NEW YORK (MarketWatch) -- U.S. stock shed early Wednesday losses to shift into positive territory, with energy shares pacing the gains as the price of crude-oil futures pulled above $71 a barrel after the government reported a drop in energy supplies. The Dow Jones Industrial Average gained 46.71 points to 9,264.65. The S&P 500 Index rose 4.53 points to 994.2, while the Nasdaq Composite advanced 5.14 points to 1,961.06.


Fed buys about $2.6 billion in Treasurys

NEW YORK (MarketWatch) -- The Federal Reserve Bank of New York bought $2.599 billion in Treasurys on Wednesday. Dealers submitted $13.087 billion in debt maturing between 2021 and 2026 to the Fed. When the Fed last bought debt with those maturities, it purchased about $3 billion. The U.S. central bank has purchased more than $250 billion of the $300 billion in U.S. debt it promised in March to buy in an effort to keep borrowing costs, particularly for companies and homebuyers, affordable. Fed policy makers said last week they will slow down purchases to finish the buybacks in October, a month later than previously anticipated. Ten-year note yields , which move in the opposite direction of prices, remained lower on the day. The yield fell 7 basis points to 3.44%, the lowest in more than a month.

SAN FRANCISCO (MarketWatch) -- The Commodity Futures Trading Commission said Wednesday it had withdrawn a no-action letter that allowed a Deutsche Bank index fund to avoid speculative position limits in grain futures. A May 2006 exemption to DB Commodity Services, a unit of Germany's Deutsche Bank , allowed its DB Commodity Index Tracking Master Fund to exceed speculative limits on corn and wheat futures. The fund aims to provide investors with broad exposure commodities. The CFTC also withdraw a similar no-action letter granted in Sept. 2006 to a commodity-pool operator employing a proprietary investment strategy in corn, soybean and wheat futures. The CFTC said the withdrawal of the no-action letters was "very specific and limited" and doesn't affect its other regulatory positions. [Updates to correct Deutsche's U.S. ticker.]


Regulators warn over risks in leveraged ETFs

BOSTON (MarketWatch) -- Securities regulators on Tuesday again warned retail investors about the risks of leveraged and inverse exchange-traded funds. The Securities and Exchange Commission and the Financial Industry Regulatory Authority have issued an investor alert and are advising investors "to consider leveraged and inverse ETFs only if they are confident the product can help meet their investment objectives and they are knowledgeable about and comfortable with the risks associated with these specialized ETFs," according to a press release. Leveraged and inverse ETFs, such as those managed by ProShares, Direxion and Rydex, are "highly complex financial instruments that can turn into a minefield for buy-and-hold investors," said John Gannon, senior vice president for investor education at FINRA.

Fed to buy Treasurys 3 times in next 2 weeks

NEW YORK (MarketWatch) -- The Federal Reserve on Wednesday said it plans to purchase Treasury securities in three operations in the next two weeks, fulfilling policy makers' promise last week to slow down purchases of U.S. debt in the hopes that the program could help keep a lid on borrowing costs for consumers and businesses. It previously held four operations every two weeks. The central bank has already bought $262 billion out of the $300 billion originally stated in March. The Fed will buy debt maturing in 2011 to 2012 on Aug. 24 and 2026-2039 debt on Aug. 26. It will also buy debt maturing in 2012 and 2013 on Sept. 1. After the announcement, the broader Treasury market held onto gains. Ten-year note yields , which move inversely to prices, fell 5 basis points to 3.47%.

USDA SECRETARY VILSACK ANNOUNCES ADDITIONAL RECOVERY ACT FUNDING FOR FOREST SERVICE PROJECTS

$94 Million in Recovery Act Funds Will Help Restore Natural Resources and Enhance Public Safety and Health

WASHINGTON, August 18, 2009 - Agriculture Secretary Tom Vilsack today announced additional funding under the American Recovery and Reinvestment Act (ARRA) for Forest Service projects in 36 states. These funds will help to restore natural resources while improving public safety and creating job opportunities in economically distressed areas. The 105 projects, funded at more than $94.6 million, are located on Federal, state, and private lands. To date, USDA has announced $1.03 billion of the $ 1.15 billion - or 89% - of funds authorized by ARRA for Forest Service projects.

