Before the Committee on Environment and Public Works, United
States Senate, Washington, D.C.
July 7, 2009
Chairman Boxer, Ranking Member Inhofe, and Members of the Committee,
thank you for the opportunity to testify on moving America toward
a clean energy economy.
We face many serious and immediate challenges. American families
and businesses are struggling in a recession and an increasingly
competitive global economy. We have become deeply dependent on
a single energy source to power our cars, trucks and airplanes,
and spend hundreds of billions of dollars a year to import nearly
60 percent of the oil we use. We face an unprecedented threat
to our very way of life from climate change.
To solve these challenges, the Administration and Congress need
to work together to spur a revolution in clean energy technologies.
The President and I applauded the historic action by the House
to pass a clean energy bill, and we look forward to working with
the Senate to pass comprehensive energy legislation.
I want to focus today on the threat of climate change. Overwhelming
scientific evidence shows that carbon dioxide from human activity
has increased the atmospheric level of CO2 by roughly 40 percent,
a level one- third higher than any time in the last 800,000 years.
There is also a consensus that CO2 and other greenhouse gas emissions
have caused our planet to change. Already, we have seen the loss
of about half of the summer arctic polar ice cap since the 1950s,
a dramatically accelerating rise in sea level, and the loss of
over two thousand cubic miles of glacial ice, not on geological
time scales but over a mere hundred years.
The Intergovernmental Panel on Climate Change (IPCC) projected
in 2007 that, if we continued on this course, there was a 50
percent chance of global average air temperature increasing by
more than 7 degrees Fahrenheit in this century. A 2009 MIT study
found a fifty percent chance of a 9 degree rise in this century
and a 17 percent chance of a nearly 11 degree increase. 11 degrees
may not sound like much, but, during the last ice age, when Canada
and much of the United States were covered all year in a glacier,
the world was only about 11 degrees colder. A world 11 degrees
warmer will be very different as well. Is this the legacy we
want to leave our children and grandchildren?
Denial of the climate change problem will not change our destiny;
a comprehensive energy and climate bill that caps and then reduces
carbon emissions will.
America has the opportunity to lead a new industrial revolution
of creating sustainable, clean energy. We can sit on the sidelines
and deny the scientific facts, or we can get in the game and
play to win.
Opponents of this effort claim the nation cannot afford to act
at this time. I disagree, and so do the Environmental Protection
Agency and the Congressional Budget Office. These organizations
estimate that meeting the greenhouse gas targets in the House
bill can be achieved at an annual cost between 22 to 48 cents
per day per household in 2020. Thats about the price of
a postage stamp per day.
History suggests that the actual costs could be even lower. The
costs to save our ozone layer, to reduce smog with catalytic
converters, and to scrub the sulfur dioxide from power plants
were all far less than estimated. For example, according to the
EPA, the SO2 reductions will be achieved for one-quarter of the
estimated cost.[1] The right clean energy incentives will start
the great American research and innovation machine, and I am
confident that American ingenuity will lead to better and cheaper
climate solutions.
We can make significant near-term carbon reductions through energy
efficiency. We use 40 percent of our energy in buildings. I firmly
believe that, with todays technologies, we can build new
homes and buildings that use 40 percent less energy than todays
new buildings and therefore save money on energy bills. By developing
a system integration approach, I believe we could eventually
build buildings that use 80 percent less energy with investments
that pay for themselves in less than 15 years through reduced
energy bills. Similarly, we could retrofit existing buildings
to achieve 50 percent energy savings with investments that will
pay for themselves.
A comprehensive energy and climate bill will drive American innovation
in fuel efficient automobiles and the development of advanced
batteries for electric vehicles. It will offer incentives to
re-start our nuclear power industry and encourage utilities to
invest in carbon capture and sequestration. It will drive investments
in wind and solar power and next generation biofuels from grasses
and agricultural waste.
In addition to deploying the technologies we have today and can
see on the horizon, we must pursue truly transformative solutions.
Climate experts, such as the IPCC, tell us we must reduce our
carbon emissions by 80 percent by mid-century to stabilize atmospheric
greenhouse gas concentrations at a level that may avoid the worst
consequences of climate change. To achieve our long-term goals
in a more cost-effective way, we will need a sustained commitment
to research and development. Only R & D can deliver a new
generation of clean technologies.
