FDIC Adopts Final Rule Imposing a Special
Assessment on Insured Depository Institutions
Move Designed to Maintain Public Confidence and Ensure That the
Deposit Insurance Fund Remains Positive

The Board of Directors of the Federal Deposit
Insurance Corporation today voted to levy a special assessment
on insured institutions as part of the agency's efforts to rebuild
the Deposit Insurance Fund (DIF) and help maintain public confidence
in the banking system. The final rule establishes a special assessment
of five basis points on each FDIC-insured depository institution's
assets, minus its Tier 1 capital, as of June 30, 2009. The special
assessment will be collected September 30, 2009.
"Assessments are a significant expense, particularly during
a financial crisis and recession when bank earnings are under
pressure," said FDIC Chairman Sheila C. Bair. "We recognize
that assessments reduce the funds that banks can lend in their
communities to help revitalize the economy. On the other hand,
deposit insurance provides a benefit for which banks have always
paid. And backed by deposit insurance, deposit funding costs
have fallen significantly, approaching historic lows. Indeed,
the unique ability of banks to access low-cost, government-backed
deposits has contributed to the recent increased profitability
of many banks. For these reasons, we have tried to strike the
right balance between keeping the assessment low enough so that
it does not unduly burden lending capacity with our longstanding
commitment to cover all projected costs through industry assessments,
not taxpayer borrowing."
With the special assessment adopted today, the FDIC projects
that the DIF will remain low but positive through 2009 and then
begin to rise in 2010. However, Chairman Bair also cautioned
that given the inherent uncertainty in these projections and
the importance of maintaining a positive fund balance and reserve
ratio, "it is probable that an additional special assessment
will be necessary in the fourth quarter, although the amount
of such a special assessment is uncertain." Chairman Bair
also stressed that FDIC-insured institutions "should not
be penalized for getting us through" the current financial
crisis. For that reason, she said the FDIC will be instructing
its examiners to ensure that they will not downgrade an institution's
supervisory CAMELS ratings because of the effect of the special
assessment.
The special assessment will be assessed against assets minus
Tier 1 capital rather than domestic deposits, but the assessment
will be capped at 10 basis points of an institution's domestic
deposits so that no institution would pay an amount higher than
they would have paid under the interim rule. "This hybrid
approach -- using assets minus Tier 1 capital as the assessment
base but with a cap based on domestic deposits -- will shift
the allocation of the special assessment somewhat towards banks
that rely more on non-deposit funding, which large banks tend
to do," Chairman Bair explained. She added, "Congress
has clearly left to the FDIC the ability to define our assessment
base. And we specifically requested -- and received -- comment
on the issue of whether assets should be used for the special
assessment. After careful consideration of competing views, I
believe today's rule is equitable and provides the appropriate
balancing of competing interests" in terms of fairness to
all insured institutions.

Summary: On May 20, 2009, President Barack
Obama signed the Helping Families Save Their Homes Act, which
extends the temporary increase in the standard maximum deposit
insurance amount (SMDIA) to $250,000 per depositor through December
31, 2013. This extension of the temporary $250,000 coverage limit
became effective immediately upon the President's signature.
The legislation provides that the SMDIA will return to $100,000
on January 1, 2014.

I am a single parent and have lost my teaching
job effective in June. I'm scared to death because my son has
a serious pre-existing condition (Neurofibromatosis) and can't
go without medical insurance. However, my employer has just informed
me that continuing my family coverage under COBRA will cost $1,400.00
a month! That's a house payment for me. Or three times my car
payment! How can I keep my family covered without going under
financially?

And it looks like we can't afford to have it either. We are stuck.

