The Federal Deposit Insurance Corporation (FDIC) today released a list of orders of administrative enforcement actions taken against banks and individuals in March. No administrative hearings are scheduled.
The FDIC processed a total of 42 orders in March. These included twenty-three cease and desist orders; two removal and prohibitions; thirteen civil money penalties; one Order Granting Permission to File Application and Approving Application for Consent to Participate in the Affairs of any Insured Depository Institution (Section 19); and three orders terminating orders to cease and desist.

Summary: Shell and shelf companies may be used as vehicles for financial fraud

SUBJECT: Lending to Shell and Shelf Companies

The Federal Deposit Insurance Corporation (FDIC) was recently alerted by the Better Business Bureaus of possible fraudulent or improper activity involving businesses advertising that they can assist borrowers, who may not otherwise be able to qualify for a loan, obtain an unsecured business line of credit. These businesses do this by selling a "shell" or "shelf company" to the potential borrower. The potential borrower is then able to substitute the creditworthiness and business history of the shell or shelf company for their own in an attempt to obtain credit. While financial institutions may use different underwriting based on their risk tolerance, in one example, potential borrowers were advised to request a line of credit below $150,000, suggesting that bank underwriting standards at this level are less stringent. These businesses promise that the borrower will not have to provide business or personal financial statements, income tax returns and personal guarantees, and that the lending financial institution will not pull a personal credit report. These businesses promise positive results while typically charging large upfront fees.
The term "shell company" generally refers to a limited liability company and other business entity with no significant assets or ongoing business activities. The term "shelf company" refers to a shell company that is created and left with no activity—or put on the "shelf" to season. The shelf company can then be sold to someone wishing to start a company without going through steps to create a new one. Common reasons for purchasing a shelf corporation include:
Saving the time involved in the process to create a new corporation;
Creating an appearance of corporate longevity; and
Gaining easier access to investment capital and credit.
If a company is thought to be "seasoned" or have historical longevity, it may boost investor, lender and consumer confidence and give the appearance of an established history of creditworthiness.
Shell and shelf companies typically have no physical presence other than a mailing address, have no employees and produce little, if anything, with independent economic value. They can be created domestically or in a foreign country. Shell and shelf companies are often formed by individuals and businesses to conduct legitimate transactions. However, they can be and have been used as vehicles for common financial crime schemes such as money laundering, fraudulent loans and fraudulent purchasing. By virtue of the ease of formation and the absence of ownership disclosure requirements, shell and shelf companies are an attractive vehicle for those seeking to conduct illicit activity.
Providing financial services to shell and shelf companies involves varying degrees of risk, depending on the ownership structure, the nature of the customer, the services provided, the purpose of the account, the location of services, and other associated factors. The potential to abuse shell and shelf companies for illicit activity must be recognized, and financial institutions should be vigilant in monitoring such companies on an ongoing basis. Financial institutions should assess the risks involved in each shell or shelf company relationship and take steps to ensure that the risks are appropriately and effectively identified and managed.
Financial institution management should establish appropriate due diligence at account opening and during the life of the relationship to manage risk in these accounts. Longstanding regulatory lending guidance advocates that financial institutions request the identity of the shell or shelf corporation's principal(s) and evaluate the appropriate factors of creditworthiness when extending credit. Important information for determining the valid use of these entities includes the type of business, the purpose of the account, the source of funds and the source of the wealth of the owner or beneficial owner.
Financial institutions should act promptly when they believe fraudulent or improper activities have occurred related to activities of a shell or shelf company. Appropriate actions may include, but are not limited to, filing a Suspicious Activity Report (SAR) in accordance with suspicious activity reporting regulations. The Financial Crimes Enforcement Network encourages using the narrative section of the SAR form to completely and sufficiently describe the suspicious conduct. The narrative should use the term "shell," as appropriate.

