response to the novel H1N1 Flu outbreak. As of May 6, 642 human
infections with novel H1N1 flu have been confirmed in 41 states
in the United States. As testing continues in many other states,
more cases and more states are expected to be added. There have
been two confirmed deaths in the US associated with the H1N1
virus to date.

has approved Creon (pancrelipase), a pancreatic enzyme replacement
product designed to help patients with cystic fibrosis and others
with exocrine pancreatic insufficiency (EPI) digest and absorb
nutrients from foods. Creon is the first FDA-approved delayed-release
pancreatic enzyme replacement product to be marketed in the United
States as a result of the agency?s unapproved drugs initiative.

Hoyer Statement on the Presidents
Budget
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement today after
President Obama announced his full budget proposal, including
$17 billion in spending cuts:
The President made clear when he took office that his Administration
would be focused on restoring responsibility to all parts of
government, including the budget. The budget proposal set forth
today makes good on that pledge by cutting nearly $17 billion
through the reduction and termination of programs found to be
duplicative or ineffective. These cuts build on action already
taken by Congress when we passed a budget that will cut our nations
deficit by nearly two-thirds in the coming years. President Obama
also reiterated his commitment to enacting statutory pay-as-you-go
budget rules, which helped turn deficits to surpluses in the
1990s, and I expect to work with him to bring legislation to
the House Floor soon.
I applaud the President for making the tough choices necessary
to start getting our nations budget back to balance. While
Democrats inherited a broken budget and record deficits and debt,
we are clearly taking action to turn these numbers around. Congress
will work closely with the Administration to review the Presidents
proposed cuts and find additional savings in the budget as we
move forward with our appropriations process this summer.

HELSINKI COMMISSION TO HOLD HEARING
ON KAZAKHSTAN
(Washington, D.C.) Senator Benjamin L.
Cardin (D-MD), Chairman of the Commission on Security and Cooperation
in Europe (U.S. Helsinki Commission) and Co-Chairman Congressman
Alcee L. Hastings (D-FL), will hold a hearing entitled, Approaching
the OSCE Chairmanship: Kazakhstan 2010. The hearing will
be held on Tuesday, May 12, 2009, at 10:00 a.m. in SVC 208/209
of the Capitol Visitor Center.
This is the third in a series of Helsinki
Commission hearings on Kazakhstan, which will become the OSCE
Chairman in Office next year. These hearings have examined Kazakhstans
record on human rights and democratization in light of reforms
pledged by Foreign Minister Tazhin at the OSCE Ministerial in
Madrid in November 2007, which were critical in gaining support
by the United States and other countries for Kazakhstans
bid. This hearing will continue that examination, as January
2010 rapidly approaches.

Hoyer Statement on Mortgage Reform and
Anti-Predatory Lending Act
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement today in
support of the Mortgage Reform and Anti-Predatory Lending Act,
which will prevent some of the dangerous practices that contributed
to the increase in foreclosures during the economic crisis. The
House passed this bill this afternoon with a vote of 300 to 114.
It is well-known by now that our economic crisis began
as a foreclosure crisis. It began with homeowners across America
signing up for mortgages they could not afford. And even though
few of us knew it at the time, much of our financial system was
riding on their ability to pay those mortgages off. When it became
clear that many of them could not, the economic chain reaction
affected every community in America. For a family, a foreclosure
is traumatic enoughbut we have also learned from this crisis
that foreclosures can have wide public consequences, as well.
Of those who applied for mortgages they could not possibly
pay back, some were simply irresponsible. But many others were
hardworking, responsible homeowners who fell victim to predatory
lending. Unfortunately, incentives in our financial system made
that predatory lending possible: unscrupulous mortgage brokers
were not required to provide sufficient information to homeowners,
and those who then sold the mortgages had little reason to see
that they were sound.
This bill goes a long way toward correcting those flaws,
protecting future homeowners, and cracking down on predatory
lending. It helps consumers get full informationthe information
they need to decide wisely on what is one of the biggest financial
commitments of their lives. It prevents lenders from steering
borrowers into higher-cost loans and bans yield spread premiums
and other compensatory incentives that lead brokers to push those
loans on borrowers. It also establishes national standards for
the protection of borrowers and ensures that those who entrap
consumers in predatory loans are liable for adjusting the loans
terms and paying the borrowers costs, including attorneys
fees.
Finally, this bill requires those who securitize loans
to third parties to put skin in the game and retain
interest in at least 5% of the credit risk of each loan they
sell or transfer. This provision will ensure that, at every link
of the chain, there is an interest in seeing that the loan is
repaid and that the homeowner does not go into foreclosure.
This is a strong, carefully deliberated response to the
foreclosure crisis, one that rules out many of the unscrupulous
practices that harmed so many responsible familiesand helped
put an entire economy at risk. I believe that if these provisions
had been in place 10 years ago, the foreclosure crisis might
have been averted. We cannot turn back time. But we can learnand
if we have learned anything, it is how much we need legislation
like this.

