Hoyer: Americans Need Health Reform
That Ends Denial of Coverage Based On Pre-Existing Conditions
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) joined Reps. Ed Perlmutter (CO) and Marcia
L. Fudge (OH), and families who are at risk of being or who have
been denied health care coverage because of a pre-existing condition
at a press conference today, calling for health reform that ends
discrimination based on a persons health status. Below
are his remarks as prepared for delivery:
For far too many decades, we have
labored under a health care system that is unworthy of our great
country. It has consistently stood against two of our most cherished
American principles: opportunity and equality.
It has stifled opportunity because
it has forced too many Americans to make life decisions not on
the merits, but on the availability of health coverage. It has
worked against the mobility and entrepreneurship that strong
economies thrive on. That is why we need reform that ensures
Americans security no matter whether they move, lose their jobs,
change their jobs, or strike out on their own.
Our health care system has also stood
against equality. Insurers are regularly permitted to discriminate
against Americans with pre-existing health conditions. As a result,
millions of Americans have found it essentially impossible to
secure health coverage. That must change, as well.
Democrats health care reform
will insist that no insurance company be allowed to discriminate
against any American on the basis of health status. For so many
of our fellow citizens, that will mean peace-of-mind, security,
and a first chance at affordable coverage.
Im proud to be joined by Representatives
Perlmutter and Fudge, and the families here with us today who
have had their dreams and opportunities curtailed because of
insurance discrimination.
Their stories deserve to be heard.
Because they can inspire us to pass a bill that finally brings
them health securityand prevents similar stories from ever
happening to our friends, families, or neighbors again.

to address a vulnerability in
Adobe Reader and Acrobat 9.1.2 and Flash Player 9 and 10. This
vulnerability may allow a remote, unauthenticated attacker to
execute
arbitrary code or cause a denial-of-service condition.
US-CERT encourages users and administrators
to review the security
advisory and implement the following workarounds until a fix
is
available:
* Disable Flash in Adobe Reader 9 on Windows platforms by renaming
the following files: "%ProgramFiles%\Adobe\Reader
9.0\Reader\authplay.dll" and "%ProgramFiles%\Adobe\Reader

to Hold National Broadband Workshop in Los Angeles, Calif.
WASHINGTON - On Friday, July 24, the Department
of Commerce's National Telecommunications and Information Administration
(NTIA) and the Department of Agriculture's (USDA's) Rural Utilities
Service (RUS) will hold the final of 10 nationwide public broadband
grant and loan workshops in Los Angeles, Calif. The workshops
are designed to help prospective applicants learn how to apply
for the first round of American Recovery and Reinvestment Act
funding aimed at expanding broadband access to bridge the technological
divide, create jobs and build Internet infrastructure. Earlier
this month, Vice President Biden announced the availability of
$4 billion in Recovery Act loans and grants to help bring broadband
service to unserved and underserved communities across America.

Overview
Adobe has released Security advisory APSA09-03,
which describes a
vulnerability affecting Adobe Flash. Other Adobe applications
that
include the Flash runtime, such as Adobe Reader 9, are also
affected.
I. Description
Adobe Security Advisory APSA09-03 describes
a vulnerability
affecting the Adobe Flash player. Flash player version 10.0.22.87
and earlier 10.x versions as well as Flash player version 9.0.159.0
and earlier 9.x versions are affected.
An attacker could exploit this vulnerability
by convincing a user
to visit a website that hosts a specially crafted SWF file. The
Adobe Flash browser plugin is available for multiple web browsers
and operating systems, any of which could be affected. An attacker
could also create a PDF document that has an embedded SWF file
to
exploit the vulnerability.
This vulnerability is being actively exploited.
II. Impact
This vulnerability allows a remote attacker
to execute arbitrary
code as the result of a user viewing a web page or opening a
PDF
document.
III. Solution
These vulnerabilities can be mitigated
by disabling the Flash
plugin or by using the NoScript extension for Mozilla Firefox
or
SeaMonkey to whitelist websites that can access the Flash plugin.

Hour Division reminds employers and employees that the federal
minimum wage increases to $7.25 on Friday, July 24, 2009. With
this change, employees who are covered by the federal Fair Labor
Standards Act will be entitled to be paid no less than $7.25
per hour. This increase is the last of three provided by the
enactment of the Fair Minimum Wage Act of 2007. A revised Federal
minimum wage poster is now available for viewing, downloading,
and posting. Every employer of employees subject to the Fair
Labor Standard Acts minimum wage provisions must post,
and keep posted, a notice explaining the Act in a conspicuous
place in all of their establishments so as to permit employees
to readily read it.

