Exciting Healthcare Update
Dear Friends,
With your support, your phone calls, your
emails, we won a major legislative victory today for a state
single payer health care option in the House of Representatives
in Washington, DC. The House Education and Labor Committee approved
the Kucinich Amendment by a vote of 27-19, with 14 Democrats
and 13 Republicans voting yes.
The amendment propels the growing single
payer health care movement at the state level. There are at least
ten states which have active single payer efforts in their legislatures.
They are California, Colorado, Illinois, Minnesota, Montana,
New Mexico, New York, Ohio, Pennsylvania and Washington. The
amendment mandates a single payer state will receive the right
to waive the application of the Employee Retirement Income Security
Act (ERISA), which has in the past been used to nullify efforts
to expand state or local government health care.
Under the Kucinich Amendment a state's
application for a waiver from ERISA is granted automatically
if the state has signed into law a single payer plan. With the
amendment, for the first time, the state single payer health
care option is shielded from an ERISA-based legal attack. Now
that the underlying bill has been passed, as amended, by the
full committee, we must make sure that Congress knows that we
want the provision kept in the bill at final passage!
The state single payer option was one of
five major amendments which I obtained support to get included
in HR3200. One amendment brings into standard coverage for the
first time complementary and alternative medicine, (integrative
medicine). Another amendment drives down the cost of prescription
drugs by ending pharmaceutical industry's sharp practices manipulating
physician prescribing habits. An amendment stops the insurance
industry from increasing premiums at the time when people are
not permitted to change health plans; and finally an amendment
imposing a requirement on insurance companies that they disclose
the cost of advertising, marketing and executive compensation
expenses (which generally divert money from patient care).

OCC Appoints Receiver for Vineyard Bank,
National Association
WASHINGTON The Office of the Comptroller of the Currency
(OCC) today appointed the Federal Deposit Insurance Corporation
(FDIC) as receiver for Vineyard Bank, National Association, Corona,
California. As of June 30, 2009, the bank had approximately $1.6
billion of total assets.
The OCC acted after finding that the bank had experienced substantial
dissipation of assets and earnings due to unsafe and unsound
practices. The OCC also found that the bank incurred losses that
depleted its capital, and there is no reasonable prospect that
the bank will become adequately capitalized without Federal assistance.
The FDIC will release information about the resolution of the
bank.

MESSAGE FROM THE MAJORITY LEADER
This week, three House committees
Energy & Commerce, Education & Labor, and Ways &
Means jointly introduced Americas Affordable Health
Choices Act, legislation designed to reduce the burden of rising
health care costs on American families and businesses, and enable
all Americans to get the health care they need at affordable
prices. Our economy, our budget, and the health and security
of millions of middle-class families are riding on the outcome
of this important legislation. We will continue to work on this
critical measure and it is my hope to bring it to the House Floor
for a vote soon.
This week, the House also passed two additional appropriations
bills that help lay the foundation for a strong economy and address
our Nation's energy and water needs. The Financial Services Appropriations
bill strengthens the oversight of our markets to protect consumers
and investors and restore the stability of Americas financial
institutions. The Energy and Water Appropriations bill invests
in long-term solutions to our energy and water needs and creates
new American jobs with investments in new technologies, scientific
research, and conservation efforts.
Next week, the House will consider legislation reestablishing
statutory pay-as-you-go (PAYGO) requirements that
helped turn deficits into surpluses during the Clinton Administration.
The American people are rightly concerned by the deep deficits
confronting our nation, so it is vital for the House to reinstate
this simple principle of paying for what we buy as we work to
bring down the deficit and put our fiscal house back in order.
By reducing the deficit, we ensure that we are able to invest
in current and new programs that keep our nations economy
strong and benefit the American people, such as health care access,
affordable higher education, and developing clean energy technology.
We will also continue work on the Fiscal Year 2010 Appropriations
bills. The Transportation, Housing and Urban Development Appropriations
bill makes critical investments in our transportation infrastructure
to help ensure the safety of all Americans and provides housing
assistance to those who need it the most. The Labor, Health and
Human Services, and Education Appropriations bill provides investments
that are critical to our nations long-term prosperity,
including job training, health care, and educational opportunities.