Let me close with a quote from Dr. Martin Luther King. His words
seem so fitting for todays climate crisis:
We are now faced with the fact, my friends, that tomorrow
is today. We are confronted with the fierce urgency of now. In
this unfolding conundrum of life and history, there is such a
thing as being too late.
Now is the time to take comprehensive and sustained action. With
the leadership of the President, the actions of this Congress,
and the support and participation of the American people, I am
confident that we will succeed.

ROLE OF RURAL AMERICA IN COMBATING CLIMATE CHANGE
Vilsack Testifies in Senate Committee on
Cap and Trade Legislation with Secretaries Chu and Salazar and
Administrator Jackson
WASHINGTON, D.C., July 7, 2009 - U.S. Secretary
of Agriculture Tom Vilsack today testified to the Senate Environment
and Public Works Committee on the role that rural America can
play in addressing climate change. Secretary Vilsack discussed
the importance of engaging farmers and ranchers in crafting the
solution to this critical issue, and highlighted many potential
economic benefits to rural communities in a cap and trade program.
Below are excerpts from Secretary Vilsack's
prepared testimony:
"Climate change is one of the great
challenges facing the United States and the world. The science
is clear that the planet is already warming. While climate change
will affect us all, there are particular vulnerabilities and
challenges for farmers, ranchers, and those who make a living
off the land.
"I believe it is crucial that we engage
the participation of farmers, ranchers, and forest landowners.
This issue is too important for agriculture and forestry to sit
on the sidelines. A viable carbon offsets market - one that rewards
farmers, ranchers, and forest landowners for stewardship activities
- has the potential to play a very important role in helping
America wean itself from foreign oil. It also represents a significant
building block to revitalizing rural America. Landowners can
also play an important role in providing low-carbon renewable
energy.
"There are significant opportunities
for rural landowners in a cap and trade program that recognizes
the contribution that farms, ranches, and forests can make in
addressing climate change. Rural landowners can benefit from
incentives in climate and energy legislation that reward production
of renewable energy such as wind and bioenergy. A number of renewable
energy technologies such as anaerobic digesters, geothermal,
and wind power can reduce farmers' reliance on fossil fuels.
In cooperation with the Department of Energy, USDA will contribute
to promoting these technologies and our outreach and extension
networks will need to help make them available to farmers, ranchers,
and land managers.
"These technologies and promotion
of a clean energy economy will also stimulate the creation of
new jobs. As farmers, ranchers, and land managers look to install
an anaerobic digester or build a wind farm - people will be needed
to build the machines and install the systems. And, because many
of these technologies will be utilized in rural areas - many
of these jobs could be created in rural America. These farmers,
ranchers, and forest owners can also benefit from legislation
that creates markets for greenhouse gas offset credits.
"To produce meaningful emissions reductions,
an offsets program will likely require the participation of thousands
of landowners. I believe USDA, working with EPA, the Department
of Energy, the Department of Interior, and other relevant agencies
can play a very important role in getting offsets to scale while
ensuring the integrity of the offsets program. We look forward
to partnering with our fellow agencies to work with the Senate
in designing a credible offsets program.
"It is important that agriculture
and forestry offsets have high standards of environmental integrity.
Quantification and reporting systems need to be rigorous, verifiable,
and transparent - and review and auditing systems will need to
be in place. Uncertainties must be accounted for and reduced.
Greenhouse gas benefits accrued through carbon sequestration
will need to be monitored over time to ensure that the benefits
are maintained and that reversals are accounted for if they occur.
If these principles are followed, the resulting offsets should
be real, additional, verifiable, and lasting."

New FAA Chief Counsel Brings Long and Diverse
Experience
WASHINGTON Federal Aviation Administration (FAA) Administrator
Randy Babbitt has announced the appointment of David Grizzle
as the new FAA chief counsel.
"David Grizzle has top-level experience and I'm looking
forward to having him on the team," Babbitt said. "He
understands the challenges of leading a diverse, international
organization, as well as the complex interaction between governmental
processes and our ultimate stakeholders, the American people."