Hoyer Statement on National Minimum
Wage Increase
WASHINGTON, DC - House Majority Leader
Steny H. Hoyer (MD) released the following statement on tomorrow's
national minimum wage increase from $6.55 per hour to $7.25 per
hour:
Tomorrows increase in the minimum wage couldnt
come at a time when it was more neededfor our families
or our economy. For minimum-wage workers and their families,
the raise will make it easier to make ends meet. And our economy
will benefit from the increased consumer spending that will result,
which, in turn, can help preserve jobs.
The raise to $7.25 per hour is the last step of Democratic
legislation that brought the minimum wage up from $5.15 per hour
in 2007, its lowest purchasing power in 51 years. Tomorrow is
an important step toward the day when no hard-working American
will ever have to live in poverty.

and their citizens as we prepare for and respond to emergencies
and disasters.

Cleaning Up: Energy and Climate Bill Will Boost the Economy

Over the next few months, Congress will
decide on historic energy legislation that would create a generation
of clean-energy jobs here in America, reduce our dependence on
foreign oil, and prevent the worst effects of climate change.
I believe passing a strong energy and climate bill is the single
most important step we could take to secure our economic prosperity
and leave a healthier planet for future generations.
The status quo on energy is unsustainable.
Today, we import about 60 percent of the oil we use, which is
a huge drain on our economy and which weakens our security. When
we burn fossil fuels for energy, we emit enormous amounts of
greenhouse gases, which have already begun to change our climate.
Climate experts predict that, on our current course, the planet
could be around 10 degrees Fahrenheit warmer by the end of this
century. Such an increase could cause more frequent extreme weather
events like droughts, heat waves, and hurricanes; rising sea
levels and coastal erosion; serious agricultural losses and water
shortages; and many other impacts in the United States.
There is no question that our energy habits
need to change. The only question is whether we can turn this
energy challenge into an energy opportunity.
Here is the future that I see. In the coming
decades, the laws of supply and demand will almost certainly
force oil and gas prices to rise. At the same time, the consequences
of climate change will become so starkly apparent that continuing
to emit carbon pollution at today's levels will be unacceptable.
As a result, clean-energy technologies will be in high demand.
Tens of thousands of windmills and solar panels will be manufactured
and installed around the world. Consumers will demand more efficient
vehicles, appliances, and buildings. There will be a race to
produce the most advanced batteries and biofuels.
We must ask ourselves: How does the United
States want to position itself in this future world? When the
great hockey player Wayne Gretzky was asked how he positions
himself on the ice, he replied: "I skate to where the puck
is going to be, not where it's been." America should do
the same.
President Obama is committed to signing
comprehensive energy and climate legislation that will position
America where the puck is going to be. The government can't solve
this problem alone, but it can provide the right incentives for
America's entrepreneurs, industries, and innovators to transform
how we produce and use energy.
With the right incentives, the private
sector will first seek out the lowest-hanging fruit. The quickest
and easiest way to reduce our carbon emissions is to make our
appliances, cars, homes and other buildings more efficient. In
fact, energy efficiency is not just low-hanging fruit; it is
fruit that is lying on the ground. And energy efficiency means
money back in your pocket because you pay less on your energy
bills.
A new energy bill will also make clean
energy profitable. That will drive investments in wind and solar
power and next generation biofuels from grasses and agricultural
waste. It will spark American innovation in fuel efficient automobiles
and the development of advanced batteries for electric vehicles.
It will offer incentives to re-start our nuclear power industry
and encourage utilities to invest in carbon capture and storage
from coal-fired power plants.
Finally, the right clean energy incentives
will start the great American research and innovation machine,
which will lead to better and cheaper energy and climate solutions.
We can do all of this for a very affordable
cost for America's families. The Environmental Protection Agency
and the Congressional Budget Office found that the goals of the
energy bill passed recently by the House of Representatives can
be achieved for between 22 to 48 cents per day per household
in 2020. That's about the price of a postage stamp per day. At
the same time, the legislation would not increase the deficit.
We have talked for decades about the energy
problem; it is time to solve it. By passing a comprehensive energy
bill that spurs a revolution in clean technologies, the United
States can position itself to lead this new industrial revolution.
This is our opportunity to shape our energy destiny, and we must
seize it.

