennsylvania
State University and an M.B.A. from Marymount College.

FRED P. HOCHBERG SWORN-IN AS THE NEW PRESIDENT OF
EXPORT-IMPORT BANK OF THE UNITED STATES
WASHINGTON, DC --- Fred P. Hochberg has been sworn-in as the
23rd president of the Export-Import Bank of the United States
(Ex-Im Bank), the official export credit agency of the United
States. In this capacity, Hochberg serves as chairman of the
board.
President Barack Obama nominated Hochberg to the position on
April 20, 2009. The United States Senate confirmed his nomination
on May 14, 2009 for a term ending on January 20, 2013.
"I want Ex-Im Bank to be an organization known for its embrace
of innovation, an organization that takes prudent risks and provides
exceptional service to its customers," Hochberg told staff
following an informal swearing-in ceremony. "American exporters
and the workers they employ need and deserve our best efforts
to help keep export sales flowing to foreign buyers, especially
during these challenging economic times."
Hochberg has more than 30 years of experience in business, government
and philanthropy. From 2004 to 2008 he was dean of Milano The
New School for Management and Urban Policy. From 1998 through
2001 he served as deputy, then acting administrator of the Small
Business Administration (SBA), where he helped to lead an enhancement
of customer service and substantially increased lending to minority
and women small-business owners.
Before joining the Clinton administration, Hochberg was president
and chief operating officer of the Lillian Vernon Corporation,
where he led the transformation of a small, family mail order
company into a publicly traded, highly successful direct marketing
corporation.
Hochberg said, in joining Ex-Im Bank, that the Bank plays a key
role in helping U.S. exporters overcome financing problems growing
out of the current economic crisis. The Bank's financing helps
create and sustain the jobs of U.S. export workers. He said he
will work to open more markets to U.S. exports.
Hochberg is dedicated to community service and philanthropic
involvement in civil rights, education and the arts. He recently
sat on the boards of the Citizens Budget Commission, FINCA International
Micro Finance, and the Howard Gilman Foundation, and has served
as an appointed representative to the New York State Financial
Control Board. Hochberg also served on the Board of Commissioners
of the Port Authority of New York and New Jersey, having been
appointed to the position in 2008 by Governor David A. Paterson.
A native of the greater New York metropolitan area, Hochberg
received a Bachelor of Arts from New York University and a Masters
of Business Administration from Columbia University.
Ex-Im Bank is the official export-credit agency of the United
States. The independent, self-sustaining federal agency, now
in its 75th year, helps create and maintain U.S. jobs by financing
the sale of U.S. exports, primarily to emerging markets throughout
the world, by providing loan guarantees, export-credit insurance
and direct loans. In fiscal year 2008, Ex-Im Bank authorized
$14.4 billion in financing to support an estimated $19.6 billion
of U.S. exports worldwide. Eighty-six percent of nearly 2,328
transactions directly benefited small-business exporters.

FDA announces the availability of a new
medical product promotion draft guidance
· On May 27, 2009, FDA announced the availability of a
draft guidance for industry titled Presenting Risk Information
in Prescription Drug and Medical Device Promotion (the Federal
Register notice announcing the availability of the guidance is
available at: http://edocket.access.gpo.gov/2009/pdf/E9-12255.pdf;
the draft guidance can be viewed online at: http://www.fda.gov/cder/guidance/7427dft.pdf)
· This guidance responds to stakeholder requests for specific
guidance on how FDA evaluates prescription drug and device promotional
pieces to determine whether they adequately present risk information.
· The guidance describes and discusses the factors FDA
considers when evaluating the disclosure of risk information
in prescription drug advertisements (ads), restricted device
ads, and prescription drug and device promotional labeling directed
to both consumer and healthcare professional audiences.
· The draft guidance discusses both content and format
factors that are relevant to FDAs determination of whether
promotional materials adequately present risk information.
· Numerous examples are included of what does, and does
not, constitute an adequate presentation of risk information
for promotional pieces.
The guidance is intended to help regulated industry gain a better
understanding of what they should consider as they develop the
content and format of their promotional communications.