Senate Confirms DOE Nominees Daniel Poneman,
David Sandalow,
Kristina Johnson, Steve Koonin, Scott Harris, and Ines Triay
WASHINGTON, D.C. -- This week, the Senate confirmed six DOE nominees,
including Deputy Secretary Daniel Poneman, Under Secretary for
Energy Kristina Johnson, and Under Secretary for Science Steven
Koonin. Also confirmed this week were Scott Blake Harris, General
Counsel; David Sandalow, Assistant Secretary for Policy and International
Affairs; and Ines Triay, Assistant Secretary for Environmental
Management.
Secretary Chu said, We are fortunate to have such talented
and dedicated leaders joining our team at the Department of Energy.
The Department has set aggressive goals for creating green jobs,
addressing our climate crisis and putting the country on a path
to energy independence, and these confirmations are an important
step toward reaching those goals.
Additional information is as follows:
Since 2001, Daniel B. Poneman was a Principal of The Scowcroft
Group, an international business advisory firm based in Washington,
D.C. Prior to that he was a partner in the law firm of Hogan
& Hartson. From 1993 through 1996, Poneman served as Special
Assistant to the President and Senior Director for Nonproliferation
and Export Controls at the National Security Council. He joined
the NSC staff in 1990 as Director of Defense Policy and Arms
Control, after serving as a White House Fellow in the Department
of Energy. Poneman coauthored Going Critical: The First North
Korean Nuclear Crisis, which received the 2005 Douglas Dillon
Award for Distinguished Writing on American Diplomacy. He received
A.B. and J.D. degrees with honors from Harvard, and an M.Litt.
in politics from Oxford University.
Kristina M. Johnson was previously the provost and senior vice
president for academic affairs of Johns Hopkins University. Prior
to that, Johnson served as the Dean of Duke University's Pratt
School of Engineering from 1999-2007 where she helped to set
up interdisciplinary efforts in photonics, bioengineering and
biologically inspired materials, and energy and the environment.
Before that she was on the faculty of the University of Colorado,
Boulder from 1985-1999 where she led an NSF Engineering Research
Center and involved engineers, mathematicians, physicists, chemists
and psychologists in working to make computers faster and better
connected. Johnson is an electrical engineer with more than 129
US and foreign patents or patents pending.
Dr. Steven E. Koonin was previously Chief Scientist for BP, plc,
where he was responsible for guiding the company's long-range
technology strategy, particularly in alternative and renewable
energy sources. Koonin joined BP in 2004 following a 29-year
career at the California Institute of Technology as a Professor
of Theoretical Physics, including a 9-year term as the Institute's
Provost. He has served on numerous advisory bodies for the National
Science Foundation, the Department of Defense, and the Department
of Energy and its various national laboratories. Koonin's research
interests have included theoretical and computational physics,
as well as global environmental science. He did his undergraduate
work at Caltech and has a PhD from MIT.
Scott Blake Harris was Managing Partner of Harris, Wiltshire
& Grannis LLP, a Washington, D.C. law firm with nationally
known telecommunications, litigation, and appellate practices.
From 1994 to 1996, Mr. Harris served as the first chief of the
International Bureau at the Federal Communications Commission.
Before joining the Commission, he was Chief Counsel for Export
Administration at the U.S. Department of Commerce. Prior to government
service, Mr. Harris was a partner at the law firm of Williams
& Connolly. Mr. Harris is a magna cum laude graduate of both
Brown University and Harvard Law School.
David Sandalow was most recently Energy & Environment Scholar
and a senior fellow in the Foreign Policy Studies Program of
the Brookings Institution. He is the author of Freedom from Oil
(2008) and has written widely on energy and environmental policy.
Previously, Sandalow served as Assistant Secretary of State for
Oceans, Environment & Science; Senior Director for Environmental
Affairs, National Security Council; Associate Director for the
Global Environment, White House Council on Environmental Quality,
and Executive Vice President, World Wildlife Fund-US. Sandalow
is a graduate of Yale College (BA Philosophy) and the University
of Michigan Law School (JD).
Dr. Ines Triay spent 14 years at the Los Alamos National Laboratory
in New Mexico before moving to the Department of Energy, first
in the Carlsbad field office and then in the Washington, DC headquarters.
In 2005, Triay became the Chief Operating Officer for Environmental
Management, and she was named to the top career position there
in October, 2007. In this capacity, she served as the acting
Assistant Secretary for Environmental Management since November,
2008. Triay was born in Cuba and came to the US when she was
3 years old. Raised in Puerto Rico, she earned her Ph.D. in chemistry
from the University of Miami, Florida and conducted her post-doctoral