Safety Net Which Serves One-in-Five Americans Each Year
WASHINGTON, July 22, 2009- Agriculture
Deputy Secretary Kathleen Merrigan will recognize the 40th anniversary
of USDA's Food and Nutrition Service tomorrow, July 23, at 11
a.m. in USDA's Whitten Building. The Food and Nutrition Service
(FNS) is the federal agency that administers America's nutrition
assistance programs. FNS programs now serve one in every five
Americans during the course of a year.
FNS' 15 domestic nutrition assistance programs
together comprise the Nation's food safety net. They include
the Supplemental Nutrition Assistance Program (SNAP, previously
known as the Food Stamp Program); National School Lunch Program;
Special Supplemental Nutrition Program for Women, Infants and
Children (WIC); and The Emergency Food Assistance Program (TEFAP),
among others.
Nutrition education and outreach efforts
to the underserved are top priorities in all FNS mission areas.
The agency educates low-income individuals and families to make
smarter dietary choices and encourages daily activity to achieve
better health. To increase participation, FNS also conducts outreach
targeting eligible populations, including Hispanics and the elderly.

Energy Secretary Chu, Agriculture Secretary
Vilsack Announce $6.3 million for Biofuels Research
Washington, DC U.S. Department of Energy Secretary Steven
Chu and U.S. Department of Agriculture Secretary Tom Vilsack
announced today the joint selection of awards of up to $6.3 million
towards fundamental genomics-enabled research leading to the
improved use of plant feedstocks for biofuel production. The
seven projects announced today follow the green jobs and renewable
energy Rural Tour event hosted last weekend by the two cabinet
Secretaries in Virginia. These investments will further the Obama
Administrations efforts to broaden the nations energy
portfolio while decreasing our dependence on foreign oil.
"Part of the solution to the energy problem will be home-grown
energy crops," Secretary Chu said. "These projects
will help us unlock the true potential of advanced biofuels,
decrease our dependence on foreign oil, and create new jobs and
a thriving biofuels industry in America.
Helping expand and diversify production of biofuels is
an example of the Obama Administrations commitment to developing
a sustainable domestic biofuels industry that can help strengthen
rural America while decreasing our dependence on foreign oil,
said Secretary Vilsack.
These grants will be awarded under a joint DOE-USDA program begun
in 2006 that is committed to fundamental research in biomass
genomics, providing the scientific foundation to facilitate use
of lignocellulosic materials for bioenergy and biofuels. Since
lignocellulosic crop plants are less intensive to produce and
can grow on poorer quality land, competition with crops grown
for food production is avoided.
DOE will provide $4 million in funding for four projects, while
USDA will award $2.3 million to fund three projects. Initial
funding will support research projects for up to three years.
Awards have been selected for:
USDA-ARS Northern Plains Area (Lincoln, NE), $1,182,000
USDA-ARS Western Regional Research Center (Albany, CA), $1,300,000
University of Georgia (Athens, GA), $1,200,000
University of Georgia (Athens, GA), $705,000
Michigan Technological University (Houghton, MI), $900,000
University of Florida (Gainesville, FL), $643,000
University of Nebraska (Lincoln, NE), $390,000
Secretary Chu recently posted a video on his Facebook page and

WASHINGTON - On Thursday, July 23, the
Department of Commerce's National Telecommunications and Information
Administration (NTIA) and the Department of Agriculture's (USDA's)

public broadband grant and loan workshops in Albuquerque, N.M.
The workshops are designed to help prospective applicants learn