Grizzle comes to the FAA following a 22-year career with Continental
Airlines, Inc. From 2005 to 2008 he served as senior vice president
of customer experience, where he was charged with developing
and implementing new operating strategies and improving product
deficiencies and services. From 1986 to 2004 Grizzle served in
many other leadership positions at the airline, including senior
vice president of marketing strategy and corporate development,
where he headed up a group of 150 finance, planning, operations
and marketing professionals.
From 2004 to 2005, Grizzle was tapped by the U.S. Department
of State and took leave from Continental to serve as the transportation
and infrastructure coordinator and attaché for the Afghanistan
Reconstruction Group, Kabul, Afghanistan. In Afghanistan, he
worked with the FAA and other government organizations to accelerate
reconstruction efforts for air and surface transportation projects
as well as power, and telecommunications.
Prior to his career at Continental, Grizzle served as vice president
of administration and general counsel for New York Air, Inc.
from 1984 to 1986. From 1978 to 1984 he practiced law at several
New York-based law firms, including as a partner at Kellner,
Chehebar, Deveney & Grizzle from 1983 to 1984.
Grizzle is a graduate of Harvard College and Harvard Law School.
He is married and has three children.

Obama Administration Awards More than
$153 Million for State Energy Programs in Seven States and Territories
Funding Will Speed Adoption of Efficiency
and Renewable Energy Technologies in Arkansas, Georgia, Kentucky,
Mississippi, Montana, New York, and the Virgin Islands
WASHINGTON, DC U.S. Department of Energy Secretary Steven
Chu today announced more than $153 million in Recovery Act funding
to support energy efficiency and renewable energy projects in
Arkansas, Georgia, Kentucky, Mississippi, Montana, New York,
and the U.S. Virgin Islands. Under DOEs State Energy Program,
states and territories have proposed statewide plans that prioritize
energy savings, create or retain jobs, increase the use of renewable
energy, and reduce greenhouse gas emissions. This initiative
is part of the Obama Administrations national strategy
to support job growth, while making a historic down payment on
clean energy and conservation.
This funding will provide an important boost for state
economies, help to put Americans back to work and move us toward
energy independence," said Secretary Chu. "It reflects
our commitment to support innovative state and local strategies
to promote energy efficiency and renewable energy while insisting
that taxpayer dollars be spent responsibly."
The following states and territories are receiving 40 percent
of their total State Energy Program (SEP) funding authorized
under the American Recovery and Reinvestment Act today: Arkansas,
Georgia, Kentucky, Mississippi, Montana, New York, and the Virgin
Islands.
With today's announcement, these states and territories will
now have received 50 percent of their total Recovery Act SEP
funding. The initial 10 percent of total funding was previously
available to states to support planning activities; the remaining
50 percent of funds will be released once states meet reporting,
oversight, and accountability milestones required by the Recovery
Act.
Under the Recovery Act, DOE expanded the types of activities
eligible for State Energy Program funding, which include energy
audits, building retrofits, education and training efforts, transportation
programs to increase the use of alternative fuels and hybrid
vehicles, and new financing mechanisms to promote energy efficiency
and renewable energy investments.
The Recovery Act appropriated $3.1 billion to the State Energy
Program to help achieve national energy independence goals and
promote local economic recovery. States use these grants at the
state and local level to create green jobs, address state energy
priorities, and adopt emerging renewable energy and energy efficiency
technologies.
Transparency and accountability are important priorities for
SEP and all Recovery Act projects. Throughout the programs
implementation, DOE will provide strong oversight at the local,
state, and national level, while emphasizing with states the
need to quickly award funds to help create new jobs and stimulate
local economies.
The following states are receiving awards today:
ARKANSAS $15.7 Million Awarded Today
Arkansas will use State Energy Program Recovery Act funding to
reduce energy consumption and advance energy independence by
implementing several energy efficiency and renewable energy programs.
These programs will also help create and support jobs within
the state. Arkansas will use over half of its SEP Recovery Act
funding to establish two loan programs to encourage industry
and state buildings to invest in energy efficiency technologies.
These energy efficiency upgrades will reduce utility bills for
both sectors and make businesses more profitable.
After demonstrating successful implementation of its plan, the
state will receive almost $20 million in additional funding,
for a total of nearly $40 million.
GEORGIA $32.9 Million Awarded Today
Georgia will implement several programs to improve energy efficiency
and renewable energy across residential, commercial, industrial
and governmental sectors with SEP Recovery Act funding. Together
these programs will advance the countrys energy independence
and create and support jobs statewide.