FRA Issues NPRM on Technology to Prevent
Train Collisions
New Rules Support Use of Positive Train Control
Today Transportation Secretary Ray LaHood and Federal Railroad
Administrator Joseph Szabo announced proposed rules designed
to prevent train collisions through the use of Positive Train
Control. The Notice of Proposed Rulemaking (NPRM) prescribes
how railroads must use Positive Train Control systems to prevent
train-to-train collisions.
PTC technology is capable of automatically controlling train
speeds and movements should a locomotive engineer fail to take
appropriate action. For example, such technology can force a
train to stop before it passes a red signal, thereby averting
a potential collision. Other benefits of PTC systems include
prevention of over-speed derailments and misaligned switches,
as well as unauthorized incursions by a train into work zones.
These proposed rules give railroads the framework to use
this life-saving technology, said LaHood. We believe
this is an important step toward making freight, intercity and
commuter rail lines safer for the benefit of communities across
the country.
Under the Rail Safety Improvement Act of
2008, major freight railroads and intercity and commuter rail
operators must submit their plans for PTC to FRA for approval
by April, 16, 2010. PTC systems must be fully in place by the
end of 2015. The proposed rules will specify how the technically
complex PTC systems must function and indicate how FRA will assess
a railroads PTC plan before it can become operational.
FRA is setting the bar high in terms of design, construction
and oversight of PTC technologies among different railroads,
said FRA Administrator Joe Szabo. FRA will continue to
advocate for ways to strengthen safety standards in the railroad
industry.
The major freight railroads have reached an agreement for the
operation of PTC technology across different rail systems, allowing
for industry-wide use. In addition, FRA is coordinating efforts
with the Federal Communications Commission to make a sufficient
amount of radio frequency spectrum available, which is essential
for PTC technology to function properly. This development will
allow PTC technology to send and receive a constant stream of
wireless signals regarding the location and speed of passenger
and freight trains moving along rail lines.

WASHINGTON - On Friday, July 17, the Department
of Commerce's National Telecommunications and Information Administration
(NTIA) and the Department of Agriculture's (USDA's) Rural Utilities
Service (RUS) will hold one of 10 nationwide public broadband
grant and loan workshops in Billings, Mont. The workshops are
designed to help prospective applicants learn how to apply for
the first round of American Recovery and Reinvestment Act funding
aimed at expanding broadband access to bridge the technological
divide, create jobs and build Internet infrastructure. Earlier
this month, Vice President Biden announced the availability of
$4 billion in Recovery Act loans and grants to help bring broadband
service to unserved and underserved communities across America.

states to pursue single payer health care plans.

Tianjin University
TIANJIN, CHINA On the final day of his trip to China with
Commerce Secretary Gary Locke, U.S. Energy Secretary Steven Chu
visited ENN Headquarters in Langfang, Hebei Province, where a
focus on clean energy generation has led to the creation of thousands
of new jobs. Fact sheet on ENN below.
On Friday Secretary Chu also delivered remarks at Tianjin University,
where his grandfather was Dean and President, and discussed the
importance of technological cooperation and codevelopment in
addressing the global climate change challenge and furthering
economic recovery in both the U.S. and China. Background on Secretary