Earlier this month, Vice President Biden announced the availability

USCIRF Delegation to OSCE Defends Religious
Freedom
WASHINGTON, D.C. The U.S. Commission
on International Religious Freedom (USCIRF) advocated for the
autonomy of religious institutions facing government interference
as part of the official U.S. delegation to the OSCE Supplementary
Human Dimension Meeting on freedom of religion or belief, July
9-10 in Vienna, Austria.
Leonard Leo, USCIRF chair, gave the official
U.S. intervention in the second session on the Status of Religious
or Belief Communities.
A societys fear of terrorism
should not be used to deprive any congregations of the ability
to participate in the choosing of their religious leaders, either
through banning such choices outright or using government-appointed
boards, said Mr. Leo, in his statement.
Also participating were USCIRF vice-chairs
Elizabeth H. Prodromou and Michael Cromartie, and commissioners
Felice Gaer and Talal Eid.
Imam Eid presented USCIRFs findings
at a Freedom House side event on Central Asia.
The United States should encourage
the Central Asian governments to cooperate more fully with the
OSCEparticularly with the recommendations on draft legislation
of its Panel of Experts on Freedom of Religion or Beliefto
find ways to maximize rather than hobble vital protections on
religious freedom, especially since Kazakhstan is due to chair
the organization in 2010 and will serve as an example for the
other 55 OSCE states, said Imam Eid.
Commissioners held private meetings with
the OSCEs Chairman-in-Offices Personal Representative
on Combating Anti-Semitism and the OSCEs Chairman-in-Offices
Personal Representative on Combating Intolerance and Discrimination
towards Muslims. The latter was encouraged to examine the status
of Muslims in Uzbekistan as well as that of the Alevi, a Muslim
minority group in Turkey.
Also, commissioners held bilateral meetings
with several OSCE delegations, including those from Turkey, Belarus,
Kazakhstan, and Tajikistan. Commissioners also met with representatives
of the OSCE Council and Panel of Experts on Freedom of Religion
or Belief, as well as with various non-governmental organizations
(NGOs) and religious leaders.
The OSCE is an important multilateral
organization, and it has established critical commitments on
freedom of religion or belief as a basic element of human rights,
said Mr. Leo. We appreciated being a part of the U.S. delegation
and are grateful for the support the U.S. Mission to OSCE has
provided for our meetings. We believe that the United States
should continue to maintain a firm and steadfast commitment to
the organization and its work on religious freedom, including
through the Panel of Experts on Freedom of Religion or Belief
and the Office of Democratic Institutions and Human Rights.
The OSCE is a multilateral organization
with 56 participating states, including the United States and
Canada, and all the countries of Europe and Eurasia.
USCIRF is an independent, bipartisan U.S.
federal government commission. USCIRF Commissioners are appointed
by the President and the leadership of both political parties
in the Senate and the House of Representatives. USCIRFs
principal responsibilities are to review the facts and circumstances
of violations of religious freedom internationally and to make
policy recommendations to the President, the Secretary of State
and Congress.

Hoyer Statement on the Statutory Pay-As-You-Go
Act
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) spoke on the House Floor today in support
of the Statutory Pay-As-You-Go Act of 2009, which passed the
House by a vote of 265-166 . This legislation reestablishes statutory
pay-as-you-go (PAYGO) requirements that helped turn
deficits into surpluses during the Clinton Administration. Below
are his remarks as prepared for delivery:
Maybe youve heard the
first rule of holes: when youre in one, stop digging.
The fact is that our nation is in
a deep hole. The deficit for this fiscal year is $1.7 trillion.
Our debt has never been higher. Unless we do something to remove
ourselves from this hole, the futures of our children and grandchildren
will be severely constrained, and interest payments will crowd
out nearly all of the investments Americans know are vital to
their future, from education to clean energy to health care.
The worst-case scenario of fiscal meltdown has a nightmare to
offer both parties: for Republicans, the prospect that taxes
will be forced through the roof; for Democrats, the prospect
that the programs we value will be slashed, and that the weakest
and least powerful will suffer most.
But there is a way out: reclaiming
the principles of responsibility that have served our country
so well. I fully believe that we are in this hole because the
last administration set responsibility by the wayside. In fact,
a recent New York Times analysis tells us that 90% of our deficit
can be attributed to Bush administration policies, the extensions
of those policies, and the economic crisis that that administration
left behind.
But whatever we think brought us
to this point, I am confident that we can agree on a tried and
tested plan for a new beginning. It is a simple one: the principle
that, from here on out, this country will pay for what it buys.
It is called pay-as-you-go, or PAYGO. It was a key part of turning
deficits into surpluses once, and it can be a key part again.
Essentially, this PAYGO bill requires
Congress to find savings to balance out the dollars it spends,
so that all new policies that reduce revenues or expand entitlement
spending are fully offset over five and ten years. In 1990, a
similar PAYGO rule was enacted as part of a budget agreement
between a Republican President and a Democratic Congress. In
1997, it was reaffirmed by President Clinton and Speaker Gingrich.
And by forcing Congress to make difficult choices between taxes
and spending, to scrutinize wasteful subsidies and loopholes,
and to fully weigh the real cost of tax cuts, PAYGO was instrumental
in creating a projected ten-year surplus of $5.6 trillion.
Its repeal, in turn, paved the way
for the fiscal excesses of the last administration. On winning
the Congressional majority in 2006, Democrats made it part of
House rulesand today, we have the chance to give PAYGO
the force of law.
With this law in place, advocates
of spending will have to find ways to offset the new costs. Advocates
of tax cuts will no longer be able to finance them with debtinstead,
theyll have to tell us which programs they would cut. PAYGO
wont make those debates go away; it wont make those
decisions for us. It means hard choices for all of us. But continuing
to shun hard choices is the road to fiscal ruin.
Exempted from this bills PAYGO
requirements are extensions of current policy on the Alternative
Minimum Tax, the estate and middle-class income tax cuts passed
in 2001 and 2003, and Medicare payments to doctors. As a result,
some have criticized this bill for not going far enough. But
supporters of PAYGO, including President Obama, see exemptions
as a crucial concession to political reality that keep the cause
of responsibility credible. It is clear that there is bipartisan
support in Congress for extending those current policies without
offsetting savings.
That gives us two choices. On the
one hand, we can pass an all-encompassing bill that is waived
again and again, one that turns into what the nonpartisan Center
on Budget and Policy Priories calls a transparently phony
fiscal responsibility promisea promise, I would add,
that would weaken the cause of responsibility as a whole. On
the other hand, we can make a promise we are prepared to keep.
In other words, we have the choice between a satisfying, but
weak, statement of idealsor of action in the real world
of politics. This bill takes the latter path. It draws a line
before future budget-busting plans: this far, but no further.
Is that enough? No, Mr. Speaker,
it is not nearly enough. Even if this bill is passed and signed,
we will still be in our holethere will still be years of
hard work ahead of us before our heads are again above ground.
But today, we can do something absolutely necessary: we can choose
to stop digging.

