2009 net income jumps 61%
SAN FRANCISCO (MarketWatch) -- Berkshire Hathaway said Saturday
that 2009 net income jumped 61% as the economy stabilized and
a market rebound boosted the value of the company's investments.
Net income attributable to Berkshire was $8.1 billion, or $5,193
per class A share, last year. That compares to net income of
$5 billion, or $3,224 per class A share, in 2008, when the financial
crisis hit. Berkshire's net worth rose 19.8% in 2009, while the
Standard & Poor's 500 index returned 26.5%, including dividends.
Change in net worth is the way Berkshire Chairman Warren Buffett
prefers to measure the company's performance.

Today, at a White House forum hosted by Vice President Joe Biden,
the U.S. Department of Labor announced two new rules designed
to enhance retirement security and transparency for the millions
of workers covered by 401(k), pension and other retirement arrangements.
The announcement was part of the White House Middle Class Task
Force's year-end report, which the vice president released at
this morning's event.

Oil and Gas Bonds: Bonding Requirements and BLM Expenditures
to Reclaim Orphaned Wells, January 27, 2010
The Federal Land Policy and Management Act of 1976 directs the
Department of the Interior (Interior) to manage lands for multiple
uses while also taking any action to prevent "unnecessary
or undue degradation" of the land. To do this, Interior's
Bureau of Land Management (BLM), among other things, requires
oil and gas operators to reclaim the land they disturb and post
a bond to help ensure they do so. Despite these requirements,
not all operators perform reclamation. If the bond is not sufficient
to cover well plugging and surface reclamation and there are
no responsible or liable parties, the well is considered "orphaned,"
and BLM uses federal dollars to fund reclamation. The 12 western
states where most oil and gas production occurs and other Interior
agencies also require bonds to ensure reclamation. GAO was asked
to (1) determine the number, value, and coverage of bonds held
by BLM for oil and gas operations; (2) determine the amount that
BLM has paid to reclaim orphaned wells over the past 20 years
and the number of orphaned wells BLM has identified but has not
yet reclaimed; and (3) compare BLM's bonding requirements for
oil and gas operations with those the 12 western states use for
oil and gas operations on state and private lands and other Interior
agencies' bonding requirements for other resources. Among other
things, GAO analyzed BLM data on wells and BLM-held bonds, and
interviewed BLM officials. According to GAO's analysis of BLM
data, as of December 2008, oil and gas operators had provided
3,879 bonds, valued at $162 million, to ensure compliance with
lease terms and conditions for 88,357 wells. BLM regulations
establish minimum bond amounts: $10,000 for an individual lease,
$25,000 to cover all leases of a single operator in a state,
and $150,000 to cover all leases of a single operator nationwide.
The bond amount for individual leases was set in 1960, while
the statewide and nationwide bond amounts were set in 1951. For
fiscal years 1988 through 2009, BLM spent about $3.8 million
to reclaim 295 orphaned wells in 10 states and has identified
an additional 144 orphaned wells in 7 states that need to be
reclaimed, according to BLM. The amount spent per reclamation
project varied greatly, from a high of $582,829 for a single
well in Wyoming in fiscal year 2008 to a low of $300 for 3 wells
in Wyoming in fiscal year 1994. BLM reclamation cost estimates
were not available for all of the wells it has yet to reclaim,
but BLM field office officials have completed reclamation cost
estimates of approximately $1.7 million for 102 of the 144 orphaned
wells. The 12 western states (Alaska, Arizona, California, Colorado,
Idaho, Montana, Nevada, New Mexico, Oregon, Utah, Washington,
and Wyoming) and other Interior agencies and offices have bonding
approaches that differ from BLM's oil and gas bonding requirements.
The states generally require higher bond amounts than the minimum
amounts established by BLM regulations for individual and statewide
oil and gas leases. Regulations governing the extraction or use
of other federally owned resources generally require bond amounts
based on the cost of reclamation or use minimum amounts that
were established more recently than the bond amounts for oil
and gas. GAO provided a draft of this report to the Department
of Interior for review and comment. The Department provided technical
comments, which were incorporated as appropriate.