FACT SHEET ON ENN
Overview
ENN is an innovative and integrated new energy company.
Founded in 1989 as a small taxi company, and then as a natural-gas
distributor, ENN has found its niche in the Chinese energy market
(where private companies often find it difficult to compete)
by focusing on clean energy. Now the seventh-largest private
company in China, ENN has revenues totaling $1.7 billion and
more than 20,000 employees. It hopes to expand globally and plans
to obtain 50% of its revenue from abroad by 2020.
Solar
The ENN campus in Langfang, Hebei Province, is fashioned after
Googles and attracts many of Chinas top engineers
and scientists. ENNs solar production facility is reportedly
about to break the world record for making solar panels competitive
with most every fuel except cheap coal. ENN is one of the few
companies in the world that can mass produce thin-film solar
panels. In late 2008, the World Banks International Financing
Corporation announced a $136 million investment into ENNs
solar business.
Coal Gasification and Algae-to-Biodiesel
ENN owns a coal mine in Ordos, Inner Mongolia, producing 600,000
metric tons per year. On the Langfang campus, the company has
a cutting-edge underground low-temperature coal gasification
plant producing dimethyl ether, which can be used for fuel in
power plants and does not emit sulfur dioxide or soot when burned.
ENN recently signed a contract to build a plant in Egypt that
will produce 200,000 tons of dimethyl ether annually. Carbon
from gasified coal is also fed into a 10,000-liter greenhouse
where algae are bred for biodiesel, fertilizer and animal feed.
ENN plans to scale up its algae process to a 100-hectare site
within three years, likely around its Ordos coal mine.
U.S. Business Ties
ENN has several business connections to the United States. Its
solar program is a joint venture with Silicon Valley-based Applied
Materials; ENN hopes to launch its own new-generation product
line in two to three years. ENN also licenses a GE process for
coal gasification.
BACKGROUND ON SECRETARY CHU'S FAMILY CONNECTIONS TO TIANJIN UNIVERSITY
Secretary Chu's maternal grandfather, Li Shu Tian, earned a Ph.D.
in Civil Engineering at Cornell University. He returned to China
and eventually became Dean and President of Pieyang University
(now called Tianjin University) in 1932. He served in this capacity
for about 11 years (including non-consecutive terms) and helped
steer the University through a tumultuous period during the Japanese
invasion and World War II. During that period, he helped lead
the efforts to relocate the University to a safer position and
then helped lead the relocation back to Tianjin.
Li Shu Tian and his family left the country in 1949, emigrating
to the United States where he updated his training and went back
to work as a civil engineer. Later in life, he became a Professor
of Civil Engineering in the midwest, and is among those who helped
inspire Secretary Chu to a career of scholarship.

18, U.S. Secretary of Agriculture Tom Vilsack and Energy Secretary
Steven Chu will hold a rural community forum in Blairs, Va.,
as part of the Obama Administration's Rural Tour. At the forum,
the two officials will share information with local residents
about the work the Obama Administration is doing to revitalize
and rebuild rural America and ask local residents how the departments
can be helpful in supporting and initiating other programs and
projects to help the community participate fully and successfully
in the new, 21st century economy. They will also highlight American
Recovery and Reinvestment Act projects improving communities
in Virginia and benefiting people throughout rural America.
In June, President Obama announced that
Secretary Vilsack will lead the Administration's Rural Tour to
visit rural communities in states throughout the country. Secretary
Vilsack is scheduled to lead Rural Tour events with a variety
of other top administration officials over the coming weeks and
months in Alaska, Louisiana, Nebraska, New Mexico, North Carolina,
Ohio, and Virginia. As the tenth similar forum Secretary Vilsack
has led since being sworn, these upcoming events follow the rural
listening sessions held earlier this year in West Salem, Wis.,