Hoyer Commemorates 94th Anniversary of Armenian Genocide

WASHINGTON, DC – House Majority Leader Steny H. Hoyer (MD) released the following statement today on the 94th anniversary of the Armenian Genocide:

“Today, we recognize the genocide that took the lives of 1.5 million Armenian children, women, and men in their ancestral homeland. Their ashes are written into history: into human history, into the history of Ottomans and Armenians, and even into the history of this country, on account of our predecessors who—like so much of the world—heard, and knew, and did too little.

“Through the 20th century and into the next, the thread of genocide, and the hate and apathy that run along it, has tied the desert concentration camps for Armenians to the camp at Auschwitz, the killing fields of Cambodia, and Rwanda, and Darfur. And yet, where the thread runs darkest, we can find words to give us hope.

“When the parliament in Istanbul was debating how best to seize the property of the exiled Armenians, a representative rose against the bill and said this: ‘If we are a constitutional regime functioning in accordance with constitutional law we can’t do this. This is atrocious. Grab my arm, eject me from my village, then sell my goods and properties—such a thing can never be permissible. Neither the conscience of the Ottomans nor the law can allow it.’

“The man who spoke those words, Ahmed Riza, was not an Armenian, but a Turk.

“As long as genocide is real in our world, may there be men and women who speak and think as he did. Let us witness that no law can ever sanction genocide—not the laws of nations, not the moral law that is higher than them all—and let us work to give the law force in our world.”

Petraeus Speaks on Capitol Hill

General David Petraeus urged the House Appropriations Sub-Committee to approve supplemental funding for the wars in Iraq and Afghanistan.

MESSAGE FROM THE MAJORITY LEADER

House Democrats continue to be very focused on the economy, and in addition to the several measures we have passed, are taking further steps to rebuild the economy and assist Americans working to get by during this recession.

Next week, the House expects to consider the budget conference report, which includes targeted, strategic investments to create jobs, make a down payment on health care reform, create a path to energy independence, reform and invest in education, and ensure economic prosperity over the short- and long-term. We will also consider the Credit Cardholders’ Bill of Rights, which passed out of the Financial Services Committee this week with bipartisan support. This important legislation provides needed protection for consumers from unfair and arbitrary practices employed by credit card companies.

This Wednesday marked our 39th Earth Day, an anniversary that is especially significant given one of the challenges we face today: our nation's energy crisis. Congress continues to work with the Obama Administration to address this issue, which is not only critical to the health of our planet, but is also a vital part of our efforts to rebuild the economy. Energy legislation will help create new ‘clean energy’ jobs, promote new sources of renewable energy, advance our energy independence, increase energy efficiency, and limit and reduce emissions of greenhouse gases. The Energy and Commerce Committee continues to hold hearings on their discussion draft with a goal of passing a bill out of committee by Memorial Day.

The House is also making good progress to advance the discussion on the need for comprehensive health care reform. Over the last three months, there have been 10 hearings in the House on health reform, with more planned in the weeks ahead. Democrats are also working to seek broad public input from citizens about what they want to see in a health reform measure, and will continue the conversation as we work towards our goal of passing a bill in the House before August. Passing a reform measure will be a major effort, and we are committed to working together to advance legislation that meets the objectives laid out by President Obama and promotes long-term economic recovery and growth.

Officials of the United States and the Netherlands today formally launched a new initiative to open membership in their expedited air travel programs to citizens of both countries in an effort to streamline entry processes for pre-screened fliers. The U.S. program is Global Entry; the Netherlands' is Privium. Citizens of the two nations now may apply to join the other country’s frequent traveler program allowing streamlined processing at the border. Cyber Security Tip ST06-003 Staying Safe on Social Network Sites

The popularity of social networking sites continues to increase, especially
among teenagers and young adults. The nature of these sites introduces
security risks, so you should take certain precautions.

What are social networking sites?

Social networking sites, sometimes referred to as "friend-of-a-friend"
sites, build upon the concept of traditional social networks where you are
connected to new people through people you already know. The purpose of some
networking sites may be purely social, allowing users to establish
friendships or romantic relationships, while others may focus on
establishing business connections.

