Ten Things You May Not Know about Farm Income and Deductions
If you are in the business of farming, here are some things you may want to know before filing your federal tax return.
Crop Insurance Proceeds You must include in income any crop insurance proceeds you receive as the result of crop damage. You generally include them in the year you receive them.
Sales Caused by Weather-Related Condition If you sell more livestock, including poultry, than you normally would in a year because of weather-related conditions, you may be able to choose to postpone reporting the gain from selling the additional animals until the next year.
Farm Income Averaging You may be able to average all or some of your current year's farm income and refiguring your tax over the three prior years. This may give you a lower tax if your current year income from farming is high, and your taxable income from one or more of the three prior years was low.
Deductible Farm Expenses The ordinary and necessary costs of operating a farm for profit are deductible business expenses. An ordinary expense is an expense that is common and accepted in the business. A necessary expense is one that is appropriate for the business.
Employees You can deduct reasonable wages paid for labor hired to perform your farming operations.
Items Purchased for Resale You may be able to deduct the cost of livestock and other items purchased for resale in the year of sale. This cost includes freight charges for transporting the livestock to the farm.
Net Operating Losses If your deductible loss from operating your farm is more than your other income for the year, you may have a net operating loss. If you have a net operating loss this year, you can carry it to other years and deduct it. You may be able to get a refund of all or part of the income tax you paid for past years, or you may be able to reduce your tax in future years.
Repayment of Loans You cannot deduct the repayment of a loan. However, if you use the proceeds of a loan for farm business expenses, you can deduct the interest you pay on the loan.
Fuel and Road Use You may be eligible to claim a credit or refund of excise taxes on fuel used on a farm for farming purposes.

Summary: The FDIC previously issued FIL-139-2008 and FIL-2-2009 to require reporting of certain information from entities participating in the debt guarantee component of the Temporary Liquidity Guarantee Program. The purpose of this Financial Institution Letter is to amend certain reporting requirements, clarify previously issued reporting guidance and consolidate reporting instructions. IMPORTANT TOBACCO TAX AND PERMIT CHANGES
The Children’s Health Insurance Program Reauthorization Act of 2009 (“the Act”) (Public Law 111-3), was signed into law on February 4, 2009. The Act increases the Federal excise taxes on tobacco products and sets forth new permit and enforcement provisions regarding tobacco products and processed tobacco. Also as a consequence of the Act, TTB is currently evaluating methods to distinguish between pipe tobacco and roll-your-own tobacco for purposes of the Federal excise tax. Read more.

Homeland Security Secretary Napolitano announced she will transition management oversight of the Mississippi Long Term Recovery Office (LTRO) from Biloxi, Miss., to the Federal Emergency Management Agency (FEMA) regional office in Atlanta, Ga., on March 23, 2009.

HHS Releases Interim Guidance for Cargo Trucking Management and Crew Personnel
Cargo trucking is part of the critical infrastructure essential to maintaining the Nation’s continuity of operations in the event of an influenza (flu) pandemic (a worldwide outbreak of a novel flu virus). This draft interim guidance is meant to inform and educate cargo trucking management and crew personnel about precautions and appropriate work practices to minimize exposure and prevent workplace-related transmission of flu in the event of a pandemic. These recommendations are primarily based on standard infection control practices and information about preventing seasonal flu and specific concerns associated with the potential for an outbreak of pandemic flu.
These guidelines were developed for the three main segments of the U.S. trucking industry: government entities, private cargo carriers, and for-hire motor carriers, but are also applicable for couriers, local delivery enterprises, and other trucking operations such as refuse haulers. These guidelines and recommendations may change as more becomes known about the specifics of a particular flu pandemic, the virus believed to be responsible, and the efficacy of public health control measures.

EPA Issues Latest Information on Toxic Chemical Releases

PHILADELPHIA (March 20, 2009) The U.S. Environmental Protection Agency released today the 2007 Toxics Release Inventory (TRI) which provides information on toxic chemicals used and released by utilities, refineries, chemical manufacturers, paper companies, and many other facilities across the nation. The TRI is compiled from industry data submitted to EPA and the States.

The 2007 TRI data indicate a small increase overall (1.9 percent) of 7.4 million pounds of on and off site chemical releases as compared with 2006. Releases in the mid-Atlantic region, which is comprised of Pennsylvania, Delaware, Maryland, Virginia, West Virginia and the District of Columbia, totaled 382.1 million pounds in 2006.