Creation of a UK Center for Nuclear Excellence
WASHINGTON, DC Thomas P. DAgostino, the Department
of Energys Under Secretary for Nuclear Security and Administrator
of the National Nuclear Security Administration, today applauded
the British governments new report on advancing the global
nuclear security agenda. Issued yesterday, The Road to
2010 Addressing the Nuclear Question in the Twenty First
Century outlines a strategy for addressing the threat posed
by the proliferation of nuclear weapons ahead of the 2010 Nuclear
Non-Proliferation Treaty (NPT) Review Conference.
Among other steps, it includes the creation of a UK Center for
Nuclear Excellence that will work to secure existing stocks of
nuclear material, develop proliferation-resistant civilian nuclear
reactor fuels, and improve access to the peaceful use of nuclear
energy for countries that play by the rules.
The Road to 2010 report is an important contribution
to the nuclear security agenda outlined by President Obama and
President Medvedev in Moscow and endorsed by the G-8 summit last
week in L'Aquila, said DAgostino. With nuclear
energy playing an increasing role in meeting growing energy demands,
it is more important than ever for the international community
to act together to reduce the threat of nuclear terrorism. The
steps outlined in this report, including the creation of a UK
Center for Nuclear Excellence, will be an important vehicle for
securing existing stocks of nuclear material, developing proliferation-resistant
civilian nuclear reactor fuels and eventually pursuing more effective
verification measures for arms control and nonproliferation agreements.
As President Obama said, the threat of a terrorist acquiring
a nuclear weapon is the single greatest threat facing our nation.
The steps outlined in the Road to 2010 report will
help prevent that nightmarish scenario from becoming a reality.
Last week in Moscow, President Obama and President Medvedev signed
a Joint Statement on Nuclear Cooperation that outlined critical
steps for securing nuclear material worldwide, minimizing the
use of highly-enriched uranium (HEU) in civilian applications,
accelerating efforts to repatriate HEU fuel to its country of
origin, further improving physical protection systems at nuclear
facilities, and strengthening the effectiveness of the international
safeguards system.
With the largest nuclear nonproliferation program in the world,
the Department of Energys NNSA plays an important role
in implementing that agenda. Through its Second
Line of Defense program, NNSA combats illicit trafficking
of nuclear materials and radioactive substances by installing
radiation detectors at ports, border crossings and points of
entry around the world. NNSAS Global
Threat Reduction Initiative works with its international
partners to convert HEU reactors to more proliferation resistant
LEU reactors and repatriate HEU and LEU to its country of origin.
To improve the security of nuclear weapons and materials at their
source, NNSA's Material
Protection, Control and Accounting Program provides material
protection, control and accounting (MPC&A) upgrades at nuclear
sites in Russia and other countries of the former Soviet Union.
To help strengthen the international safeguards regime, NNSA's
Next Generation Safeguards Initiative is working to develop
the policies, concepts, technologies, expertise, and infrastructure
necessary to sustain the international safeguards system as its
mission evolves over the next 25 years.
Established by Congress in 2000, NNSA is a semi-autonomous agency
within the U.S. Department of Energy responsible for enhancing
national security through the military application of nuclear
science in the nations national security enterprise. NNSA
maintains and enhances the safety, security, reliability, and
performance of the U.S. nuclear weapons stockpile without nuclear
testing; reduces the global danger from weapons of mass destruction;
provides the U.S. Navy with safe and effective nuclear propulsion;
and responds to nuclear and radiological emergencies in the U.S.