Cyber Security Tip ST04-002 Choosing
and Protecting Passwords
Passwords are a common form of authentication
and are often the only barrier
between a user and your personal information. There are several
programs
attackers can use to help guess or "crack" passwords,
but by choosing good
passwords and keeping them confidential, you can make it more
difficult for
an unauthorized person to access your information.
Why do you need a password?
Think about the number of personal identification
numbers (PINs), passwords,
or passphrases you use every day: getting money from the ATM
or using your
debit card in a store, logging on to your computer or email,
signing in to
an online bank account or shopping cart...the list seems to just
keep
getting longer. Keeping track of all of the number, letter, and
word
combinations may be frustrating at times, and maybe you've wondered
if all
of the fuss is worth it. After all, what attacker cares about
your personal
email account, right? Or why would someone bother with your practically
empty bank account when there are others with much more money?
Often, an
attack is not specifically about your account but about using
the access to
your information to launch a larger attack. And while having
someone gain
access to your personal email might not seem like much more than
an
inconvenience and threat to your privacy, think of the implications
of an
attacker gaining access to your social security number or your
medical
records.
One of the best ways to protect information
or physical property is to
ensure that only authorized people have access to it. Verifying
that someone
is the person they claim to be is the next step, and this authentication
process is even more important, and more difficult, in the cyber
world.
Passwords are the most common means of authentication, but if
you don't
choose good passwords or keep them confidential, they're almost
as
ineffective as not having any password at all. Many systems and
services
have been successfully broken into due to the use of insecure
and inadequate
passwords, and some viruses and worms have exploited systems
by guessing
weak passwords.
How do you choose a good password?
Most people use passwords that are based
on personal information and are
easy to remember. However, that also makes it easier for an attacker
to
guess or "crack" them. Consider a four-digit PIN number.
Is yours a
combination of the month, day, or year of your birthday? Or the
last four
digits of your social security number? Or your address or phone
number?
Think about how easily it is to find this information out about
somebody.
What about your email passwordis it a word that can be
found in the
dictionary? If so, it may be susceptible to "dictionary"
attacks, which
attempt to guess passwords based on words in the dictionary.
Although intentionally misspelling a word
("daytt" instead of "date") may
offer some protection against dictionary attacks, an even better
method is
to rely on a series of words and use memory techniques, or mnemonics,
to
help you remember how to decode it. For example, instead of the
password
"hoops," use "IlTpbb" for "[I] [l]ike
[T]o [p]lay [b]asket[b]all." Using
both lowercase and capital letters adds another layer of obscurity.
Your
best defense, though, is to use a combination of numbers, special
characters, and both lowercase and capital letters. Change the
same example
we used above to "Il!2pBb." and see how much more complicated
it has become
just by adding numbers and special characters.
Longer passwords are more secure than shorter
ones because there are more
characters to guess, so consider using passphrases when you can.
For
example, "This passwd is 4 my email!" would be a strong
password because it
has many characters and includes lowercase and capital letters,
numbers, and
special characters. You may need to try different variations
of a
passphrasemany applications limit the length of passwords,
and some do not
accept spaces. Avoid common phrases, famous quotations, and song
lyrics.
Don't assume that now that you've developed
a strong password you should use
it for every system or program you log into. If an attacker does
guess it,
he would have access to all of your accounts. You should use
these
techniques to develop unique passwords for each of your accounts.
Here is a review of tactics to use when
choosing a password:
* Don't use passwords that are based on personal information
that can be
easily accessed or guessed.
* Don't use words that can be found in any dictionary of any
language.
* Develop a mnemonic for remembering complex passwords.
* Use both lowercase and capital letters.
* Use a combination of letters, numbers, and special characters.
* Use passphrases when you can.
* Use different passwords on different systems.
How can you protect your password?
Now that you've chosen a password that's
difficult to guess, you have to
make sure not to leave it someplace for people to find. Writing
it down and
leaving it in your desk, next to your computer, or, worse, taped
to your
computer, is just making it easy for someone who has physical
access to your
office. Don't tell anyone your passwords, and watch for attackers
trying to
trick you through phone calls or email messages requesting that
you reveal
your passwords (see Avoiding Social Engineering and Phishing
Attacks for
more information).
If your internet service provider (ISP)
offers choices of authentication
systems, look for ones that use Kerberos, challenge/response,
or public key
encryption rather than simple passwords (see Understanding ISPs
and
Supplementing Passwords for more information). Consider challenging
service
providers that only use passwords to adopt more secure methods.
Also, many programs offer the option of
"remembering" your password, but
these programs have varying degrees of security protecting that
information.
Some programs, such as email clients, store the information in
clear text in
a file on your computer. This means that anyone with access to
your computer
can discover all of your passwords and can gain access to your
information.
For this reason, always remember to log out when you are using
a public
computer (at the library, an internet cafe, or even a shared
computer at
your office). Other programs, such as Apple's Keychain and Palm's
Secure
Desktop, use strong encryption to protect the information. These
types of
programs may be viable options for managing your passwords if
you find you
have too many to remember.
There's no guarantee that these techniques
will prevent an attacker from
learning your password, but they will make it more difficult.