Although the features of social networking sites differ, they all allow you
to provide information about yourself and offer some type of communication
mechanism (forums, chat rooms, email, instant messenger) that enables you to
connect with other users. On some sites, you can browse for people based on
certain criteria, while other sites require that you be "introduced" to new
people through a connection you share. Many of the sites have communities or
subgroups that may be based on a particular interest.

What security implications do these sites present?

Social networking sites rely on connections and communication, so they
encourage you to provide a certain amount of personal information. When
deciding how much information to reveal, people may not exercise the same
amount of caution as they would when meeting someone in person because
* the internet provides a sense of anonymity
* the lack of physical interaction provides a false sense of security
* they tailor the information for their friends to read, forgetting that
others may see it
* they want to offer insights to impress potential friends or associates

While the majority of people using these sites do not pose a threat,
malicious people may be drawn to them because of the accessibility and
amount of personal information that's available. The more information
malicious people have about you, the easier it is for them to take advantage
of you. Predators may form relationships online and then convince
unsuspecting individuals to meet them in person. That could lead to a
dangerous situation. The personal information can also be used to conduct a
social engineering attack (see Avoiding Social Engineering and Phishing
Attacks for more information). Using information that you provide about your
location, hobbies, interests, and friends, a malicious person could
impersonate a trusted friend or convince you that they have the authority to
access other personal or financial data.

Additionally, because of the popularity of these sites, attackers may use
them to distribute malicious code. Sites that offer applications developed
by third parties are particularly susceptible. Attackers may be able to
create customized applications that appear to be innocent while infecting
your computer without your knowledge.

How can you protect yourself?

* Limit the amount of personal information you post - Do not post
information that would make you vulnerable, such as your address or
information about your schedule or routine. If your connections post
information about you, make sure the combined information is not more
than you would be comfortable with strangers knowing. Also be
considerate when posting information, including photos, about your
connections.
* Remember that the internet is a public resource - Only post information
you are comfortable with anyone seeing. This includes information and
photos in your profile and in blogs and other forums. Also, once you
post information online, you can't retract it. Even if you remove the
information from a site, saved or cached versions may still exist on
other people's machines (see Guidelines for Publishing Information
Online for more information).
* Be wary of strangers - The internet makes it easy for people to
misrepresent their identities and motives (see Using Instant Messaging
and Chat Rooms Safely for more information). Consider limiting the
people who are allowed to contact you on these sites. If you interact
with people you do not know, be cautious about the amount of information
you reveal or agreeing to meet them in person.
* Be skeptical - Don't believe everything you read online. People may post
false or misleading information about various topics, including their
own identities. This is not necessarily done with malicious intent; it
could be unintentional, an exaggeration, or a joke. Take appropriate
precautions, though, and try to verify the authenticity of any
information before taking any action.
* Evaluate your settings - Take advantage of a site's privacy settings.
The default settings for some sites may allow anyone to see your
profile. You can customize your settings to restrict access to only
certain people. However, there is a risk that even this private
information could be exposed, so don't post anything that you wouldn't
want the public to see. Also, be cautious when deciding which
applications to enable, and check your settings to see what information
the applications will be able to access.
* Use strong passwords - Protect your account with passwords that cannot
easily be guessed (see Choosing and Protecting Passwords for more
information). If your password is compromised, someone else may be able
to access your account and pretend to be you.
* Check privacy policies - Some sites may share information such as email
addresses or user preferences with other companies. This may lead to an
increase in spam (see Reducing Spam for more information). Also, try to
locate the policy for handling referrals to make sure that you do not
unintentionally sign your friends up for spam. Some sites will continue
to send email messages to anyone you refer until they join.
* Use and maintain anti-virus software - Anti-virus software recognizes
most known viruses and protects your computer against them, so you may
be able to detect and remove the virus before it can do any damage (see
Understanding Anti-Virus Software for more information). Because
attackers are continually writing new viruses, it is important to keep
your definitions up to date.