A total of 389.5 million pounds of chemicals were released on and off-site during 2007 to the air, water or landfills by facilities in the mid-Atlantic region.

When compared with the 2000 TRI data where 464.7 million pounds were released, the 2007 figures represent a 16.2 percent reduction (75.2 million pounds) in toxic pollutants released by facilities in the region. This was accomplished by process modifications, raw material substitution and pollution control equipment.

Today’s data include information on releases and other wastes from more than 650 chemicals and chemical compounds that companies are required to report under EPA=s Toxic Release Inventory Program. The data include chemicals that were released at the company=s facility and those transported to disposal facilities off site.

The TRI is a valuable resource for citizens and government alike” said William T. Wisniewski, Acting EPA mid-Atlantic regional administrator. “Communities can use this type of data to begin dialogues with local facilities to encourage them to reduce emissions or develop pollution prevention plans; EPA and the states use the data to set priorities and allocate environmental protection resources to the most pressing problems.@

The TRI has been credited with providing communities with valuable knowledge and encouraging facilities to reduce their releases of toxic chemicals into the environment through source reduction or pollution prevention measures.

In the mid-Atlantic region some chemical categories of TRI reporting are characterized as persistent bioaccumlative toxics, including lead and lead compounds, and mercury and mercury compounds. The lead and lead compound data for on and off-site releases show a decrease from 6.0 million pounds in 2006 to 5.6 million pounds in 2007. Since 2002 there has been a decrease from 8.9 million pounds to 5.6 million pounds. The mercury and mercury compound data show a decrease from 46,157 pounds in 2006 to 44,805 pounds in 2007. Since 2002 there has been a decrease from 57,643 pounds to 44,805 pounds in 2007. It is important to review the full data in context, since in many cases changes from one year to the next are less important than longer term trends.

The reporting of data to the TRI is required under the federal Emergency Planning and Community Right-to-Know Act (EPCRA), passed in 1986. The TRI provides the amount, location, and type of releases to the environment B whether a pollutant is emitted into the air, discharged into the water, or released onto the land. It also includes information on waste shipped off-site for disposal or further treatment.

It is important to note that these chemical emissions are reported to EPA under the TRI and generally do not reflect illegal discharges of pollutants to the environment.

CTP Special Topics LOMR Delegation Training
The Federal Emergency Management Agency (FEMA), supported by the Mapping On Demand (MOD) team, joined 23 state and local Cooperating Technical Partners (CTPs) at the Emergency Management Institute (EMI) in Emmitsburg, MD, for the CTP: Special Topics LOMR Delegation training March 2-5, 2009. This course was offered to CTPs and focused on the roles, responsibilities and application process for the LOMR Delegation pilot activity.
The course was lead by Beth Norton, FEMA's National CTP Lead. Paul Huang of FEMA Headquarters talked to students about the transition from Map Modernization into Risk MAP. Bill DeGroot of UDFCD, Ken Ashe of the State of North Carolina and David Love of Charlotte-Mecklenburg spoke on their experiences as CTPs who have taken on the responsibility of processing their own LOMRs. Lauren Clem and Allison Westlund of the MOD Team taught the students about LOMR processing and how LOMRs are pushed through the Mapping Information Platform. Mike Domaratz of the MOD Team and Chris Eckhart of the Map Service Center demonstrated a variety of FEMA's digital tools. Laura Algeo of FEMA Region IV and Beth Norton described the LOMR Delegation application process and FEMA's vision for the LOMR Delegation pilot going forward.
The overall response from students was positive. A prerequisite to apply for this activity is to have successfully completed this training. The deadline to apply for the LOMR Delegation task is May 1, 2009.
The attentiveness of the students, their cooperation and eagerness to learn, the favorable training environment of EMI, knowledgeable instructors, and pertinent training materials all contributed to yet another successful CTP training course.

FDIC Chairman Sheila C. Bair said, "It has been clear for some time that troubled loans and securities have depressed market perceptions of banks and impeded new lending. Difficult market conditions have complicated efforts to sell these troubled assets because potential buyers have not had access to financing. The Legacy Loans Program aligns the interests of the government with private investors to provide financing and market-based pricing, and is a critical step forward in the process of restoring clarity to the markets. While there are inherent challenges to implementing a program of this magnitude quickly, the framework announced today provides the foundation upon which the FDIC will begin to build immediately."
"The FDIC intends to move forward with this program in a methodical and transparent fashion. We will provide the opportunity for public comment on critical aspects of the program prior to implementation."