House Majority Statement on President
Obama's Press Conference on Health Care Reform
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement tonight
after President Obamas press conference on health care
reform:
Tonight, President Obama demonstrated
that health care reform is urgent on multiple fronts. It is urgent
for middle-class families who are in danger of losing health
coverage for reasons beyond their control, from sudden illnesses
to job loss. It is urgent for the 45 million Americans who lose
out on the preventive care they need, and whose higher costs
of treatment are ultimately borne by the rest of us. It is urgent
for small businesses struggling under the burden of continually
rising insurance costs for their employees. And it is urgent
for a federal budget that will never escape deficits until the
rising cost of health care is brought under control.
Details of reform are still being
worked out amid strong debate on Capitol Hillexactly the
kind of debate that is healthy when such a crucial issue is at
stake. But Democrats are dedicated to a reform plan that will
prevent insurance companies from discriminating against patients,
strengthen competition among insurers, expand patient choice
of options and doctors, and ensure that middle-class Americans
find affordability, security, and peace-of-mind in their coverage.
Reform must be done in a fiscally responsible way that does not
add to the deficit and addresses the rapid rise in health care
costs making health care more expensive for everyone and consuming
more of our federal budget each year. Our commitment to those
goals is unshakeable, and we will succeed in passing the health
reform that the vast majority of Americans demand.

Young Adults 19-29 Are Largest Portion Of Uninsured In The U.S,
Mostly Losing Coverage Upon Leaving High School Or College. The
Commonwealth Fund reported in their study that, Young adults,
ages 19 to 29, are one of the largest segments of the U.S. population
without health insurance: 13.7 million lacked coverage in 2006.
They often lose coverage at age 19 or upon high school or college
graduation almost two of five (38%) high school graduates
who do not enroll in college and one-third of college graduates
are uninsured for a time during the first year after graduation.
The study also noted that young adults account for almost
30 percent of the nonelderly uninsured, the largest chunk
of the nonelderly uninsured. [Commonwealth Fund, May 2008]
The health care reform plan presented by
President Obama will impact impact young people by reducing the
cost of health care, giving young Americans and all Americans
a choice of providers (including a public option), and making
quality health care affordable for all.
On Thursday, July 23, 2009, Organizing
for America is calling on young people in the greater Baton Rouge
area to attend a press conference and rally for health care reform.
Right now the US Congress has an opportunity to take action and
provide coverage for the 48 million Americans who are without
coverage. We need your voices and presence.

& Co said that its second-quarter net profit rose to $1.16
billion, or $1.06 a share, from $958.8 million, or 88 cents a
share, recorded at the same point a year ago. Revenue climbed
3% to $5.3 billion. Adjusted proforma earnings per share totaled
$1.12, up 19%. Analysts had been expecting earnings per share
of $1.02, according to data compiled by FactSet. For the year,
analysts had pegged earnings at $4.23 a share. Lilly said that
that it's now expecting fiscal-year earnings in a range of $4.14
to $4.24 a share, or $4.20 to $4.30 on a proforma basis. Pro
forma earnings exclude significant items and assume the firm's
acquisition of ImClone was completed on Jan. 1 2008. Increased
volumes drove growth in the second quarter, offsetting unfavorable
exchange rates, the firm said.

above analyst estimates of 30 pence. It lifted its dividend by
8% to 14 pence a share, or 46.09 cents per U.S.-listed share.
Glaxo also said it expects to have an annual production capacity
of Relenza, to treat H1N1, of 190 million treatment courses by
the end of the year, a more than a threefold increase to its
previously announced maximum capacity of 60 million courses.
Last month, it started production of an H1N1 adjuvanted vaccine.