Federal Education Funding: Overview of K-12 and Early Childhood
Education Programs, January 27, 2010
The federal government invests in the education of children,
in part, to help ensure that the United States has a well-educated
and skilled workforce to compete in the global marketplace. The
federal government accounts for about nine percent of the total
investment in K-12 education, with state and local sources covering
the rest. Over the last two decades there have been a number
of efforts to catalogue and determine how much is spent on federal
education programs. However, because education programs are administered
by agencies throughout the federal government, and there is no
standard definition of a federal education program, there currently
is no single source that legislators and policymakers can refer
to for an accounting of federal education programs. To address
Congressional interest in these issues, we answered the following
questions: (1) What is the federal expenditure on K-12 and early
childhood education programs? (2) What are the characteristics
of these programs? (3) To what extent have these programs completed
evaluations? In summary, (1) The federal government provided
an estimated $166.9 billion over the 3-year period from fiscal
years 2006-2008--for an average of $55.6 billion per year--to
administer 151 different federal K-12 and early childhood education
programs. (2) Federal K-12 and early childhood education programs
have a variety of goals, although serving disadvantaged populations
was cited most frequently by survey respondents. (3) Agencies
reported that 65 of the 151 programs have completed program evaluations.
In addition, of the 20 programs with the largest funding amounts,
representing 90 percent of fiscal year 2006-2008 funding, 12
reported performing program evaluations, and 3 reported evaluations
under way.

DOD Assessments of Supplier-Base Availability for Future Defense
Needs, January 27, 2010
The Department of Defense (DOD) relies on thousands of suppliers
to ensure it has the weapons and supporting equipment needed
to meet U.S. national security objectives. Congress has provided
DOD with a variety of authorities to allow it to maintain information
on its suppliers and to take actions to ensure that its suppliers
can deliver needed items. In October 2008, we reported on our
assessment of DOD's efforts to monitor the health of its supplier
base and identify and address gaps and recommended that DOD develop
a departmentwide framework and consistent approach, which DOD
has begun to implement. In light of increased globalization in
the defense industry and consolidation of the defense supplier
base into a few prime contractors, Congress requested that we
review DOD's efforts to assess supplier-base availability for
future defense needs. Both DOD and Commerce conduct assessments
of supplier-base availability for defense needs that generally
focus on the next 5 years. Several offices within DOD and Commerce's
Office of Technology Evaluation have a role in assessing supplier-base
availability, primarily conducting short-term assessments of
selected sectors or existing weapon programs. In 2004, DOD's
Office of Industrial Policy conducted a one-time series of comprehensive
DOD-wide assessments of supplier-base availability that forecasted
10-20 years into the future. According to DOD and Commerce officials,
assessments of future supplier-base availability for defense
needs beyond a 5-year time frame can have limitations, in part,
because it can be difficult to predict technologies and whether
investment in the supplier base will be needed to support these
technologies. Recently, the National Research Council and an
industry association recommended that DOD continually assess
the supplier base from a more strategic perspective to include
its availability for long-term defense needs. DOD has not acted
on these recommendations; however, DOD plans to incorporate industrial-base
considerations into its 2010 Quadrennial Defense Review to raise
awareness of long-term, future, supplier-base availability for
defense needs.

Economic Growth Another Positive Sign
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement today after
the Commerce Department revised their report of economic growth
for the last quarter of 2009 upward, from 5.7% to 5.9%:
News that the economy grew by 5.9% in the last quarter
of 2009 is another encouraging sign that steps taken by the Obama
Administration and this Congress are working to turn the economy
around. This represents a large change in direction from just
one year ago, when the economy shrunk by -5.4%. Were also
seeing dramatically fewer job losses, and a stronger stock market.
While we are heartened to see clear signs of progress,
these numbers mean little to families who remain out of work,
or who are still struggling to make ends meet. The Senate passed
a jobs bill this week by a strong bipartisan vote, and the House
will move in the near-term as well, I hope also in a bipartisan
manner. Our top priority this year continues to be creating jobs,
and we will remain focused on taking action and get America back
to work.

OCC Takes Balanced Approach in Examinations, But Warns that Lower
Demand, Distressed Banks, and Tighter Underwriting Present Ongoing
Challenges to Loan Growth
WASHINGTON Comptroller of the Currency John C. Dugan told
a Congressional panel today that access to credit is critical
to the health of our nations economy and that national
banks play a vital role in meeting this need.
The OCC has always encouraged national banks to lend to
creditworthy borrowers, he said in testimony before a joint
hearing of the House Financial Services Committee and the House
Small Business Committee. In fact, banks cannot be healthy
and profitable if they do not continue to focus on making sound
loans to businesses and consumers.
The Comptroller said one reason for reduced
lending is the lack of demand. In the face of economic uncertainty,
both consumers and businesses have cut back on spending, he said.
However, he added, lenders have also become more cautious. Loan
underwriting standards have tightened, reflecting a return to
more prudent practices, and some banks have shifted resources
away from lending so they can deal with problem loans.
We recognize that this environment presents particular
challenges to the OCC and the other banking regulators,
Comptroller Dugan said. It is imperative that we take a
balanced and consistent supervisory approach to ensure that our
actions do not discourage banks from making loans to creditworthy
borrowers.
The Comptroller said the OCC has consistently instructed examiners
not to tell bankers which loans to approve and which to deny,
and not to criticize loans based simply on collateral values
or a borrowers association with a particular industry or
geographic location.
Instead, the OCC has stressed that national
banks should:
Make sound loans to creditworthy borrowers;
Work with borrowers who are facing difficulties; and
Recognize and address problem credits by maintaining appropriate
reserves and taking charge-offs when payment is unlikely.
Mr. Dugan also struck a cautionary note,
saying that 185 banks have failed since the onset of the financial
crisis, and failures are likely to be up this year over 2009.
While we should be very careful not to encourage the banks
we supervise to become excessively conservative, we simply cannot
turn a blind eye to increasing losses and mounting credit problems,
he said. In this environment, we need to avoid the kind
of forbearance that put off problems and caused such huge losses
in the savings and loan crisis, an experience that led Congress
to enact the Prompt Corrective Action regulatory regime in 1991.
Prompt Corrective Action, he said, reinforced
to supervisors how important it is for institutions to realistically
recognize losses and deal with them both to avoid further
problems and, more important, to put themselves in a better position
going forward to make loans to creditworthy borrowers.