The state will use a large portion of the Recovery Act funding
to implement the State Utilities Retrofit Program, administered
by the Georgia Environmental Facilities Authority. In this new
program, the state of Georgia proposes to allocate $65 million
to retrofit state government facilities. This funding will be
used to conduct energy audits and assessments and capital projects
to pay for the incremental cost difference between standard and
high-efficiency technologies. Proposals for funding will be selected
based on the projects ability to comply with state and
federal energy goals and priorities, including energy independence,
reduction of greenhouse gas emissions, and the creation of green
jobs.
After demonstrating successful implementation of its plan, the
state will receive more than $41 million in additional funding,
for a total of almost $82.5 million.
KENTUCKY $21 Million Awarded Today
Kentucky will utilize State Energy Program funding from the Recovery
Act to advance energy efficiency and renewable energy initiatives,
creating and saving jobs across the state. Kentucky will reduce
energy consumption through energy efficiency and education assistance
to state and local agencies, schools, nonprofits, and the commercial,
industrial and agricultural sectors. These programs will include
energy audits and funding assistance for building retrofits in
schools and public buildings to reduce operating expenses and
save taxpayers money.
Recovery Act SEP funding will also be used to educate students,
teachers, and administrators on energy issues, which will expand
the knowledge base of younger generations and help provide an
understanding of how personal habits can affect energy consumption.
Equipping the public and the states youth with the ability
to assess the effects of these habits can greatly reduce our
energy dependence.
After demonstrating successful implementation of its plan, the
state will receive over $26 million in additional funding, for
a total of more than $52.5 million.
MISSISSIPPI $16.1 Million Awarded Today
Mississippi will use its State Energy Program funding through
the Recovery Act to promote energy efficiency in state buildings
and initiate selected renewable energy projects. The state plans
to initiate a lead by example program to enhance
energy efficiency in state buildings, including the installation
of advanced smart meters to monitor real-time energy consumption.
Meters that can gather energy data quickly and identify equipment
problems will be installed in various state agencies. The agencies
will then be able to analyze their energy use data to know exactly
how much energy their facilities are using at any given time
so that they can reduce consumption and unnecessary power use
where possible. The state will also provide grants, loans, or
other incentives to municipalities in Mississippi to purchase
hybrid and alternative-fueled vehicles.
In addition, Mississippi will design and implement selected pilot
projects for renewable energy installations, targeting several
sectors including commercial, industrial, residential, and transportation.
On a competitive basis this program will provide incentives to
public and private entities to build or expand renewable energy
production or manufacturing facilities that produce energy or
transportation fuels from biomass, solar or wind resources.
After demonstrating successful implementation of its plan, the
state will receive an additional $20 million, for a total of
$40 million.
MONTANA $10.3 Million Awarded Today
Montana will use its Recovery Act funding to undertake projects
that will improve the energy efficiency of state buildings, while
expanding renewable energy use and recycling infrastructure in
the state. State Energy Program funds will support energy efficiency
improvements to fifty state-owned buildings and will provide
for a significant expansion of the State Buildings Energy Conservation
Program. The state will also use Recovery Act funds for grants
to speed the implementation of new clean energy technologies
that have moved into the production phase but are not yet well
known or utilized in the state.
In addition, the Montana Department of Environmental Quality
(DEQ), which oversees the SEP program, will be able to increase
the amount it lends in low-interest loans to consumers, businesses,
and nonprofit organizations to install various renewable energy
systems, including wind, solar, geothermal, hydro and biomass.
Under the State Energy Program, DEQ will also expand the states
recycling infrastructure to help limit the quantity of recyclable
materials that end up in landfills. As a result of the states
rural nature with small population centers and long distances
between communities, it is often difficult to cost effectively
recycle materials. With an expanded recycling infrastructure,
the state will be able to reduce the need for new materials to
be mined and manufactured, which saves energy at all stages of
the processing.
After demonstrating successful implementation of its plan, the
state will receive an additional $13 million, for a total of
$25 million.