USCIRF Urges Accountability for the
Murder of Chechen Human Rights Activist
WASHINGTON, D.C. Natalya Estemirova,
a leading Chechen human rights activist, was kidnapped in Chechnya
and murdered in Ingushetia on July 15. For ten years, Estemirova
had fearlessly documented killings and kidnappings in Chechnya
for Memorial, a leading Russian human rights group.
She had drawn the ire of Chechen President Ramzan Kadyrov, a
known human rights abuser, who reportedly threatened her in March
2008 after Ms. Estemirova had criticized a new law limiting religious
freedoms by requiring women to wear head scarves in Chechnya.
The United States must make clear
that Moscow cannot ignore the consistent pattern of impunity
for the killing of human rights defenders and others, including
those who advocate for freedom of religion or belief in Russia,
said Leonard Leo, chair of the U.S. Commission on International
Religious Freedom (USCIRF).
Over its ten-year history, USCIRF has monitored
religious freedom conditions in the Russian Federation, and for
the first time in 2009 added Russia to its Watch List of countries
with extremely problematic government policies. In its May 2009
Annual Report, USCIRF cited nine other high-profile murders linked
to Chechnya which have occurred in the past year.
Ramzan Kadyrov presides over Chechnya,
where, according to numerous reports, his local militia engages
with impunity in the abduction, disappearance, torture, and killing
of civilians. USCIRF calls on the Obama Administration to urge
President Medvedev to remove Kadyrov from office. After the murder
of Ingush human rights activist Magomed Yevloyev last fall, President
Medvedev replaced the governor of Ingushetia. added Mr.
Leo.
The 2009 Annual Report chapter on the Russian
Federation cited the following:
The most frequent targets of such
[violent] attacks seem to be those who bring Russian human rights
violations to international attention, particularly to the European
Court of Human Rights (ECtHR), as well as government critics,
particularly of Chechen President Ramzan Kadyrov. For example,
in January 2009, Moscow human rights lawyer Stanislav Merkelov
was shot dead and Anastasiya Baburova, an intern for Novaya Gazeta,
was mortally wounded near the Kremlin. President Medvedev did
not issue an official statement denouncing these killings; instead,
he held a private Kremlin meeting with the Novaya Gazeta editor
and former President Mikhail Gorbachev nine days after the attacks,
to express his sympathy. In February 2009, four ethnic Chechen
suspects on trial for the 2006 murder of journalist Anna Politkovskaya
were acquitted for lack of evidence. In March 2009, the Ingush
Prosecutor's Office launched an official 4-day probe into the
2008 killing of Ingush human rights activist Magomed Yevloyev,
accidentally shot while in police custody. Also in
March 2009, human rights activist Lev Ponomaryov was beaten in
Moscow; his passport had been revoked one month earlier and he
was charged with slander for his statements on Russian human-rights
abuses. Moreover, at least six Chechen opposition leaders have
been killed in the past six months, including Umar Izrailov,
who had filed a case against Russia at the ECtHR and was shot
dead in Vienna in January 2009.
USCIRF is an independent, bipartisan U.S.
federal government commission. USCIRF Commissioners are appointed
by the President and the leadership of both political parties
in the Senate and the House of Representatives. USCIRFs
principal responsibilities are to review the facts and circumstances
of violations of religious freedom internationally and to make
policy recommendations to the President, the Secretary of State
and Congress.

WASHINGTON - On Tuesday, July 21, the Department
of Commerce's National Telecommunications and Information Administration
(NTIA) and the Department of Agriculture's (USDA's) Rural Utilities
Service (RUS) will hold one of 10 nationwide public broadband
grant and loan workshops in the Minneapolis-St. Paul, Minn.,
area. The workshops are designed to help prospective applicants
learn how to apply for the first round of American Recovery and
Reinvestment Act funding aimed at expanding broadband access
to bridge the technological divide, create jobs and build Internet
infrastructure. Earlier this month, Vice President Biden announced
the availability of $4 billion in Recovery Act loans and grants
to help bring broadband service to unserved and underserved communities
across America.

remarks. Commerce Assistant Secretary for Communications and
Information Lawrence E. Strickling and USDA Rural Development
State Director Colleen Landkamer will make opening remarks at