The millions of Americans suffering in
a health care system that costs too much, and denies too many

Steny H. Hoyer (MD) released the following statement today after
President named members to the bipartisan National Commission
on Fiscal Responsibility and Reform:
Today, President Obama named four members to the bipartisan
National Commission on Fiscal Responsibility and Reform, which
is charged with the crucial national goal of developing recommendations
to return our budget to balance. President Obama appointed David
Cote, Chairman, CEO, and President of Honeywell; Ann Fudge, former
chairman and CEO of Young & Rubicam Brands; Alice Rivlin,
senior fellow at the Brookings Institution, former Vice Chair
of the Federal Reserve Board, and Director of the White House
Office of Management and Budget; and Andy Stern, President of
the Service Employees International Union.
This is a team well-suited to contribute to the task of
rebuilding our fiscal responsibility. It combines proven business
leadership, public policy expertise, and advocacy for the working
Americans who are most directly affected by our federal entitlement
programs. As both parties in Congress nominate their own members
of the Commission, it is essential that they choose men and women
who are ready to compromise and make the tough decisions our
countrys fiscal future demands. Given the urgency of our
mounting debt, no options can be taken off of the Commissions
table.

[Taking Recovery Act funds] was the
right thing to do. Our economy was going off into the abyss and
if we didn't have those monies, we would have had 87,000 people
out of work today in the Sunshine State. Twenty thousand of those
are educators, and how many people does that translate into in
terms of the children they teach?... It was the right thing to

Economy Highlights:
Today, the Department of Commerce
announced that the fourth quarter 2009 gross domestic product
(GDP) was revised upward to 5.9% from its previous reading of
5.7%, the strongest pace in over six years. Fourth-quarter
GDP was helped by spending effects of the government's $787 billion
stimulus and also by companies restocking their inventories,
which they allowed to diminish during the recession. [Wall

Another sign that the housing market is continuing to
recover, the Standard & Poor's/Case-Shiller home-price index
reported this week that home prices continued to climb
for the seventh consecutive month in December
prices of
single-family homes rose in most parts of the country when adjusted
for seasonal factors, climbing 0.3 percent in December from November.
That's the biggest monthly rise since August. [Washington

According to retail-sector reports
released this week, three major national retail chains reported
solid quarterly earnings for the time period including the holiday
shopping season. Retailers have resuscitated their bottom
lines after the dark days of the recession, thanks to heavy cost-cutting,
inventory reductions and stabilizing consumer spending.

Office found that the American Recovery and Reinvestment Act
is having the intended effect of creating jobs and growing the
economy. A report released this week estimates that there
were between 1 million and 2.1 million more jobs during the last

Emergency Management Agency).
FMAC + MSC = FMIX
The Contact Center for the Map Service
Center (MSC) has been consolidated into the current FEMA Map
Assistance Contact Center (FMAC) to increase efficiency as it
will provide a one-stop shop for a variety of information, products,
services and tools that support the National Flood Insurance
Program (NFIP).
The toll-free number currently used by
the FMAC, 1-877-FEMA MAP (1-877-336-2627) should be used instead
of the MSC number (1-800-358-9616). This MSC number will still
be in use for a while, but will be discontinued by the end of
April 2010.
In addition, to reflect the consolidation
of the contact centers the name of the FEMA Map Assistance Center
(FMAC) will change to the FEMA Map Information eXchange, or FMIX.
As stated, the phone number for the
FMIX is the same as before, 1-877-FEMA
MAP (1-877-336-2627).
This change will occur as of Monday March
1, 2010.
The FMIX, looks forward to helping you with any FEMA map related