NEW YORK $49.2 Million Awarded Today
New York will direct its State Energy Program Recovery Act funding
to programs that will accelerate the introduction of alternative-fuel
vehicles into New York communities, boost the energy efficiency
of buildings across the state, increase compliance with the states
energy codes, and expand the use of solar power.
The Clean Fleet program will provide funding for eligible entities
- such as cities, counties, public school districts, public colleges
and universities and others - to accelerate the deployment of
alternative fuel vehicles in their fleets. Recovery Act funding
will also provide financial support for energy efficiency and
retrofit projects in the municipal, K-12 public schools, public
university, hospital, and not-for-profit sectors.
A third project aims to achieve at least 90 percent compliance
in the commercial and residential sectors for a new statewide
Energy Code. With Recovery Act funding, the state will offer
technical assistance and local compliance support to local municipal
officials, as well as those professions who work closely with
energy code buildings, such as architects, engineers, and home
builders. Finally, New York will provide SEP funding to encourage
installation of a range of solar photovoltaic (PV) and solar
thermal systems across the state, and to provide training opportunities
for installers.
After demonstrating successful implementation of its plan, the
state will receive an additional $61.5 million, for a total of
$123 million.
VIRGIN ISLANDS $8.2 Million Awarded
Today
The U.S. Virgin Islands will utilize its State Energy Program
Recovery Act funding to advance energy efficiency initiatives
and renewable energy projects on the islands. The Virgin Islands
Energy Office (VIEO) will establish or expand multiple programs
to reduce energy demand in buildings and the transportation sector
through energy efficiency education, outreach, and financial
assistance.
Buildings initiatives that will receive Recovery Act funding
include an expansion of VIEOs existing Energy Star Rebate
program, which provides incentives for consumers to purchase
energy-efficient products. VIEO will also direct SEP funding
to the development and implementation of energy education and
training programs to promote energy efficiency in the design,
construction, installation and maintenance of a wide variety
of buildings and energy systems.
VIEO will also work to implement a financial incentive program
for residents to encourage the purchase of hybrid and electric
vehicles.
After demonstrating successful implementation of its plan, the
Virgin Islands will receive over $10 million in additional funding,
for a total of more than $20.5 million.

The FCKeditor project has released FCKeditor
version 2.6.4.1 to
address a vulnerability. This vulnerability is due to improper
verification of input passed to the "CurrentFolder"
parameter.
Exploitation of this vulnerability may allow an attacker to execute
arbitrary code.
Additionally, FCKeditor is part of Adobe
ColdFusion 8 and is enabled
by default. The Adobe Product Security Incident Response Team
(PSIRT)
has posted a blog entry indicating that they are aware of public
reports of ColdFusion websites being targeted for exploitation
of this
vulnerability.
US-CERT encourages users and administrators

Microsoft has released Security Advisory
972890 to alert users about a
vulnerability in Microsoft Video ActiveX Control. Exploitation
of this
vulnerability may allow an attacker to execute arbitrary code.
The
advisory also indicates that Microsoft is aware of attacks attempting
to exploit the vulnerability.
US-CERT encourages users and administrators
to review Microsoft
Security Advisory 972890 and implement the workaround listed
in the
advisory. This workaround will help mitigate the risks until
a patch
or update is released by the vendor.

SECRETARY DONOVAN ANNOUNCES RECOVERY
ACT FUNDS TO SUPPORT COMMUNITY DEVELOPMENT IN ALABAMA
First award made under the Recovery CDBG
program will revitalize neighborhoods and create jobs
WASHINGTON - In an effort to stimulate
community development and job growth, U.S. Housing and Urban
Development Secretary Shaun Donovan today announced $1.8 million
in funding to Birmingham, Alabama through the American Recovery
and Reinvestment Act of 2009 (Recovery Act). The announcement
came at the HUD field office in Birmingham, where the Secretary
was joined by Congressman Artur Davis.
This is the first of 1200 Recovery Act-funded
grants awarded through the Community Development Block Grant
(CDBG) Program, which primarily benefit low- to moderate-income
families living in these communities. CDBG enables state and
local governments to undertake a wide range of activities intended
to create suitable living environments, provide affordable housing
and create economic opportunities. Under the Recovery Act, recipients
give priority to prudent projects that can award contracts based
on bids within 120 days of the grant agreement. A total of $1
billion will be awarded nationwide by HUD in Recovery Act Community
Development Block Grants.