"The Recovery Act projects announced today will help achieve the Obama Administration's goals of providing critical job opportunities for communities across Rural America, rebuilding our country's infrastructure and protecting natural resources," said Vilsack. "These projects will address public health and safety by helping create healthy ecosystems, clean water supplies, reduced wildfire risks to communities, and recreational opportunities for all Americans."

Last week, Vilsack outlined his vision for the future of our nation's forests and set forth a new direction for conservation, management, and restoration of these natural treasures. Many of the Recovery Act investments announced today will help further that goal of reducing catastrophic fires, disease and pests that have all led to declining forest health in recent decades.

Over $45 million will be made available for Wildland Fire Management projects on Federal lands and in cooperation with States, local governments, tribes, and private lands owners on their lands for the following types of projects: Ecosystem Restoration, Research, and Rehabilitation; Invasive Species Protection; Hazardous Fuels Reduction Activities; State Fire Assistance Projects; Biomass Utilization Grants; and Wood to Energy Grants. For example, a biomass utilization grant will reduce the fire risk around the community of Ruidoso, the last remaining mill in southern New Mexico that processes smaller diameter material and woody biomass removed through hazardous fuels reduction projects on nearby Federal, Tribal, state, and private lands. This project is a partnership with the Mescalero Forset Products, New Mexico State Forestry, and the Bureau of Indian Affairs.

Additionally, $49 million will be provided for Capitol Improvement and Maintenance (CIM) projects which include the following types of projects: Abandoned Mine Lands Remediation; Facility Improvement, Maintenance, and Rehabilitation; Facility-Related Ecosystem/Watershed Enhancements related to road and trail maintenance; and Roads and Trails Maintenance and Decommissioning. For example, through a facility-related watershed enhancement project, long term restoration of two priority watersheds will be completed in Alaska. This project will stabilize and restore 5.5 miles of valuable salmon spawning habitat for Portland Chum Salmon, a major forest health indicator species on the Tongass National Forest. These watersheds support subsistence, recreational, and commercial fisheries vital to the rural economies of small remote communities in Alaska. Earlier work in these watersheds was done in partnership with The Nature Conservancy.

OCC Guidance on Tenant Protections - Helping Families Save Homes Act of 2009

Helping Families Save Homes Act of 2009 - Title VII Description: Guidance Tenant Protections
To: Chief Executive Officers of National Banks, All Department and Division Heads, and All Examining Personnel

On May 20, 2009, the Helping Families Save Their Homes Act of 2009, P.L. 111-22, was signed into law. Title VII of this law, the Protecting Tenants at Foreclosure Act, provides protections to tenants from eviction as a result of foreclosure on the properties they are renting. These provisions took effect on May 20, 2009, and will expire on December 30, 2012..
The tenant protection provisions apply in the case of any foreclosure on a “federally-related mortgage loan” 1 or on any dwelling or residential real property. They provide that “any immediate successor in interest” in such a foreclosed property, including a bank that takes title to a house after foreclosure, will assume the interest subject to the rights of any bona fide tenant and certain notice requirements.
Under this law, the immediate successor in interest must provide tenants with notice at least 90 days before evicting them. Additionally, tenants must be able to stay in the residence until the end of their lease, with two exceptions: (1) where the property is sold after foreclosure to a purchaser who will occupy the property as a primary residence and, (2) where there is no lease (or where the lease is terminable at will under state law). However, even when these exceptions apply, tenants must still receive 90 days’ notice before they may be evicted.
The protections of this law apply only to “bona fide” tenants — meaning that the lessee is not the mortgagor or a child, spouse, or parent of the mortgagor; the lease is the product of an arm’s-length transaction; and the rent is not substantially less than fair market rent (unless it is due to a government subsidy). Additionally, the law provides that it does not affect the requirements for termination of any federal- or state-subsidized tenancy or of any state law that provides longer notice requirements or other additional protections for tenants.
National banks are advised to adopt policies and procedures to ensure compliance with these new tenant protection provisions. The OCC will evaluate bank compliance in the course of our supervisory process.

USDA STUDY FINDS RURAL COMMUNITIES BENEFIT FROM GREATER BROADBAND INTERNET ACCESS

WASHINGTON, August 18, 2009 - A new USDA economic analysis has found that rural communities with greater broadband Internet access had greater economic growth than areas with less access. The study, 'Broadband Internet's Value for Rural America' by economists at USDA's Economic Research Service, compared counties that had broadband access relatively early - by 2000 - with similarly situated counties that had little or no broadband access. Employment growth was higher and non-farm private earnings greater in counties with a longer history of broadband availability.