Web Site and Toll-free Line Will Help Unemployed
Workers Appeal Denials
of COBRA Premium Assistance Under Recovery Act
The Centers for Medicare & Medicaid
Services (CMS) today announced a new
Web site (www.ContinuationCoverage.net)
and helpline (1-866-400-6689)
where certain unemployed workers may request expedited review
of a
denial by their former employers of eligibility for COBRA premium
assistance under the American Recovery and Reinvestment Act of
2009
(ARRA).
CMS has contracted with MAXIMUS Federal
Services, Inc., a subsidiary of
MAXIMUS, Inc., to review requests for expedited review of denials
and
make recommendations - subject to CMS's review - on whether individuals
are eligible for health insurance premium assistance under the
Recovery
Act's expansion of COBRA continuation coverage. Maximus will
also
answer questions about the premium assistance program and the
expedited
review process. Contact information for the Web site and helpline
is
provided below.
To help displaced workers maintain health
care coverage for themselves
and their families, the Recovery Act provides a 65 percent subsidy
for
health insurance premiums for workers who have elected COBRA
after they
have been involuntarily terminated from their jobs. "COBRA
coverage"
generally refers to the continuation of coverage provisions of
the
Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA),
which
apply to employers with twenty or more employees. The ARRA-established
subsidy is also available to eligible Federal, state, and local
government employees, and, if state law requires certain continuation
coverage, to workers for private sector employers with fewer
than twenty
employees.
The Recovery Act's premium assistance applies
to periods of continuation
coverage beginning on or after February 17, 2009 (when ARRA became
law),
and lasts for up to nine months.
To qualify for premium assistance, a worker
must be involuntarily
terminated between September 1, 2008, and December 31, 2009,
and elect
continuation coverage. The subsidy ends when the worker is offered
any
new employer-sponsored health care coverage or becomes eligible
for
Medicare. Workers who were involuntarily terminated between September
1, 2008, and February 16, 2009, but who failed to elect COBRA
coverage
at that time, most likely because it was unaffordable, or who
elected
COBRA after September 1, 2008, but let it drop because it was
unaffordable, would be given an additional 60 days after employer
notifications are released to elect COBRA and receive the subsidy.
Depending on actions taken by their states, individuals with
state
continuation coverage may also be eligible for this additional
election
period. To ensure that the premium assistance is targeted at
workers
who are most in need, the subsidy generally will be available
only to
people whose income does not exceed $125,000 for individuals
($250,000
for families).
When an individual's former group health
plan denies access to ARRA's
premium assistance, he or she may request an expedited review
of the
denial. Under the law, CMS handles requests for review for all
Federal
government employees, employees of state and local governments,
and
those individuals covered by certain state continuation coverage
laws
(sometimes called "mini-COBRA" programs) that apply
to employers with
fewer than 20 employees. Decisions on appeals will be made within
15
business days after receipt.

Obama Administration Announces $85 Million
in Recovery Act Funding for Early Career Scientists Research
WASHINGTON, DC U.S. Energy Secretary Steven Chu announced
today that up to $85 million in funding under the American Recovery
and Reinvestment Act will be awarded in early 2010 to support
at least 50 early career researchers for five years at U.S. academic
institutions and DOE national laboratories.
This funding highlights the Administrations continued commitment
to building the nations scientific workforce by attracting
top emerging researchers to careers in vital areas of basic research,
said Secretary Chu. By investing in scientific researchers
in their formative years, we can provide scientists with the
resources to do some of their most exciting and productive work.
To be eligible for the competition, a researcher must be an untenured,
tenure-track assistant professor at a U.S. academic institution
or a full-time employee at a DOE national laboratory. The applicant
must also have received a Ph.D. within the past ten years.
Each university award will be at least $150,000 per year for
five years to support summer salary and other research expenses.
For DOE national laboratories, awards will be at least $500,000
per year for five years to support year-round salary and expenses.
Early career researchers may apply to one of six Office of Science
program offices: Advanced Scientific Computing Research; Biological
and Environmental Research; Basic Energy Sciences; Fusion Energy
Sciences; High Energy Physics; or Nuclear Physics. Proposed research
topics must fall within the programmatic priorities of DOEs
Office of Science, which are provided in the program announcements.
Funding will be competitively awarded on the basis of peer review.
Letters of intent will be due on August 1, 2009, and proposals
will be due on September 1, 2009.

OCC Releases CRA Evaluations For 46 National
Banks
WASHINGTON The Office of the Comptroller of the Currency
(OCC) today released a list of Community Reinvestment Act (CRA)
performance evaluations that became public during the period
of June 15, 2009 through July 14, 2009. The list contains only
national banks and insured federal branches of foreign banks
that have received ratings. The possible ratings are outstanding,
satisfactory, needs to improve, and substantial noncompliance.
Of the 46 evaluations made public this month, 7 were outstanding,
39 were satisfactory, and none were needs to improve. None were
substantial noncompliance. Evaluations are available from links
on http://www.occ.treas.gov/cra/jul09.htm.
The OCCs World Wide Web site (http://www.occ.treas.gov)
also offers access to a searchable list of all public CRA evaluations
(http://www.occ.treas.gov/cra/crasrch.htm).