U.S. HELSINKI COMMISSION TO HOLD BRIEFING ON HUMAN RIGHTS IN AFGHANISTAN

(Washington, D.C.) Senator Benjamin L. Cardin (D-MD), Chairman of the Commission on Security and Cooperation in Europe (the U.S. Helsinki Commission) and Co-Chairman Congressman Alcee L. Hastings (D-FL), will hold a briefing entitled, “Human Rights in Afghanistan.” The briefing will be held on Thursday, March 26, 2009, at 2:30 p.m. The briefing room is still ‘To Be Determined.’
The briefing will examine the current state of human rights in Afghanistan, a Partner for Cooperation of the Organization for Security and Cooperation in Europe (OSCE). While some progress has been made, rule of law and protection of human rights remains fragile. Human rights defenders and civil society leaders face harassment, intimidation, and violence. Women and girls continue to be threatened and even attacked as they try to go to work or school. Journalists have been jailed for speaking out and killed by extremists. The death penalty has been imposed on those who seek to convert from Islam to Christianity.

WITNESSES
Dr. Sima Samar chairs the Afghanistan Human Rights Commission, which was established in 2002 to promote and protect human rights in the country and to investigate and verify cases of human rights violations. Dr. Samar served as Vice-Premier of Afghanistan in the first interim government in 2002, and later as Minister for Women’s Issues. She resigned following death threats from religious extremists. Dr. Samar earned her reputation as a human rights activist through her work caring for Afghan women refugees and the establishment of the Shuhada Organization, which is dedicated to providing health care and education to Afghan women and girls. Dr. Samar has received numerous human rights awards for her work and has been on the Forbes list of top 100 most powerful women. She also serves as the UN Special Envoy to Darfur, Sudan.
Mr. Scott Worden is an adviser for the U.S. Institute of Peace’s Rule of Law Program and Co-Director of the International Network to Promote the Rule of Law (INPROL). He served as an adviser to the U.N. Assistance Mission in Afghanistan on human rights and elections issues, as well as to the Afghanistan Joint Election Management Body on the conduct of the 2005 Parliamentary elections. Before serving in Afghanistan, Worden worked with several Cambodian NGOs on legal reform projects, including advocating procedures for the Extraordinary Chambers in the Courts of Cambodia to try former Khmer Rouge leaders.

The Commission on Security and Cooperation in Europe, also known as the U.S. Helsinki Commission, is an independent agency of the Federal Government charged with monitoring compliance with the Helsinki Accords and advancing comprehensive security through promotion of human rights, democracy, and economic, environmental and military cooperation in 56 countries. The Commission consists of nine members from the U.S. Senate, nine from the House of Representatives, and one member each from the Departments of State, Defense, and Commerce.

Hoyer Statement on Treasury Plan Announced Today

WASHINGTON, DC – House Majority Leader Steny H. Hoyer (MD) released the following statement today after Treasury Secretary Geithner unveiled the Administration’s Public-Private Investment Program this morning:

“The plan announced by Treasury Secretary Geithner this morning is another positive step toward ending the current financial crisis. This program, in conjunction with measures to restore the flow of credit to individuals and small businesses and address the underlying housing crisis, will help stabilize our financial system.

“The Public-Private Investment Program will set up a way for banks to get rid of legacy assets that have clogged lending and reduced confidence. Risk will be shared by the private sector, helping to protect taxpayer money.

“This program is just one part of an ongoing, comprehensive strategy to get our nation’s economy moving again. The financial stabilization plan, combined with the American Recovery and Reinvestment Act and the budget outline moving through the House Budget Committee this week, will restore economic growth and help families struggling under this recession.”

Hoyer Statement on Cover the Uninsured Week

WASHINGTON, DC – Majority Leader Steny H. Hoyer (Md.) released the following statement today on Covered the Uninsured Week (March 22-28), a weeklong effort to foster conversation about reforming the nation’s health care system and making affordable health insurance available to the 45 million currently uninsured Americans.

“America’s health care system is in need of reform. Millions of Americans are living without health insurance, and millions more are underinsured or barely able to afford the coverage they have. Rising health care costs are becoming more of a burden for families and businesses, and are grabbing a greater share of the federal budget every year.

“Waiting on health care reform is not an option we can afford any longer. And it is not one we can put aside in the midst of an economic recession where families, businesses and our economy need the relief that a more efficient and affordable health care system can provide.