NRC 22ND ANNUAL REGULATORY INFORMATION
CONFERENCE
MARCH 9-11 HIGHLIGHTS KNOWLEDGE FOR TODAY
AND TOMORROW
The Nuclear Regulatory Commission will
hold its 22nd annual Regulatory Information Conference (RIC)
March 9-11 at the Bethesda North Marriott Hotel and Conference
Center, 5701 Marinelli Road, Bethesda, Md. This years conference
theme is Knowledge for Today and Tomorrow. This annual conference
brings together more than 3,000 participants from 32 countries
to provide an opportunity for government, industry, international
agencies and other interested stakeholders and members of the
public to meet and discuss safety initiatives and regulatory
trends.
Agency speakers at the conference will
include NRC Chairman Gregory B. Jaczko,
Commissioners Dale E. Klein and Kristine
L. Svinicki, and Executive Director for
Operations William Borchardt. This years
special guest speaker is President and Chief Executive Officer
of the Institute of Nuclear Power Operations (INPO), James O.
Ellis, Jr. Located in Atlanta, Ga., INPO is an independent, nonprofit
organization whose mission is to promote the highest levels of
safety and reliability -- to promote excellence -- in the operation
of nuclear electric generating plants.
The conference brings together NRC staff,
nuclear plant owners, nuclear materials users, key industry stakeholders,
representatives from all levels of government, international
regulators, special interest groups, and the public to discuss
key issues affecting the safety and security of commercial nuclear
facilities and current regulatory activities.
Topics at this years RIC include:
applications for new nuclear power plants; regulatory approaches
to new reactor designs; security; safety research; safety culture;
domestic and international nuclear power plant operating experience;
and other technical issues. The conference will also feature
posters, exhibits and models on various nuclear topics of interest.
The RIC also offers tours of the NRCs
Operations Center, which serves as the focal point for coordinating
and communicating with plant personnel, state entities, and other
federal agencies during an emergency involving a nuclear facility
or nuclear materials.
The conference is free and open to the
public. The RIC is a joint presentation of the NRC's Offices
of Nuclear Reactor Regulation and Nuclear Regulatory Research.

MESSAGE FROM THE MAJORITY LEADER
Over the course of the last year, the House
and Senate thoroughly and publicly debated how best to make health
care more affordable and accessible for American families and
small businesses. This week, President Obama invited a bipartisan
group of Members from the House and Senate for a public discussion
on how best to achieve health insurance reform. We discussed
substantive differences, but there were also areas of agreement
among Democrats and Republicans many of which are already
included in the House and Senate-passed bills and the Presidents
proposal. In the days and weeks ahead, I look forward to
moving forward to accomplish the objectives we all agree on
the need to contain rising costs, reform insurance industry practices,
and slow the growth of health care spending and its impact on
the federal budget.
Next month, we will begin working our way through the budget
process, looking to address our deficits and focus on fiscal
responsibility. I was pleased to learn today that President Obama
appointed members to the National Commission on Fiscal Responsibility
and Reform. The proven leadership they bring to the table will
be helpful as they work with Members of Congress to compromise
and make the tough decisions our countrys fiscal future
demands.
We also remain focused on our top priority of job creation. The
Senate passed a jobs bill this week, and I was very encouraged
that twelve Republicans chose to vote for it. I hope they and
their colleagues will continue to work with us in a bipartisan
way so that we can get a final bill to the Presidents desk
very soon.

Hoyer: Republican Obstruction Makes
Hard Times More Difficult For Ordinary Americans
WASHINGTON, DC House Majority Leader
Steny H. Hoyer (MD) released the following statement after Senator
Jim Bunning (R-KY) blocked legislation extending important benefits
to millions of Americans:
Last night, a single Republican Senator, Jim Bunning of
Kentucky, blocked the extension of the benefits that are keeping
Americans heads above water in the greatest economic crisis
since the Depression. And many of his Senate Republican colleagues
are allowing his action to stand.
More than 1 million American workersmost of whom
lost their jobs through no fault of their ownwill stop
receiving unemployment insurance on Monday because of this irresponsible
action. Many Americans will also lose their health insurance,
because Senate Republicans are also blocking the extension of
the COBRA program that helps Americans stay insured after theyve
lost their jobs. Programs to build roads and put Americans to
work will shut down, as well as federal flood insurance for homeowners
will also be affectedand even satellite TV for 2 million
Americans.
Senate Republicans say they are blocking this legislation
because it would add a fraction of a percent to the deficit.
But we didnt hear those concerns when they borrowed billions
give debt-financed tax cuts to the wealthiest Americans. Instead,
they are erecting their fiscal discipline talking points on the
backs of people who have lost their jobs in the Great Recession.
The deficit is serious business, and Congress must take
it seriously. But making these hard times even worse for ordinary
Americans is not going to make any measurable difference. What
will? The new PAYGO law, so that Congress pays for what it buys,
and working with the Presidents fiscal commission to tackle
the greatest sources of our deficit. I hope that Republicans
contribute constructively to these key steps to restore Americas
fiscal health.