"Rebuilding and revitalizing rural communities is one of my top goals and a key component of the American Recovery and Reinvestment Act, and this study reaffirms that expanding access to broadband is a catalyst for economic development," said Agriculture Secretary Tom Vilsack.

By 2007, the study found, most households - 82 percent - with in-home Internet access had a broadband connection. However, there was a marked difference between urban and rural broadband use. Only 70 percent of rural households with in-home Internet access had a broadband connection in 2007, compared with 84 percent of urban households.

Rural America has shared in the growth of the Internet economy, the study found. Such benefits as online course offerings for students and continuing education programs have improved educational opportunities, especially in small isolated rural areas. Telemedicine and telehealth have been hailed as vital to health care provision in rural communities. Most employment growth in the U.S. over the last several decades has been in the service sector, which is especially conducive for broadband applications. Broadband allows rural areas to compete for low-and high-end service jobs, from call centers to software development. The farm sector is increasingly comprised of farm businesses that buy inputs and make sales online, the study found.

The Recovery Act provided a total of $7.2 billion to the Commerce Department's National Telecommunications and Information Administration (NTIA) and the U.S. Department of Agriculture's Rural Utilities Service (RUS) to accelerate broadband deployment in unserved, underserved and rural areas. This past July, the two agencies hosted Recovery Act Broadband Workshops, which succeeded in bringing detailed information to prospective applicants for stimulus funding available through grants, loans and grant/loan combinations. Workshops in 10 cities across the country attracted audiences ranging in size from 150 to 500 participants from both private and public sector groups, demonstrating enthusiastic response to the economic development opportunities made possible by expanding rural broadband.

IRS to Receive Unprecedented Amount of Information in UBS Agreement
WASHINGTON — The Internal Revenue Service and the Department of Justice today announced the successful negotiation of an agreement that will result in the IRS receiving an unprecedented amount of information on United States holders of accounts at the Swiss bank UBS.
As a result of this agreement, the IRS will receive substantially all of the accounts that it was interested in when it initiated the John Doe summons against UBS.
Under the agreement, the IRS will submit a treaty request to the Swiss government describing the accounts for which it is requesting information. The Swiss government will then direct UBS to initiate procedures to turn over information on thousands of accounts to the IRS. The IRS will receive information on accounts of various amounts and types, including bank-only accounts, custody accounts in which securities or other investment assets were held and offshore company nominee accounts through which an individual indirectly held beneficial ownership in the accounts.
Also, the agreement retains the U.S. Government’s right, if the results are significantly lower than expected and other measures fail, to seek appropriate judicial remedies, including resuming actions to enforce the John Doe summons.
The agreement involves a number of simultaneous legal actions:
The judicial enforcement of the John Doe summons will be dismissed. While this enforcement motion will be withdrawn, the underlying summons remains in effect.
Upon receiving the treaty request, the Swiss government will direct UBS to notify account holders that their information is included in the IRS treaty request. It is expected that these notices will be sent on a rolling basis with some being sent over the coming weeks and others over the coming months. Receipt of this notice will not by itself preclude the account holder from coming into the IRS under the Voluntary Disclosure Program.
In addition, the Swiss Government has agreed to review and process additional requests for information for other banks regarding their account holders to the extent that such a request is based on a pattern of facts and circumstances equivalent to those of the UBS case.
Information provided to the IRS through this process will be thoroughly examined for all potential civil and criminal tax violations. The IRS will assess any additional tax, interest and a number of applicable penalties. This includes the penalty for the willful failure to file an FBAR. This penalty can be up to 50 percent of the value of the account for each year an FBAR was not filed.
The IRS will also recommend criminal prosecution in those cases where the facts warrant such an action. To date, the IRS and the Department of Justice have successfully prosecuted four United States customers of UBS whose information was provided to the IRS by UBS as part of the Deferred Prosecution Agreement.
Individuals whose information is obtained by the IRS through this process will, by longstanding policy, not be eligible for the voluntary disclosure program.

Agriculture Secretary Vilsack Announces Recovery Act Funding for Indian Tribal Organizations and States Operating the Food Distribution Program on Indian Reservations

WASHINGTON, August 19, 2009 - Agriculture Secretary Tom Vilsack today announced that Indian Tribal Organizations and States operating the Food Distribution Program on Indian Reservations (FDPIR) will receive approximately $1 million from the American Recovery and Reinvestment Act to purchase equipment and improve facilities needed to provide food assistance.