HUD FY2010 Budget Shifts Focus to Responsibility,
Effectiveness, and Transparency
(Washington, DC)- U.S. Housing and Urban
Development Secretary Shaun Donovan today unveiled the Department's
fiscal year 2010 budget, which focuses on responsibility, effectiveness
and transparency. The proposed 2010 budget exercises strong fiscal
discipline, consolidating or eliminating 27 programs and activities,
and investing in initiatives to increase transparency and accountability.
"We are cutting or consolidating programs
that don't work and instead, investing in programs that do work,"
said Secretary Donovan. "The HUD budget will put in place
systemic reform and policy innovation, and harness private sector
capital and talent as well as new kinds of partnership and collaboration
to respond to the nation's housing crisis, address new national
priorities, and change the way HUD does business."
The budget will allow HUD to effectively
respond to the housing crisis through new efforts to strengthen
FHA, curb mortgage abuse and predatory practices, and increase
counseling for homeowners at risk of foreclosure. Importantly,
HUD will not be asking taxpayers to support FHA's single family
program in the 2010 budget. The budget will also help HUD shape
new markets and methods in the production and preservation of
affordable housing, the "greening" of residential housing,
the regeneration of high poverty neighborhoods and the promotion
of sustainable growth.
Highlights from HUD's FY2010 Budget include:
FHA's single family program will generate
sufficient revenues from new insurance premiums without requiring
any taxpayer assistance. Meanwhile investments in FHA will help
cut fraud and abuse.
Enhanced investments in technology, staffing and training will
ensure the safety and soundness of FHA, enabling it to cope with
the rising volume of mortgage business, detect fraud, and monitor
the practices of lenders and appraisers.
Expanded funding in fair housing and FHA will also enhance the
Department's ability to curb mortgage abuse and lending discrimination
and provide pre- and post-purchase counseling to vulnerable homeowners.
The budget will make targeted investments to help rebuild the
economy through reinvigorating housing construction for low-
and moderate-income families by infusing the Affordable Housing
Trust with $1 billion in capital.
A new $250 million Choice Neighborhoods Initiative will build
on the lessons of HOPE VI and revitalize high poverty neighborhoods
through transformative investments in distressed public and assisted
housing and closer linkages with school reform and early childhood
interventions.
To address those families struggling during the economic crisis,
the budget will provide targeted increased funding for Section
8 tenant based rental vouchers, enabling HUD to assist more families
than ever before.
The budget couples a $550 million increase in funding for the
Community Development Block Grant program, reflecting President
Obama's pledge to fully fund the program, with a call for updating
a formula that is more than thirty years old and new performance
accountability.
The budget also makes targeted investments in energy innovation
to contribute to our nation's long term economic growth and recovery,
including:
A $25 million Rural Innovation Fund to test and rapidly disseminate
innovative efforts to revitalize rural communities and a $25
million University Community Fund, which consolidates current
programs to leverage the critical role of higher educational
institutions in urban and rural communities.
A $100 million Energy Innovation Fund to spur private sector
investment in the energy efficiency of the Nation's housing stock.
A $150 million new Sustainable Communities Initiative to spur
a new generation of metropolitan and rural efforts to integrate
transportation, housing and land use planning and decisions in
a way that maximize choices for residents and businesses, lowers
transportation costs, saves energy and improves quality of life.
A new Transformation Initiative will generate programmatic savings
through rigorous evaluation and technology investments.
"We went line by line, to see where
we could cut spending in order to invest in effective programs
that contribute to our nation's long term economic growth and
recovery," said Secretary Donovan. "This budget addresses
the nation's current housing crisis by finding savings and making
targeted investments to help grow the economy and keep people
in their homes. I look forward to the consideration and approval
of this budget in Congress."