Children are especially susceptible to the threats that social networking
sites present. Although many of these sites have age restrictions, children
may misrepresent their ages so that they can join. By teaching children
about internet safety, being aware of their online habits, and guiding them
to appropriate sites, parents can make sure that the children become safe
and responsible users (see Keeping Children Safe Online for more
information).

Hoyer Plauds House Passage of COPS Improvement Act

Washington, DC – House Majority Leader Steny H. Hoyer (Md.) applauded House passage today of the Community Oriented Policing Services (COPS) Improvements Act. The bill bolsters the successful COPS program, authorizing $1.8 billion a year over the next five years to help improve community policing efforts and place an additional 50,000 police officers on the street nationwide.

“Since its creation in 1994, the COPS program has seen great success across the country, allowing officers to spend more time on the streets fighting and preventing crime through time-saving technology, information-sharing systems, and improved communications equipment.

“Under the previous Administration, cuts to COPS significantly impaired this effort, hampering the ability of law enforcement agencies to hire additional officers and invest in the community policing programs that have proven to be so successful. Now, during a time of recession, enforcement agencies are being hit again – operating under smaller budgets at the same time they must address the rise in certain types of crime brought on by increased foreclosures and other economic stresses.

“The COPS Improvements Act renews our commitment to helping law enforcement address these challenges, providing the tools it needs to combat crime and ensure the safety of our communities. I am pleased that this bill has passed the House, and look forward to its consideration in the Senate.”

Young Democrats of America South-Central Regional Convention Update

Dear South-Central Region YDs,

As you know, our Regional Convention will be held on May 1-2, 2009 in Little Rock, AR. Anyone is welcome to attend, and Jamie Oliver, our Deputy Region Director, has graciously arranged for us to have a block of very affordable rooms at the Legacy Hotel in Little Rock. Please call the Legacy at 501-374-0100 and mention that you are with the Young Democrats of America to secure your room if you haven't done so already. Jamie has also booked us meeting space at the Capitol (near the hotel) for our business meeting and other activities. Convention Registration will be $25. At the convention you will have an opportunity to meet with other members from around the South-Central region, run and/or vote for the positions of Regional Director, Deputy Director, Secretary/Treasurer, and/or South-Central Judicial Council Representative, and sit in on a training taught by YDA's wonderful new Interim Executive Director, Gary Moody. Region 9 Texas Young Democrats: Region 9 in the Year Ahead

Hey everyone, this is your new TYD Region 9 Director. Thank you so much for giving me this opportunity to grow and strengthen the presence of Young Democrats in East Texas. In my first discussion with previous Director and current Regional Director Chair Sarah Hannah, I expressed my desire to double the number of Region 9 attendees at next year's convention from this years. "Why not triple it?" she replied. Well, I aim to deliver on this goal. But I need your help!

The most important thing I ask of you all is relatively simple: open and frequent communication. I have created a new gmail account:

This will serve as the central nexus of communication for our region, supplemented by this facebook group, and will allow me to easily hand over valuable contact information to my successor in a year's time.

First of all, have as many of your members as possible send an email letting me know who they are and what chapter they're with so I can build up the contact list. If any of you chapter presidents have existing rosters of email addresses, please send them my way, it'd be super helpful.

Secondly, any time your chapter is hosting an event, whether it's a mixer, a fundraiser, or a candidate speaking, let me know so I can make sure everyone in the region knows about it. You never know who might drive down from where to make connections and lend their support. Interested in hosting an inter-chapter event or activity? I know I sure am! Let me know and we'll get the ball rolling.

Finally, if you or anyone you know hears of a Young Democrat or two in a county or campus with no existing chapter, tell them to look up Justin Hudspeth on facebook, give them my contact info, and then point me in their direction too.