"It is imperative that people in the United States have access to safe and nutritious food, and through the Recovery Act, we're investing resources to enhance the availability of food on Indian Reservations and tribal lands," said Vilsack. "The Obama administration is committed to increasing the health and nutrition of people throughout the country, and these Recovery Act investments will help further that goal."

Through FDPIR, USDA purchases food that is provided to low-income households, including the elderly, living on Indian reservations, and to Native American families residing in designated areas near reservations and in the State of Oklahoma. Currently, there are 271 tribes receiving benefits under FDPIR through 98 Indian Tribal Organizations and 5 State agencies. Almost 100,000 individuals receive a monthly FDPIR food package.

Today's announcement is the first in a series of FDPIR Recovery Act allocations; altogether $5 million in Recovery Act funding will be provided.

OCC Hosts Web and Telephone Seminar on SBA Lending Programs
and the American Recovery and Reinvestment Act of 2009

WASHINGTON — The Office of the Comptroller of the Currency will host a live Web and telephone seminar that focuses on changes to SBA Lending Programs resulting from the Recovery Act. These loan programs represent opportunities for banks to provide long-term financing to small business customers who would not otherwise be able to find the type of financing that allows them to preserve capital for long-term growth. The event will take place on September 21, 2009 from 2 to 3:30 p.m. (EDT).
SBA Lending Programs can be attractive to banks because these loans can retain and attract customers, assist in risk and liquidity management, provide fee and interest income, and may be given positive consideration under the Community Reinvestment Act under certain conditions.
Participants will have an opportunity to ask panelists questions during the seminar, online or by telephone. Panelists include Barry Wides, OCC Deputy Comptroller for Community Affairs; Grady B. Hedgespeth, Director, Office of Financial Assistance, Small Business Administration; and Pat Thomson, President, Grow America Fund, National Development Council.

In Louisville, Secretary Napolitano will meet with veterans and deliver remarks at the American Legion 91st Annual National Convention. Small Business Assistance (SBA) in the Center for Drug Evaluation and Research (CDER) provides assistance to businesses with less than 500 employees in the development of new pharmaceutical products.

Through an extensive outreach program SBA provides guidance and information to small pharmaceutical businesses through its ListServ, Q&A's, workshops, and website. The ListServ provides current information from CDER/FDA via e-mail on a biweekly basis that is relevant to small pharmaceutical businesses which includes Federal Register notices, guidances, workshop announcements, etc.

1. Authorized Generic Drugs. The Food and Drug Administration announced in a Federal Register notice of July 28, 2009, the agency is amending its regulations to require that the holder of a new drug application (NDA) submit certain information regarding authorized generic drugs in an annual report. The agency is taking this action as part of its implementation of the Food and Drug Administration Amendments Act of 2007 (FDAAA). FDAAA requires that FDA publish a list of all authorized generic drugs included in an annual report since 1999, and that the agency update the list quarterly.

2. New Guidance. The Food and Drug Administration announced in a Federal Register notice of July 30, 2009, the availability of a guidance for industry entitled ‘‘Drug-Induced Liver Injury: Premarketing Clinical Evaluation.’’ This guidance is intended to assist the pharmaceutical industry and others engaged in new drug development in the assessment of the potential of a drug to cause severe drug-induced liver injury (DILI) during the conduct of premarketing trials. This guidance defines severe DILI as injury that is fatal or requires liver transplantation.

3. Rates for Prescription Drug User Fees for Fiscal Year (FY) 2010. The Food and Drug Administration announced in a Federal Register notice of August 3, 2009, the rates for prescription drug user fees for fiscal year (FY) 2010. The Federal Food,Drug, and Cosmetic Act (the act), as amended by the Prescription Drug User Fee Amendments of 2007 (Title 1 of the Food and Drug Administration Amendments Act of 2007 (FDAAA)) (PDUFA IV), authorizes FDA to collect user fees for certain applications for approval of drug and biological products, on establishments where the products are made, and on such products. Base revenue amounts to be generated from PDUFA fees were established by PDUFA IV, with provisions for certain adjustments. Fee revenue amounts for applications, establishments, and products are to be established each year by FDA so that one-third of the PDUFA fee revenues FDA collects each year will be generated from each of these categories. This notice establishes fee rates for FY 2010 for application fees for an application requiring clinical data ($1,405,500), for an application not requiring clinical data or a supplement requiring clinical data ($702,750), for establishment fees ($457,200), and for product fees ($77,720). These fees are effective on October 1, 2009, and will remain in effect through September 30, 2010. For applications and supplements that are submitted on or after October 1, 2009, the new fee schedule must be used. Invoices for establishment and product fees for FY 2010 will be issued in August 2009, using the new fee schedule.