results of the Capital Assessment Program.
Chairman Bair said: "I want to commend the Federal Reserve
for leading the stress assessment exercise and believe that this
effort will serve to strengthen the capital positions of our
largest financial institutions. A well-capitalized banking system
instills market confidence and assures economic growth and development.
In addition, bank funding remains stable because insured depositors
continue to be fully protected by the full faith and credit guarantee
of the Federal Deposit Insurance Corporation.

Hoyer Statement on Floor Schedule for
the Supplemental Appropriations Bill
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement today after
the House Appropriations Committee passed the 2009 supplemental
appropriations bill by voice vote:
I commend Chairman Obey for completing work on the Presidents
supplemental request for 2009 quickly. I will bring the supplemental
to the House Floor for a vote next week so that we can send a
bill to the President for his signature as soon as possible.
The supplemental contains critical funds for Iraq, Afghanistan,
Pakistan, and pandemic flu. President Obama inherited a difficult
situation in the Middle East, and this supplemental provides
the funding needed to begin winding down operations in Iraq and
shifting resources to Afghanistan and Pakistan, where they are
desperately needed. The supplemental also requires a report on
five performance assessment measures so that we can ensure that
taxpayer dollars are being used wisely in Afghanistan and Pakistan.
I expect this bill to receive bipartisan support when it comes
to the Floor next week.

URGES LEADERS OF AFGHANISTAN AND PAKISTAN TO SEIZE HISTORIC OPPORTUNITY
TO WORK TOGETHER
(Washington, DC) U.S. Senator Benjamin
L. Cardin, Chairman of the U.S. Helsinki Commission and a member
of the Senate Foreign Relations Committee (SFRC), released the
following statement today after he and other members of the SFRC
met with Afghan President Hamid Karzai and Pakistani President
Asif Ali Zardari.
Todays discussions reinforced
the many positive signs that the Afghan and Pakistani governments
are prepared to work with the United States in the fight against
extremists that threaten Pakistan and Afghanistan, and, indeed,
threaten us all. I was encouraged to see the leaders of both
of these countries together in Washington for their meetings
with the Congress and President Obama. This partnership is essential
to successfully disrupting and defeating terrorist elements that
respect no borders when choosing a target or a safe haven.
We stand at a moment of historic
opportunity for progress that reflects the commitment of President
Karzai and President Zardari to advance measures that enhance
the security and stability for their own citizens and the entire
region. When I was in Islamabad last year and met with their
leadership, we concurred on the need to confront terror and tyranny
together and work to ensure peace and prosperity for our own
people and the citizens of the world. I witnessed the same commitment
from President Zardari and President Karzai today.
Afghanistan is a Partner for Cooperation
of the Organization for Security and Cooperation in Europe (OSCE),
the 56-nation regional security organization that includes the
United States, Canada and the countries of Europe and Central
Asia, including Afghanistans three northern neighbors.
As it did in 2004 and 2005, the OSCE will send an election support
team to Afghanistan for the countrys upcoming presidential
and provincial council elections. The OSCE is also considering
potential projects with its Afghan partner to enhance border
security and management, police training and anti-drug trafficking
efforts. I support these initiatives and, in my view, it would
be a very positive development going forward if Pakistan became
an OSCE Partner for Cooperation. I intend to explore this issue
in greater depth during my Chairmanship of the U.S. Helsinki
Commission
The Commission on Security and Cooperation
in Europe, also known as the U.S. Helsinki Commission, is an
independent agency of the Federal Government charged with monitoring
compliance with the Helsinki Accords and advancing comprehensive
security through promotion of human rights, democracy, and economic,
environmental and military cooperation in 56 countries. The Commission
consists of nine members from the U.S. Senate, nine from the
House of Representatives, and one member each from the Departments
of State, Defense, and Commerce.

