A federal grand jury in the Western District of New York, has returned an indictment charging Keith Gordon-Smith, owner of an asbestos removal company, with numerous violations of the Clean Air Act, submitting false statements and obstruction of justice. The charges stem from allegations that Gordon-Smith directed and caused illegal asbestos removal at several sites in the Rochester, N.Y., area, and hid the illegal asbestos removal from federal agencies.

FDIC Announces Settlement With Insurance Company for Misuse of the FDIC Logo and Seal and Misrepresentation of Insured Financial Products

The Federal Deposit Insurance Corporation (FDIC) announced a settlement with AL Amerilife, LLC, an entity responsible for managing Amerilife First Financial, LLC, of Clearwater, Florida, formerly known as Interstate First Financial, LLC and other commonly controlled entities (collectively Amerilife). Amerilife is an insurance company that markets and sells insurance and financial products, such as annuities, nationwide. As part of its marketing campaign, Amerilife advertised above market-rate certificates of deposit (CDs) in 80 newspapers nationwide. Amerilife generated customer lists with information from those who responded to the ads in order to later contact the consumers and attempt to sell them uninsured annuities.
The FDIC has reason to believe that Amerilife violated the amended Federal Deposit Insurance Act (FDI Act), 12 U.S.C. § 1828(a)(4), relating to misuse of the FDIC sign, seal, and symbol and misrepresentation of the insured status of entities and products. Specifically, Amerilife's CD ads promised an interest rate on the CDs higher than the rates offered by any bank, and prominently displayed the FDIC logo and seal, giving the impression that Amerilife was an insured bank. When a consumer went into an Amerilife office to purchase the advertised CD, Amerilife helped the consumer sign up for the CD on a bank's website. Amerilife then forwarded a bonus payment plus the consumer's check to the bank as the CD principal. The total amount created the rate of return advertised by Amerilife. The advertisements, however, misrepresented the actual terms and conditions under which the bank offered the insured CDs.
AL Amerilife has consented to a Cease and Desist Order that will correct the violations of the FDI Act and prevent Amerilife from using the FDIC sign, seal, and symbol, and from misrepresenting that its financial products are insured. The order, dated June 18, 2009, also requires Amerilife to pay a civil money penalty of $100,000. In agreeing to the issuance of the order, Amerilife does not admit or deny any liability.
"The Amerilife settlement demonstrates the FDIC's commitment to protecting the integrity of the FDIC name, logo and seal. Seniors and other consumers rely on these symbols of confidence and stability, particularly during these difficult economic times," said FDIC Board member Thomas J. Curry. "Any person or business that deceptively uses the FDIC name, logo or seal to market non-insured financial products should be aware that the FDIC will pursue and stop these deceptive and damaging marketing practices."

OCC Appoints FDIC Receiver for First National Bank of Anthony
WASHINGTON — The Office of the Comptroller of the Currency (OCC) today appointed the Federal Deposit Insurance Corporation (FDIC) as receiver for First National Bank of Anthony, Anthony, Kansas. First National Bank of Anthony has six branches and a loan production office all located in Kansas in the cities of Anthony, Harper, Mayfield, Olathe, Overland Park and Wichita. The bank, with approximately $156 million in assets as of March 31, 2009, was established in 1885.
The OCC acted after finding that the bank had experienced substantial dissipation of assets and earnings due to unsafe and unsound practices. The OCC also found that the bank has incurred losses that have depleted most of its capital, and there is no reasonable prospect that the bank will become adequately capitalized without Federal assistance.
The FDIC will release information about the resolution of the bank.

This summer, President Barack Obama is calling on all Americans – young and old, from every background, all across this country – to participate in our nation’s recovery and renewal by serving in our communities. As part of the Administration’s call to service, United We Serve, a summer service initiative will kick-off Monday, June 22 and conclude with the National Day of Service and Remembrance on September 11.

Department of Homeland Security (DHS) and Federal Emergency Management Agency (FEMA) officials will be participating in several events throughout the summer to support United We Serve. Beginning with DHS Secretary Janet Napolitano’s support for community readiness in Orlando, Fla., on June 22, where she will work with the Orlando Citizen Corps Council and volunteers to assemble CERT kits in preparation for hurricane season at the Orlando Emergency Operations Center. In addition, FEMA Administrator W. Craig Fugate will discuss the importance of service at a roundtable in Denver, Col., with firefighters and volunteers from Fire Corps and CERT programs on June 22. We invite you to join Administrator Fugate at this event via a live streaming webcast on the internet at 11:00 AM Mountain Time (1:00 PM EST) at DHSON.TV (http://www.dhson.tv/).

You can also participate in United We Serve events across the nation this summer by visiting the new White House website, Serve.gov (http://www.serve.gov/). On this website, you can find service opportunities in your community, register your service projects, connect with others with similar interests, and share your stories. To encourage participation in service this summer and beyond, the Serve.gov website allows people to search for volunteer opportunities based on location and interests. The site also includes social media tools to share volunteer opportunities with friends. FEMA is working closely with the developers of Serve.gov to post Citizen Corps Council and Partner Program information on the website. Please be sure to post your summer service projects and share stories of how your volunteers are making a difference on Serve.gov and encourage your neighbors to do the same.