4. New Guidance. The Food and Drug Administration announced in a Federal Register notice of August 7, 2009, the availability of a guidance for industry entitled ‘‘Pharmaceutical Components at Risk for Melamine Contamination.’’ This guidance provides recommendations that will help pharmaceutical manufacturers of finished products, repackers, other suppliers, and pharmacists who engage in drug compounding to better control their use of at-risk components that might be contaminated with melamine. The guidance explains that the agency is recommending that at-risk components be properly tested for melamine contamination before they are used in the manufacture or preparation of drugs or drug products.

5. Warning Letters. The Food and Drug Administration announced in a Federal Register of August 11, 2009, a program to support public health protection by facilitating the timely issuance of warning letters. The program establishes a timeframe for the submission and agency review of postinspection responses to inspectional observations that are communicated to a firm through issuance of a form FDA 483, list of inspectional observations. The program will begin on September 15, 2009.

6. Charging Patients for Investigational Drugs. The Food and Drug Administration announced in a Federal Register notice of August 13, 2009, that the agency is amending its investigational new drug application (IND) regulation concerning charging patients for investigational new drugs. This final rule revises the charging regulation to clarify the circumstances in which charging for an investigational drug in a clinical trial is appropriate, to set forth criteria for charging for an investigational drug for the different types of expanded access for treatment use and to clarify what costs can be recovered for an investigational drug. This final rule will permit charging for a broader range of uses than was explicitly permitted. This rule is effective October 13, 2009.

7. Expanded Access for Treatment Use. The Food and Drug Administration announced in a Federal Register notice of August 13, 2009, that the agency is amending its regulations on access to investigational new drugs for the treatment of patients. The final rule clarifies existing regulations and adds new types of expanded access for treatment use. Under the final rule, expanded access to investigational drugs for treatment use is available to individual patients, including in emergencies; intermediate size patient populations; and larger populations under a treatment protocol or treatment investigational new drug application (IND). The final rule is intended to improve access to investigational drugs for patients with serious or immediately life-threatening diseases or conditions who lack other therapeutic options and who may benefit from such therapies. This rule is effective October 13, 2009.

8. FDA’s Transparency Task Force The Food and Drug Administration announced in a Federal Register notice of August 18, 2009, that the agency is reopening until November 6, 2009, the comment period for the notice of public meeting and request for comments that appeared in the Federal Register of June 3, 2009 (74 FR 26712). In the notice of public meeting and request for comments, FDA’s Transparency Task Force requested comments on ways in which FDA can make useful and understandable information about FDA activities and decision making more readily available to the public. The agency is taking this action because the agency is planning a second public meeting this fall and is reopening the comment period to allow interested persons additional time to submit comments.

9. Reorganization of the Office of the Commissioner. The Food and Drug Administration announced in a Federal Register notice of August 18, 2009, that the agency has reorganized the Office of the Commissioner (OC). Brian Ullom, age 38, of Louisville, Kentucky, in Jefferson County, was sentenced in federal court in Louisville, Kentucky to 1 year and 3 months’ imprisonment and ordered to pay $2.3 million in restitution today for health care fraud and making illegal campaign contributions, Acting United States Attorney Candace G. Hill of the Western District of Kentucky announced today. In June 2007, Ullom pleaded guilty to billing for prescriptions that were never filled and for illegally selling prescription drug samples, and for illegally making campaign contributions in the names of others through Rouben’s Pharmacy in Louisville.

Cisco Releases Security Advisory for Firewall Services Module Vulnerability

Cisco has released a security advisory to address a vulnerability in
the Firewall Services Module (FWSM) for the Catalyst 6500 series
switches and the 7600 series routers. By sending specially crafted
ICMP messages to the Firewall Services Module, an attacker can cause a
denial-of-service condition.