even if you have insurance.

Statement
of Comptroller Dugan on the Results of the Supervisory Capital
Assessment Program
WASHINGTON Comptroller of the Currency John C. Dugan issued
the following statement today on the results of the Supervisory
Capital Assessment Program (SCAP):
The results of the stress test demonstrate the strength of the
banking system and its ability to withstand losses and sustain
lending, even if economic conditions are more severe than currently
anticipated. I want to emphasize several key points about the
results of the test.
First, the stress test is not a solvency test. It is designed
to be a significantly adverse, lower probability scenario; it
is not a prediction that the scenario will occur or that the
bank is undercapitalized or insolvent today.
Second, the purpose of the test is to create an excess capital
buffer in case the adverse scenario comes to pass. Once the buffer
is in place, if the adverse scenario occurs, the bank will still
be more than adequately capitalized; if it does not, the bank
will still be viewed as stronger today for having higher levels
of capital in an uncertain world.
Third, the stress test criteria were appropriately conservative;
this was a severe test, and high capital requirements were used
to measure success. Conservative assumptions were made with respect
to the three key elements of the test: loss rates, revenues,
and loan loss reserves. For example, with respect to aggregate
loan losses, the 9.1 percent two-year loss rate was higher than
any two-year loss rate since 1921, including the worst two-year
period of the Great Depression. Similarly, assumed losses on
individual categories of loans were very high by historical measures.
While our data set for these individual categories goes back
only about 20 years, the annualized loss rates in the stress
test were substantially higher than the highest annual losses
during this period and the stress test assumed these higher
levels for two years, not one. Moreover, the test assumes that
these very high rates of loss strike all categories of loans
simultaneously, which has not been observed historically
losses generally dont peak for all types of loans at the
same time.
Fourth, banks generally had enough overall Tier 1 capital to
survive the severe stress a very positive sign for the
overall strength of the banking system. The results show that,
with the capital already provided by the U.S. government to these
banks last year through the Capital Purchase Program, the 19
banks generally have enough overall Tier 1 capital to withstand
an unlikely but very adverse stress period. That is a very positive
result.
Fifth, the test shows that many banks do not have enough Tier
1 common equity for such a stress period, and the key consequence
of the test is the need to increase such equity. Supervisors
have been concerned about improving the quality of capital to
absorb losses, and the test results confirm this concern, showing
that some banks need to increase common equity. Doing so should
also help address concerns weve observed in the market,
which appear to value common equity significantly more in times
of distress.
Sixth, the test provides very strong incentives for firms to
increase common equity without resorting to the government for
same. Thats a good thing, because private capital is far
preferable, and banks will have six months to get to that result.
Indeed, a number of banks have already announced their intention
to raise new common equity, and my fervent hope is that very
little government capital will be required at the end of the
six-month period.
One final note of caution: while we have some good news today,
credit losses in banks are likely to increase in the coming months
across all asset classes. Supervisors are very focused on this
concern. Banks will need strong capital to weather these losses
while continuing to make loans to creditworthy borrowers
which is exactly what the stress test is designed to ensure.
The OCC and the other supervisors will continue ongoing rigorous
supervision of banks capital adequacy.