"Today, we make another critical investment
in the economic recovery of our communities most affected by
the national economic crisis," said Donovan. "I am
proud to announce the first Community Development Block Grant
going to the City of Birmingham, which will create jobs and help
to revitalize the city's hardest hit neighborhoods. President
Obama and I are anxious to put this money to work long-term,
sustainable community development."
Birmingham, specifically, will use its
$1.8 million in Recovery Act CDBG funds to award rehabilitation
grants to homeowners who are at least 30% below Birmingham's
median family income to make critical home repairs. This funding
will also create jobs for small, local contractors in Birmingham,
and will continue to provide a steady stream of work for those
contractors over the next 24 months.
President Obama directed all Recovery Act
funding to be spent responsibly and in a transparent manner in
order to provide a necessary economic boost, create jobs, and
strengthen America's middle class. In a letter to CDBG recipients
of Recovery Act funds, Donovan wrote, "In accepting these
funds, it is imperative that you be good stewards of these precious
taxpayer dollars by focusing your efforts on the Recovery Act
goals of investing in infrastructure that will create or sustain
jobs in the near-term and generate maximum economic benefits
in the long-term."
Since 1974, CDBG has provided more than
$127 billion to state and local governments to target their own
community development priorities. The rehabilitation of affordable
housing and the construction and improvement of public facilities
have traditionally been the largest uses of CDBG funds although
the program is also an important catalyst for job growth and
business opportunities. Annual CDBG funds are distributed to
communities according to statutory formulas based on population,
poverty, pre-1940 housing stock, growth lag, and housing overcrowding.
HUD is committed to implementing Recovery
Act investments swiftly and effectively as they generate tens
of thousands of jobs, modernize homes to make them energy efficient,
and help the families and communities hardest hit by the economic
crisis. The Recovery Act includes $13.61 billion for projects
and programs administered by HUD, nearly 75 percent of which
was allocated to state and local recipients only eight days after
President Obama signed the Act into law. The CDBG funding was
among the 75 percent that was allocated during that time. Now
as grant recipients' spending plans are approved, HUD is officially
making funding available to spend. The remaining 25 percent of
HUD Recovery Act funds will be awarded through a competitive
process in the coming weeks and months.
In addition, Secretary Donovan and the
Department are committed to providing the highest level of transparency
possible as Recovery Act funds are administered. It is vitally
important that the American people are fully aware of how their
tax dollars are being spent and can hold their federal leaders
accountable. Every dollar of Recovery Act funds HUD spends can
be reviewed and tracked at HUD's Recovery Act website. The full

Secretaries Chu and Locke to Travel
to China Next Week
Pair will focus on clean energy jobs and technology
WASHINGTON -- Energy Secretary Steven Chu and Commerce Secretary
Gary Locke will travel to China from July 14 to 17. The two secretaries
will highlight the tremendous potential for mutually beneficial
relationships in the clean energy sector.
Clean energy will drive the economy of the future, both
in the United States and around the world, Chu said. From
renewable energy to more efficient buildings to carbon capture
and storage, clean energy technologies can create millions of
jobs. Working together, we can accomplish more than acting alone.
Its in our interest and Chinas to explore ways to
cooperate for our mutual benefit -- by promoting renewable energy,
encouraging energy efficiency and cutting pollution.
Most of the events will be in Beijing, but additional travel
is scheduled outside the capital city. The Secretaries will each
depart the U.S. on Monday, July 13th and arrive on Tuesday, July
14.
"Today, we are more interdependent with China than at any
point in the last 30 years," Locke said. "The relationship
between our two countries is of critical importance, and while
great progress has been made in our cooperation on economic,
trade and global terrorism fronts, there's much more to do.
That's especially true in the clean
energy sector. As China confronts climate change, there will
be opportunities for American green technology companies to fill
a critical need, creating jobs here and helping to curb pollution
in China a win-win for both counties."

Dear Mr. President,
I write on behalf of the U.S. Commission
on International Religious Freedom, an independent U.S. government
commission established by Congress to monitor religious freedom
worldwide and make policy recommendations to the executive and
legislative branches. We respectfully urge you to raise human
rights concerns, including freedom of religion or belief, in
your upcoming meeting with Russian President Dmitri Medvedev.