DNI BLAIR SELECTS CHRISTOPHER KOJM AS CHAIRMAN
OF THE NATIONAL INTELLIGENCE COUNCIL (NIC)
Today, the Director of National Intelligence (DNI) Dennis C.
Blair announced that he has selected Christopher Kojm to be the
next Chairman of the National Intelligence Council (NIC). As
Chairman of the NIC and advisor to the DNI, Kojm will be responsible
for overseeing the analysis and production of coordinated Intelligence
Community products, including National Intelligence Estimates.
Chris is a highly respected national security expert with
a deep background in intelligence and foreign policy, Blair
said. He understands how important quality intelligence
is to the policy making process, and he understands the critical
need for intelligence to be timely, relevant and objective. He
will be an outstanding NIC Chairman.
Kojm is well known for his work as the Deputy Director of the
9/11 Commission working with Chairman Thomas H. Kean and Vice
Chair Lee H. Hamilton. The result of that panel, formally known
as the National Commission on Terrorist Attacks Upon the
United States culminated in a final report that formed
the basis of significant intelligence reforms in 2004. Kojm also
later served as a Senior Advisor to another prominent commission
the Iraq Study Group which was co-chaired by former
Secretary James A. Baker III and former Rep. Lee H. Hamilton.
From 1998-2003, Kojm served as the Deputy Assistant Secretary
of State for Intelligence Policy and Coordination at the Bureau
of Intelligence and Research at the Department of State. In that
role, Kojm was responsible for the daily editorial review of
intelligence assessments, coordination with IC counterparts,
articulation of State Department interests and requirements.
Most recently, Kojm served as a Professor of International Affairs
Practice and Director of the U.S. Foreign Policy Summer Program
at the Elliott School of International Affairs at George Washington
University. He also served as the Director of the Elliott Schools
Master of International Policy and Practice (mid-career) program.
Kojm has also served as a visiting Professor at Princeton University.
From 1984-1998, Kojm was a staff member on the House Committee
on Foreign Affairs under former Chair and Ranking Member Lee
H. Hamilton.
From 1979-1984 he was a writer and editor at the Foreign Policy
Association in New York City.
Kojm received his Bachelors Degree from Harvard College
and his Masters Degree from the Woodrow Wilson School of Public
and International Affairs at Princeton University.

NSTAC has a long and distinguished history of partnering with
the federal government. It includes more than 25 years, five
different presidential administrations, and so it becomes one

but in the areas that NSTAC is dealing with, there's no other
way to get the work done because these areas are divided between
the public sector and the private sector. So we have to have
some sort of way on a real-time basis to unite our efforts.