US-CERT encourages users and administrators to review Cisco security
advisory cisco-sa-20090819-fwsm and apply any necessary updates or
workarounds to help mitigate the risks.

New Series of Working White Papers From Effective Health Care
As part of our ongoing project on Registries for Evaluating Patient Outcomes, AHRQ has commissioned four white papers. The purpose of these white papers is to stimulate discussion and building of consensus on emerging issues in the development and implementation of registries that cross technical, legal and ethical disciplines. As for the full registry handbook, first drafts of these white papers were developed by several authors and reviewers representing various points of view including academia, industry and clinical practice. We are now posting these drafts for public comment for an initial period of four weeks. We encourage critical comments and evaluation of the information in these papers to be submitted to AHRQ.
Comments that are received by AHRQ will be organized by theme and a disposition of comments and response by the authors will be posted before November 2009. Where the comments received through public comment indicate broad consensus, parts of these white papers will be incorporated into the next version of the full registries handbook, which will be posted in draft form for public review at the same time as the disposition of comments from the draft white papers. Where the comments indicate disagreement on the technical implementation or legal or ethical implications of different topics, we are planning to post new drafts of the white papers for a new round of public comment as part of the next phase of the ongoing registries methods project. We hope that this process will help to clarify critical issues in the development and use of registries.

MANHATTAN U.S. ATTORNEY CHARGES INTERNATIONAL ARMS TRAFFICKER
WITH NARCO-TERRORISM CONSPIRACY


PREET BHARARA, the United States Attorney for the Southern District of New York, and MICHELE M. LEONHART, the Acting Administrator of the United States Drug Enforcement Administration ("DEA"), today announced that JAMAL YOUSEF, a/k/a "Talal Hassan Ghantou," an international arms trafficker, was charged with participating in a narco-terrorism conspiracy. The charges stem from a plot by YOUSEF and co-conspirators to sell military-grade weapons to the Colombian terrorist group Fuerzas Armadas Revolucionarias de Colombia (the "FARC"), in exchange for nearly one metric ton of cocaine.

According to the Superseding Indictment unsealed today in Manhattan federal court:
YOUSEF is a former member of the Syrian military. From July 2008 until his arrest on the charges unsealed today, YOUSEF and co-conspirators in Honduras negotiated to sell military-grade weapons to the FARC in exchange for 938 kilograms of cocaine. However, unbeknownst to YOUSEF and his co-conspirators, the purported FARC representatives they were dealing with were, in fact, confidential informants working with the DEA. During the negotiations, YOUSEF's co-conspirator described the weapons as including 100 AR-15 assault rifles, 100 M-16 assault rifles, 10 M-60 machine guns, C-4 explosives, 2,500 hand grenades, and rocket-propelled grenades. YOUSEF's co-conspirator also offered to sell 17 to 18 surface-to-air missiles to the FARC, and e-mailed the confidential informants photographs of some of the weapons.

With the full cooperation and assistance of Interpol, YOUSEF was transferred to the United States after his release from a prison sentence served in Honduras. YOUSEF arrived today in New York and is expected to be arraigned in Manhattan federal court this afternoon.

The Superseding Indictment charges YOUSEF with one count of narco-terrorism conspiracy, which carries a mandatory minimum sentence of 20 years in prison and a maximum sentence of life in prison. The case is assigned to United States District Judge JOHN F. KEENAN.

Mr. BHARARA praised the outstanding investigative work of the DEA, including its Special Operations Division Bilateral Investigations Unit and the Bogota, Colombia, Country Office. Mr. BHARARA also thanked Interpol and the Department of Justice National Security Division and Office of International Affairs for their assistance.

The prosecution of YOUSEF is being handled by the Office's International Narcotics Trafficking Unit. Assistant United States Attorneys JEFFREY A. BROWN and REBECCA MONCK RICIGLIANO are in charge of the prosecution.

The charges contained in the Superseding Indictment are merely accusations and the defendant is presumed innocent unless and until proven guilty.

Former Taiwanese Executive Indicted in Color Display Tube Price-Fixing Conspiracy

A federal grand jury in San Francisco indicted Wen Jun (Tony) Cheng, a former executive of a large Taiwanese color display tube (CDT) manufacturing company, for participating in a global conspiracy to fix prices of CDTs, a type of cathode ray tube used in computer monitors and other specialized applications.