For ten years the Commission has reported
on the status of freedom of religion or belief in Russia, and
this year the Commission decided to add Russia to its Watch List.
This decision was based on several negative new policies and
trends, particularly the establishment in early 2009 of a new
body in the Ministry of Justice with unprecedented powers to
recommend measures to control religious groups. There also are
increasing violations of religious freedom by government officials,
particularly against allegedly non-traditional religious
groups and Muslims, based on the governments interpretation
and application of Russian laws, such as on religious organizations,
non-governmental organizations, and extremism. Russian officials
continue to describe certain religious and other groups as alien
to Russian culture and society, and there has been a sharp rise
in xenophobia and intolerance, including anti-Semitism, resulting
in numerous violent attacks and other crimes. The Russian government
has chronically failed to address these serious problems adequately,
consistently, or effectively.
We ask that you raise with President Medvedev
serious U.S. concerns about the Ministry of Justices new
Expert Council on Religious Studies. The Expert Council was given
wide powers to recommend investigations of religious organizations,
including their activities and literature, for numerous reasons,
including extremism. While governments have a duty to combat
direct incitement to imminent violence and acts of violent extremism
as part of their obligation to protect citizens, there are reasons
for serious concern over the establishment, composition, and
expansive mandate of this new Council. The Councils chairman,
Aleksandr Dvorkin, is Russias most prominent anti-cult
activist and he lacks academic credentials as a religion specialist.
Dvorkins deputy, Roman Silantyev, is noted for his overbroad
characterizations of what constitutes radical Islam. Observers
are concerned that under Dvorkins leadership, the Council
may call for the closure of registered organizations, including
Evangelical Protestant and Jehovahs Witnesses communities,
and unregistered minority religious communities, particularly
the Council of Churches Baptists. Ominously, the Russian Bible
Society was highlighted in a discussion during the first meeting
of the Council.
The sharp deterioration in the human rights
climate appears to be a direct consequence of the authoritarian
stance of the Russian government, as well as the growing influence
of chauvinistic groups in Russian society, which seem to be tolerated
by the government. We encourage you to highlight the importance
of fair and effective methods of combating acts of violent extremism,
including towards religious minorities, as a priority issue.
In connection, over the past several years,
a major threat to religious freedom has emerged in the Russian
governments amendment and application of the countrys
anti-extremism law, which defines extremist activity in a religious
context. As is the case in many other countries, the Russian
government faces major challenges as it addresses acts of terrorism
that claim a religious linkage, while also protecting freedom
of religion or belief and other human rights. However, NGOs and
human rights activists report numerous cases of Muslims being
prosecuted for extremism or terrorism even though the individuals
had no apparent relation to such activities. Such policies toward
Russian Muslims, which constitute the countrys second largest
religious community, risk increasing instability and exacerbating
radicalism. We hope that you will find a way to convince the
Russian government to adopt new policies to more effectively
address security concerns as well as the problems faced by the
countrys diverse ethnic and religious groups, particularly
in the North Caucasus region.
Thank you for your attention to these issues.
Raising U.S. concerns about the retreat away from fundamental
freedoms would make clear the United States commitment
to human rights and religious freedom in our bilateral relationship
with the Russian Federation.

Overview
An unpatched vulnerability in the Microsoft
Video ActiveX control
is being used in attacks.
I. Description
Microsoft has released Security Advisory
(972890) to describe
attacks on a vulnerability in the Microsoft Video ActiveX control.
Because no fix is currently available for this vulnerability,
please see the Security Advisory and US-CERT Vulnerability Note
VU#180513 for workarounds.
II. Impact
A remote, unauthenticated attacker could
execute arbitrary code
with the privileges of the victim user.
III. Solution
Apply workarounds
Microsoft has provided workarounds for
this vulnerability in
Security Advisory (972890). Additional details and workarounds
are
provided in US-CERT Vulnerability Note VU#180513.
The most effective workaround for this
vulnerability is to set kill
bits for the Microsoft Video ActiveX control, as outlined in
the
documents noted above. Other workarounds include disabling
ActiveX, as specified in the Securing Your Web Browser document,
and upgrading to Internet Explorer 7 or later, which can help
mitigate the vulnerability with its ActiveX opt-in feature.
